Abstract

Perjanjian baku telah menjadi instrumen dominan dalam transaksi komersial modern, khususnya di era ekonomi digital. Fenomena ini sering kali menimbulkan ketimpangan posisi tawar antara pembuat dan pihak yang menerima perjanjian, yang berpotensi menabrak prinsip keadilan kontraktual. Penelitian ini bertujuan untuk menganalisis rekonstruksi konsep keadilan kontraktual dalam perspektif Hukum Perdata Indonesia, khususnya terkait perjanjian baku. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan analisis kasus. Hasil penelitian menunjukkan bahwa prinsip Pacta Sunt Servanda dalam Pasal 1338 KUH Perdata tidak dapat lagi diterapkan secara absolut. Keadilan kontraktual dalam perjanjian baku mensyaratkan adanya intervensi dari itikad baik subyektif maupun objyektif. Perlindungan hukum terhadap pihak yang lemah diatur eksplisit dalam UU Perlindungan Konsumen, namun implementasinya masih menghadapi tantangan dalam bentuk “kesepakatan sepihak” yang disamarkan dalam click-wrap agreements. Penelitian ini menyimpulkan bahwa Hukum Perdata Indonesia perlu mereinterpretasi doktrin kebebasan berkontrak menuju kebebasan yang bertanggung jawab, di mana klausula baku yang tidak seimbang dapat dinyatakan batal demi hukum karena bertentangan dengan sifat objektif perjanjian.

Abstract

The development of information technology has led to a shift from conventional transactions to electronic commerce, including the widespread use of Cash on Delivery (COD) systems on marketplace platforms. Although COD provides a sense of security for consumers, it also creates legal risks for sellers, particularly when buyers abuse the product return mechanism. This study examines the legal protection available to online sellers against the misuse of COD returns, using a case example of a sports retail business in Banyumas, including Planet Shoes Banyumas. This research applies a normative legal method based on the Indonesian Civil Code (KUHPerdata), particularly the provisions governing sale and purchase agreements (Articles 1457–1540), the principle of good faith (Article 1338 paragraph 3), the principle of balance between contractual parties, and the concept of breach of contract (Article 1243). The act of returning goods that have been replaced with different items constitutes a breach of contract, which gives sellers the legal right to demand performance or compensation. The findings indicate that the enforcement of sellers’ rights is often constrained by limited evidence, incomplete consumer data, and the restricted role of third parties such as marketplace platforms and courier services, whose responsibilities are not comprehensively regulated in electronic contracts. This study recommends strengthening legal protection through clearer contractual clauses, proper documentation of product conditions, and technical verification mechanisms during the return process. The findings are expected to contribute to the development of civil law in the context of digital transactions and to provide practical guidance for business actors using COD systems in order to promote more balanced contractual relationships.

Abstract

Violence against women and children remains a serious issue in Banyumas Regency, exacerbated by limited legal awareness and inadequate community-based legal assistance capacity. This condition highlights the need for community empowerment through strengthening the role of women’s organizations at the grassroots level. This community service program aims to empower members of Nasyiatul Aisyiyah Muhammadiyah Banyumas through paralegal training to enhance legal understanding and initial legal assistance capacity for women and children. A participatory approach was employed, including material enrichment, group discussions, group dynamics, and role-playing activities. The results indicate an improvement in participants’ understanding of paralegal concepts, women’s and children’s rights, and basic legal procedures for handling cases of violence. Furthermore, the training increased participants’ readiness to act as initial legal companions and strengthened the organizational role of Nasyiatul Aisyiyah as a community-based legal protection actor. This program contributes to expanding access to justice and reinforcing sustainable legal protection for women and children at the community level.
