Abstract

This study described the understanding of the law of Iddah and Ihdad in the Qur'an and Hadith as well as Positive Law. The purpose of this study was to understand the provisions of Iddah and Ihdad in Islamic Law and Positive Law by using Gender Analysis. In this case the wife whose husband died must carry out Iddah and Ihdad, for one hundred and thirty days, in order to honor the departure of her husband, the wife must refrain from things that can cause slander. The researcher used a qualitative approach to the type of library researc. The results of this study indicated that the prohibition of women who are carrying out the Iddah and Ihdad periods is forbidden to marry another man, it is forbidden to leave the house except for urgent reasons, it is obligatory to do Ihdad for women who are doing Ihdad In Islamic law, the Iddah period for a wife is four months and ten days. While Iddah and Ihdad for men are mentioned in the Association of Legislations relating to the Compilation of Islamic Law (2011) in Chapter XIX article 170 paragraph (2) it is stated that "Husbands who are left behind by their wives, carry out a period of mourning according to propriety".

Abstract

The role of career women in the world of work professions. Generally, careers are run by women outside the home. So that career women include those who take part in the public sector. But in the case of career women at the Bahrul 'Ulum Al-islamy Islamic Boarding School, Perhentian Raja District, Kampar Regency, they work only in the cottage environment. A career woman who has an obligation to manage the household as well as possible, always serves her husband and helps her husband to work together to find economic needs so that the mandatory role of a housewife as well as being a career woman can fulfill the requirements that women may work according to legal theory. Islam Buya Yahya.The formulation of the problem in this study are: (1) What are the rights and obligations of the wife who becomes a career woman from the perspective of Islamic law and positive law? (2) What is the perspective of Islamic law and positive law on the dual role of a wife who becomes a career woman? This research is in the form of a sociological approach or empirical legal research. The researcher uses the method in this thesis using a qualitative analysis approach which is intended to examine the final results of in-depth interviews (deep interviews), then analyze the final results of the data obtained in order to conclude the research conclusions. This approach is intended for the views of the ustadzah who at the same time has a structural position within the Bahrul 'Ulum Al-Islamy Islamic Boarding School. Kata kunci: : Rights and Obligations, Career Women, Islamc Law, Positive Law.

Abstract

AbstractMediation is a model of problem solving through deliberation to obtain the agreement of the parties with the assistance of the mediator or a judge. This writing aims to determine the effectiveness of mediation in Sumber Cirebon  Religious Court Number 1 of 2016. This type of research is a field of study, the type of research used is descriptive research qualitative, mainly by describing a state of subject or object of research. Then the data collection methods used are interviews, observation and documentation. Then the data processing and analysis techniques used by using that the effectiveness of mediation in Sumber Cirebon Religious Court based on the review of Supreme Court Regulation Number 1 of 2016 have not been effective, this is because the parties do not have good faith and in each mont there are approximately 700 cases that go to court religious sources. However, the implementation of Supreme Court Regulation Number 1 in 2016 at the source religious court has been effective and has been implemented since March 2016.Keywords: Effectiveness, Mediation, Supreme Court Regulation Number 1 in 2016.

Abstract

Marriage is an inner and outer bond that is woven by a man and woman as husband and wife to reach the pleasure of Allah SWT. To achieve it affection, love, good two-way communication and attention are needed so these things minimize the divorce occurrence. Among the types of divorce is divorce qobla dukhul, which means a divorce that occurs between a husband and wife have not had sexual relations. This divorce resulted a different law from the divorce of ba'da dukhul, therefore the author is interested in researching more deeply, especially regarding the maintenance and the period of iddah for women who are divorced in qobla dukhul state. This study uses literature review research, by conducting a study of library sources which in this case is centered on text study of the book of Abdurrahman al Jaziri namely fiqh ala madzahibil arba'ah. The result of this literature review  is that Imam Syafi'i and Imam Abu Hanifah both do not require a living for a divorced wife in qobla dukhul state. Imam Shafi'i’s opinion is that a divorced wife in qobla dukhul state is not entitled to undergo the iddah whether she had khalwat with her husband or not. Imam Abu Hanifah's opinion is that a wife who is in khalwat with her husband has to undergo iddah and a divorced wife in qobla dukhul state who had not khalwat with her husband is not entitled to undergo iddah

Abstract

Early marriage has become a social problem due to promiscuity, way of life and culture in community groups. This problem is still attached to the majority of the people of Malang Regency. The purpose of this research is to clarify the issue of early marriage and positive law, as well as Islamic views  on early marriage. This study uses descriptive qualitative research methods. This research uses descriptive qualitative research method. Data collection is done by interview and documentation techniques. The results of the study indicate that early marriage in Malang Regency is classified as "very sad" with applications for marriage dispensation reaching 5 to 10 cases every day. The positive legal perspective of Indonesia through Law Number 16 of 2019 concerning marriage has determined the minimum age for marriage, namely 19 years for both men and women. Islamic law through the Compilation of Islamic Law (KHI) has determined the minimum age at marriage for the  bride and groom to achieve physical and mental maturity  to achieve the goal of a happy and harmonious marriage.Kata kunci: hukum islam, hukum positif, usia dini, dispensasi nikah, pernikahan

Abstract

Marriage is a human need. Marriage becomes a more prominent symbol of one's identity. In Jatisari Village, Tempeh Lumajang District, there is a tradition of repeating marriage. This tradition gave rise to many disagreements. Researchers will solve the problems that occur in these differences with the formulation of the problem as follows: (1) What are the factors causing the repetition of marriage in Jatisari Village, Tempeh Lumajang District? (2) How is the process of repeating the tradition of marriage in Jatisari Village, Tempeh Lumajang District? (3) How is the review of Islamic law and positive law about the repetition of marriage in Jatisari Village, Tempeh Lumajang District?. Methodology in this study, researchers plunge spaciousness using a qualitative approach. This study is descriptive and uses phenomenological methods. The method of data collection comes from interviews, field records, voice recordings, and documentation. The results of this study, researchers identified two factors that affect the repetition of marriage, first because the calculation of weton that does not fit and the second ihtiyat. From the opinion of jumhur scholars of the law to repeat marriage is mubah. As a solution, the repetition of marriage in Jatisari Village, Tempeh Lumajang district should be analyzed further. Keywords: Repetition of marriage, calculation of weton, Javanese

Abstract

The research aims to describe the viewpoint of Islamic law on regional regulation number 5 of 2003 which obliges the prospective bride and groom to be good at reading the qur’an, otherwise their marriage will be canceled/postponed. The research also aims to determine of these regional regulations in the Sinunukan religious affairs office. The research is a qualitative research with the type of case study research, the main instrument in this research is the researcher himself. Data collection techniques used in this study are library research, observation, interviews and documentation, after the data is obtained, the data is analyzed using data condensation, conclusions and data verification. The results of the research show that there’s a mismatch between the requirements given by the regional regulation and the conditions set by Islamic law, but if is seen from the point of view of maslahah mursalah then the regulations may be applied. The results of research also show this since the beginning this regulation was stipulated in the religious affairs office of Sinunukan sub-district, no data was found on the number of prospective brides who were not good at reading in the Al-Qur’an.ut can be concluded that the regulations are not implemented perfectly. Abstract

The household conditions experienced by construction workers during the pandemic are quite worrying where the opinions obtained are very minimal, plus during the current pandemic, there are various kinds of basic needs that must be met. This study aims to answer the questions: 1). How is the implementation of the family of construction workers in Wates Village, Mojokerto City in maintaining the integrity of the Sakinah family during the covid19 pandemic. 2). How to fulfill the needs of construction workers' families in the perspective of Islamic law during the covid-19 pandemic in Wates Village, Mojokerto City. The research location is in Wates Village, Mojokerto City. The approach used is qualitative with the type of case study research. The results of this study indicate that the implementation of the family of construction workers in maintaining the integrity of the sakinah family during the covid19 pandemic is able to maintain family unity even in a pandemic period, namely by mutual openness between partners in terms of financial management, as well as establishing good communication with partners, both in terms of income and conditions that occur in the household. Fulfilling the needs of families of construction workers in the perspective of Islamic law is also divided into several parts, namely: primary, secondary and tertiary needs by the head of the family, as well as the fulfillment of needs by the head of the family while working as construction workers by seeking to borrow emergency funds needed during the pandemic. Abstract

Perkawinan adalah hubungan lahir dan batin antara seorang pria dan seorang wanita sebagai suami istri, dengan tujuan untuk mewujudkan keluarga (rumah tangga) yang bahagia dan kekal berdasarkan ketuhanan Yang Maha Esa Usia minimal untuk menikah dalam Undang-Undang Nomor 16 Tahun 2019 adalah 18 tahun. tua. Hal ini merupakan salah satu amandemen Undang-Undang Nomor 1 Tahun 1974 yang dibentuk untuk mengatur perkawinan. Namun penelitian ini lebih fokus pada pemutakhiran lapangan pada Undang-Undang Nomor 16 Tahun 2019 tentang Perubahan Atas Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan. Penelitian ini menyajikan permasalahan dan perspektif yang dikaji dalam konsep dan perilaku kehidupan sosial, yaitu penelitian kualitatif dengan menggunakan metode penelitian deskriptif. Teknik pengumpulan data yang digunakan adalah observasi, wawancara, dan dokumentasi. Menurut temuan ini, hasil penelitian ini menunjukkan bahwa. Landasan filosofis batasan usia menikah dalam Pasal 7 Ayat 1 Undang-Undang Nomor 16 Tahun 2019 adalah Pancasila. Dasar hukum pembatasan usia perkawinan adalah perbedaan usia antara laki-laki dan perempuan dalam Pasal 7 ayat 1 Undang-Undang. Saat ini tidak ada bukti yang mendukung klaim bahwa keju menyebabkan kanker. Pemberlakuan UU Perkawinan tahun 1974 menimbulkan diskriminasi gender, serta sinkronisasi UU Perlindungan Anak Tahun 2014 dengan UU Nomor 23 Tahun 2002 tentang perubahan atas Undang-Undang Nomor 23 Tahun 2002. Kedua, pandangan hukum Islam tentang perkawinan. adalah bahwa seseorang harus berusia minimal 19 tahun untuk menikah. Hal ini didasarkan pada prinsip Maqashid Syariah. Jika hal ini diabaikan, tentu akan berdampak buruk bagi pria dan wanita di kemudian hari. Ketiga, pandangan bahwa KUA wajib bekerja untuk mensejahterakan masyarakat, sekalipun ada yang tidak beres setelah amandemen Undang-Undang Nomor 1 Tahun 1974 dilaksanakan, merupakan tanggung jawab kita.Kata Kunci: Aktualisasi, Batas Usia Perkawinan, Undang-Undang Nomor 16 Tahun 2019.

Abstract

Abstract               Marriage is a way to validate the bond between men and women in a sacred bond so that they become a husband and wife. The purpose of marriage as stated in the Marriage Law article 1, paragraph 1, is to form a family or household that is endangered and based on a Godhead. In deciding a marriage. It is not a benchmark if you are ready and able to get married. Age is one of the material requirements for a marriage, a material requirement is a condition that is related to the core or principle in a marriage in general. Regarding the age limit of marriage, in positive law refers to the Marriage Law article 7 paragraph 1 of 1974 which was later revised and became Marriage Law No. 16 of 2019. Then in Islamic law there is no argument in the Koran or Hadith that states how many restrictions marriage age.
