Abstract

Kafa'ah means being equal, balanced, and compatible. This abstract discusses the importance of the principle of Kafa'ah in marriage, particularly in the context of choosing a spouse who is compatible in social, moral, and economic aspects. Kafa'ah is recognized by scholars from the four Islamic schools of thought, each with different views on its application. The Hanafi, Maliki, Shafi'i, and Hanbali schools emphasize different aspects of religion, lineage, social status, and economics. The author also highlights the practice of Kafa'ah among the Habaib (Ahlul Bayt), especially in preserving the lineage of the Prophet Muhammad, where a Syarifah is expected to marry a Sayyid to maintain the family lineage. Although Kafa'ah in marriage aims to preserve household harmony, marriages are still considered valid even if the couple is not equal in lineage. In Indonesia, organizations like Rabithah Alawiyyah play an important role in preserving the traditions and welfare of the Alawiyyin community, including in matters of Kafa'ah lineage. This research examines the views of the Habaib on Kafa'ah lineage as a primary condition for the marriage of Sayyid and Syarifah.

Abstract

Penelitian ini mambahas tentang tradisi masyarakat bugis dalam nilai-nilai makkalu dapureng wekka pitu yang diintegrasikan dengan fiqh munakahat tentang kesiapan menikah. Analisis falsafah tasyri’ digunakan untuk menggali nilai-nilai yang terkadung dalam hukum perkawinan. Penelitian ini adalah penelitian kualitatif dengan pendekatan normatif empiris untuk memecahkan masalah tentang makkalu dapureng wekka pitu yang menjadi tradisi dari masyarakat bugis. Teknik pengumpulan data yang dilakukan yaitu observasi, wawancara. Hasil penelitian menunjukkan bahwa nilai-nilai dalam makkalu dapureng wekka pitu  sejalan dengan konsep fiqh munakahat dalam konsep tanggung jawab seorang suami kepada istri. Hal inilah yang perlu dikuatkan bagi setiap laki-laki yang akan menikah agar tidak mudah dalam mengambil keputusan pernikahan tanpa ada persiapan dalam kesanggupan pemenuhan tanggung jawab kepada perempuan.

Abstract

This study attends to analyze the ulama perspective regarding the corruption, gift and grants, as well as the actions taken to prevent corruption. Qualitative descriptive is type of this research and uses a juridical sociology approach in analyzing corruption. Prizes and grants that are assumed to be gratuities are basically commendable acts but can lead to criminal acts of corruption when related to officials government. while the ulama agree that corruption is an illegal act. And the preventing and overcoming corruption is to carry out strict supervision and to give strict sanctions to the perpetrators.Penelitian ini bertujuan untuk menganalisa pandangan ulama menyangkut korupsi, hadiah dan hibah, serta tindakan  yang dilakukan dalam mencegah tindak pidana korupsi. Deskriptif kualitatif merupakan jenis penelitian ini dan menggunakan pendekatan sosiologi yuridis dalam menganalisis tindak pidana korupsi. Hadiah dan hibah yang diasumsikan sebagai gratifikasi pada dasarnya merupakan perbuatan terpuji namun bisa berujung pada tindak pidana korupsi apabila berkaitan dengan pejabat. Sementara ulama bersepakat bahwa korupsi adalah perbuatan haram. Hal yang dilakukan dalam pencegahan dan penanggulangan tindak pidana korupsi ialah melakukan pengawasan ketat dan memberikan sanksi yang tegas kepada para pelaku.

Abstract

This study examines the rejection of Marriage Isbat for converts from the Towani Tolotang community in Sidenreng Rappang Regency (Sidrap) in the context of the relationship between customary law, Islam, and state law. Through a normative-empirical approach, this study combines regulatory studies, Islamic law, and field data in the form of interviews with judges and affected communities. The results of the study show that the rejection of Marriage Isbat is based on incompleteness of documents, incompatibility with the pillars of marriage according to Sharia, and the status of customary marriage that has not been legally administered. The Towani Tolotang case illustrates the challenge of harmonizing the implementation of customary law, Islamic law principles, and state regulations. The Sidrap Religious Court rejected the application not because it ignored customs, but for the sake of legal certainty and the validity of sharia. The harmonization of customary and state law is an important step in ensuring legal protection for women converts and strengthening the sustainability of local cultural values in the national legal system.

Abstract

The rapid expansion of digital life has produced a new inheritance dilemma: social media accounts may outlive their owners as economically productive assets, while legal systems remain unprepared to regulate their posthumous transfer and management. This study aims to formulate an Islamic inheritance law framework for social media accounts as digital assets through a case study in Parepare City, Indonesia. It employs an empirical juridical design with a case-study approach involving 17 purposively selected participants, consisting of 15 influencers, one religious court judge, and one legal academic. Data were collected through semi-structured interviews and questionnaires and analyzed using qualitative content analysis. The findings reveal that social media accounts have developed into economically valuable digital assets through monetization, endorsements, and online commercial activities, and that most participants regard such accounts as inheritable when they have identifiable ownership, measurable economic value, and lawful benefit. The study further finds that the main challenge lies not in the normative legitimacy of inheriting such assets, but in the lack of clear mechanisms for ownership verification, lawful access, managerial authority, privacy protection, and the distribution of continuing economic benefits after death. The discussion shows that Islamic inheritance law is conceptually flexible enough to accommodate these assets through the concepts of al-māl, qiyās, and maqāṣid al-syarī‘ah, but remains operationally underdeveloped in regulating their posthumous management. This study implies the need for normative-technical reform through explicit recognition of economically valuable social media accounts as inheritance objects, clearer distinction between economic rights and access rights, stronger use of digital wills, and a more defined role for religious courts in digital inheritance disputes. Abstract

Hukum Islam di bidang kepidanaan dapat didiskusikan dan dijalin dalam hukum pidana Indonesia, sepanjang sesuai dengan dasar filosofis Pancasila. Penggunaan istilah pidana itu sendiri diartikan sebagai sanksi pidana. Untuk pengertian yang sama, sering juga digunakan istilah-istilah yang lain, yaitu hukuman, penghukuman, pemidanaan, penjatuhan hukuman, pemberian pidana, dan hukuman pidana. Dalam hukum Islam, hukuman mati dikenal istilah jinayat yang berkenaan hukuman mati dimana para imam mazhab sepakat bahwa seorang yang membunuh orang Islam yang sama-sama merdeka, dan yang dibunuh itu bukan anaknya, dengan cara sengaja, maka ia wajib menerima balasan bunuh pula. Pemberian hukuman mati adalah untuk menjaga jiwa dan kelangsungan hidup

Abstract

Procedural bioethics stops at clinical safety and informed consent, while positive law stops at regulatory compliance; Both treat reconstructive interventions and elective cosmetic enhancements equally if formal requirements are met, and neither provides an instrument for assessing the moral purpose of people seeking treatment. This study reconstructs maqāṣid al-mukallaf the second dimension of al-Shāṭibī's Islamic legal purpose theory, which highlights the purpose of the subject of law as an operational evaluation framework for the use of stem cells for aesthetic purposes. This study is qualitative normative legal research, combining conceptual, philosophical, and comparative approaches. The main legal materials include the Qur'an, hadith, legal maxims, and uṣūl al-fiqh literature, especially al-Muwāfaqāt; Secondary materials include contemporary fatwas, stem cell regulation, and the latest bioethical and biomedical studies, which are analyzed through content analysis and maqāṣidī reasoning. The findings of this study are, First, the ethical legitimacy of aesthetic stem cell interventions is not determined only by clinical safety or legal validity, but rather by the correspondence between qaṣd al-mukallaf and qaṣd al-shāriʿ. Second, applying the hierarchies of ḍarūriyyāt, ḥājiyyāt, and taḥsīniyyāt results in tiered assessments: reconstructive applications fall under ḍarūriyyāt, interventions that eliminate true difficulties fall under ḥājiyyāt, while purely cosmetic enhancements fall within taḥsīniyyāt and demand the strictest ethical oversight. Third, patient autonomy cannot be the sole determinant of legitimacy when individual intentions are formed under the pressure of the commercialized beauty industry. The study's main contribution is the Integrative Bioethical Governance Model that connects the four normative dimensions scientific validity, legal legitimacy, bioethical principles, and maqāṣid al-mukallaf along with a three-filter instrument that includes the legitimacy of the cell source, the proportionality of benefits to harms, and the authenticity of intentions. This model shifts the unit of analysis in Islamic bioethics from a technological object to a moral agent and answers the criticism that maqāṣidī reasoning is too abstract to be applied on the patient's side
