Abstract

Health sectors covers wide range of criminal acts, including medical malpractice, circulation of illegal drug, pharmacy and prescription drug fraud, and hospital unprofessionalism. The Number of victims due to crimes in health sector is far more than what it appears to be. An example of crimes within the health sectors is medical malpractice. Malpractice is a bad practice. Restorative justice as new approach offers a solution to criminal cases that focus more on the recovery rather than vengeance. Therefore, the issue that need to be discuss is whether health crimes equate to medical malpractice and how should the application of restorative justice be applied to criminal acts in health sectors. One of the main reasons to implement restorative justice is because the victim as the party who is most harmed and suffers, is in fact generally being abandoned in criminal justice system. The care and protection given to the victim felt not yet adequate especially if the aim is to restore the victim’s suffering. This study shows that health crimes does not equate to medical malpractice because as the name suggested medical malpractice entail a profession. However, criminal acts can be committed by anyone. The application of restorative justice should be applied to cases in health sectors that involve negligence and not cases based on intent. The application of restorative justice can be beneficial to perpetrators, victims, and society. Keywords: restorative justice, malpractice, health crime

Abstract

Restorative justice in the investigation is carried out by using the penal mediation method which provides an opportunity for the Victim and the Perpetrator in a participatory way to formulate a peace agreement facilitated by the Investigator. Penal mediation comes from civil mediation with problems in the process of drafting an agreement which must be ensured that it comes purely from the Parties. This research is a socio legal research conducted at the Directorate of General Criminal Investigation of the Regional Police of Central Java and the Indonesian Advocates Association of the Semarang Branch of the Leadership Council with the methods of interviewing, observing, and reviewing case files. This research examines two problems: how the process of preparing a penal mediation agreement fits into the application of restorative justice at the investigation stage, and how to supervise the implementation of a penal mediation agreement at the investigation stage. The results of the study show that the penal mediation agreement was prepared by the Parties themselves, facilitated by the Investigator, but did not involve the community so that the orientation of returning to social harmonization was not felt. Abstract

Children are a group that is highly vulnerable to becoming victims of violence, especially sexual violence. Sexual violence against children is a serious crime that has a broad impact, especially on the future of children as the next generation of the nation. Legal protection is a state policy to protect, fulfill, and guarantee the fulfillment of children's rights and obligations in the context of law enforcement for the protection of children. This study aims to examine the legal protection provisions for child victims of sexual violence in Law No. 35 of 2014 concerning Amendments to Law No. 23 of 2002 concerning Child Protection and its compatibility with the principles of the Convention on the Rights of the Child (CRC). The method used in this study is normative juridical and the data used is secondary data. The results of the study show that the child protection law has provided a legal basis for child victims of sexual violence and that the protection provided is in accordance with the principles set out in CRC. In this case, strengthening the monitoring mechanism is very important so that regulations on the protection of child victims of sexual violence can be implemented effectively and in the interests of the victims.

Abstract

The legal protection of victims of crime requires serious attention, as the victims frequently refuse to respect their human rights. In the criminal justice system in Idonesia the rights of victims of criminal acts are not widely accommodated, as the normative provision in the Act only states that the victim of a serious offence can obtain compensation from the state. With regard to criminal acts, it should be recognised that not all perpetrators can pay damages or compensation. So in this case, the state must play a role in restoring the condition of victims of crime, which can undermine the dignity and dignity of the victims

Abstract

Law enforcement treats children in conflict with the law as “small adults” who commit criminal acts. The handling of children as perpetrators of crimes punishable by imprisonment of 7 years or more frequently neglects the best interests of the child. This study examines whether the concept of Restorative Justice can complement the resolution of cases involving children in conflict with the law, particularly those facing a sentence of 7 years or more. This study uses a normative juridical research method. The research findings suggest that Restorative Justice can complement the resolution of cases involving children in conflict with the law, particularly those facing sentences of 7 years or more, as it fundamentally upholds children’s rights. Moreover, Restorative Justice can be applied to such cases through existing diversion mechanism, which shifts the legal process from criminal proceedings to non-criminal alternatives. This approach involves mediation and negotiation between the perpetrator, the victim, their families, the community, and law enforcement to identify the best solution for addressing the issues faced by children as criminal offenders.

Abstract

Pembinaan keterampilan narapidana merupakan bagian dari pembinaan kemandirian yang diberikan melalui serangkaian program pelatihan keterampilan kerja sebagai salah satu upaya mewujudkan reintegrasi sosial. Pembinaan melibatkan semua lembaga yang ada dalam sistem pemasyarakatan diantaranya Lembaga Pemasyarakatan dan Balai Pemasyarakatan. Penelitian ini bertujuan menganalisis sinergi antara Lapas Kelas IIA Purwokerto dan Bapas Kelas IIA Purwokerto dalam pembinaan keterampilan narapidana. Metode yang digunakan adalah yuridis-empiris dengan pendekatan kualitatif melalui wawancara dengan petugas Lapas dan Bapas serta studi kepustakaan. Hasil penelitian menujukan bahwa sinergi antara Lapas dan Bapas dalam pembinaan keterampilan diwujudkan melalui dokumen penelitian kemasyarakatan atau litmas yang berisikan rekomendasi program pembinaan  yang akan diberikan kepada narapidana. Sinergi tersebut didukung dengan letak geografis yang berdekatan dan adanya koordinasi yang baik, namun memiliki kendala keterbatasan sumber daya manusia dan sarana prasarana. Penelitian ini menyimpulkan bahwa sinergi tersebut sudah efektif namun belum optimal dalam implementasinya karena terdapat kendala dan memerlukan evaluasi lebih lanjut. Meningkatkan pelatihan SDM dan alokasi anggaran khusus dapat dijadikan rekomendasi untuk mengatasi keterbatasan tersebut.Kata Kunci: Narapidana; Pembinaan Keterampilan; Reintegrasi Sosial.
