Abstract

We have moved away from the era of the prophet, the exemplary disciples of the prophet, the founders of the madhhab, and the era of the classical ‘ulama. This periodical “moving away” has a tremendous impact on the way we understand Islam. While the revelation has long been ceased since the passing away of the prophet, our social and cultural problems have at the same time increased and intensified. This requires a serious ijtihad to solve some serious problems facing our society. We are obliged to exercise our utmost intellectual ability to extrapolate what Islam has to say concerning these problems. During the lifetime of the prophet, Muslims could consult him on all issues facing them. Vis-à-vis this, the prophet could always offer a satisfactory answer due to his prudence, intellectual acumen, and indeed divine guidance. Muslims living in the post-prophetic eras have to accept that the prophet is no longer with them. They have to rely on their ability to do the ijtihad by interpreting and reinterpreting the divine texts, articulating the views of the previous ‘ulama, and proposing new ideas in line with the spirit of the Qur’ân and the prophetic tradition. This paper deals with the complexity of ijtihad in modern time by highlighting the necessity of reformulating the Islamic thought on Divine Law so that the teachings of Islam may stay relevant to the demand of modern man.

Abstract

Persoalan agama dan budaya adalah salah satu persoalan krusial yang melahirkan berbagai penilaian dalam masyarakat. Sebagian masyarakat menganggap bahwa agama harus steril dari budaya . sementara sebagaian lain menganggap bahwa agama bisa berdialog dengan budaya dengan beberapa hal yang harus diperhatikan dalam rangka menjaga kemurnian agama. Hal ini terkait erat dengan fenomena perubahan pola pemahaman keagamaan dan perilaku keberagamaanpemeluk agama (Islam). Tulisan ini mencoba mendiskusikan fenomena dialog agama dan budaya di masyarakat sekaligus memaparkan berbagai corak Islam lokal.Problem on religion and culture is one crucial problem which generates various assessments within society. Some people think that religion must be sterilized from culture. While, someother point out that religion is able to dialogue with culture under some considerable aspects to maintain religion's purity. It is closely related to the phenomenon of pattern changing of religious understanding and Muslim religious behavior. This paper tries to discuss the phenomenon of religion and culture dialogue within society and to describe various local Islam pattern.Kata Kunci: Keberagamaan, Mitos, Budaya

Abstract

The paper discusses the ideology of fundamentalism on political fiqh. Their idea of ‘total Islam’ emerges problematic situation as the concept they build has not yet faced theoretical and practical construction. This is in line with the idea they have, historical-philology, a hint of paragidm which trying to have religious comprehension structurally, textually, and literally. Since its establishment in 1981, Ikhwan community has conducted many political activities. All activities are intended to reach the vision and mission of the organization, even, by conducting an extreme way that is executing the leader who does not response and accomodate their belief, syari’at Islam. This situation leads to a point of view that their movement is successful and fail in two different sides. They successfully defend the consistency to build the religious proselytizing activities. On the other hand, they cannot have any support from the leader to accommodate their activities.

Abstract

Fazlur Rahman states that Sunnah tends to be guidance not a set of rule. Thus, efforts should be done to formalize, verbalize and make it permanent in the form of Hadith text. Otherwise, Moslems will face discontinuity of history. However, the formulized Hadiths do not necessarily mean that the Hadiths become absolute. When it is so, the Hadiths were essentially reduced.

Abstract

The Islamic education has ever been sociologically and historically regarded as Islamic religious education. It is intended to differentiate it from general (secular) education. This view is considered as the reason for the presence of Islamic religious school (madrasah diniyah) and the dichotomy between religious education and general (secular) education. Since then, the treatment for students'. characters, moral, attitude, personality or what commonly known as affective aspects is relied on religious education. On the contrary, the treatment for students 'psychometrics and cognitive aspects is charged to general education system.

Abstract

Majapahit Java has customary law, namely rules prohibiting "kembar manten" marriages, namely two bride and groom couples marrying at the same time, and the walimah party is held together with the symbol 'kuwade' in one 'terop'. This study employs empirical legal methodologies, incorporating a phenomenological and anthropological approach. Meanwhile, the analytical tools encompass notions related to natural law, justice, and the anthropology of Islamic law. The collection of primary data was conducted through interviews of traditional authorities, religious leaders, knowledgeable individuals in the customary laws, and marriage practitioners who perform 'Kembar Manten' marriages in Mojokerto. The examination was conducted utilizing Thomas Aquinas' theory of natural law and justice, joining with the anthropology of Islamic law. In order to achieve justice in the natural law, it is necessary to have a policy and proportionality when making the walimah ursy, which is specifically created for a single wedding pair. In the field of the Islamic law anthropology, the 'Kembar Manten' refer to customs and customary laws that are regarded obligatory and advantageous. They are intended to promote the welfare of both the bride and groom's families. Neither the Qur’an nor the Hadith provide any instructions suggesting that the walimah ursy is meant for more than one couple during a single walimah. The ban of 'Kembar Manten' in the framework of  Islamic legal anthropology is a customary practice within the community aimed at achieving well-being and security. Provided that the rules are designed to promote goodness and safety, it is imperative to preserve the values of local wisdom rules as a valuable cultural heritage of the nation. This article aims to enhance understanding of the customary law and local wisdom values in the Indonesian marital law.

Abstract

This study aims to explore the extent of Javanese mysticism from the perspective of al-Qur’an and modern society. The type used in this study is using a qualitative approach with literature (library research). Results in this study (1) The mystic of puppetry, which is likened to a poet, is found in QS. Asy-Syu’ara/26:222-22, (2) Mysticism “sastra dan gending,” which contains philosophical symbols and allegorical or better known from the work of Sultan Agung, (3) Mystical mirror, which is figurative or metaphorical in nature, where when one worships and faces Him specifically as self-introspection, contained in Q.S. al-Isra/17:23, (4) Mystical kebatinan, which leads to “Manunggaling Kawula Gusti,” which is defined as a union between “Kaula” and “God,” this is found in Q.S. al-An’am/6:162-163, (5) Magical mysticism, which examines a world that is difficult for human knowledge to reach. Overall, contemporary society has presented diverse perspectives in implementing and interpreting aspects of Javanese mysticism. While there are individuals who are more skeptical of the practice of mysticism, others still preserve their cultural heritage and may stick to the tradition.

Abstract

This research aims to elucidate the relationship between religion, local wisdom, and power relations in the dynamics of Madurese community life from an Islamic perspective, religious scripture texts, and social theory. The research employs qualitative methods focusing on the Madura community as a distinct ethnic group in conducting social interactions and identifying language expressions that symbolize everyday peace. This study employs various data collection methods, including observation, interviews, and documentation. A thorough examination of the dynamics of religion, traditional knowledge, and power dynamics within the Madurese community serves as the data analysis technique employed in this study. By focusing on ontological and epistemological issues, this research utilizes social theory and an Islamic viewpoint to conceptually explain the study of religion, local wisdom, and power relations. The findings show that the Madurese people are known for their unwavering commitment to togetherness, balance, peace, and harmony. This is reflected in 'rampak naong bringen korong,' a concept of local wisdom that represents their deeply ingrained cultural values and moderate religious teachings. These insights hold implications for further studies in exploring the practical applications of local wisdom in promoting social cohesion, governance effectiveness, and community well-being. Penelitian ini bertujuan untuk menjelaskan hubungan antara agama, kearifan lokal, dan hubungan kekuasaan dalam dinamika kehidupan masyarakat Madura dari perspektif Islam, teks-teks agama, dan teori sosial. Penelitian ini menggunakan metode kualitatif yang berfokus pada komunitas Madura sebagai kelompok etnis yang berbeda dalam melakukan interaksi sosial dan mengidentifikasi ekspresi bahasa yang melambangkan perdamaian sehari-hari. Studi ini menggunakan berbagai metode pengumpulan data, termasuk observasi, wawancara, dan dokumentasi. Pemeriksaan menyeluruh terhadap dinamika agama, pengetahuan tradisional, dan dinamika kekuasaan dalam komunitas Madura berfungsi sebagai teknik analisis data yang digunakan dalam penelitian ini. Dengan memfokuskan pada isu ontologis dan epistemologis, penelitian ini menggunakan teori sosial dan sudut pandang Islam untuk menjelaskan secara konseptual studi tentang agama, kearifan lokal, dan hubungan kekuasaan. Temuan menunjukkan bahwa masyarakat Madura dikenal karena komitmennya yang teguh terhadap kebersamaan, keseimbangan, perdamaian, dan harmoni. Hal ini tercermin dalam 'rampak naong bringen korong,' sebuah konsep kearifan lokal yang mewakili nilai-nilai budaya mereka yang sangat tertanam dan ajaran agama yang moderat. Temuan ini memiliki implikasi untuk penelitian lebih lanjut dalam mengeksplorasi aplikasi praktis kearifan lokal dalam mempromosikan kohesi sosial, efektivitas tata kelola, dan kesejahteraan masyarakat.

Abstract

Research on the analysis of KH. Faqih Maskumambang's thoughts on the prohibition of using the Kentongan as a prayer time marker from the perspective of the prophet's hadith needs to be conducted. The aim is to describe the understanding of hadith in the classical and contemporary eras. Kentongan is a tool commonly used by some people as a sign of prayer. The use of this tool is a part of the characteristics of Islam in the archipelago. Along with the development of knowledge, traditions have drawn the attention of many circles. The main reason for criticism and refutation is because the use of these tools is considered an act of bid'ah and resembles non-Muslim worship. Even the founding figure of the NU and KH. Hasyim Asy'ari was among those who opposed traditions. In this study, the author used a descriptive-qualitative method with a contextual approach. The primary source used the book Sharh Hazzu al-Ru'us fi Radd al-Jasus 'an Tahrim al-Naqus by KH. Faqih Maskumambang. The result of this study is that, according to KH. Faqih Maskumambang, the hadith used as the basis for the prohibition of the use of the horn is not valid. In fact, another Hadith refutes Hadith, which is more valid. In explaining this, Kyai Faqih took explanations from the Qur'an and Hadith, which have similar topics of discussion. He also takes the opinions of scholars and the methods of fiqh and logic as reinforcements.
