Abstract

The purpose of this study is to analyze and criticize the arrangement of the Notary's responsibility after his term of office ends and the legal consequences of the Notary's liability after the end of his term of office. This research is a normative legal research and uses a conceptual approach and a statutory approach. The results of the research are that the responsibility of the Notary's position on the deed made by or before him is until the Notary dies because the authentic deed made by the Notary has perfect evidentiary power where the Notary knows for sure the legal actions outlined in the deed are desired and agreed upon by the parties. The legal consequences for a Notary if a legal problem arises criminally, namely if it is indicated in Article 263 of the Criminal Code to falsify a letter, criminal sanctions can be given, if there is a civil error, namely a formal error which results in the deed being an underhand deed and causing a loss, it can be requested for compensation. the loss to the deed is because it should be an authentic deed that has legal force as perfect evidence in the trial, instead it becomes an underhand deed.   Abstrak: Tujuan dari penelitian ini adalah untuk menganalisis dan mengkritisi tentang Tanggung jawab Notaris terhadap akta yang dibuat oleh atau dihadapannya. Notaris sebagai pejabat umum memiliki tanggung jawab pada Pasal 65 UUJN, Tanggung jawab Notaris terhadap Protokolnya, termasuk akta yang dibuatnya adalah bersifat personal, yang mengetahui secara pasti perbuatan hukum yang dituangkan dalam aktanya yang dikehendaki dan disepakati oleh para pihak. Sedangkan Notaris penyimpan Protokol hanya mempunyai tanggung jawab untuk menyimpan dan memelihara akta yang disimpanya, hal ini berbeda dengan pasal 65 UUJN mengenai Notaris bertanggungjawab atas setiap akta yang dibuatnya meskipun Protokol Notaris telah diserahkan dan dipindahkan kepada pihak penyimpan Protokol Notaris. Oleh karena itu werda notaris masih dapat dimintai pertanggungjawabannya atas setiap akta yang dibuatnya pada waktu menjabat menjadi notaris. Kedua mengenai Akibat dan perlindungan hukum terhadap Notaris yang telah berakhir masa jabatannya apabila permasalahan hukum yang muncul secara pidana maka dapat diberi sanksi pidana, apabila ada kesalahan perdata yaitu terhadap kesalahan pada akta tidak memenuhi Pasal 38 UUJN maka mengakibatkan akta tersebut menjadi akta dibawah tangan dan menimbulkan kerugian yang dapat di mintai ganti kerugian. Perlindungan hukum terhadap Notaris yang berakhir masa jabatannya tidak dilindungi pada UUJN, bahwa UUJN melindungi notaris yang masih aktif berdasarkan Majelis Kehormatan Notaris yang bersifat independen, jika tidak aktif atau sudah berakhir masa jabtannya, maka Notaris yang tidak aktif tersebut hanya dilindungi secara moral oleh Organisasi INI saja, hal ini dilakukan secara represif.

Abstract

This research aims to examine the implementation of Article 16 paragraph (3) of Law No. 28 of 2014 on Copyright, which states that copyright can be used as an object of fiduciary security. The research addresses two main issues: How is the regulation of copyright valuation (as an intangible asset) arranged for its use as fiduciary collateral in bank credit distribution in Indonesia? And does the Fiduciary Security Law provide opportunities for copyright to be used as collateral in credit agreements? To analyze the objectives of this thesis, a normative juridical method was employed. The approach is based on primary legal materials, including Law No. 42 of 1999 on Fiduciary Security, Law No. 28 of 2014 on Copyright, and Law No. 10 of 1998 concerning Amendments to Law No. 7 of 1992 on Banking. The findings indicate that, normatively, copyright fulfills the requirements to be used as an object of fiduciary collateral because it is an intangible asset that is transferable and holds economic value. However, its implementation within the banking system still faces obstacles, particularly in the areas of valuation and acceptance by financial institutions. Therefore, a more structured valuation standard and synergy among relevant institutions are needed to optimize the use of copyright as a legitimate and productive collateral instrument within the national financing system.

Abstract

This research aims to reveal that royalties as intangible movable objects can be counted as assets in marital property. Various perspectives such as Islamic law, civil law, and the Indonesian National Marriage Law fight to strengthen the argument. This research is normative legal research that is prescriptive in nature using a conceptual approach, a statutory approach, and a comparative approach. Empirically, intellectual property rights are difficult to be considered objects that can be shared. The main focus in this research is on the legal and ethical aspects that underlie profit sharing in the context of intellectual property as a right. On the other hand, the civil law perspective explores the secular law that regulates the distribution of royalties. This article examines the issue of managing legal conflicts between several different legal systems and identifies points of convergence and divergence between Islamic legal perspectives and intellectual property law and marriage law.
