Abstract

This article aims to find out how Mahar's position on the law of marriage in particular for Islamic believers where the obligation of Mahar is a thing to be carried out and how the compilation of Islamic law views on the Mahar arrangement. But the reality is that there is still a divergence in the society that from the prospect of the bride to the prospective bride asks Mahar to a very oppressive male prosecutor so that the prosecuted bride is unable to hold it that eventually the candidate bride and bride take the crossroads of fleeing to the place of the Principal. So to reveal that, the author uses the Library Research approach with the research methods carried out to study literature and writings that are closely related to the issues raised in this research. The functions of the Mahar are: a. the distinction between marriage and marriage; b. the form of respect, appreciation, and protection for women; c. the type of seriousness of a man toward the woman he is to marry; d. the symbol of the responsibility of a woman toward a given Mahar; e. a symbol of responsibility for a man; and f. the symbole of agreement and disagreement.

Abstract

 The study explores how Islamic law and local culture influence democracy in the United Arab Emirates (UAE) and Indonesia and how each country's constitution facilitates the implementation of democracy based on Islamic principles. In the context of the UAE, Islamic law (sharia) is the primary source of law, while in Indonesia, Pancasila and the 1945 Constitution establish a more inclusive and pluralist legal framework, enabling the practice of Islamic law in a context that respects religious freedom. The research employs juridical legal research with historical, comparative, and Islamic legal approaches and will be analyzed with descriptive-analytical methods. The results showed the role of Islamic law, constitution, and culture in shaping democracy in the UAE and Indonesia through public policies and laws that accommodate the wider community's interests. With its sharia law and authoritarian constitution, the UAE shows a democracy different from Indonesia, which implements an inclusive democracy based on Pancasila and the 1945 Constitution. Cultural factors also play a role, with the UAE influenced by the monarchy and ruling family loyalties, while Indonesia is influenced by ethnic and cultural diversity. Implementing Islamic democracy requires transforming power, inclusive dialogue, and balancing Islamic values and universal democracy. Abstrak: Penelitian ini mengeksplorasi bagaimana hukum Islam dan budaya lokal mempengaruhi demokrasi di Uni Emirat Arab (UEA) dan Indonesia serta bagaimana konstitusi masing-masing negara memfasilitasi penerapan demokrasi berdasarkan prinsip-prinsip Islam. Dalam konteks UEA, hukum Islam (syariah) merupakan sumber hukum utama sedangkan di Indonesia, Pancasila dan UUD 1945 membentuk kerangka hukum yang lebih inklusif dan pluralis. Hal ini memungkinkan penerapan hukum Islam dalam konteks yang menghormati kebebasan beragama. Penelitian ini menggunakan penelitian hukum yuridis dengan pendekatan sejarah, komparatif, dan hukum Islam yang  dianalisis dengan metode deskriptif-analitis. Temuan penelitian menunjukkan peran hukum Islam, konstitusi, dan budaya dalam membentuk demokrasi di UEA dan Indonesia melalui kebijakan publik dan undang-undang yang mengakomodasi kepentingan masyarakat luas. UEA dengan hukum syariah dan konstitusi otoriternya menunjukkan demokrasi yang berbeda dengan Indonesia yang menerapkan demokrasi inklusif berdasarkan Pancasila dan UUD 1945. Faktor budaya juga berperan, UEA dipengaruhi oleh monarki dan kesetiaan keluarga penguasa sedangkan Indonesia dipengaruhi oleh keragaman etnis dan budaya. Penerapan demokrasi Islam memerlukan transformasi kekuasaan, dialog inklusif, dan keseimbangan nilai-nilai Islam dan demokrasi universal.

Abstract

Since 2017, the Ministry of Agrarian Affairs and Spatial Planning/Head of the National Land Agency has been tasked by President Joko Widodo to complete land registration across Indonesia by 2025 through the Complete Systematic Land Registration Program (PTSL). Based on Ministerial Regulation ATR/BPN Number 12 of 2017, updated with Number 6 of 2018, this program aims to provide legal certainty and protection of land rights for the community. However, many people, especially in North Gorontalo Regency, still do not understand how to obtain land certificates due to a lack of information and education about PTSL. This research aims to explore government policies that provide land ownership certificates as legal protection for the community. Better coordination is needed between local governments and the Ministry of ATR/BPN to raise public awareness of the importance of land certificates, which not only guarantee ownership but can also be utilized as business capital. The PTSL program is expected to improve community welfare and reduce land disputes. Research findings indicate that public understanding in North Gorontalo Regency remains low, with obstacles such as a lack of information, complicated procedures, and limited access. Government policies need to include regulatory simplification and increased transparency as well as public services.

Abstract

This research aims to analyze the role of legislation in addressing cases of unregistered marriages conducted by Civil Servants (PNS). Utilizing a normative legal research method with a statute approach, this study employs library research, expert opinions, and an examination of Government Regulation No. 10 of 1983 in conjunction with Government Regulation No. 45 of 1990 concerning Marriage and Divorce Licenses for Civil Servants. These regulations have a hierarchy that refers to Law No. 16 of 2019 concerning amendments to Law No. 1 of 1974 on marriage. The perspective of this research is to evaluate the extent to which government regulations can control the functions and positions of civil servants as state apparatus faced with freedom of perspective, both from administrative, legal norms, and religious values.

Abstract

Introduction to The Problem: The revelation of cases of misuse of humanitarian donations by philanthropic organizations reported by the media. The Aksi Cepat Tanggap (ACT) organization, which is one of the suspects in the misuse of humanitarian donations, is a big question about the implementation of supervision carried out by the government. There are not many cases of ACT, there are several institutions or community organizations to government organizations that have misused their donations. The form of misuse of humanitarian donations with the misuse of public funds to the waste of funds.Purpose/Objective Study: This research aims to reconstruct the legal liability of social philanthropy institutions in the misuse of humanitarian funds. Thus, the collection of humanitarian donations can provide real benefits to the community, and government programs related to poverty alleviation can have a real impact.Design/Methodology/Approach: This type of research is normative juridical with an analytical descriptive approach that discusses legal symptoms and problems with a legislative and doctrinal approach.Findings: The author identifies a significant gap in governmental oversight concerning the collection of money or goods intended for humanitarian aid. This lack of supervision has resulted in the opportunistic exploitation of disaster events, where individuals or groups capitalize on the urgency and generosity elicited by such crises. These actors collect donations ostensibly for relief efforts but instead divert these resources to serve their own personal or financial interests. The absence of stringent regulatory frameworks and effective monitoring mechanisms allows for this misuse, undermining public trust and depriving genuine victims of the essential aid they desperately need. The author underscores the critical need for robust government intervention and accountability measures to safeguard the integrity of humanitarian donations and ensure they reach those most in need.Keywords: Reconstruction; Philanthropic Institutions; Humanitarian Donations

Abstract

Penelitian ini bertujuan menganalisis tanggung jawab orang tua terhadap anak dalam fenomena kohabitasi di Desa Bajo, Kecamatan Tilamuta, Kabupaten Boalemo, serta mengidentifikasi faktor-faktor yang menghambat penerapan hukum adat dalam menangani praktik tersebut. Menggunakan pendekatan hukum empiris kualitatif, penelitian ini mengumpulkan data melalui wawancara mendalam, observasi, dan studi dokumen di lapangan. Temuan menunjukkan bahwa meskipun hukum adat di Desa Bajo masih berlaku terutama melalui sanksi berupa pemaksaan pernikahan terhadap pelaku kohabitasi penerapannya menghadapi berbagai hambatan, baik internal maupun eksternal. Secara internal, hukum adat belum tertulis, bergantung pada otoritas personal, dan kurang dipahami esensinya oleh masyarakat. Secara eksternal, terjadi ketegangan antara norma adat dan prinsip hukum nasional, terutama terkait hak anak, kesukarelaan dalam perkawinan, serta pergeseran nilai sosial akibat modernisasi. Di sisi lain, peran orang tua sering kali lemah, pasif, atau bahkan membiarkan kohabitasi dengan alasan “akan segera dinikahkan”, sehingga gagal memenuhi kewajiban hukumnya berdasarkan UU No. 1 Tahun 1974 dan UU No. 35 Tahun 2014

Abstract

Abstract This study aims to analyze the legal protection for a legitimate wife who does not receive maintenance within her marriage, specifically based on Law No. 16 of 2019 concerning Amendments to Law No. 1 of 1974 on Marriage. This research uses an empirical legal research method with a juridical-sociological approach. The research questions addressed in this study are: first, how is the legal protection for the legitimate wife’s right to maintenance in her marriage according to Law No. 16 of 2019, and second, what are the factors causing the failure to fulfill the wife’s maintenance rights within her marriage in Tombolango Village? Data was collected through interviews with relevant parties in the Tombolango Village community and by reviewing regulations such as the Marriage Law, the Law on the Elimination of Domestic Violence (PKDRT), and the Compilation of Islamic Law (KHI). The study found that although the law provides protection for the wife's right to maintenance, in practice, there are socio-economic and cultural factors that hinder the fulfillment of this right in Tombolango Village. Therefore, efforts to raise legal awareness in the community and increased oversight from authorities are necessary to protect women's rights in marriage.

Abstract

This study aims to examine the positive legal void in responding to the practice of child cohabitation in Indonesia and analyze the role of the patriarchal system in worsening the weak protection of children, especially girls. Using a juridical-normative method with a qualitative approach, this study examines national laws and regulations, international conventions, and critical legal literature to uncover structural inequalities in regulations. The results of the analysis show that child cohabitation is a form of covert sexual exploitation that has been allowed to take place in the social space without legal certainty due to legal-formalistic views and the dominance of patriarchal cultural norms. The state has failed to carry out its constitutional mandate in guaranteeing children's rights to protection, health, education, and self-development. Therefore, progressive legal reform, based on gender justice and based on the principles  of the best interest of the child and maqasid al-shariah is needed as an urgent step to ensure comprehensive and transformative legal protection for Indonesian children.

Abstract

Penelitian ini bertujuan untuk mengalisis pengaturan dan implementasi sistem pembayaran shopee paylater (SPayLater) di Indonesia dan Malaysia dari perspektif hukum. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang - undangan terkait fintech, perlindungan konsumen, serta transaksi elektronik, dan bahan hukum sekunder berupa literatur akademik dan penelitian terdahulu. Hasil penelitian menunjukan bahwa di Indonesia, layanan Paylater diatur dalam kerangka fintech lending di bawah pengawasan OJK dan Bank Indonesia, namus masih terdapat kelemahan pada aspek transparansi biaya, mekanisme penagihan dan perlindungan data pribadi. di Malaysia, pengawasan dilakukan oleh Bank Negara Malaysia dan Securities Commission dengan batas bunga maksimal 18% per tahun, namun masih menghadapi tantangan dalam transparansi onformasi dan praktik responsible lending. Kesimpulannya, meskipun terdapat perbedaan substansi regulasi, kedua negara sama - sama berupaya menyeimbangkan inovasi digital dengan perlindungan konsumen, meski masih memerlukan penguatan regulasi dan mekanisme pengawasan.

Abstract

The growth of digital transactions in the pedesaan community frequently leads to various legal issues as a result of the lack of understanding regarding health and obligations for individuals. This service activity aims to provide concrete actions through counseling, education, and legal training to the people of Padengo Village, Dengilo District, Pohuwato Regency. The execution of the activity involves a variety of stakeholders, including the government, the military, TNI, and the general public as the main subject. Through this activity, the general public has a better understanding of the legal protections in digital transactions, whether they are being used as buyers or sellers. In addition, the training aims to make paralegals in the area strategic in enhancing the community's legal knowledge so they can be proactive in resolving the first issues in the community. This study emphasizes the importance of stakeholder collaboration in creating a safe and effective digital transaction system for the local population.
