Abstract

Legal disputes over land rights have become a fundamental and complex problem in the history of the development of agrarian law in force in Indonesia. The inequality that occurs in the pattern of distribution of control, ownership, use and utilization of land, which is also exacerbated by the condition of many land being abandoned by land rights holders, either due to intentional or unintentional factors, has triggered widespread cases of land disputes that have occurred until At the moment. The government itself has attempted to create policies and related regulations, in order to find solutions in resolving cases of ownership disputes over abandoned land. This includes Government Regulation Number 20 of 2021, concerning controlling abandoned areas and land. In this research the author raises two issues, namely, what is the urgency of eliminating ownership rights to abandoned land based on Government Regulation Number 20 of 2021, and what legal remedies can be taken by land rights owners and/third parties who suffer losses due to their abolition rights to abandoned land based on Government Regulation Number 20 of 2021. This research is a form of normative legal analysis (normative legal research), using a statutory approach and a conceptual approach. This research also has important implications in the context of land law, especially in terms of protecting the rights of land owners and encouraging the use of productive land uses. It is hoped that the results will serve as a guide for land ownership rights holders, the government and legal practitioners to better understand the relevant regulations and the impact of loss of ownership rights to land due to abandonment in accordance with the provisions contained in Government Regulation Number 20 of 2021.

Abstract

Upaya Penindakan Terhadap Kelompok Kriminal Bersenjata Oleh Korps Brigade Mobile Untuk Menciptakan Keamanan dan Ketertiban di Papua. Permasalahan dalam penelitian ini adalah Bagaimana Korps Brigade Mobil menciptakan Kemanan dan Ketertiban di Papua. Hasil penelitian ini adalah : Penindakan terhadap KKB yang dilakukan anggota Brimob dengan melakukan kontak senjata juga dilakukan penegakan hukum terhadap anggota yang tertangkap. Penegakan hukum terhadap kelompok pemberontak berdasarkan ketentuan KUHP terletak pada pasal 106 dan pasal 107 yang menjelaskan bahwa makar (aanalag) yang dilakukan dengan niat hendak menaklukan daerah negara sama sekali atau sebagaimananya kebawah pemerintah asing atau dengan maksud hendak memisahkan diri daerah tersebut maka dihukum penjara seumur hidup atau penjara sementara selama-lamanya dua puluh tahun. Salah satu hambatan utama (hambatan pertama) terletak pada lingkup yurisdiksi dan kontrol pemerintah terhadap daerah-daerah yang sering kali menjadi basis operasi KKB, letak geografis, daerah-daerah terpencil seringkali menjadi basis operasi KKB karena faktor geografis yang sulit dijangkau, kurangnya infrastruktur yang memadai, kemampuan anggota Brimob mengenai pengetahuan dan keterampilan tertentu yang mutlak diperlukan untuk menindak anggota KKB yang mereka sudah paham kondisi dan situasi serta mereka sering berbaur dengan masyarakat sehingga sulit untuk membedakannya. Solusi dalam mengatasi hambatan utama yaitu sebagai berikut : Pemerintah harus membuat aturan hukum sebagai dasar anggota Brimob dalam melakukan penindakan anggota KKB yang melakukan kejahatan, Pemerintah harus sering melakukan kontrol pemerintah terhadap daerah-daerah yang sering kali menjadi basis operasi KKB dengan melakukan patroli yang dilakukan anggota Brimob, melakukan koordinasi antara anggota Brimob, masyarakat dan TNI dalam melakukan pengamanan wilayah yang menjadi basis-basis anggota KKB, Meningkatkan kemampuan anggota Brimob dengan mengikutkan dikjur-dikjur dalam rangka peningkatan SDM anggota Brimob.

Abstract

Pencegahan dan penindakan tindak pidana siber oelh Kepolisian Resort Teluk Bintuni. Permasalahan dalam penelitian ini adalah bagaimana bentuk pencegahan atas tindak pidana siber yang telah dilakukan oleh Kepolisian Resor Teluk Bintuni dan bagaimana Apa bentuk penindakan atas tindak pidana siber yang telah dilakukan oleh Kepolisian Resor Teluk Bintuni. Hasil penelitia ini adalah: Pencegahan cyber crime oleh Polres Teluk Bintuni menyebutkan bahwa Pada beberapa tindakan yang di dalam melakukan pencegahan cyber crime adalah dengan melakukan: a. Patroli siber, b. Edukasi siber, c. Teguran langsung melalui medsos, d. Penindakan lansung berupa take down medsos dan e. Penegakan hukum. Penindakan terhadap tindak pidana siber di Indonesia telah membentuk peraturan mengenai kejahatan dalam dunia cyber pada Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik (selanjutnya disebut UU ITE). Rumusan tindak pidana dalam UU ITE diatur dalam Bab VII: Perbuatan Yang Dilarang, yang mencakup Pasal 27 sampai Pasal 37, sedangkan ancaman pidananya ditentukan dalam Bab XI: Ketentuan Pidana, yang mencakup Pasal 45 sampai dengan Pasal 52.

Abstract

This research aims to analyze the legal protection provided to bank customers in cases of erroneous fund transfers by the bank. The research method used is a normative legal research method with a statutory approach and literature study. This research identifies and analyzes legal regulations that regulate legal protection for bank customers in cases of erroneous fund transfers, such as the Banking Law, Bank Indonesia regulations, and related court decisions. The research results show that bank customers have rights that are protected by legal regulations. If there is an error in transferring funds by the bank, the customer has the right to recover the incorrectly transferred funds, compensation for losses incurred, and compensation for loss of business opportunities or reputation that may occur. This research provides recommendations for improving legal protection for bank customers in cases of erroneous fund transfers. Recommendations include improving existing legal regulations, increasing customer awareness of their rights, and increasing supervision of banks by competent authorities.

Abstract

Not all investment agreements are made before a notary, so that agreement does not have strong enough evidence, so when one party commits a default, the other party does not have sufficient evidence to prosecute the party committing the default before the law. The purpose of this study is to analyze the validity of investment agreements without a notary deed and the legal consequences of default in investment agreements without a notary deed. This research is a normative legal research technique. This research used descriptive, interpretation, evaluation, and argumentation techniques to analyze legal material. Akad (contract) is a bond that occurs between two parties, one states ijab and the second states qabul, which then creates legal consequences, namely the emergence of rights and obligations between the two parties. This ijab and qabul show that both parties have voluntarily entered into an agreement that made must be in accordance with the Shari'a. The agreement made not before a notary is still valid, as long as it has fulfilled the legal requirements of the agreement stated in Article 1320 of the Civil Code and as long as no law stipulates that the agreement to be made must be in writing. Legal consequences of the default, the debtor is required to pay compensation for the losses suffered by the creditor, if the engagement is reciprocal, the creditor can demand termination or cancellation of the engagement through the court, the engagement to provide something, the risk of switching to the debtor since the default, the debtor is required to fulfill the engagement if it can still be made or cancellation, accompaniedby payment of compensation, and the debtor obliged to pay court fees if brought before a district court and debtor found guilty.
