Abstract

Penelitian ini betujuan untuk mengkaji dan menganalisis perlindungan hukum terhadap pemilik ciptaan karya sinematografi pada aplikasi TikTok dan bentuk pertanggungjawaban perdata pemilik akun TikTok terhadap penyebarluasan karya sinematografi tanpa watermark di aplikasi TikTok. Pendekatan penelitian ini dilakukan dengan menggunakan pendekatan doktrinal, yaitu penelitian yang berbasiskan ketentuan perundang-undangan dengan meneliti bahan Pustaka yang ada, yang bertujuan untuk mengkaji dua pokok pembahasan: Pertama, untuk menganalisis perlindungan hukum terhadap pemilik ciptaan karya sinematografi pada aplikasi TikTok. Kedua, untuk menganalisis bentuk pertanggungjawaban perdata pemilik akun TikTok terhadap penyebarluasan karya sinematografi tanpa watermark di aplikasi TikTok. Hasil penelitian dalam penulisan hukum ini ialah bahwa film yang dirilis pada platform Youtube dilindungi oleh Undang-Undang Hak Cipta sebagai objek hak cipta, berdasarkan Pasal 40 Ayat (1) huruf m Undang-Undang No. 28 Tahun 2014 tentang Hak Cipta.  Lebih lanjut lagi, pengaturan watermark yang diterapkan dilindungi Undang-Undang Hak Cipta sebagai informasi manajemen hak cipta, informasi elektronik hak cipta, dan sarana kontrol teknologi, berdasarkan Pasal 7 Ayat (1) huruf a-b dan Pasal 7 Ayat (2) huruf a-f Undang-Undang Hak Cipta No. 28 tahun 2014 tentang Hak Cipta.  Kata kunci: Hak Cipta; Sinematografi; Tanda Air

Abstract

Melanin, a pigment derived from UV radiation, is crucial in preventing skin damage and can cause aesthetic and dermatological problems such as hyperpigmentation or hypopigmentation. Melanogenesis is a complex process involving enzymes and cytokines, with UV being a primary contributor. Tyrosinase is a key enzyme in melanin synthesis. This study aims to test the potential of combining cermai fruit extract (CE) and mulberry fruit (ME) as a tyrosinase inhibitor. The tests included antioxidant activity using the 2,2-diphenyl-1-picrylhydrazyl (DPPH) method, total phenolic content using the Folin Ciocalteu method, flavonoid content using the AlCl3 colorimetric method, and sun protection factor (SPF) value using UV-Vis spectrophotometric method. The results showed that the highest total phenolic content was observed in (CE), followed by the combination of ME: CE in the ratio of 1:3, 1:1, 3:1, and then ME. The same pattern was seen in the flavonoid content assay results. The antioxidant activity, as indicated by the IC50 values, followed the following order CE 418.30%; ME: CE (1:3) 400.49%; ME: CE (1:1) 367.73%; ME: CE (3:1) 358.04%; and ME 344.43%. The highest SPF value was observed in ME. It can be concluded that this study shows that the combination of CE and ME extracts has potential as a tyrosinase inhibitor and skin protective agent from hyperpigmentation due to UV exposure.

Abstract

This study aims to determine total polyphenol content of Bromelia (Neoregelia marmorata) leaves extract with ethanol and water solvent ratio. There are three kinds of comparisons, ethanol 96%, ethanol 50 % and aquadest. The third variation of the extract is then determined the total polyphenol content. Determination of total polyphenol content was performed using visible light spectrophotometry at wavelength 758 nm with Folin-ciocalteu reagent and standard used was gallic acid. The highest average polyphenol content was obtained ethanol extract 96% then ethanol 50%, aquadest that is 0,4710 mgGAE / g; 0.3677 mgGAE / g; 0.1847 mgGAE / g. The more part of ethanol 96%, the total polyphenol content is higher. Furthermore, one way anova test is used to know the difference in the three extracts and followed by Post Hoc test. The results of the analysis showed significant differences between the three variants extract with probability value (p≤0,05).

Abstract

Penelitian ini membahas tanggung jawab hukum kontraktor atas keterlambatan pembayaran upah pekerja pada Proyek Teras Samarinda Tahap Pertama. Sebanyak 84 pekerja belum menerima upah dengan total tunggakan sekitar Rp500 juta, meskipun proyek telah diresmikan dan bernilai Rp36,9 miliar. Berdasarkan Undang-Undang No. 13 Tahun 2003 tentang Ketenagakerjaan dan PP No. 36 Tahun 2021 tentang Pengupahan, kontraktor wajib membayar upah tepat waktu. Keterlambatan ini menunjukkan lemahnya manajemen keuangan dan pengawasan pemerintah dalam menjamin hak-hak pekerja. Penelitian ini menekankan pentingnya penerapan solusi seperti penguatan perencanaan keuangan, penggunaan escrow account, digitalisasi sistem pembayaran, dan pengawasan yang ketat untuk mencegah pelanggaran serupa. Studi ini bertujuan meningkatkan kesadaran akan pentingnya kepatuhan terhadap regulasi ketenagakerjaan serta perlindungan hukum bagi pekerja.

Abstract

Reclamation is a critical environmental recovery measure aimed at restoring former mining areas to a sustainable and functional state. This research investigates the role of government supervision and law enforcement in the reclamation of ex-mining land within the development zone of Indonesia’s new National Capital (IKN), located across North Penajam Paser and Kutai Kartanegara Regencies in East Kalimantan. As the IKN project represents a large-scale transformation of land use, the study focuses on how regulatory oversight and enforcement influence the effectiveness of reclamation efforts. Using a qualitative descriptive method, the study collects data through document analysis, field observations, and interviews with local government officials, environmental agencies, and stakeholders in the mining and reclamation sectors. The findings reveal that while regulatory frameworks for reclamation exist, challenges remain in implementation due to overlapping authority, limited monitoring resources, and weak enforcement of legal obligations by mining companies. Additionally, many ex-mining lands remain unproductive and pose environmental risks due to insufficient reclamation. The study emphasizes the need for a more integrated and accountable supervision system, increased inter-agency coordination, and stricter enforcement mechanisms to ensure that reclamation aligns with sustainable development goals. The implications of this research highlight the importance of legal compliance and government leadership in managing environmental risks in areas designated for national development projects.

Abstract

The development of technology nowadays seems to reach all aspects of life, includes the realm of art, especially digital illustration. However, these developments were not followed by regulatory developments so that there was a legal vacuum in them. This study is intended to analyze the legal vacuum of limiting an act that can be categorized as piracy and legal protection for the creator of the piracy of digital illustrations which are  tokenized in the form of NFT using doctrinal research methods. Based on the results of the study, it is concluded that the Standard of Copyright Ability and substantial similarity can be used as criteria for piracy of digital illustrations. There are still vacancies in the regulations regarding the limitations of piracy of a work and the provisions governing NFT. The copyright protection system for digital illustrations in the current regulations consists of preventive and repressive protection. Due to this legal vacuum, it is hoped that regulation about NFT and fine art can be added, and awareness of all parties can be made to avoid infringement of other people's copyrights.

Abstract

Obesity is a health problem in many countries, both developed and developing, including Indonesia. The increasing trend indicates that obesity in Indonesia remains a serious public health issue. This study aimed to determine the relationship between BMI and total cholesterol levels in the community of Malang City, which may serve as a basis for policymaking in community-based non-communicable disease prevention programs. The study was conducted using a cross-sectional design on 30 respondents, selected through purposive random sampling. The results of the bivariate analysis showed a p-value < 0.05, indicating a significant relationship between BMI and total cholesterol levels. The correlation coefficient (ρ) was 0.738, suggesting a strong positive correlation between the two variables. This means that the higher a person’s BMI, the higher their total cholesterol levels tend to be in this population. In conclusion, this study demonstrates a significant and strong relationship between BMI and total cholesterol levels in the studied community. These findings support the hypothesis that excess body weight contributes to increased cholesterol levels and may serve as a basis for preventive and promotive interventions in the community.

Abstract

Kuliah Kerja Nyata (KKN) merupakan bentuk pengabdian mahasiswa kepada masyarakat dengan tujuan meningkatkan pembangunan desa serta memperkuat hubungan perguruan tinggi dan masyarakat. Desa Sukamaju, Kecamatan Tanjung Tiram, Kabupaten Batubara, memiliki potensi besar di bidang sosial, pendidikan, dan keagamaan, namun sebelumnya masih menghadapi permasalahan mendasar. Anak-anak kurang memiliki semangat belajar, lebih banyak menghabiskan waktu untuk bermain, serta minim keterlibatan dalam kegiatan keagamaan dan pembelajaran tambahan. Masyarakat juga cenderung kurang aktif dalam kegiatan sosial-keagamaan sehingga interaksi antarwarga belum maksimal. Kehadiran mahasiswa melalui program KKN membawa perubahan nyata. Dengan pendekatan edukatif, sosial, dan keagamaan, mahasiswa berhasil membangkitkan motivasi belajar anak-anak melalui les sore, pembelajaran mengaji, dan kegiatan masjid. Semangat mereka dalam menuntut ilmu dan beribadah meningkat secara signifikan. Tidak hanya itu, masyarakat juga mulai aktif mengikuti kajian yang disampaikan mahasiswa, serta menunjukkan kesadaran kolektif untuk bersama-sama membangun desa. Perubahan ini membuktikan bahwa KKN tidak hanya berdampak pada anak-anak, tetapi juga pada penguatan nilai keagamaan, sosial, dan kebersamaan di masyarakat. Kolaborasi mahasiswa dan masyarakat menjadi motor penggerak menuju Desa Sukamaju yang lebih maju, religius, dan berdaya saing.

Abstract

This research is directed at examining 2 (two) problems, namely first, legal protection of the rights of foreign workers based on Samarinda District Court Decision Number 65/Pdt. Sus-PHI/2017/PN. Smr Jo Supreme Court Decision 1121 K/Pdt.Sus-PHI/2018 and secondly, legal liability by companies for the rights of foreign workers who are not stated in the employment agreement. The study of this problem was carried out using doctrinal legal research.The results of this research conclude that firstly, legal protection for the rights of foreign workers has been regulated in Law Number 13 of 2003 concerning Employment as preventive protection and is confirmed in the ruling of the Samarinda District Court which granted some of the claims of foreign workers with consideration of several rights claimed by them. foreign workers are not included in the work agreement as repressive protection, and secondly, legal responsibility by the company for the rights of foreign workers who are not stated in the work agreement, namely fulfilling the company's obligations which is one of the conditions for employing foreign workers in Indonesia. Keywords: Accountability; Protection; Rights

Abstract

The Value Added Tax (VAT) on gold jewelry requires merchants to calculate, deposit, and report the amount of tax payable independently (self-assessment) in accordance with prevailing tax regulations. However, in Samarinda City, several gold shops have yet to comply with this obligation. This study employs a non-doctrinal/empirical approach using both primary and secondary data. The research focuses on the inhibiting factors in the collection of VAT on gold jewelry sales and its legal implications. The findings reveal that the main obstacles are the low participation of taxpayers due to limited awareness of taxation obligations related to gold jewelry as a taxable object, as well as weak systems of recording and monitoring the number of gold shops subject to tax. From the law enforcement perspective, the lack of time and human resources among tax officials further hampers the optimization of VAT collection. These findings highlight the necessity of improving taxpayer awareness, strengthening monitoring systems, and enhancing the capacity of tax authorities to ensure the effectiveness of VAT collection on gold jewelry sales in Samarinda City.Keywords: Implications; Value Added Tax; Jewelry
