Abstract

Given that Indonesia is a country based on legal principles where nearly everything is intertwined to government agencies or the law, the role of Notaries in Indonesia become very necessary. Many people find it difficult to process documents or deeds, so in this case the role of a notary becomes crucial for the community. This causes notaries to become busy and get sick or tired, causing notaries request to take leave. During their leave, the Notary shall appoint a Substitute Notary as stated in the Law of The Republic of Indonesia Number 30 of 2004 on Office of Notary Public (Law on the Rules of Notary Profession). Substitute Notary is responsible in carrying out the duties and obligations of the Notary who is on leave. In carrying out their obligations Substitute Notary must obey the laws and regulations in Indonesia. However in verdict number: 395/Pdt.G/2011/PN.JKT.Sel a deed by Substitute Notary contains a forge signature which lead to question about the liability of Substitute Notary in the case. The research used a normative juridical research method and using secondary data sources. The results of this research proves that the Substitute Notary is indeed committed an unlawful act against the Plaintiff. This research is aims to find the liability of Substitute Notary whose deeds containing forge signatures.

Abstract

The significance of this research stems from the prevalence of religious freedom violations in Indonesia, indicative of the inadequate level of respect, protection, and fulfillment of this entitlement within the framework of the Pancasila legal system. This study aims to ascertain how to effectively uphold, safeguard, and fulfill the right to freedom of religion within the Pancasila Rule of Law. Utilizing normative juridical research methods, the findings reveal a discrepancy within the legal norms governing religious rights in the Constitution. While Article 28I, paragraph (1) of the 1945 Constitution unequivocally affirms the inviolability of the right to religion under any circumstances, Article 28J, paragraph (2) of the same Constitution delineates that this right is subject to limitations regulated by law. The research concludes that, despite its normative recognition as an inherent entitlement, numerous violations of religious freedom persist in Indonesia in practical application.

Abstract

The Prosecutor's Office of the Republic of Indonesia is a state institution that exercises state power, especially in prosecution, the Prosecutor's Office as the authorized body in law enforcement and justice is led directly by the Attorney General who is appointed by and responsible to the President of the Republic of Indonesia. The Attorney General's Office, the High Prosecutor's Office, and the State Attorney's Office are state powers, especially in the field of prosecution, where all of them are a whole and inseparable whole. The research method that I use is a type of Normative Juridical research method by researching literature materials.

Abstract

The Indonesian constitution and international instruments mandate the recognition and protection of customary law communities. The plan to build the Rempang Eco-City on Rempang Island triggered an agrarian conflict, which resulted in violations of the traditional rights of the Rempang Island customary community, especially land rights. This research is intended to determine the state's responsibility for the rights of the Rempang Island customary community by examining it from a Human Rights (HAM) perspective. This research uses a type of normative legal research with descriptive research characteristics through data collection techniques, a literature study of secondary data through a statutory regulations approach, and is analyzed qualitatively. This legal research provides results that implementing development must be based on the human rights of local customary law communities in order to reduce the potential for conflict, considering that human rights are very closely related to development, and there is a contradiction between fulfilling rights through the implementation of National Strategic Projects (PSN) in order to improve the quality of life of the community. Local communities' traditional rights serve as a foundation for state accountability, ensuring the fulfillment of their human rights through relocation efforts, all while respecting and safeguarding their right to remain free from forced relocation.   Masyarakat hukum adat telah diakui dan dilindungi sebagaimana diamanatkan dalam konstitusi Indonesia maupun melalui instrumen internasional. Rencana pembangunan Rempang Eco-City di Pulau Rempang memicu konflik agraria yang mengakibatkan pelanggaran hak-hak tradisional masyarakat hukum adat Pulau Rempang khususnya hak atas tanah. Penelitian ini ditujukan guna mengetahui tanggung jawab negara atas hak masyarakat hukum adat Pulau Rempang dengan mengkaji dari perspektif Hak Asasi Manusia (HAM). Penelitian ini menggunakan jenis penelitian hukum normatif dengan sifat penelitian deskriptif melalui teknik pengumpulan data studi kepustakaan terhadap data sekunder melalui pendekatan peraturan perundang-undangan, dan dianalisis secara kualitatif. Penelitian hukum ini memberikan hasil bahwa dalam melaksanakan pembangunan harus berlandaskan pada HAM masyarakat hukum adat setempat agar mengurangi potensi terjadinya konflik mengingat HAM memiliki kaitan sangat erat dengan pembangunan, dan terdapat kontradiksi antara pemenuhan hak melalui pelaksanaan Proyek Strategis Nasional (PSN) guna meningkatkan kualitas hidup masyarakat dengan hak tradisional masyarakat setempat, serta bentuk pertanggungjawaban negara dalam pemenuhan HAM masyarakat setempat ialah melalui upaya relokasi dengan tetap menghormati dan melindungi hak untuk tidak direlokasi secara paksa.

Abstract

Internet and social media as a result of globalization and technological revolution have become a new media in committing crime. Criminal Investigation Unit in 2022 there were 8,831 cases of cyber crime dominated by authentic data manipulation (3,723 cases) and fraud through electronic media (2,131 cases). Therefore it is necessary to have legal protection from state against security of social media as stated in Article 28C paragraph (1), Article 28F, and Article 28G paragraph (1) of the 1945 Constitution. Community service activities conducted to the people of RT.001/RW.006, Srengseng Village, Kembangan District, West Jakarta, with theme of digital literacy community to build awareness and legal protection against fraud and digital theft. This activity is in the form of legal counseling, with pre-survey stages, socialization, and monitoring and evaluation. This location was chosen because the community was a legal awareness group need to increase public understanding of digital security. The results achieved of legal counseling are the community to know the scope, form, type, mode, and workings of fraud and digital theft, know legal aspects and protection available, as well as efforts that need to be made to avoid fraud and theft digital so that people are expected to be able to literate on digital security. Suggestions to the government to increase socialization concerning institutions that handle fraud and digital theft, and scope of socialization needs to be expanded to increase digital literacy and legal awareness of community.

Abstract

The globalization and digitalization due to technological advances has led society to a chaotic situation. Distinction between truth and lies or honesty and dishonesty has become biased. This is era of false truth and post truth. This situation endangers the unity of Indonesian nation. This vulnerability has the potential to occur in younger generation who are largest in number but the intensity of interaction with local cultural values is minimal. The younger generation has experienced a shift in value and ethical behavior that has been degraded. This Community Service’s Team (PKM Team) intends to provide legal education to students regarding "Indonesian National Insight". PKM was carried out at SMA Negeri 17 Jakarta in form of socialization regarding importance of Pancasila to national problems. The aim of PKM is to provide understanding and guidance to the younger generation so that they aren’t deceived and are able to position themselves in global dynamics. Geopolitic of Indonesia has three basic capitals in geographical, demographic and historical aspects which are full of values to achieve national goals and face the challenges of times. However, technological advances have distorted people's mindset and behavior regarding national insight so the approach to strengthening national insight requires the involvement of all components and the approach taken is more relevant to the young generation. Through this PKM, students gain understanding and national values that need to be instilled to face globalization and digitalization. Strengthening national insight must be carried out continuously by combining socialization and education in community activities. Arus globalisasi dan proses digitalisasi karena kemajuan teknologi telah mengarahkan masyarakat pada situasi chaotic terlepas dari kemanfaatan dan keburukan yang ditimbulkan. Pembedaan antara kebenaran dan kebohongan, maupun kejujuran dan ketidakjujuran menjadi bias. Inilah yang disebut era false truth dan post truth. Pembiaran atas situasi demikian membahayakan kesatuan dan persatuan bangsa Indonesia. Kerentanan ini potensial terjadi pada generasi muda yang jumlahnya paling besar tetapi intensitas interaksi dengan nilai-nilai budaya lokal yang paling minim. Hal ini sebagai akibat globalisasi dan digitalisasi tersebut sehingga generasi muda telah mengalami pergeseran nilai, norma, dan etika perilaku yang terdegradasi. Atas dasar tersebut, Tim PKM bermaksud memberikan penyuluhan hukum kepada pelajar mengenai “Wawasan Kebangsaan Indonesia”. PKM dilaksanakan di SMA Negeri 17 Jakarta berupa sosialisasi dan edukasi mengenai arti penting Pancasila terhadap permasalahan bangsa. Tujuan PKM ini untuk memberikan pemahaman dan pedoman kepada generasi muda agar tidak terpedaya dan mampu menempatkan diri ditengah dinamika global yang penuh ketidakpastian dan kekacauan. Sebagai bangsa majemuk, Indonesia secara geopolitik memiliki tiga modal dasal dalam aspek geografis, demografis, dan historis sarat akan nilai dan makna untuk mencapai tujuan negara dan menghadapi tantangan zaman. Akan tetapi, kemajuan teknologi mendistorsi pola pikir dan perilaku masyarakat sehingga menanamkan wawasan kebangsaan memerlukan keterlibatan dan tanggung jawab seluruh komponen bangsa dengan pendekatan yang relevan dan kontekstual dengan karakter generasi muda Indonesia. Melalui PKM ini, pelajar memperoleh pemahaman, gambaran, dan nilai-nilai kebangsaan yang perlu ditanamkan untuk menghadapi globalisasi dan digitalisasi. Penguatan wawasan kebangsaan harus dilakukan secara berkelanjutan dengan memadupadankan pendekatan sosialisasi dan edukasi dengan aplikasi dalam aktivitas masyarakat.

Abstract

General Background: The rapid expansion of digital services in Indonesia has transformed mobile phone numbers into core digital identifiers across banking, e-commerce, transportation, and governmental platforms. Specific Background: Under current regulations, particularly Ministerial Regulation No. 14/2018, inactive numbers may be recycled and reassigned without uniform data-sanitization procedures, exposing users to substantial privacy and security risks. Knowledge Gap: Despite the enactment of the Personal Data Protection Law, there remains regulatory disharmony between Ministerial Regulation No. 14/2018 and No. 5/2021, especially regarding conflicting timelines for data retention and number reassignment, with no standardized technical safeguards in place. Aims: This study examines the inconsistencies between these regulations and evaluates their implications for data protection, consumer security, and legal certainty. Results: Findings indicate that number-recycling practices allow residual digital identities to persist, enabling unauthorized access, data breaches, and identity theft, thereby conflicting with data-protection principles and consumer-rights provisions. Novelty: This research highlights the structural legal gap that permits overlapping identity cycles and proposes adopting a Reassigned Numbers Database model to mitigate misdirected authentication risks. Implications: Harmonizing regulatory frameworks and establishing national technical standards are urgently required to safeguard user privacy, strengthen digital-ecosystem integrity, and ensure compliance with emerging data-protection norms. Highlights: Regulatory disharmony creates legal uncertainty and heightens privacy risks. Recycled numbers enable unauthorized access to prior users’ digital accounts. Abstract

The era of artificial intelligence has become a characteristic of industrial era 5.0 which has been used in various aspects. Potential economic value of AI has driven various forms of AI innovation development. Exploration of AI tends to override negative impacts of such developments. The emergence of ethical issues with presence of AI encourages the need for a law-based approach to establishing ethical standards to protect entire Indonesian nation. Therefore, this research was conducted to examine urgency for an AI code of ethics. This paper will normatively describe data qualitatively to answer urgency and development of AI code of ethics in doctrinal and regulative contexts, including comparisons of countries that apply ethical code. Phenomenon of emergence of AI has given rise to systemic ethical problems that are both incidental and existential related to humans. Due to disruptive threat of AI, it encourages countries to formulate ethical standards regulatory models. European Union and China have AI ethical guidelines within their legal frameworks although their characteristics differ. Meanwhile, Indonesian legal system doesn’t yet have tools that specifically regulate AI ethics. Weaknesses in regulating AI related to scope of AI, legal harmonization, and weak government commitment and competence. To regulate AI Ethics substantially and formally can be formulated in many variants based on categorization of ethical principles nature, implementation of ethical principles, forming institutions, nature and type of regulations, normative power, and scope of AI impact. New legal instruments are needed based on this categorization.

Abstract

The Indonesian Constitution, as well as the highest legal basis, the 1945 Constitution, contains the rights of every citizen. These include the right to obtain decent work and legal protection, as stated in Article 27 paragraph (2) and Article 28D paragraph (1) and paragraph (2). The current Employment Law, as the legal basis for employment in Indonesia, still limits worker qualifications only based on work agreements as regulated by the Employment Law. In fact, the workforce population in Indonesia is currently dominated by informal workers, which has an impact on informal workers who are still far from access to legal protection due to the current legal instruments that limit worker categories. This study examines legal protection for informal workers in Indonesia. This study is a normative legal study, examining legal norms using theories including the legal protection theory put forward by Satipdjo Rahardjo. The results of the analysis indicate a legal vacuum in the protection of informal workers, so that changes are needed in the legal system and policies to create special regulations that can explain the rights and obligations of informal workers, as well as provide a clear legal status

Abstract

Putusan Mahkamah Konstitusi Nomor 168/PUU-XXI/2023 memberikan dampak signifikan terhadap kerangka hukum administrasi perizinan pertambangan di Indonesia, terutama terkait kepastian hukum dan kedudukan Keputusan Tata Usaha Negara (KTUN). Penelitian ini bertujuan untuk menganalisis implikasi putusan tersebut terhadap legalitas KTUN yang diterbitkan pemerintah dalam proses perizinan pertambangan, serta mengevaluasi sejauh mana perubahan norma dan praktik administrasi pasca putusan mampu menjamin prinsip kepastian hukum bagi pelaku usaha dan penyelenggara pemerintahan. Melalui pendekatan yuridis normatif dengan analisis terhadap putusan MK, peraturan perundang-undangan, dan doktrin hukum administrasi, penelitian ini menemukan bahwa putusan MK memunculkan reinterpretasi penting terhadap kewenangan administratif yang sebelumnya membuka ruang multitafsir. Koreksi konstitusional ini menuntut harmonisasi regulasi, penguatan prosedur administratif, serta penyesuaian sistem digital seperti Minerba One Data Indonesia (MODI) agar KTUN yang diterbitkan tetap memiliki dasar hukum yang sah. Hasil penelitian menunjukkan bahwa kepastian hukum baru dapat terwujud apabila respons pemerintah berjalan cepat, komprehensif, dan konsisten, terutama dalam memastikan keselarasan antara norma substantif, prosedural, dan implementasi teknis. Tanpa langkah tersebut, perubahan yang ditimbulkan putusan MK justru berpotensi menimbulkan ketidakpastian hukum baru. Oleh karena itu, penguatan tata kelola administrasi dan sistem perizinan berbasis digital menjadi langkah strategis untuk menjamin stabilitas hukum di sektor pertambangan.
