Abstract

Polyandry marriage is a form of marriage that is prohibited by Islam. This prohibition has been clearly stated in the Al-Qur'an and also the hadith of the Prophet. The scholars also agreed on its prohibition. This marriage also contradicts Law Number 1 of 1974 and article 40 of the Compilation of Islamic Law. However, in reality, polyandry marriages have occurred in Biau District, Buol Regency. The main problems that will be studied in this thesis research are as follows: The Role of the Biau District Office of Religious Affairs in Overcoming Polyandry Marriage Problems in Buol District. Empirical legal research that combines primary data obtained in the field, especially regarding, with primary data derived from primary legal materials, includes primary, secondary and tertiary data. The results of this study, the first is that polyandry marriages that occur in Biau District, Buol Regency are caused by ignorance of the guardian, also the will of the perpetrator himself, low level of knowledge, and also administrative factors which then make this forbidden marriage able to be registered and obtain a marriage book . And the role of the KUA itself is in conducting counseling and fostering the understanding of the people of Biau District, Buol Regency regarding the good and bad of polyandry marriages.

Abstract

Penelitian ini bertujuan mengkaji peran nilai-nilai lokal dalam memotivasi PNS dalam melaksanakan tugas pelayanan publik, dengan fokus pada dua nilai utama Gorontalo, yaitu "huyula" (gotong royong) dan "bapodulu" (saling menghormati). Tujuan penelitian ini adalah untuk mengeksplorasi bagaimana nilai-nilai tersebut dapat diintegrasikan ke dalam reformasi administrasi publik guna meningkatkan motivasi PNS, serta dampaknya terhadap kualitas pelayanan publik. Pendekatan yang digunakan adalah deskriptif kualitatif dengan teknik pengumpulan data melalui wawancara mendalam, observasi, dan analisis dokumen. Hasil penelitian menunjukkan bahwa integrasi nilai-nilai lokal dapat memperkuat budaya organisasi yang mendukung kolaborasi, empati, dan rasa tanggung jawab terhadap masyarakat. Meskipun ada tantangan dalam implementasinya, seperti resistensi terhadap perubahan dan ketidaksesuaian antara praktik birokrasi modern dan nilai lokal, penelitian ini menawarkan rekomendasi untuk pengembangan program pelatihan berbasis nilai lokal dan kebijakan yang mendukung penerapan nilai-nilai tersebut dalam administrasi publik. Penelitian ini diharapkan memberikan kontribusi terhadap pengembangan reformasi administrasi publik yang lebih responsif, efektif, dan berkelanjutan.

Abstract

The purpose is to find out the impact of the implementation of mediation and the factors that affect the success of mediation in divorce cases in Religious Courts. Mediation is a form of case settlement through Alternative Dispute Resolution. The urgency of research to resolve disputes in the divorce process in Religious Courts and help build better relationships after divorce. Using normative and empirical research types. The results of the study show that the impact of mediation on divorce is to reduce the accumulation of cases in Court, increase the satisfaction of the parties, increase time/cost efficiency, minimize conflicts, maintain privacy, encourage agreements, and build positive relationships after divorce. Factors that affect the success of divorce mediation in the Religious Court are the commitment of both parties, the competence of the mediator, support from the Court, emotional and psychological factors, and the involvement and support of third parties. In conclusion, mediation has a significant positive impact on the settlement of divorce cases in the Religious Court so mediation is an effective method and its implementation needs to be continuously improved in the Religious Court. The findings show that mediation reduces the divorce rate by increasing communication between husband and wife and resolving problems through dialogue.

Abstract

This research aims to provide knowledge to the community regarding the limitations for adopted children, especially in terms of inheritance, so that the community is not wrong in providing knowledge about adopted children. This research is a field research (Field Research), the data sources used are primary data sources collected through interviews, documentation and observation. Primary data is obtained directly from respondents regarding inheritance for adopted children in Islamic law and customary law, while secondary data is in the form of legal theories and norms as well as other supporting data obtained from literature, documentation and biographies. All of these data are materials to describe an overview of Islamic law regarding inheritance for adopted children in the perspective of customary law. Based on the results of the research, it turns out that the Indigenous people of the city of Gorontalo, in giving their inheritance to adopted children, carry out the provisions of Islamic inheritance law and some carry out customary inheritance law. For people who implement Islamic law, the adopted child does not get an inheritance but gets assets in the form of a mandatory testament and may not exceed 1/3 of the assets left behind, while for people who use Javanese customary law they determine their own in accordance with the agreement in the deliberations of experts the heir concerned. It is better for people who adhere to Javanese customs to be given knowledge about Islamic inheritance law.

Abstract

The purpose of this study is to further analyze the urgency of recording interfaith marriages in population administration regulations for legalization and licensing. The research method used is a normative legal research method with a statutory approach. The results of this study found that the registration of interfaith marriages is an important aspect to ensure the formal legality and protection of the civil rights of couples, such as inheritance rights, joint property, and child status. However, interfaith couples often face legal obstacles because population administration regulations do not explicitly accommodate interfaith marriages. As a result, they often have to resort to the courts to obtain legalization. The role of the court is crucial in granting permission for registration, although decisions vary depending on the interpretation of the judge. While some are successful, the process still poses legal and social challenges for couples.

Abstract

The social conflict in Pohuwato Regency, involving local communities and mining companies, reflects the tensions between formal law and customary values. This conflict is triggered by power imbalances, a lack of recognition for customary rights, and minimal transparency in natural resource management. This study aims to analyze the root causes of the conflict, evaluate the role of law in creating social justice, and identify solutions based on the principle of inclusive legal certainty. The research methodology employs a qualitative approach with data collection techniques including interviews, observations, and document analysis. The study's findings indicate that formal law often overlooks local norms, thereby exacerbating tensions between the community and companies. Resolving the conflict requires the integration of customary values into formal policies, transparency in mining management, and the establishment of independent mediation institutions involving all parties. Additionally, economic empowerment of the community and legal education are strategic steps to enhance the community's capacity to handle conflicts. The research recommendations include strengthening the government's role as a neutral facilitator, developing local policies based on community participation, and ensuring that companies commit to relevant social responsibility programs. In conclusion, resolving the conflict in Pohuwato can serve as a model for managing similar conflicts in other regions, while supporting social harmony and sustainable development.

Abstract

Abstract The purpose of this research is to examine the legal reasoning by judges in determining the legitimacy of a child's origin from a clandestine marriage. This study employs empirical legal research with a qualitative research approach. The research findings indicate that in performing legal reasoning, judges must carefully make decisions regarding the status of a child for the best interests of the child. This process involves legal and social considerations, and requires the examination of evidence, petitioner's arguments, and relevant legal foundations with three main factors: evidence, witness testimonies, and legal provisions. When deciding cases of determining a child's origin and legal status, judges rely on the trial facts and evidence presented by the petitioners and assess whether the petitioner's marriage complies with Islamic law and Law Number 1 of 1974 on Marriage. The judges adhere to legal principles and concrete evidence in the decision-making process.

Abstract

This research examines how local regulations regulate the functions of the Village Consultative Body (BPD) and whether these rules have been implemented properly. The research method used is empirical-sociological juridical with a statutory and conceptual approach. This research not only focuses on the applicable legal rules, but also looks at how the law is implemented and affects social life through field data collection. The results showed that BPD has a legislative function in discussing and agreeing on village regulations with the Sangadi (village head), accommodating and channeling community aspirations, and overseeing the performance of the Sangadi. The results showed that implementing the BPD function in Motabang Village was not optimal. The BPD tends to carry out its duties as a formality, especially in discussing village regulations and supervising the performance of the Sangadi. The inhibiting factors include the BPD members' low understanding of regulations, lack of community participation, and conflicts of personal interest. To improve the effectiveness of BPD performance, it is necessary to increase the capacity of members through training, increase community participation, and strengthen independence in carrying out supervisory functions.

Abstract

This study discusses the effectiveness of the application of the OJK Number: 77 / POJK.01/2016 concerning Information Technology-Based Money Lending Services. This study uses normative juridical research (normative law research). Normative juridical research refers to legal norms contained in legislation, Court decisions, legal theory and scholar's opinions and norms that exist in society. The approach used in the study is a normative juridical approach, then the approach taken in this paper is the approach to legislation, case approach and conceptual approach. In the study concluded that there are five (5) factors that cause the ineffectiveness of the application of this regulation are as follows; 1). Legal factors; 2). Law enforcement Factors; 3). Factors of law enforcement means; 4). Community factors; 5). Cultural factors.

Abstract

The purpose of this study is to find out about underage marriages after the enactment of the latest marriage law and see how effective the enforcement of the law is and what efforts have been made by the Office of religious affairs against the latest law, which discusses the existence of underage marriages. The research method used is normative, with the statute and contextual approaches. The results of the study show that underage marriages after the entry into force of Law number 16 of 2019 are allowed on the condition that they request a letter of dispensation and are accompanied by urgent reasons and also include supporting evidence and the effectiveness of the latest marriage law in Pohuwato Regency it can be considered ineffective and requires in-depth evaluation because of the high number of underage marriages. Because of this, the Office Of Religious Affairs of Marisa district continues to conduct outreach related to the enforcement of marriage under the law, as regulated in the latest marriage regulations. The government is expected to revise law no. Married even though he is underage, not only in Article 7 paragraph (2), which says the parties' parents can ask the court for dispensation with urgent reasons accompanied by evidence.
