Abstract

The urgency of climate mitigation in Southeast Asia, particularly in Indonesia, Vietnam, Thailand, and Malaysia, drives the need for carbon market frameworks that balance economic goals with ecological equity. Despite rapid development, a significant research gap persists in integrating ecological justice principles, especially indigenous rights and equitable benefit-sharing. This study examines ASEAN carbon market regulations and proposes legal reforms for more inclusive governance. The main objective of this study is to analyze the extent to which ASEAN carbon market regulations accommodate ecological justice principles through a normative juridical approach and to propose targeted legal reforms. The findings reveal that ASEAN carbon market regulations have established a legal basis for emissions trading but remain fragmented in protecting indigenous rights, ensuring equitable benefit-sharing, and integrating ecological justice principles. This study contributes by developing a comparative normative framework that links ecological justice with regional carbon market governance. Normatively, this study proposes targeted legal reforms to strengthen ecological equity: mandatory FPIC for indigenous rights, enforceable benefit-sharing mechanisms, standardized social-ecological justice benchmarks in ASEAN’s carbon framework, and enhanced transparency through public registries. These reforms provide a legal foundation for harmonizing ASEAN carbon market governance while advancing equitable and sustainable climate mitigation.

Abstract

Important resources Management rights over customary landnare a resource for human life and community welfare. Human life and community welfare are management rights over customary land. This study looks atnthe role of the state innland management, relevant laws, and land management rights, over land and natural resources. relevant laws, and constitutional rights to landnand natural resources. The aim is to evaluate how well the current laws in place and support the interests ofnthe community. Protect andnrealize the interestsnof the community. Collected through literature studies and using a socio-legal research approach along with a conceptual and legal framework. The results of the study emphasize then need for the government to establish a complete and clear legislative framework for land management, as well as the recognition and defense of 'indigenous peoples' land rights. To address land inequality and ensure equitable and sustainable use and distribution of land resources, this study suggests agrarian reform.

Abstract

This study aims to understand the use of medical cannabis for fulfilling citizens' health rights based on scientific research. The study examines the potential positive impacts of legalizing medical cannabis and the potential risks that might occur when a country legalizes medical cannabis. Additionally, it analyzes whether Indonesia should legalize medical cannabis based on existing scientific research. This study employs normative legal research and has a prescriptive- analytical nature, using statutory approaches, historical approaches, case approaches, comparative approaches, and conceptual approaches. This study uses primary legal materials, which are legal materials issued by official government institutions, and secondary legal materials, consisting of document publications not officially issued by state agencies. The results of the study indicate that scientific research on the potential benefits of legalizing medical cannabis is still limited. The lack of comprehensive research means that medical cannabis is not yet fully understood, and many potential benefits and risks still need to be validated. Moreover, in the context of medical cannabis, the supervision of drug distribution plays a crucial role in preventing the misuse of medical cannabis itself.Considering the known potential benefits and risks, Indonesia should not rush to legalize the use of cannabis for medical purposes. Just because many countries have started to legalize the use of cannabis for medical purposes does not mean Indonesia should force itself to legalize medical cannabis, especially since the scientific research is still in its early stages and requires further investigation

Abstract

Notaries hold attributive authority to draft authentic deeds, yet the Notary Law does not clearly delineate administrative violations from criminal liability, creating a normative gap. This legal issue is analyzed through Supreme Court Decision Number 379 K/Pid/2021 concerning a land-rights-transfer deed made without the owner's consent. This normative-juridical, descriptive-analytical research applies statute, conceptual and case approaches. The findings show that the abuse of authority occurred in the substance, procedure and public-office dimensions of the notarial function, producing tripartite legal consequences in civil, criminal and administrative law. Amending the Notary Law to formulate explicit intent-based parameters is proposed as a solution to close this normative gap.

Abstract

Occupational Safety and Health (OSH) is a crucial aspect of the geothermal energy industry to ensure worker safety and prevent occupational diseases. This study examines the implementation of legal protection for OSH at PT Geo Dipa Energi (Persero) Unit Dieng, focusing on the company's Health, Safety, and Environment (HSE) policies, compliance with labor regulations, and workplace risk management. PT Geo Dipa Energi enforces various safety measures, including HSSE (Health, Safety, Security, and Environment) mandatory procedures, OSH training programs, and social security coverage through BPJS Employment and BPJS Health. The findings indicate that the company’s OSH management aligns with national regulations and international standards such as ISO 45001. However, several challenges persist, including a lack of discipline in using personal protective equipment (PPE), potential exposure to toxic gases such as hydrogen sulfide (H₂S), high noise levels from machinery, and inadequate ventilation. These factors pose significant risks to workers’ health and productivity. To address these challenges, PT Geo Dipa Energi has implemented the Hazard Observation (OrBa) program, which encourages employees to actively identify and report workplace hazards. This initiative aims to foster a stronger safety culture and enhance proactive risk management. By continuously improving its OSH strategies, PT Geo Dipa Energi is committed to ensuring a safer, healthier, and more compliant work environment, ultimately minimizing workplace hazards and improving operational sustainability.

Abstract

The online buying and selling of songbirds in Surakarta has grown significantly with the rise of e-commerce, offering convenience, efficiency, and broader market access. Consumers can easily browse and purchase birds through various online platforms without geographical limitations. However, this type of transaction also presents several risks, including fraud, uncertainty about the bird’s quality, and potential issues during shipping, such as injury or death. Legal protection for consumers engaging in online transactions is regulated under Law No. 8 of 1999 on Consumer Protection (UUPK) and Law No. 11 of 2008, amended by Law No. 19 of 2016, on Electronic Information and Transactions (UU ITE). These regulations outline the rights and obligations of both business actors and consumers to ensure fair and secure transactions. Despite the benefits of online transactions, challenges such as lack of transparency, unreliable sellers, and logistical issues remain prevalent. Consumers are advised to conduct transactions with reputable sellers, such as members of bird enthusiasts’ communities, to reduce the risk of fraud. Additionally, in cases of consumer losses, dispute resolution mechanisms are available through e-commerce complaint services or institutions such as the Consumer Dispute Settlement Agency (BPSK), Consumer Protection Organizations (LPKSM), and the Indonesian Consumers Foundation (YLKI). As online commerce continues to evolve, strengthening consumer protection mechanisms is essential to creating a more secure and reliable marketplace for songbird enthusiasts.

Abstract

Indonesia as an achipelagic country has impacts of climate change. To overcome the impacts, Indonesia uses two methods, namely climate change mitigation and adaptation. In accordance with the provisions stipulated in Presidential Regulation No. 98 of 2021 concerning the Implementation of Carbon Economic Values ​​to Achieve Nationally Determined Contribution Targets, the forestry sector is the main sector in controlling emissions to store carbon with a carbon net sink approach from the forestry and land sector in 2030 (Indonesia's FOLU Net Sink 2030) with two targets, namely 29% with own efforts and 41% with international cooperation. This study aims to conduct a legal review of Indonesia’s climate change mitigation strategy by achieving the net sink target in the forestry and land use (FOLU) sector by 2030. This research method use is normative legal research with statue approach. This research use analyse techniques with syllogism method based on deductive. The results indicate that limited specific and integrated regulations, weak law enforcement, implementation of decentralization, to low public awareness of the impact of climate change. However, Indonesia does not have regulations that specifically and comprehensively to regulate climate change. The research concludes that several conditions have impact the achievement of Indonesia’s Forestry and Other Land Use Net Sink target in 2030.

Abstract

Food safety is a crucial aspect of consumer protection and national food security. Registration of Fresh Food from Plants of Domestic Production of Small Businesses (PSAT-PDUK Registration) is regulated as a form of legal instrument to ensure that fresh food in circulation meets quality and safety standards. This article aims to analyze the regulation of PSAT-PDUK registration in Indonesia from a legal perspective and review the effectiveness of its implementation. The method used is normative juridical with the approach of legislation and legal theory of consumer protection. The results of the study show that despite being regulated in the Food Law, Government Regulation No. 86/2019, Government Regulation No. 5-2021, MOA No. 53/2018, and other technical implementing regulations, the implementation of PSAT-PDUK registration still faces a number of obstacles such as low literacy of small business actors, limited supervision, and not optimal synergy between supervisory institutions. Therefore, it is necessary to strengthen the role of the Food Safety Competent Authority (OKKP) and harmonize regulations in order to increase the effectiveness of the implementation of PSAT-PDUK Registration as a legal instrument of the government in guaranteeing and monitoring food safety of Fresh Food of Plant Origin in public circulation.
