Abstract

This study examines the moderation of Hindu diaspora in West Jakarta amidst the majority of Muslims. This study is a qualitative research type, because this study is presented in a descriptive analytical interpretative manner. Data collection methods are participant observation, interviews, and document studies. Field data were analyzed using interpretive analysis techniques. The results of the study indicate that religious moderation of Hindu diaspora in West Jakarta can be implemented and well understood by Hindu diaspora and other communities as a balance in religion through attitudes and actions that respect each other, respect, and are open in carrying out religious activities. This implementation is manifested in the form of strengthening tolerance, anti-violence and radicalism, commitment to devotion and accommodating local culture

Abstract

Legal certainty, fairness, and community benefits are the goals of Indonesia's Complete Systematic Land Registration Program (PTSL), which seeks to streamline and simplify the land registration process. The purpose of this study is to examine the PTSL policy and its execution in order to draw conclusions about the program's strengths and weaknesses in terms of its ability to provide legal certainty, fairness, and advantages. This study delves into the effects of PTSL on several parts of Indonesian agricultural legislation using a qualitative method with normative analysis. Although PTSL has improved access to land rights and legal clarity, the study found that indigenous peoples' rights, conflict resolution, and equitable benefit sharing remain major obstacles. In order to maximize the effectiveness of PTSL implementation, this study suggests three main strategies: enhancing regulatory frameworks, empowering communities, and strengthening the ability to implement

Abstract

The presence of PERMA No.1 Year 2016 of the mediation procedure is intended to give legal certainty, orderliness and smoothness in the process of the settlement of civil disputes beyond in order to produce the peace if the parties reach a peace then These standards are formulated in the form of writings and strengthened in peace certificate has the same power with the ruling of the judge agreement is settlement which has been completed, and a final binding cannot remedy or appeal in cassation only the execution can be carried out by Tribunal Judges against an act of peace. From the background then it can be formulated as the following problems: 1. how is the Division of property jointly with their inheritance according to Islamic Law Compilation? 2. How the legal power of the deed of the peace mediation results? As for the research methods used i.e. using normative approach to research methods used i.e. a conceptual approach and legislation. Legal materials used i.e. Premier legal materials and legal secondary materials. And in the end can be summed up as follows, regarding the Ordinance Division, according to a compilation of Islamic law which in the joint property that refers to the article 96 and 97 set about the Division of both the living and the dead for divorce, in the Division of inheritance is divided in Islamic law, the mediation results strengthened in peace, consisting of the deed. Dalam hubungan sosial kemasyarakatan sengketa pada umumnya terjadi menyangkut hak dan kewajiban yang digolongkan dalam permasalahan perdata konflik dapat diselesaikan salah satunya dengan mediasi baik di luar pengadilan (nonlitigasi) ataupun di dalam pengadilan (litigasi) implementasi mediasi dalam penyelesaian perkara perdata seperti gugatan waris dan gugatan harta bersama. Kehadiran PERMA No. 1 Tahun 2016 tentang Prosedur Mediasi dimaksudkan untuk memberi kepastian hukum, ketertiban dan kelancaran dalam proses penyelesaian suat sengketa perdata agar dapat menghasilkan perdamian jika para pihak mencapai perdamaian maka kesepakatan tersebut dirumuskan dalam bentuk tulisan dan dikuatkan dalam akta perdamaian memiliki kekuatan yang sama dengan putusan hakim kesepakatan merupakan penyelesaian yang tuntas, mengikat dan final tidak bisa di upaya hukum banding atau kasasi hanya bisa dilakukan eksekusi oleh Majelis Hakim terhadap akta perdamaian. Dari latar belakang maka dapat dirumuskan masalah sebagai berikut : 1. Bagaimana tata cara pembagian harta bersama beserta harta warisan menurut Kompilasi Hukum Islam? 2. Bagaimana kekuatan hukum dari akta perdamaian hasil mediasi? Adapun metode penelitian yang digunakan yaitu menggunakan metode penelitian normatif dengan pendekatan yang digunakan yaitu pendektan konseptual dan perundang-undangan. Bahan hukum yang digunakan yaitu bahan hukum primier dan bahan hukum sekunder. Dan pada akhirnya dapat disimpulkan sebagai berikut, mengenai tata cara pembagian harta bersama beserta harta warisan menurut Kompilasi Hukum Islam dimana dalam harta bersama yang mengacu pada pasal 96 dan 97 mengatur tentang pembagian syirkah ini baik cerai hidup maupun cerai mati diman dalam tata cara pembagian harta warisan dibagi secara Hukum Islam,hasil mediasi yang dikuatkan di dalam akta perdamaian yang berkekuatan hukum tetap. Sebab akta perdamaian adalah akta yang dibuat dihadapan hakim yang berkekuatan hukum esekutorial dan tidak dapat dibanding atau kasasi hanya di lakukan eksekusi.

Abstract

Traditional inheritance law has a collective, major, and individual system. Indigenous peoples in Bali have a system of inheritance which is based on a system called patililinial, which has the understanding that male or male descendants are preferred for inheriting from their families. Problems regarding land tenure without the consent of heirs often occur because the heirs only prioritize their own interests without prioritizing common interests, namely the interests of the entire extended family in the distribution of inheritance. This research was analyze the distribution of inheritance in the traditional legal system of inheritance in Bali and the legal consequences of inherited land without the consent of other heirs? The research method used is normative legal research, namely by conducting a literature study and writing in a descriptive manner from primary and secondary legal materials using the Supreme Court Decision Number 1899 K/Pdt/ 2008. The result of research is distribution of inheritance in the customary law system in Bali, based on a family system including the patrilineal system, that this system draws the lineage of men which means that the right to inherit this system is boys. The legal consequences of inherited land without the consent of other heirs will result in a dispute between the heirs who can take the court if the problems that occur cannot be resolved through a customary institution. So to the heirs who adhere to the Balinese inheritance customary law system in its distribution, carried out with the knowledge of all family members, especially the heirs concerned and with the knowledge of the traditional village. This division of inheritance is based on the nature of Balinese inheritance customary law which adheres to the principle of kinship and deliberation from all legitimate heirs. Hukum adat waris mempunyai sistem kolektif, mayorat, dan individual. Masyarakat adat di Bali memiliki sistem untuk mewaris yang dimana berdasar pada sistem yang disebut patrilinial, yang mempunyai pengertian bahwa keturunan pria atau laki-laki lebih diutamakan untuk mewaris di keluarganya. Permasalahan mengenai penguasaan tanah tanpa persetujuan ahli waris sering terjadi dikarenakan para ahli waris tersebut yang hanya mengutamakan kepentingan tersendiri tanpa mengutamakan kepentingan bersama yaitu kepentingan seluruh keluarga besarnya dalam pembagian waris. Penelitian ini menganalisis tentang pembagian harta (tanah) warisan dalam sistem hukum adat waris di Bali dan akibat hukum tanah warisan yang dikuasai tanpa persetujuan dari ahli waris lain. Metode penelitian yang digunakan adalah penelitian hukum normatif, yaitu dengan melakukan studi kepustakaan dan penulisan secara deskriptif dari bahan hukum primer dan sekunder menggunakan Putusan Mahkamah Agung Nomor 1899 K/Pdt/2008. Hasil penelitian ini menemukan pembagian harta warisan dalam sistem hukum adat di Bali, berdasarkan sistem kekeluargaan termasuk sistem patrilinial, bahwa sistem ini melihat dan mengutamakan keturunan laki-laki artinya yang berhak mewaris dalam sistem ini adalah anak laki-laki. Akibat hukum dari tanah waris yang dikuasai tanpa persetujuan ahli waris lain akan mengakibatkan terjadinya perselisihan antara para ahliwaris yang dapat menempuh jalur pengadilan jika permasalahan yang terjadi tidak dapat diselesaikan melalui lembaga adat. Maka kepada ahli waris yang menganut sistem hukum adat waris Bali dalam pembagiannya, dilakukan dengan sepengetahuan seluruh anggota keluarga khususnya para ahli waris yang bersangkutan dan dengan sepengetahuan desa adat. Pembagian warisan ini berdasarkan sifat hukum adat waris Bali yang menganut asas kekeluargaan dan musyawarah dari seluruh ahli waris yang sah.

Abstract

Abstract-In the inheritance system, people in Bali have a system of inheritance that originates from the male kinship system which causes the relationship to be emphasized more according to the husband's lineage. Generally, any inheritance disputes do not have to end in court, because disputes about inheritance involve adat law in their resolution. Moreover, if the inheritance land dispute is still a family dispute, then the settlement should also be settled amicably through the active role of the Bendesa as the Leader in Pakraman Village. The formulation of the problem in this study is: How is the regulation of inheritance in Pakraman Buduk Village ?, What is the role of Bendesa in the settlement of inheritance land disputes in Pakraman Buduk Village? The problems discussed are examined from an empirical point of view. The results showed that the inheritance arrangement in Pakraman Buduk Village was in accordance with the contents of awig-awig Pakraman Buduk village contained in Palette 4 Pawos 75 to Pawos 78 which included inheritance, heirs, heir obligations, inheritance distribution, and loss of rights to be heir. The role of adat Bendesa in the settlement of inheritance land disputes in Desa Pakraman Buduk as a mediator. Keywords: Inheritance, Bendesa, Dispute Resolution Abstrak-Dalam sistem kewarisan, masyarakat di Bali memiliki sistem kewarisan yang bersumber dari sistem kekerabatan laki-laki yang menyebabkan pertalian hubungan lebih dititikberatkan menurut garis keturunan suami. Umumnya pada setiap sengketa tanah waris tidak harus berakhir di pengadilan, karena sengketa tentang waris melibatkan hukum adat dalam penyelesaiannya. Apalagi kalau sengketa tanah waris tersebut masih merupakan sengketa yang bersifat kekeluargaan, maka penyelesaiannya pun seharusnya diselesaikan secara kekeluargaan melalui peranan aktif dari pihak Bendesa selaku Pemimpin di Desa Pakraman. Rumusan masalah dalam penelitian ini adalah Bagaimana pengaturan warisan di Desa Pakraman Buduk ?, Bagaimana peranan Bendesa dalam penyelesaian sengketa tanah waris di Desa Pakraman Buduk ?. Permasalahan yang dibahas dikaji berdasarkan sudut pandang empiris. Hasil penelitian menunjukkan, bahwa Pengaturan warisan di Desa Pakraman Buduk sesuai dengan isi awig-awig Desa Pakraman Buduk termuat dalam Palet 4 Pawos 75 sampai dengan Pawos 78 yang mencakup tentang harta warisan, ahli waris, kewajiban ahli waris, pembagian warisan, dan kehilangan hak untuk menjadi ahli waris. Abstract

Abstract-In society today checks as securities are commonly used in trade transactions as a practical means of payment, can be transferred from one hand to another, so as to support the smooth running of trade. Checks as unconditional orders from account holders or current accounts to banks to pay a certain amount of money. However, the problem is when submitted to the bank it turns out that the customer's funds at the bank are insufficient to pay the check letter in question or often referred to as a blank check. In this research the author raises the problem of how the responsibility of the issuer checks is related to payment by using a blank check and how is the legal protection of the recipient of the check when receiving payment with a blank check. The type of research used in this paper is normative legal research. In the KUHD, a blank check puller or someone who is at the cost of the check is withdrawn, is obliged to try so that the funds required for payment on the day of submission are interested, even if the check is determined to be paid by a third party, without reducing the towing obligations in accordance with article . Legal protection against recipients of blank checks is a legal guarantee in the form of recourse rights in the event that there is no payment of new recourse rights will arise if the holder of the check certificate does not receive payment from being caught after being asked to pay within 70 days of the issuance date. Abstrak-Di dalam masyarakat saat ini cek sebagai suatu surat berharga menjadi suatu yang lazim digunakan dalam transaksi perdagangan sebagai alat pembayaran yang praktis, dapat dialihkan dari suatu tangan ke tangan yang lain, sehingga dapat menunjang kelancaran perdagangan. Cek sebagai perintah tidak bersyarat dari pemegang rekening atau nasabah giro kepada bank untuk membayar sejumlah uang tertentu. Namun demikian yang menjadi masalah adalah pada saat diajukan kepada bank ternyata dana nasabah pada bank tidak mencukupi untuk membayar surat cek yang bersangkutan atau sering disebut sebagai cek kosong. Dalam penelitian ini penulis mengangkat permasalahan bagaimanakah tanggung jawab penerbit cek terkait dengan pembayaran dengan menggunakan cek kosong dan bagaimanakah perlindungan hukum terhadap penerima cek ketika menerima pembayaran dengan cek kosong. Tipe penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Hasil dari penelitian ini adalah di dalam KUHD, cek kosong penarik atau seseorang yang atas tanggungannya cek itu ditarik, wajib berusaha agar dana yang diperlukan untuk pembayaran pada hari pengajuannya ada di tangan tertarik, sekalipun bila cek itu ditetapkan harus dibayar pihak ketiga, dengan tidak mengurangi kewajiban penarik sesuai dengan pasal. Perlindungan hukum terhadap penerima cek kosong adalah jaminan hukum berupa hak regres dalam hal tidak ada pembayaran hak regres baru akan timbul bila pemegang surat cek tidak mendapat pembayaran dari tersangkut setelah diminta pembayaran dalam 70 hari semenjak tanggal penerbitannya. Abstract

The purpose of this research is to know the shape of the inheritance level (Munasakhat) and to know the resolution of Division of inheritance matters multilevel form (Munasakhat). The inheritance of many implementation Practices occurred, the beneficiary does not immediately complete the Division of the inheritance, which then go on – even then dissolves before the Division of the inheritance is settled, one of the heirs died as well and cause a new inheritance relationship. Such a thing is called with the inheritance level (Munasakhat). At issue is how the heirs wife in part inheritance Decker (Munasakhat) in the concept of Islamic law? And what the resolution of the matter inheritance Decker (Munasakhat), which can meet the sense of fairness of the heir's wife? The research method used is the normative legal research with approach legislation and the approach to the case. Based on an analysis of the discussion of the problem, that the provisions of section heir's wife left her husband dead, that 1/8 part in General and certain, already written and specified in terms of Al-Qur'an Surat Annisa verse 12 and Article 180 Compilation of Islamic law and inheritance through dispute resolution litigation process 2 lanes and Non litigation. The beneficiary can do deal estate subdivision, with the sections agreed the heir or heirs of all willing self-revelation, even though the number of the Division of the inheritance deviate inheritance provisions, provided that all the heirs agree and know the proper heir part he can. The author can give advice that there should be a legal breakthrough which can protect the wife gets to keep the priority of the estate of her husband's remains. Tujuan Penelitian ini yaitu untuk mengetahui bentuk keahliwarisan bertingkat (Munasakhat) dan untuk mengetahui penyelesaian perkara pembagian waris bentuk bertingkat (Munasakhat). Praktik pelaksanaan kewarisan yang banyak terjadi, ahli waris tidak segera menyelesaikan pembagian waris, yang kemudian berlarut – larut bahkan kemudian sebelum diselesaikan pembagian waris tersebut, salah seorang ahli waris meninggal dunia juga dan menimbulkan hubungan kewarisan yang baru. Hal yang demikian disebut dengan keahliwarisan yang bertingkat (Munasakhat). Permasalahannya adalah Bagaimana bagian waris istri dalam keahliwarisan bertingkat (Munasakhat) dalam konsep Hukum Islam? Dan bagaimana penyelesaian perkara keahliwarisan bertingkat (Munasakhat), yang dapat memenuhi rasa keadilan terhadap bagian waris istri? Metode penelitian yang digunakan ialah penelitian hukum Normatif dengan pendekatan Perundang-undangan dan pendekatan kasus. Berdasarkan analisa dari pembahasan permasalahan, bahwa ketentuan tentang bagian waris istri yang ditinggal mati suaminya, yaitu 1/8 bagian secara umum dan pasti, sudah tertulis dan ditentukan di ketentuan Al-Qur’an Surat Annisa Ayat 12 serta Pasal 180 Kompilasi Hukum Islam dan penyelesaian sengketa waris melalui 2 jalur proses Litigasi dan Non Litigasi. Para ahli waris dapat melakukan kesepakatan pembagian harta waris, dengan bagian – bagian waris yang disepakati atau direlakan antara semua ahli waris, meskipun jumlah Pembagian waris tersebut menyimpangi ketentuan waris yang telah ditentukan, asalkan semua ahli waris sepakat dan telah mengetahui bagian waris yang semestinya ia dapat. Saran yang dapat penulis berikan seharusnya ada terobosan hukum yang dapat melindungi istri agar tetap mendapat prioritas harta waris tinggalan suaminya.

Abstract

Local Government has the rights to enfore each local provisions and other acts to exercise autonomy and co-administration duty. In each phases of the drafting of legislation, it involves the drafter of such legislation. The problem in this article is regarding the position and the duty of a drafter during the drafting of a local legislation as well as the implementation of the participation of a drafter in drafting of local legislation in the province of Bali. This research uses empirical legal research method. The result of this research shows that the position and duty of a drafter of a legislation in the drafting of local legislation is very important, namely to prepare, process, and formulate the draft of legislation and other legal instruments. Moreover, the implementation of the participation of the legislative drafters in the drafting of local legislation in the province of Bali, there are still 3 Districts or Cities which have not involve a drafter in the drafting of local legislation. The comparison of revoked legislation from the year 2013-2018 between Districts or Cities which do involve drafters and the Districts or Cities which do not involve a drafter shows a significant gap of numbers. However in the year 2018, the implementation of the drafters' involvement in the drafting of local legislation in the provincr of Bali is starting to be involved from the beginning to the final phase. Therefore the implementation of the drafters' involvement is starting to proceed effectively. The legal effect of not involving drafters explicitly, no legislation has clearly sanctioned such situasion, hence, there is an empty norm in this case. Pemerintah Daerah berhak menetapkan peraturan daerah dan peraturan perundang-undangan lain untuk melaksanakan otonomi dan tugas pembantuan. Dalam setiap tahapan pembentukan peraturan perundang-undangan mengikutsertakan perancang peraturan perundang-undangan. Permasalahan dalam penelitian ini adalah mengenai kedudukan dan tugas perancang dalam pembentukan perda serta pelaksanaan keikutsertaan perancang dalam pembentukan perda di Provinsi Bali. Penelitian hukum ini menggunakan metode empiris. Hasil penelitian menunjukkan bahwa Kedudukan dan Tugas Perancang Peraturan Perundang-undangan dalam Pembentukan Peraturan Daerah sangat penting yaitu menyiapkan, mengolah, dan merumuskan rancangan peraturan perundang-undangan dan instrumen hukum lainnya. Sedangkan Pelaksanaan Keikutsertaan Perancang Peraturan Perundang-undangan Dalam Pembentukan Peraturan Daerah Di Provinsi Bali, masih terdapat 3 Kabupaten atau Kota yang belum melibatkan perancang dalam pembentukan perda. Perbandingan jumlah perda yang dicabut dari tahun 2013-2018 antara Provinsi atau Kabupaten yang melibatkan perancang dengan Kabupaten atau Kota yang belum melibatkan perancang tidak menunjukkan perbandingan jumlah angka yang signifikan. Akibat hukum apabila tidak mengikutsertakan perancang secara ekplisit, peraturan perundang-undang tidak mencantumkan secara tegas mengenai sanksi sehingga terdapat norma kosong dalam hal ini.

Abstract

Inheritance customary law is a customary law that regulates how inheritance or inheritance is forwarded or divided from heirs to inheritors from generation to generation. Balinese indigenous people with the patrilineal family system, cause only descendants of kapurusa status are considered to be able to take care and carry on family responsibilities. The formulation of the problem in this study is how inheritance rights for women in Balinese customary law, what is the procedure for granting inheritance rights for single women to family inheritance. This research is a normative legal research. The problem approach used is the case approach, conceptual and legislative approach. Legal material used by primary and secondary legal materials. The results of the study and discussion show that inheritance rights for women in Balinese customary law are essentially women who are not heirs according to the Bali Customary Law, but women are entitled to a share of inheritance from their parents, which in practice is used with various terms including property and, provision of life, the soul of the soul and also called the soul of the fund. The procedure for granting inheritance rights for a single woman to the family's inheritance of a Single Female child can be an heir by changing the status, from predana status to purusa status. Hukum adat waris adalah aturan hukum adat yang mengatur tentang bagaimana harta peninggalan atau harta warisan diteruskan atau dibagi dari pewaris kepada para waris dari generasi ke generasi. Masyarakat adat Bali dengan sistem kekeluargaan patrilineal, menyebabkan hanya keturunan yang berstatus kapurusa dianggap dapat mengurus dan meneruskan tanggung jawab keluarga. Rumusan masalah dalam penelitian ini adalah bagaimanakah hak waris bagi wanita dalam hukum adat Bali, Bagaimana prosedur pemberian hak waris bagi wanita tunggal terhadap harta warisan keluarga. Penelitian ini adalah penelitian hukum normatif. Pendekatan masalah yang digunakan adalah pendekatan kasus,konseptual dan pendekatan perundang-undangan. Bahan hukum yang digunakan bahan hukum primer dan sekunder. Hasil penelitian dan pembahasan menunjukkan bahwa Hak waris bagi wanita dalam hukum adat Bali pada dasarnya Wanita bukan ahli waris menurut Hukum Adat Waris Bali, namun wanita berhak mendapat bagian harta warisan dari orang tuanya, dimana dalam praktek pemberian tersebut dipergunakan dengan berbagai macam istilah diantaranya harta tetatadan, bekal hidup, pengupa jiwa dan juga disebut jiwa dana.Prosedur pemberian hak waris bagi wanita tunggal terhadap harta waris keluarga anak Wanita Tunggal bisa menjadi ahli waris dengan jalan perubahan status yaitu dari status predana menjadi status purusa.

Abstract

The use of Indonesian National Standard Helmets is very important in driving, because using a helmet, the failure due to an accident in driving can be minimized, and protect the head from the impact of hard objects when an accident occurs while driving. Communities sometimes do not understand the benefits of using helmets, so they seem to wear helmets for fear of police officers. The problem is how is Community Effectiveness in the use of Helmets when driving? And what are the efforts of the police in overcoming the low use of helmets when driving in the jurisdiction of the Bangli police station? The type of research used in this study is an empirical study; with the problem approach used in this research is juridical sociology. The source of the data comes from Primary and Secondary data, this research technique in data collection is done by means of interviews (interviews), and also Literature Studies. In this study the analysis carried out was quantitative analysis. The regulation of helmet use has been regulated in Article 106 paragraph (8) of Law Number 22 Year 2009, affirming the obligation to use Helmets which are the Indonesian National Standard (SNI). Based on the number of helmet use violations occurring within a period of 4 (four) years, public awareness in using helmets when driving can be said to be quite low, this is based on data that helmet use violations that occur in the Legal District of Bangli Police are still high. There are several factors that cause motorists to not use helmets; they are ignorance, lack of awareness and others. Police efforts in overcoming the low use of helmets are preventive measures such as socialization, while repressive efforts in the form of tickets to get the deterrent effect on the results of traffic violations.
