Abstract

Disiplin merupakan faktor utama untuk meraih kesuksesan. Sikap dan batin yang kuat dan terarah yang akan menentukan keberhasilan kita di masa depan. Hal ini yang akan menentukan siapa kita di masa yang akan datang. Karena orang yang sukses adalah orang yang dapat mengsinkronkan antara perilaku dengan hawa nafsunya sehingga ia dapat mengontrol dirinya sendiri serta dapat memposisikan dirinya dengan baik. tujuan dari pengabdian kepada masyarakat dalam bentuk penyuluhan ini dapat terlaksana dengan baik, yaitu dapat menumbuhkan pemahaman kepada generasi muda agar mengetahui hukum-hukum tertentu dan menwujudkan kedisiplinan serta kesadaran dalam masyarakat. Metode yang dipakai adalah metode ceramah dan tanya jawab. Dan dari hasil penyuluhan didapat antusias para peserta bahwa pentingnya kesadaran hukum dan kedisiplinan dalam hidup di masyarakat. Karena kedisiplinan merupakan kunci utama dalam membangun karakter manusia yang unggul. Mimpi besar seorang remaja harapan bangsa hanya dapat terwujud dengan menanamkan sikap disiplin dan ketaatan terhadap norma hukum yang berlaku di masyarakat. Jika kedisiplinan sudah melekat dan Menjadi karakter seorang remaja, makai a tidak mudah terpengaruh pada hal-hal negative atau yang tidak penting. Remaja sebagai role model bagi adik-adiknya di masyarakat terkait dasar hukum. Remaja harus mampu Menjadi pelopor warga masyarakat yang disiplin dan memiliki budaya taat hukum.

Abstract

The rapid advancement of artificial intelligence (AI) introduces unprecedented opportunities and complexities, particularly in its intersection with the legal domain. This study envisions a future where autonomous decision-making robot lawyers play a pivotal role in legal proceedings, providing counsel and representation. Examining the implications of AI’s scientific progress on Indonesian law, normative legal research methods were employed, encompassing statutory, conceptual, comparative, and futuristic analyses. Qualitative scrutiny and content analysis were applied to collected materials. The study reveals the potential of robot lawyers to enhance efficiency in Indonesia’s criminal justice system, aiding in evidence gathering, case analysis, and indictment drafting. This technological integration promises to alleviate the workload of legal professionals and expedite case resolutions, thereby improving public access to legal services. However, challenges loom, including ethical concerns, data security, and professional qualifications. To address these challenges, the study advocates for collaborative efforts among the government, industry, and academia. This cooperation is crucial for formulating regulations and establishing supportive infrastructure for the seamless integration of robot lawyers. Additionally, enhancing digital literacy and public understanding of AI in the legal sphere is emphasized as a vital step toward maximizing the benefits of this technology. In essence, the study underscores the transformative potential of AI in reshaping legal processes, emphasizing the need for a concerted, informed effort to navigate the challenges and optimize the benefits of this evolving technological landscape.

Abstract

Narcotics abuse is a very complicated matter in Indonesia, even become alert and dangerous. The government's effort to deal with drug addicts is to provide medical rehabilitation and social rehabilitation. The purpose of this study was to find out and analyze related to the provision of rehabilitation for narcotics addicts at the Badung Regency National Narcotics Agency. The research method that the writer uses is the empirical legal research method through the fact approach and the statute approach. The primary data source that the writer uses is interviews, while secondary data is in the form of laws and regulations, journals, and books. The author's research location is the Badung Regency National Narcotics Agency. The implementation of rehabilitation by National Narcotics Agency is an ongoing rehabilitation that is divided into two stages, namely the rehabilitation and post-rehabilitation processes. The functions and benefits of rehabilitation for narcotics addicts are recovery, productivity, and social functioning. However, facilities, and infrastructure are still not effective because National Narcotics Agency in every regency has not a special place for inpatient care and detoxification tools to medical rehabilitation.

Abstract

Peran Dewan Keamanan tercantum dalam Statuta Roma yang mana menjadi dasar hukum pembentukan Mahkamah Pidana Internasional. Kewenangan Dewan Keamanan yang diatur dalam Statuta Roma menyangkut perannya untuk memberi rujukan dan menghentikan penyelidikan atau penuntutan.  Secara umum, hak untuk menyerahkan (referral) dan hak untuk menghentikan penyelidikan atau penuntutan (deferral) yang dimiliki oleh Dewan Keamanan mengganggu independensi Mahkamah Pidana Internasional sebagai penegak hukum pidana internasional. Mahkamah Pidana Internasional sebagai entitas internasional berhak menentukan sendiri fungsinya sesuai yang diatur dalam Statuta Roma.Penegakan keadilan oleh Mahkamah Pidana Internasional secara formal dipengaruhi oleh Dewan Keamanan Perserikatan Bangsa-Bangsa atas dasar adanya Relationship Agreement. Penelitian ini adalah penelitian normatif dengan pendekatan historis, pendekatan teoritis dan pendekatan undang-undang. Undang-Undang dalam pengertian perjanjian internasional dan dokumen terkait. Kesimpulannya, hak referral memberikan keuntungan pada kemandirian Mahkamah Pidana Internasional karena tidak dapat dipaksakan oleh Dewan Keamanan, sedangkan hak deferral dapat mengganggu seketika Dewan Keamanan mengeluarkan resolusi. Deferral dapat diperpanjang sampai waktu yang tidak dibatasi.

Abstract

Humanitarian Law develops and shifts from meaning to protect wars interpreted as wars between states, eventually developing also to protect conflicts other than the meaning of war between states. This journal was created to provide national and international law views on the Free Papua Organisation case study. The 1945 Constitution, the Declaration of Human Rights, and other regulations relevant to the research are the references for this journal study. The Free Papua Organisation is a movement whose actions will be examined based on the reference regulations. The method used in this research is the normative research method. The data collection method is done employing a literature study. The actions carried out by the Free Papua Organisation are a category of spreading violence that makes this organisation not be said to be belligerent and is more interpreted as a criminal offender.Keywords: Separatism; Free Papua Organization; National Law; International Law.

Abstract

The increasing number of cases of sexual violence that occur in the university environment makes the government, in this case, the Ministry of Education and Culture of the Republic of Indonesia ratify and enforce Ministry of Education and Culture Regulation Number 30 of 2021 concerning the Prevention and Handling of Sexual Violence in Higher Education Environments. The importance of the passing of this regulation is to fill the legal vacuum in terms of handling sexual violence in universities, including the protection of the rights and obligations of victims and perpetrators and the entire academic community, with a definite legal umbrella, it is hoped that it can reduce the criminal act of sexual violence. In addition, Minister of Education and Culture Regulation Number 30 of 2021 not only focuses on punishment and sanctions, but also pays attention to the rights of victims and perpetrators as well as the obligations that must be carried out by universities. Examples of the rights of victims and perpetrators such as; Sustainability guarantees for completing studies, protection of identity confidentiality, provision of information regarding protection facilities, etc. In addition, examples of obligations from universities are; the establishment of a Task Force (SATGAS) that plays an active role in helping prevent and handle cases of sexual violence in the relevant universities.

Abstract

The advancement of artificial intelligence has undeniably fostered progress and expedited human development. Artificial intelligence's capacity to emulate human thinking enables computers to exhibit human-like responsiveness through cognitive processes. Conversely, the advancement of artificial intelligence consumes significant energy and produces heat. A more substantial number of computers is necessary to achieve artificial intelligence that is on par with human thinking. A considerable quantity of computers produce thermal energy, resulting in an adverse impact on the surrounding environment. Under these circumstances, the concept of green victimology should be created. A literature review explored the convergence of AI technology with green victimology. The data selection is derived from secondary sources, such as articles, books, papers, and other written references, including legislation. The data collected will be analysed qualitatively, meaning that only data sources that are relevant and consistent with the situation will be used. The research concludes that the extensive utilisation of computers in advancing AI technology if left unregulated, will result in environmental harm through the emission of excessive heat and the generation of computer trash. Indonesia is fully prepared to implement green policies, supported by appropriate regulations, to demonstrate the importance of protecting the environment. This is based on the understanding that the environment can suffer due to human actions, as shown by the concept of green victimology. Perkembangan artificial intelligence memang membawa kemajuan dan percepatan tumbuh manusia. Kemampuan artificial intelligence untuk berpikir layaknya manusia membuat komputer menjadi responsif bagaikan manusia menggunakan akalnya. Di sisi lain, pengembangan artificial intelligence menyerap banyak energi dan menghasilkan panas. Untuk membuat artificial intelligence berkembang menyamai cara pikir manusia membutuhkan lebih banyak lagi komputer. Banyaknya komputer ini menghasilkan panas dan membuat lingkungan sekitarnya menjadi terkorban. Maka, keadaan demikianlah green victimology harus diperkenalkan. Untuk mencari jawaban atas bersinggungnya teknologi AI dengan green victimology, kajian pustaka dilakukan. Pemilihan data berasal dari data sekunder yaitu seperti artikel, buku, laporan, dan referensi tertulis lainnya termasuk perundang-undangan. Hasil akhir dari pengumpulan data akan dianalisis secara kualitatif, yaitu hanya sumber data yang isinya berkorespondensi dan koheren dengan permasalahan akan diambil. Kesimpulan dari penelitian ini yaitu, penggunaan komputer yang masif untuk pengembangan teknologi AI jika tidak dipantau akan merusak lingkungan dengan pencemaran berupa panas yang berlebihan dan munculnya limbah dari komputer. Walau demikian, Indonesia dengan segala peraturan yang mendukung telah siap untuk menegakkan green policy untuk menunjukkan bahwa lingkungan perlu dilindungi karena dalam pandangan green victimology, lingkungan dapat menjadi korban.

Abstract

Several previous studies suggested that personality factors influence corrupt behavior (Abidin and Siswadi, 2015), Zhao et al. (2016). A survey by Matulessy et al. (2021) and research by Putri and Rahayu (2021) found that dark personality (Paulhus and Williams, 2002) is a factor that can influence corrupt behavior. The last two studies used civil servants and the private sector as research subjects. This research aims to determine the relationship between students' dark personality or dark triad personality and students' anti-corruption perceptions. This research involved 125 respondents who were students at the Unjaya Faculty of Economics and Social Sciences and were selected using a non-random sampling method. The data collection tool in this research was the Dark Triad Personality Scale. Adapted from the Jones and Paulhus Short Dark Triad (SD3) measurement instrument and has a coefficient valueCronbach alpha of .820, according to Hasanati & Istiqomah (2018), with a coefficient value Back alpha of .960. The findings show a relationship between dark triad personality and student anti-corruption attitudes. The correlation coefficient (correlation Pearson) is .220, and the significance level is .000. The correlation coefficient is more significant than .05 (p < .05), and the one-sided significance level is less than .05 (p < .05). Therefore, this relationship is considered vital.

Abstract

In Indonesia's democratic landscape, the presence of Article 256 of the Criminal Code has become a crucial point in discussions on freedom of expression and human rights. This article, with its criminal provisions for demonstration organisers who do not give prior notice to the authorities, poses a significant dilemma. The threat of imprisonment for up to six months and/or a maximum fine of Rp10 million raises deep questions about the space given to citizens to express their opinions in public spaces. This research uses normative legal research methods using statutory, conceptual, comparative, and futuristic approaches. The nature of this research is descriptive-prescriptive. The data that has been collected is analysed using the content analysis method. This research conducts an in-depth exploration of the implications of Article 256 of the current Criminal Code, which threatens criminal sanctions for organisers of unannounced demonstrations. This research investigates how this regulation has the potential to curb individual freedom of expression in public spaces, as well as its impact on the quality of democracy and the maintenance of human rights in Indonesia. The findings of this research confirm that Article 256 of the Criminal Code is a step backward in democratic practice and jeopardises freedom of expression. The research underscores the urgency of revising this regulation to ensure that the right to express opinions in public, as mandated by Law No. 9 of 1998, is protected as a key element in democracy and human rights. This reflects the importance of maintaining public space as an arena for free discussion and criticism, which is at the core of a healthy democratic system.

Abstract

Neuro-Cognitive Risk Assessments (NCRA) represent a groundbreaking innovation in the criminal justice system, concentrating on evaluating cognitive and decision-making factors to assess inmate recidivism risk. Introduced initially in Houston, Texas, in 2017, NCRA have shown substantial efficacy, evidenced by a 2020 study reporting an Area Under the Curve (AUC) value of 0.70, signifying a significant advancement in recidivism prediction. This research employs normative legal methods, utilizing a conceptual, comparative, and forward-looking approach, characterized as descriptive-prescriptive with data analyzed through content analysis. Key advantages of NCRA include their emphasis on cognitive factors and their capability to operate independently via digital platforms, reducing bias and enhancing objectivity. The global adoption of NCRA, including in countries like Canada, the Netherlands, and Australia, underscores its recognition as a promising tool in criminal justice practices. However, ethical considerations and responsible usage are paramount, ensuring the protection of individual rights and involving diverse stakeholders. The integration of NCRA into rehabilitation programs and public policies presents opportunities to enhance efforts against recidivism. By identifying individual needs more accurately and improving predictions of rehabilitation success, NCRA can motivate inmate engagement in rehabilitation initiatives. Moreover, NCRA support the development of effective crime prevention policies, contributing to broader societal well-being. In conclusion, NCRA represent a transformative approach in criminal justice, leveraging cognitive assessments to refine recidivism risk evaluations and enhance rehabilitation outcomes. Ethical deployment and collaborative engagement are critical to maximizing NCRA's potential in promoting justice and reducing reoffending globally.
