Abstract

This thesis aims to determine the age limit for marriage as regulated in Law Number 16 of 2019. In this Law, the minimum age limit for marriage is set at 19 (nineteen) years for both men and women. Apart from that, this thesis also examines the factors that cause underage marriage in Paleleh and West Paleleh Districts. Underage marriages are marriages that do not meet the minimum age limit for marriage as regulated in Law Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning Marriage. In Law Number 16 of 2019 article 7 it is stated that marriage is only permitted if the man and woman have reached the age of 19 (nineteen) years. In this research, the author used an empirical research method, namely by going directly into the field to obtain data related to underage marriage in Paleleh and West Paleleh Districts. This research uses a descriptive approach in analyzing the data obtained. Based on research results, the number of underage marriages in Paleleh and West Paleleh sub-districts is still relatively high. This is proven by the high percentage of underage marriages in Paleleh and West Paleleh Districts from year to year based on underage marriage dispensation data from the KUA in Paleleh District. Apart from that, based on research results, there are several factors that cause underage marriages in Paleleh and West Paleleh Districts, including the factor of accidental marriage (pregnancy out of wedlock), and the factor of low level of education.

Abstract

This research aims to determine the supporting factors, both internal and external supporting factors, and inhibiting factors, both internal and external inhibiting factors, for mediators in mediating against bed-separated perpetrators at the Class 1A Gorontalo Religious Court. This research is classified as empirical research with a case, context and sociological law approach. Data sources were obtained through interviews and observations which were then analyzed descriptively. The results of this research show that in conducting mediation, both Judge Mediator and non-Judge Mediator still experience several obstacles which have an impact on the success of the mediation process.

Abstract

This research aims to determine the legal implications of debt collection via social media. This research is normative research with a conceptual approach, which is analyzed descriptively qualitatively. The results of the research show that the legal implications of debt collection from an agreement as fulfillment of performance are viewed from article 1365 of the Civil Code, every act that violates the law and brings loss to another person, requires the person who caused the loss through his fault to compensate for the loss, giving meaning in principle in debt and receivable agreement that has been agreed, if the agreement cannot be implemented by one of the parties then an unlawful act has occurred. In fact, debt collection via social media is not a violation as long as it does not lead to defamation of the debtor. There is a difference between unlawful acts in the context of criminal law and unlawful acts in the context of civil law, namely that more emphasis is placed on the differences in the nature of criminal law which is public in nature and civil law which is private in nature.

Abstract

The purpose of conducting this research is to find out what factors are the reasons for the prospective groom to falsify his identity in marriage in Boliyohuto District. The research method used in this article is to use empirical research methods by taking a qualitative approach. The results of this study show that in the case of a marriage annulment lawsuit at the Gorontalo Religious Court, there was one party who filed for annulment of her marriage on the grounds that her husband had falsified his identity so that she felt she had been lied to, claiming to be a virgin. After a week of having relations as husband and wife, the wife found out that her husband already had a wife and child so she sued for annulment of the marriage. As a result of the annulment of marriage that occurred in the case under study, the wife felt disadvantaged, which in law violates Article 27 paragraph (2) of Law Number 1 of 1974 concerning Marriage which reads: "A husband or wife may file a petition for annulment of marriage if at the time of marriage there is a misconception about the husband or wife".

Abstract

The significant potential of zakat on profession needs to be actualized through a clear regulation. The targets of zakat on profession are: Ministry or State Institutions, Local Government, State-owned Enterprises, Local Government Owned Enterprises, even other professions that have a high income. The government's efforts to facilitate zakat on profession are solely aimed at making the mechanism of zakat management to be good, transparent and integrated into a system. However, zakat levies should have a specific rule that is binding all citizens, especially all Muslim Civil State Apparatus (henceforth called as ASN) who certainly meets the applicable regulations. For those who have income and already reach nishab or nominal income limit must pay zakat, while the ones whose incomes do not reach nishab are not obliged to do such a thing. Gorontalo province is one of the regions whose population is predominantly Muslim and has potential in terms of Islamic values-based economic development. Therefore, there needs to be a strict regulation to regulate zakat on profession, so that the utilization of zakat can help to alleviate the burden of the poor. By the existence of regulation, people who pay and receive zakat are equally having the benefits of zakat. This is to say that government has a prominent role and responsibility in optimizing the enactment of zakat on profession since the reality of the most significant zakat received by BAZNAS (Islamic board which oversees the collection of Zakat) in Gorontalo province is from ASN and other professions income.

Abstract

Cross-border trade is something that can no longer be avoided in today's era of globalization. Countries conduct business activities in order to advance their economic activities. In these activities, many countries do things that harm business principles. One of them is the evasion action. This research aims to determine the regulation of circumvention measures in international trade. This article uses normative legal research methods based on the international economic legal framework. The research results show that circumvention measures constitute a form of evasion of anti-dumping import duties. These actions involve manipulation or changes in the way trade is conducted to avoid paying high import duties. In Indonesia, anti-dumping regulations do not specifically regulate circumvention issues.

Abstract

The aim of this activity is to provide an understanding of the fair distribution of inheritance in cases of fighting over inheritance rights using several types of settlement methods. To give people an understanding that the position of a will is very important in Indonesia and even if it is not carried out according to existing procedures then the will is not legally valid. This type of research is normative-empirical legal research. According to Abdulkadir Muhammad, what is meant by normative-empirical legal research (applied law research) is research that uses normative-empirical legal case studies in the form of legal behavioral products. The results of the research obtained regarding the granting of wills that did not comply with procedures were that there were conflicting norms due to the public's lack of understanding of the regulations for granting valid wills. In conclusion, the legal status of wills will be very well maintained if the community is able to apply the legal procedures that the law has established because everything we do will definitely be directly related to the law, as we know as citizens of Indonesia, we are a country that upholds the law. justice for human rights, in its application laws are made to provide legal certainty to the community, it only remains for the community itself to be able to implement it or not, because if seen from a civil law perspective, everything that is done by humans is not in accordance with the law. existing then the action can be null and void by law.

Abstract

Perceraian dapat menyebabkan pernikahan berakhir. Setelah pernikahan dibubarkan, istri tidak hanya kehilangan tanggung jawabnya, tetapi juga kehilangan hutang perkawinan. Hutang perkawinan harus dibayar di pengadilan bersamaan dengan pembagian properti. Properti bersama pada dasarnya berbicara tentang kekayaan, uang, atau properti yang dihasilkan dari hutang dan modal. Kepemilikan bersama adalah salah satu hal yang paling sensitif dan bermasalah di masyarakat. Tanggung jawab suami dan istri atas hutang bersama kepada pihak ketiga tidak diatur secara eksplisit dalam undang-undang. Pada dasarnya, utang bersama adalah tanggung jawab bersama. Dalam Pasal 35 Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan, harta bersama dan harta warisan adalah dua jenis harta yang diakui dalam perkawinan. Jadi, hutang yang timbul dalam sengketa properti bersama juga dapat diperhitungkan. Dalam penelitian ini kami mengkaji dan menganalisis pertanggungjawaban suami dan istri atas hutang bersama kepada pihak ketiga sesuai dengan undang-undang perkawinan dan implikasinya.

Abstract

This study discusses the legal status and protection of children in the womb of an unmarried woman in Kua Dungingi. The purpose of this study is to find out how the status and legal protection of children in the womb of an unmarried woman are viewed from the perspective of positive law and Islamic law. The research method used is an empirical research method. The status of children of women who are pregnant out of wedlock is to have the same rights as other children as in Article 1 number 12 of Law Number 23 of 2022 concerning child protection states that ha kana are part of of human rights that must be guaranteed, protected and fulfilled by parents, family, society, government and the state. However, after the birth of a child from a woman who is pregnant out of wedlock, there will be several obstacles in terms of administrative arrangements, such as processing birth certificates. Then, the legal arrangements for pregnant women out of wedlock are based on positive law, the compilation of Islamic law, and Islamic law in Indonesia, there is a difference in positive law. regulated more towards the crime of adultery, while in the compilation of Islamic law one can marry a woman who is pregnant out of wedlock, and in Islamic law itself there are two opinions, namely there are those who allow it and there are those who forbid it.

Abstract

 The study explores how Islamic law and local culture influence democracy in the United Arab Emirates (UAE) and Indonesia and how each country's constitution facilitates the implementation of democracy based on Islamic principles. In the context of the UAE, Islamic law (sharia) is the primary source of law, while in Indonesia, Pancasila and the 1945 Constitution establish a more inclusive and pluralist legal framework, enabling the practice of Islamic law in a context that respects religious freedom. The research employs juridical legal research with historical, comparative, and Islamic legal approaches and will be analyzed with descriptive-analytical methods. The results showed the role of Islamic law, constitution, and culture in shaping democracy in the UAE and Indonesia through public policies and laws that accommodate the wider community's interests. With its sharia law and authoritarian constitution, the UAE shows a democracy different from Indonesia, which implements an inclusive democracy based on Pancasila and the 1945 Constitution. Cultural factors also play a role, with the UAE influenced by the monarchy and ruling family loyalties, while Indonesia is influenced by ethnic and cultural diversity. Implementing Islamic democracy requires transforming power, inclusive dialogue, and balancing Islamic values and universal democracy. Abstrak: Penelitian ini mengeksplorasi bagaimana hukum Islam dan budaya lokal mempengaruhi demokrasi di Uni Emirat Arab (UEA) dan Indonesia serta bagaimana konstitusi masing-masing negara memfasilitasi penerapan demokrasi berdasarkan prinsip-prinsip Islam. Dalam konteks UEA, hukum Islam (syariah) merupakan sumber hukum utama sedangkan di Indonesia, Pancasila dan UUD 1945 membentuk kerangka hukum yang lebih inklusif dan pluralis. Hal ini memungkinkan penerapan hukum Islam dalam konteks yang menghormati kebebasan beragama. Penelitian ini menggunakan penelitian hukum yuridis dengan pendekatan sejarah, komparatif, dan hukum Islam yang  dianalisis dengan metode deskriptif-analitis. Temuan penelitian menunjukkan peran hukum Islam, konstitusi, dan budaya dalam membentuk demokrasi di UEA dan Indonesia melalui kebijakan publik dan undang-undang yang mengakomodasi kepentingan masyarakat luas. UEA dengan hukum syariah dan konstitusi otoriternya menunjukkan demokrasi yang berbeda dengan Indonesia yang menerapkan demokrasi inklusif berdasarkan Pancasila dan UUD 1945. Faktor budaya juga berperan, UEA dipengaruhi oleh monarki dan kesetiaan keluarga penguasa sedangkan Indonesia dipengaruhi oleh keragaman etnis dan budaya. Penerapan demokrasi Islam memerlukan transformasi kekuasaan, dialog inklusif, dan keseimbangan nilai-nilai Islam dan demokrasi universal.
