Abstract

This study aims to analyze the criminological factors underlying illegal excise cigarette crimes, identify the transformation of perpetrators' modus operandi, and evaluate the effectiveness of law enforcement in Gorontalo Province. This research employs an empirical juridical method with socio-legal research and criminological legal research approaches, conducted as a case study at the Gorontalo Customs and Excise Supervisory Office. Primary data were obtained through semi-structured interviews with Customs investigators, while secondary data were derived from enforcement documentation for the period 2023–2025 as well as criminological literature and excise regulations. Data analysis was conducted qualitatively using a thematic analysis approach integrated with four classical criminological theories, namely Becker's Rational Choice Theory, Merton's Anomie Theory, Sutherland's Differential Association Theory, and Hirschi's Social Control Theory. The findings reveal a drastic increase in illegal cigarette discoveries in Gorontalo, from 133,000 sticks in 2023 to 878,000 sticks in 2025, driven by price disparity between legal and illegal cigarettes, socio-economic structural pressures, organized informal distribution networks, and the weak social bonds of perpetrators toward legal norms. This study finds that the distribution modus operandi of illegal cigarettes has undergone a significant transformation toward digital-logistics channels through the exploitation of e-commerce platforms and courier services with disguised cargo identities a phenomenon that has received limited scholarly attention in previous research. The contribution of this study lies in the application of a combinative approach integrating four classical criminological theories to analyze economic crime at the regional level, while simultaneously affirming the urgency of digital surveillance reform and excise intelligence strengthening as relevant policy responses within the national excise policy framework.

Abstract

This study aims to examine the positive legal void in responding to the practice of child cohabitation in Indonesia and analyze the role of the patriarchal system in worsening the weak protection of children, especially girls. Using a juridical-normative method with a qualitative approach, this study examines national laws and regulations, international conventions, and critical legal literature to uncover structural inequalities in regulations. The results of the analysis show that child cohabitation is a form of covert sexual exploitation that has been allowed to take place in the social space without legal certainty due to legal-formalistic views and the dominance of patriarchal cultural norms. The state has failed to carry out its constitutional mandate in guaranteeing children's rights to protection, health, education, and self-development. Therefore, progressive legal reform, based on gender justice and based on the principles  of the best interest of the child and maqasid al-shariah is needed as an urgent step to ensure comprehensive and transformative legal protection for Indonesian children.

Abstract

This article investigates the distortion of maqāṣid al-sharīʿah within the practice of child marriage in Indonesia, where a normative framework intended to safeguard protection is increasingly reinterpreted as a mechanism for social legitimation. This research seeks to critically examine the selective deployment of maqāṣid al-sharīʿah in judicial decisions on marriage dispensation and to uncover internal tensions among the objectives of Islamic law concerning child welfare protection. We employ a normative legal research design using conceptual and case-based approaches drawing upon statutory regulations, court rulings, and both classical and contemporary maqāṣid literature. The findings reveal that judicial reasoning in dispensation cases tends to overemphasize the protection of honor (ḥifẓ al-‘ird) while marginalizing essential safeguards such as life (ḥifẓ al-nafs) and intellect (ḥifẓ al-‘aql). This pattern produces a pseudo-maqāṣid phenomenon and reflects underlying power relations in legal construction shaped by prevailing social pressures. This study concludes that a methodological reconstruction is required for the application of maqāṣid through a hierarchical and contextual framework that prioritizes child protection, ensuring that Islamic law operates as an instrument of substantive justice rather than mere normative legitimacy within the Indonesian judicial practice.

Abstract

This study analyzes the management of sexual health information among adolescents in Ayula Selatan Village, Gorontalo, amidst the challenges of social taboos, conservative values, and vulnerability to myths. The Elaboration Likelihood Model (ELM) was used in this study. The purpose of this study is to identify the message processing pathways, i.e. central or peripheral pathways, used by adolescents. This study adopted a mixed methods method with an explanatory sequential design to complete the analysis in this study. Quantitative data from 76 respondents measured adolescents' understanding of sexual health myths and facts, combined with in-depth interview data from selected respondents. The results showed an imbalance in adolescents' knowledge about myths and facts related to sexual health. In addition, information about sexual health tends to be obtained from digital media without assistance from parents or teachers. A sense of taboo and embarrassment to ask questions is one of the reasons why adolescents discuss with peers rather than adults. Another interesting finding shows that adolescents also discuss with artificial intelligence to validate their knowledge about sexual health. ELM analysis found that the majority of adolescents used peripheral pathways in this study. They accepted messages based on non-message cues such as influencer popularity, language style and aesthetic visualization. The adolescents disregarded the quality of arguments. The dominance of this pathway has consequences in the form of temporary changes in attitudes and the risk of spreading misinformation. This study suggests designing adaptive educational programs and strengthening the role of family and school as credible sources.

Abstract

The prevalence of sexual violence against children in Indonesia has not been matched by law enforcement that prioritizes the victims, particularly regarding their right to material recovery through restitution mechanisms. This study aims to conduct an in-depth analysis of the determining factors underlying the disparity in judicial rulings regarding the fulfillment of restitution rights for child victims of sexual intercourse. Using a normative legal research method with legislative, case-based, and conceptual approaches, this study examines the ratio decidendi of three different judicial jurisdictions: Judgment No. 267/Pid.Sus/2024/PN Gto, Judgment No. 26/Pid.Sus/2023/PN Tbn, and Judgment No. 35/Pid.Sus/2022/PN Jnp. The results of the study reveal massive inconsistencies in the fulfillment of children’s rights to restitution, influenced by four main factors: the passive role of the public prosecutor as dominus litis in filing and overseeing restitution documents; the antinomic tension between formal legal certainty and substantive justice; technical obstacles in proving immaterial damages; and the low degree of internalization of the principle of the best interests of the child among judges, as reflected in the total denial of restitution in the case of a 14-month-old toddler victim in Jeneponto. The study’s conclusions affirm that the main problem in ensuring restitution lies not in the absence of legal norms, but rather in the lack of consistency in implementation due to a law enforcement paradigm that remains offender-oriented. A regulatory overhaul is needed to grant judges ex officio authority to order minimum restitution in order to ensure the fair and optimal restoration of the rights of child victims. ABSTRAKMaraknya kekerasan seksual pada anak di Indonesia belum diimbangi dengan penegakan hukum yang berpihak pada korban, terutama terkait hak pemulihan material melalui mekanisme restitusi. Penelitian ini bertujuan untuk menganalisis secara mendalam faktor faktor determinan yang melatarbelakangi terjadinya disparitas putusan hakim dalam pemenuhan hak restitusi anak korban persetubuhan. Menggunakan metode penelitian hukum yuridis normatif dengan pendekatan perundang-undangan, pendekatan kasus, dan pendekatan konseptual, penelitian ini mengkaji ratio decidendi dari tiga yurisdiksi peradilan yang berbeda, yaitu Putusan Nomor 267/Pid.Sus/2024/PN Gto, Putusan Nomor 26/Pid.Sus/2023/PN Tbn, dan Putusan Nomor 35/Pid.Sus/2022/PN Jnp. Hasil penelitian menunjukkan adanya inkonsistensi masif dalam pemenuhan hak restitusi anak yang dipengaruhi oleh empat faktor utama: pasifnya peran penuntut umum sebagai dominus litis dalam mengajukan dan mengawal dokumen restitusi; ketegangan antinomi nilai antara kepastian hukum formal dan keadilan substantif; hambatan teknis pembuktian kerugian immaterial; serta rendahnya derajat internalisasi prinsip kepentingan terbaik bagi anak (the best interest of the child) di sanubari hakim, tecermin dari penolakan total restitusi pada kasus korban balita berusia 14 bulan di Jeneponto. Kesimpulan penelitian menegaskan bahwa problem utama pemenuhan restitusi bukan terletak pada ketiadaan norma hukum, melainkan pada lemahnya konsistensi implementasi akibat paradigma penegak hukum yang masih bersifat offender oriented. Diperlukan rekonstruksi regulasi yang memberikan wewenang ex officio kepada hakim untuk menetapkan restitusi minimal demi menjamin pemulihan hak korban anak secara adil dan optimal.
