Abstract

ABSTRAK Harta bersama adalah harta yang diperoleh sepanjang perkawinan, dimulai sejak awal perkawinan hingga berakhirnya perkawinan. Proses pembagian harta bersama tersebut dilakukan sejak perkawinan berakhir, apakah disebabkan perceraian ataupun kematian salah satu pasangan. Aspek utama yang dipertimbangkan dalam pemeriksaan sengketa harta bersama hanya terkait waktu perolehan harta tanpa aspek lain di luar harta, seperti aspek kepentingan terbaik untuk anak. Hal ini berbeda dengan pemeriksaan harta bersama dalam Putusan Nomor 159 K/Ag/2018 jo. Putusan Nomor 6 PK/Ag/2019 yang juga mempertimbangkan aspek kepentingan anak. Penelitian ini dilakukan secara kualitatif literer menggunakan pendekatan kepustakaan, dengan merujuk kepada dokumen-dokumen atau literatur lain terkait perkara harta bersama dikonjungsikan dengan putusan yang dibahas. Dari penelitian ini dapat disimpulkan bahwa majelis hakim dalam Putusan Nomor 159 K/Ag/2018 jo. Putusan Nomor 6 PK/Ag/2019 telah melakukan ijtihad progresif dengan melakukan rechtsvinding perihal waktu pembagian harta bersama, dengan mempertimbangkan kepentingan terbaik untuk anak dan menunda proses pembagian harta bersama hingga mereka beranjak dewasa. Maka, gugatan harta bersama yang diajukannya harus dinyatakan tidak dapat diterima. Putusan ini merupakan salah satu putusan yang memberikan jaminan terhadap hak anak untuk mendapatkan perlindungan atas tempat tinggal layak. Putusan ini melahirkan kaidah hukum bahwa apabila gugatan harta bersama berpotensi menghalangi terwujudnya kepentingan terbaik bagi anak maka gugatan tersebut dinyatakan tidak dapat diterima. Kata kunci: harta bersama; gugatan; hak-hak anak; kepentingan terbaik anak.  ABSTRACT Marital property refers to the property that a couple acquires during the course of marriage. The process of dividing the joint assets is carried out after the marriage is terminated, whether due to divorce or one of the spouses’ death. The main aspects considered in the examination of marital property disputes are only related to the time of acquiring the assets, without external aspects such as the best interests of the child. This is in contrast to the examination of joint assets in Decision Number 159 K/Ag/2018 and Decision Number 6 PK/Ag/2019, which takes into account aspects of the child’s interests. This analysis is a qualitative literary research approach, reviewing and exploring documents relevant to the decision in question. This study concluded that the panel of judges in Decision Number 159 K/Ag/2018 jo. Decision Number 6 PK/Ag/2019 has done a progressive ijtihad by carrying out rechtsvinding regarding the timing of sharing joint assets. The judge considers the best interests of the child by delaying the distribution of joint assets until they reach adulthood. Therefore, the marital property lawsuit has to be declared unacceptable. This was one of the decisions that ensured the child’s right to live in safety. This decision put forward the rule of law that if a marital property lawsuit has the potential to hinder the best interests of the child, it is declared unacceptable. Abstract

This study analyzes the comparative interpretations of Islamic economic jurisprudence (fiqh) in financial transactions across the Hanafi, Maliki, Shafi'i, and Hanbali schools of thought. Employing a descriptive qualitative approach, data were collected from academic literature, official documents, historical sources, and expert interviews. The research focuses on key Sharia financial transactions, including murabahah, mudarabah, musyarakah, ijarah, and sukuk, to explore the diversity of fiqh interpretations. The findings reveal significant differences, with the Hanafi and Maliki madhhabs showing greater flexibility and adaptability to socio-economic contexts, while the Shafi'i and Hanbali madhhabs maintain a stricter adherence to religious texts. These differences impact the design and implementation of Sharia-compliant financial products, influencing how they align with diverse fiqh perspectives. This study concludes that such variations highlight the dynamic and adaptable nature of Islamic economic jurisprudence in addressing diverse socio-economic needs. It underscores the importance of harmonizing interpretations to support the globalization of Islamic finance, ensuring inclusivity and sustainability without compromising Sharia principles. This research provides valuable insights into the role of madhhab diversity in shaping the growth and development of Sharia-compliant financial systems.Keywords: Economic Fiqh, Islamic Financial Transactions, Madhhab Comparison, Sharia Finance.
