Abstract

This research is directed at examining 2 (two) problems, namely first, legal protection of the rights of foreign workers based on Samarinda District Court Decision Number 65/Pdt. Sus-PHI/2017/PN. Smr Jo Supreme Court Decision 1121 K/Pdt.Sus-PHI/2018 and secondly, legal liability by companies for the rights of foreign workers who are not stated in the employment agreement. The study of this problem was carried out using doctrinal legal research.The results of this research conclude that firstly, legal protection for the rights of foreign workers has been regulated in Law Number 13 of 2003 concerning Employment as preventive protection and is confirmed in the ruling of the Samarinda District Court which granted some of the claims of foreign workers with consideration of several rights claimed by them. foreign workers are not included in the work agreement as repressive protection, and secondly, legal responsibility by the company for the rights of foreign workers who are not stated in the work agreement, namely fulfilling the company's obligations which is one of the conditions for employing foreign workers in Indonesia. Keywords: Accountability; Protection; Rights

Abstract

The Value Added Tax (VAT) on gold jewelry requires merchants to calculate, deposit, and report the amount of tax payable independently (self-assessment) in accordance with prevailing tax regulations. However, in Samarinda City, several gold shops have yet to comply with this obligation. This study employs a non-doctrinal/empirical approach using both primary and secondary data. The research focuses on the inhibiting factors in the collection of VAT on gold jewelry sales and its legal implications. The findings reveal that the main obstacles are the low participation of taxpayers due to limited awareness of taxation obligations related to gold jewelry as a taxable object, as well as weak systems of recording and monitoring the number of gold shops subject to tax. From the law enforcement perspective, the lack of time and human resources among tax officials further hampers the optimization of VAT collection. These findings highlight the necessity of improving taxpayer awareness, strengthening monitoring systems, and enhancing the capacity of tax authorities to ensure the effectiveness of VAT collection on gold jewelry sales in Samarinda City.Keywords: Implications; Value Added Tax; Jewelry

Abstract

Streaming Service Provider is a method of sending files in the form of video or audio that can be widely enjoyed by the public via the internet network from one computer to another and can be downloaded freely without any time limits. The purpose of this study is to be a reference for law enforcement in implementing fair, certain, and beneficial rules. The problem in this thesis is in the actions of perpetrators of violations of exclusive copyright of copyright who upload or distribute films. The results of this study found that the act of uploading films on one of the nobar24 streaming sites has fulfilled the elements of committing an act of violating the exclusive rights of the creator because the film is a cinematographic work protected in Article 40 letter m of the Copyright Law Number 28 of 2014. As for legal efforts that can be taken by the creator or copyright holder if there is a problem or dispute regarding copyright, dispute resolution can be done through non-court channels, in the form of alternative dispute resolution, arbitration or through the courts.Keywords: Exclusive Rights; Film; Website

Abstract

The existence of traditional dental practitioners (tukang gigi) is often considered an alternative dental care option for lower-middle-class communities, although such practices are generally unlicensed and exceed the authority granted by law. This study aims to analyze two main issues: first, the forms of legal protection for consumers against unauthorized dental practices in Kutai Kartanegara Regency; and second, the legal remedies available to consumers harmed by such practices. This research applies a socio-legal approach, collecting empirical data through interviews with various parties, including traditional dental practitioners in Kutai Kartanegara Regency, consumers who suffered losses, the Kutai Kartanegara Health Office, the Consumer Dispute Settlement Agency (BPSK) of Samarinda City, and dentists who have treated patients previously handled by tukang gigi. The findings reveal that unauthorized dental practices, such as tooth filling, extraction, braces installation, and veneer application, can be classified as unlawful acts (onrechtmatige daad) under Article 1365 of the Indonesian Civil Code. These acts cause both material and immaterial losses to consumers, thereby requiring legal protection under Law No. 8 of 1999 on Consumer Protection and relevant civil law provisions. With effective protection mechanisms and legal remedies, consumers are expected to obtain legal certainty and fair accountability for the losses suffered.Keywords: Consumer Protection, Traditional Dental Practitioners, Unlawful Act, Liability.

Abstract

Currently, the organization of music concerts requires careful planning and coordination. However, in practice, unilateral cancellations by organizers still frequently occur, causing losses to consumers. This study aims to analyze the elements of unlawful acts and the forms of legal protection available to consumers in cases of unilateral concert cancellations. A normative juridical approach is employed in this research by examining the provisions of Article 8 letter f of Law Number 8 of 1999 on Consumer Protection and Article 1365 of the Indonesian Civil Code. The findings indicate that concert cancellations without valid justification can be classified as unlawful acts. Concert organizers are obliged to provide compensation to consumers in the form of damages. The legal protection afforded is based on the principles of justice and the responsibility of business actors. This study highlights the necessity of including consumer protection clauses in concert contracts and strengthening dispute resolution mechanisms that are both swift and fair.Keywords: Consumer Protection; Unlawful Act; Music Concert; Compensation; Consumer Protection Law.

Abstract

Pemanfaatan sistem informasi pada usaha jasa laundry sangat penting, melalui sistem informasi ini semua proses pengolahan data yang sebelumnya masih menggunakan cara manual sekarang dapat tersusun dengan rapi melalui aplikasi komputer, sehingga dapat memudahkan petugas pelayanan mencari data dan meminimalisir kesalahan pencatatan transaksi. Tujuan penelitian ini adalah membuat sebuah aplikasi sistem informasi transaksi pelayanan jasa laundry yang memudahkan manajemen pelayanan di zifa laundry menjadilebih efektif dan efisien. Metode penelitian yang digunakan adalah metode Grounded Research yaitu metode penelitian berdasarkan observasi dan wawancara. Untuk pembuatan aplikasi menggunakan metode pengembangan sistem yaitu waterfall dalam penelitian ini dengan tahapan seperti analisis kebutuhan, desain sistem, pengerjaan, pengujian, dan pemeliharaan perangkat lunak. Aplikasi ini dibuat dengan menggunakan Java Netbeans dan database MySQL. Sistem informasi pelayanan jasa laundry ini dibuat agar dapat meningkatkan efektifitas dan efisiensi waktu dalam proses pendataan pelanggan, data layanan, transaksi, dan pengambilan laundry.

Abstract

The exoneration clause is a clause that limits or eliminates responsibilities that should be borne by business actors. This clause is often found in laundry service notes in Samarinda City, even though its application is prohibited in Article 18 of Law Number 8 of 1999 concerning Consumer Protection. This research uses a social-legal approach to analyze the application of exoneration clauses and the implementation of consumer protection regarding the use of exoneration clauses in laundry service notes in Samarinda City. The research results show that the use of exoneration clauses in laundry service notes is detrimental to consumers because consumers do not receive compensation. The less than optimal role of the Consumer Dispute Resolution Agency (BPSK) causes the public, both consumers and business actors, to lack understanding of their rights and obligations. Therefore, there is a need for deeper attention to the application of exoneration clauses so that consumers are protected.

Abstract

Penayangan Film Edukasi "Sejauh Kumelangkah" tanpa izin yang dilakukan oleh Lembaga Siaran Pemerintah TVRI telah memicu perdebatan kompleks mengenai keseimbangan antara kepentingan publik dan penegakan hak cipta. Penelitian ini bertujuan untuk menganalisis kasus tersebut dari perspektif hukum hak cipta dan kebijakan publik, dengan menggunakan Undang-Undang No. 28 Tahun 2014 tentang Hak Cipta (UUHC) dan Undang-Undang No. 19 Tahun 2002. Penelitian ini menyelidiki apakah tindakan TVRI merupakan pelanggaran hak cipta dan bagaimana undang-undang seharusnya mempertimbangkan kepentingan pendidikan dalam mengizinkan penayangan film tanpa izin, sekaligus menjamin perlakuan yang adil bagi pemegang hak cipta. Dengan mendalami isu ini, penelitian ini berupaya menemukan solusi yang adil dalam menghargai hak kekayaan intelektual dan mengakomodasi penyebaran informasi edukatif serta bermanfaat bagi masyarakat.

Abstract

This research is proposed to answer two questions: Firstly, to find out the cause of fictitious orders experienced by Go-Jek drivers in the Go-food menu in Go-Jek app. Secondly, to know the legal protection of Go-Jek drivers who suffered losses due to a fictitious plane in the Go-food menu on the Go-Jek app. And the research is directed to educate the public the importance of Civil law which governs agreement in the life of society. This study uses socio-legal approach with a number of resource persons. The choice of approach to socio-legal does not mean disregarding doctrinal side support on the grounds that one of the aims of this study sees a set of positive norms in relation to Legal protection of Go-Jek drivers, including legal theory support with a view to verifying the implementation of law in practice (protection and responsible). This study concludes that, Transactions using Go-Jek access has so far caused legal consequences among others who is responsible for the losses experienced by drivers, whether the Go-Jek party is responsible for the losses experienced drivers, including what kind of legal protection obtained by the driver when suffering application losses by irresponsible consumers. The factors of the emergence of fictitious orders are the existence of competitions between the Go-Jek driver, Go-Jek verification system is still weak, and the existence of bad faith in someone. Partnership agreement between PT. Go-Jek and Go-Jek’s driver is a standard clause that created and provided without involving the Go-Jek drivers in which there is a clause of transfer of responsibility because of PT. Go-Jek as the Go-Jek application service manager will not be responsible if there is a loss caused by the use of Go-Jek application. The legal relations and responsibilities of the parties should be clearly stipulated in the partnership agreement between PT. Go-Jek Indonesia, and Partners are created based on mutual agreement and agreement between both parties. To minimize the losses experienced by Go-Jek drivers in service delivery for every use of consumer spending service must have a Go-Pay account, which expenditures can not be executed if the balance in the Go-Pay account is insufficient to make an expense transaction.

Abstract

Melanin, a pigment derived from UV radiation, is crucial in preventing skin damage and can cause aesthetic and dermatological problems such as hyperpigmentation or hypopigmentation. Melanogenesis is a complex process involving enzymes and cytokines, with UV being a primary contributor. Tyrosinase is a key enzyme in melanin synthesis. This study aims to test the potential of combining cermai fruit extract (CE) and mulberry fruit (ME) as a tyrosinase inhibitor. The tests included antioxidant activity using the 2,2-diphenyl-1-picrylhydrazyl (DPPH) method, total phenolic content using the Folin Ciocalteu method, flavonoid content using the AlCl3 colorimetric method, and sun protection factor (SPF) value using UV-Vis spectrophotometric method. The results showed that the highest total phenolic content was observed in (CE), followed by the combination of ME: CE in the ratio of 1:3, 1:1, 3:1, and then ME. The same pattern was seen in the flavonoid content assay results. The antioxidant activity, as indicated by the IC50 values, followed the following order CE 418.30%; ME: CE (1:3) 400.49%; ME: CE (1:1) 367.73%; ME: CE (3:1) 358.04%; and ME 344.43%. The highest SPF value was observed in ME. It can be concluded that this study shows that the combination of CE and ME extracts has potential as a tyrosinase inhibitor and skin protective agent from hyperpigmentation due to UV exposure.
