Abstract

This research is motivated by indigenous peoples' belief in customary rules which encourages studies on their legitimacy in the Indonesian legal system. The author collected study samples from the Bangkalan Dayak tribe in South Kalimantan Province as an example of an Indonesian customary village. This study focuses on two formulations of problems, namely the role of the customary criminal justice system in the national criminal justice system and the impact of Dayak Bangkalan customary criminal justice law enforcement when related to the national criminal justice system. This research is a sociological legal research, the legal data collection technique is carried out through literature review, including primary legal data, secondary legal data, and tertiary legal data related to this research. The result of the study is that the state recognizes the existence of customary law communities in accordance with Article 18B of the 1945 Constitution of the Republic of Indonesia. Even though there is no legal framework that can regulate this at the national level, the mandate of regional legislative policy still recognizes the existence of customary courts. This is evidenced by the existence of regional regulations that recognize and protect indigenous peoples. In addition, the results of the study conveyed that the legal implications arising from customary court decisions turned out to be able to be used as legal data in national criminal courts.

Abstract

Malpraktek medis adalah suatu tindakan medis yang dilakukan oleh tenaga kesehatan yang menyebabkan kerugian, baik fisik maupun psikis, kepada pasien. Sistem hukum kesehatan di setiap negara memiliki ketentuan yang berbeda-beda dalam mengatur malpraktek medis. Hal ini disebabkan oleh berbagai faktor, seperti perbedaan budaya, nilai-nilai, dan sistem hukum. Tujuan penelitian ini adalah untuk membandingkan sistem hukum kesehatan di Indonesia dan Amerika Serikat dalam hal malpraktek medis. Penelitian ini menggunakan metode penelitian komparatif. Data penelitian dikumpulkan dari berbagai sumber, seperti peraturan perundang-undangan, buku, jurnal, dan artikel ilmiah. Data yang telah terkumpul kemudian dianalisis menggunakan teknik analisis kualitatif. Hasil penelitian menunjukan bahwa sistem hukum malpraktik di Indonesia dan Amerika serikat memiliki beberapa perbedaan diantaranya dari sistem hukum Indonesia menganut civil law dan Amerika menganut common law. Sedangkan dari sisi pembuktian Indonesia melakukan pembuktiann dengan pembuktian langsung dan Amerika dengan pembuktian terbalik. Kemudian dari bentuk pertanggungjawabannya, Indonesia mengimplementasikannya dalam bentuk Litigasi dan Non litigasi dan Amerika dalam bentuk hukum perdata. Selain itu, dari pengaturan dan pengawasan indonesia berada di dalam pengawasan Kementerian Kesehatan dan Lembaga profesi seperti MDKDI dan IDI dan Amerika dalam pengawasan badan federal dan yuridiksi negara bagian.

Abstract

This research discusses the application of Kerinci customary criminal law to criminal acts of abuse and its comparison with national criminal law in Indonesia. There is a conflict between Article 351 paragraph (3) of the Criminal Code and the practice of resolving customary abuse in Kerinci Regency. The research method used is normative legal research with a conceptual and analytical approach. The research results show differences in the application of customary and national crimes, with an emphasis on the principle of deliberation in Kerinci customary law. The application of Kerinci's customary crime involves three levels of sanctions, adjusted to the level of the violation, with a Restorative Justice approach. Differences arise in the resolution of minor criminal cases, where customary law involves traditional judges, ninik mamak, and traditional leaders. Harmonization between customary law and national law is crucial to achieving holistic justice.

Abstract

The research explores the resolution of customary criminal disputes in the context of the Baduy tribe, an ethnic group in Banten Province, Indonesia, with a focus on harmonization between local customary law and national criminal law. Through normative juridical methodology and analytical descriptive analysis, this study explores the mechanisms for resolving customary criminal disputes and their relationship with national criminal law. The results reveal the challenges in achieving harmony between traditional values and modern criminal law principles, as well as the implications for legal justice and human rights. The statutory approach and case approach help to comprehensively describe these dynamics, provide in-depth insight into the interaction between Baduy tribal customary law and Indonesian national criminal law and highlight the need for improved policies that are more inclusive and just.

Abstract

Tulisan ini mendiskusikan aspek norma Hak Asasi Manusia dalam peraturan perundang-undangan. Dalam konsep Hukum Progresif, dimana Hukum Untuk Manusia, maka setiap bentuk hukum seperti undang-undang seharusnya mengandung norma Hak Asasi manusia. Dalam pengertian demikian, pertanyaannya, apakah setiap undang-undang memuat norma Hak Asasi manusia ? Untuk menganalisanya, data yang dijadikan bahan hukum adalah Undang-Undang Tentang Organisasi Masa yang 2011 telah direview di Mahkamah Konstitusi. Dengan pendekatan budaya dan filsafat hukum, hasilnya adalah norma Hak Asasi manusia terlah terakomodasi dalam Undanh­Undang tentang Ormas dan sebagaimana norma yang sama dalam Konstitusi. Untuk itu rekomendasinya, setiap upaya pembaugan peraturan hendaknya mengakomodasi Norma Hak Asasi Manusia mengingat Hukum itu untuk manusia.

Abstract

The procedural Code of Ethics trials of the Indonesian National Police face significant legal vacuums that affect law enforcement and public trust. These gaps arise from unclear and conflicting legal provisions, undermining the legitimacy and internal performance of the police institution. This study aims to examine these legal vacuums and propose strategic solutions for their resolution. Utilizing a qualitative research method with legal and institutional analysis, the research investigates the structural and procedural deficiencies in the ethical trials conducted within the police force. The findings reveal a lack of consistency in regulations, insufficient transparency in trial processes, and weak enforcement mechanisms, leading to diminished accountability and public confidence. To address these issues, the study underscores the need for legislative reform, enhanced transparency, legal education for both police personnel and the public, and strengthening the Ethics Commission’s role. These measures are pivotal in ensuring the effective implementation of the Code of Ethics and rebuilding trust in the institution. In conclusion, addressing legal vacuums and fostering ethical accountability will enhance the integrity and legitimacy of the Indonesian National Police in the public’s eyes.
