Abstract

The contain research in this analysis is about the contract used by Darurrahmah Islamic Boarding School and Bank Syariah Indonesia. This research is literature and field research by emphasizing the quality of data obtained from the literature focused on examining the role of Bank Syariah Indonesia in Darurrahmah Boarding School Bogor, West Java. The approach used by the researcher was descriptive qualitative by providing solutions to problems by collecting data, compiling, classifying, analyzing, evaluating, and interpreting them. The sources of data used in this study were in the form of primary sources, namely Bank Syariah Indoensia and the Boarding School Administration Division, as well as books related to this. In addition, there were also some secondary sources i.e. a journal entitled “Prospek dan Kendala Bank Syariah di Era Globalisasi” by Siti Yunitarini. The results show that the contract used by Darurrahmah Islamic Boarding School and Bank Syariah Mandiri branch of Cibubur related to monthly salaries and tuition fees for students are mudharabah muthlaqah and wadi'ah yad dhamanah contracts with the provisions described in this thesis. The author also concludes that there is an agreement between the contracts and the DSN-MUI fatwa related to these contracts in terms of the form for creating new savings accounts with the DSN-MUI fatwa accompanied by the results of interviews with several staff at the central and branch of Bank Syariah Mandiri

Abstract

Pancasila sebagai dasar negara Indonesia memiliki peran penting dalam membentuk sikap toleransi antar umat beragama. Pancasila, dengan prinsip-prinsipnya yang menekankan pada kemanusiaan, persatuan, dan keadilan sosial, menyediakan landasan moral dan etika yang mendukung kerukunan antar umat beragama. Makalah ini menganalisis bagaimana Pancasila, melalui prinsip-prinsipnya, dapat dijadikan sebagai alat untuk mengedukasi dan mempromosikan toleransi antar umat beragama. Dengan pendekatan ini, diharapkan dapat menciptakan lingkungan yang lebih inklusif dan toleran, di mana setiap individu dapat hidup dalam kebebasan dan keadilan tanpa diskriminasi. Pancasila memiliki potensi besar untuk menjadi alat yang efektif dalam membangun sikap toleransi antar umat beragama. Melalui pemahaman dan penerapan nilai-nilai Pancasila, diharapkan dapat meningkatkan kerukunan dan kesatuan antar umat beragama dalam masyarakat Indonesia. Penulis menggunakan metode penelitian kualitatif deskriptif dengan studi kepustakaan. Teknik pengumpulan data dilakukan dengan metode kualitatif melalui studi kepustakaan, atau yang sering disebut dengan Literature Review, adalah suatu pendekatan penelitian yang menggunakan data sekunder berupa literatur, jurnal, buku,artikel ilmiah, dan dokumen lainnya sebagai sumber utama informasi.

Abstract

This study looks at how the government isn't doing enough to watch over logging in Sumatra and how that leads to a higher chance of flooding, using the ideas from Administrative Law. Ineffective supervision, both during the licensing process and afterwards, significantly contributes to the decline of the forest's ecological functions, resulting in hydrological disasters. The study uses normative law and follows a literature review method. The data used consists of secondary data, including primary legal materials such as legislation, as well as secondary materials like textbooks, academic journals, and digital sources. Data was gathered by looking at documents and then looked at using a descriptive-qualitative approach. The research shows that the government's failure to properly carry out its responsibilities in forestry management can be considered an illegal government action, known as an 'onrechtmatige overheidsdaad'. This action goes against the General Principles of Good Governance (AUPB), especially the principles of being careful with public money, being responsible, and ensuring that laws are clear and followable. This situation leads to the government being responsible, which means they must take steps to fix the environment and offer help to the communities that were affected. This study suggests strengthening the forestry oversight system by implementing regulatory improvements, improving the capacity of officials, utilizing technology, and involving the community actively to ensure transparent, accountable, and sustainable environmental management.

Abstract

The phenomenon of unregistered polygamous marriages has generated negative perceptions within society, particularly regarding justice in household relations. In practice, women and children born from unregistered marriages often lose their legal rights, such as maintenance and inheritance, due to the lack of state recognition of such marriages. Indonesian positive law, as regulated in Marriage Law No. 1 of 1974, requires marriage registration as the basis of legal validity; therefore, unregistered marriages do not provide formal legal protection. Meanwhile, from the perspective of Islamic law, an unregistered marriage is considered valid as long as it fulfills the pillars and requirements of marriage, thereby granting wives and children inheritance rights. This study aims to analyze the legal protection of inheritance rights for wives and children in unregistered polygamous marriages from the perspectives of Islamic law and positive law. The research employs a qualitative descriptive method with a normative juridical approach. Data were collected through observation, interviews with judges of the Religious Court and religious figures, as well as documentation from various legal sources. The results of the study indicate that: (1) under Islamic law, wives and children from unregistered polygamous marriages retain their legal status and inheritance rights as long as the marriage is religiously valid; (2) under positive law, the inheritance rights of wives and children from unregistered marriages are not recognized unless isbat nikah is conducted as a form of marriage legalization; and (3) mediation mechanisms and family deliberation serve as alternative means of resolving inheritance disputes; however, legal certainty ultimately requires official marriage registration and legalization.

Abstract

This study investigates the emerging phenomenon of "digital self-slavery" (perbudakan diri digital) within Indonesia's Society 5.0 landscape, focusing on the TikTok live-streaming ecosystem as a site of voluntary self-exploitation mediated by algorithmic systems. Employing a mixed-method approach combining an online survey of 304 respondents with qualitative essay analysis and social media observation this research identifies a critical gap in existing digital slavery literature, which predominantly addresses externally coerced exploitation while neglecting voluntary self-exploitation through digital platforms. Drawing on the Modern Slavery Wheel theory, the digital labor exploitation framework, and the Islamic jurisprudential concept of maqashid al-syariah, this article introduces "self-slavery" as a distinct analytical category separating it from conventional modern slavery. Empirical findings reveal that 85.5% of respondents—predominantly Generation Z—classified online gift-begging behavior as technology-disguised slavery, directly refuting the prevailing social stigma of generational digital apathy. Additionally, 33.2% reported experiencing algorithmic pressure to follow social media trends, and 73.3% expressed support for cyber law reform. From the Islamic legal perspective, this practice constitutes violations of hifzh al-'irdh (preservation of honor) and hifzh al-nafs (preservation of the self), rendering it inconsistent with the objectives of Islamic law. The study concludes that Indonesia's current cyber law framework—including the ITE Law and Presidential Regulation No. 47 of 2023—is structurally insufficient to address nuanced forms of digital self-exploitation, and proposes a reform agenda grounded in both positive law and Islamic normative principles.

Abstract

Toba Regency, North Sumatra Province. This phenomenon is triggered by the pressures of poverty, low public legal awareness, and weak oversight of children's rights. This situation demands preventive legal protection to prevent exploitation before it occurs, as mandated by Law Number 35 of 2014 concerning Child Protection. This study aims to analyze the forms of preventive legal protection for children as an effort to prevent economic exploitation in Toba Regency and to identify factors inhibiting its implementation. This study used a normative-empirical method with a qualitative descriptive approach. Primary data were obtained through observation and in-depth interviews with the Toba Regency Women's Empowerment and Child Protection Office (PMDPPA) and the Toba Police. Secondary data were sourced from laws and regulations, books, journals, and scientific literature. Data collection was conducted through observation, interviews, and documentation, then analyzed using data reduction, data presentation, and conclusion drawing techniques. The results of the study indicate that preventive legal protection for children in Toba Regency has been pursued through outreach, legal education, supervision, and synergy between the local government and law enforcement officials. However, its implementation has not been optimal due to structural, cultural, and social barriers, including family poverty, low legal awareness, and cultural norms that consider children's involvement in economic activities normal.
