Abstract

Micro, Small and Medium Enterprises (UMKM) activities are an alternative to increase community economic growth, including rural communities. However, with the large potential of UMKM, there are problems that can weaken the rights of UMKM, one of which is trademark registration for products produced by UMKM activities. This condition also occurs in UMKM actors in Separi Village, Tenggarong Seberang District. Therefore, it is necessary to conduct socialization to increase legal understanding for the public on the urgency of trademark registration and assistance to UMKM actors in the process of registering their marks. The method used in this activity is counseling and mentoring which is carried out through three stages, namely mapping the potential of UMKM, delivering law informations, and assisting in trademark registration. The result is an increase in legal understanding for the community and UMKM actors regarding trademark registration, as well as the registration of product brands from 1 (one) UMKM actor in Separi Village. This shows that it is important to carry out an empowerment process by increasing the legal understanding capacity of the community

Abstract

Illegal mining activities in Sebulu District have become a serious issue as they not only violate the law but also cause significant damage to public infrastructure such as village roads, bridges, and drainage systems, which are deteriorating due to heavy trucks transporting mining materials. Although Article 158 of Law Number 3 of 2020 concerning Mineral and Coal Mining stipulates strict sanctions, law enforcement remains weak. The main contributing factors are local community involvement, inadequate supervision by authorities, and social legitimacy that perceives mining as a normal activity. This study aims to analyze criminal liability for illegal mining offenders and to identify its social and environmental impacts in Sebulu District. The research applies a socio-legal approach that combines normative and empirical methods. The normative approach examines applicable legal provisions, while the empirical approach includes field observations, interviews with local officials and residents, and documentation of relevant regulations and events. The findings indicate that the most severe impacts are the deterioration of village roads and bridges and environmental degradation, such as changes in water color in nearby drainage channels. These conditions cause public concern and disrupt daily life. Weak law enforcement allows illegal mining to persist. Therefore, synergy among law enforcers, local government, and communities is needed to strengthen regulation enforcement and develop sustainable economic alternatives.

Abstract

Coal mining activities in Indonesia are legally required to conduct post-mining reclamation as part of environmental and social responsibility. However, in practice, violations of reclamation obligations remain prevalent, leading to damage to public infrastructure, including roads affected by unreclaimed mining pits. This study aims to analyze corporate criminal liability in violations of coal mine reclamation obligations and their implications for road damage. The research employs an empirical approach using a socio-legal method, with purposive sampling to select informants, and data collection conducted through interviews, observations, and literature review. The findings indicate that corporate entities have failed to fulfill their reclamation obligations, resulting in direct impacts on public road infrastructure. Furthermore, significant challenges in law enforcement were identified, including weak supervision by mining inspectors and the lack of firm action by law enforcement authorities. These conditions demonstrate that corporate criminal liability has not been effectively enforced in practice. This study highlights the necessity of strengthening regulatory oversight, enforcing stricter legal measures, and ensuring the effective implementation of corporate criminal liability to prevent environmental degradation and infrastructure damage caused by mining activities. From a theoretical perspective, this research contributes to the development of corporate criminal liability discourse in environmental law by emphasizing the linkage between regulatory compliance and public infrastructure protection.Keywords: Coal Mining, Corporate Criminal Liability, Reclamation, Road Damage, Law Enforcement

Abstract

Land is a basic human right, including for women. As a living space, land occupies a strategic position in the fulfillment of human rights. Constitutionally, women's equal rights to land are guaranteed by law, but in reality, it is neglected and lacks recognition and protection, especially in the natural resource extraction area. Economics that rely on mining extraction have the consequence of widespread ecological and environmental crises that affect people's lives, including vulnerable groups of women. The gender inequality in tenure, ownership, access and control over land has many impacts on women's lives. This research focuses on the law guarantees the recognition and protection of women's human rights to land, and the reality of recognition and protection of women's human rights to land in mining areas. The research findings show that ideally the law provides recognition of equal rights between women and men in access, control, and ownership of land. However, mining regulations provide more convenience for mining business actors, not ensuring protection for the community, especially women. In addition, the male paradigm as the head of the family has led to the marginalization of women in decision-making related to their land and living space. In the midst of conflicts in mining areas, efforts to assert rights and struggle for women's basic rights to land often receive discriminatory treatment and gender bias. The ecological crisis situation is a problem for the protection of women's human rights to land in mining extraction areas.

Abstract

Mangrove merupakan kawasan penting bagi kehidupan masyarakat pesisir dan keberlangsungan layanan alam. Namun kondisi ekosistem mangrove di Kawasan Delta Mahakam masih mengalami kerusakan meskipun upaya rehabilitasi telah banyak dilakukan. Salah satu kelemahannya adalah belum adanya payung hukum terkait perlindungan dan rehabilitasi mangrove. Sehingga dibutuhkan upaya hukum berupa penyusunan produk hukum lokal terkait perlindungan dan rehabilitasi mangrove berbasis masyarakat. Pelatihan ini dilakukan melalui dua tahapan, antara lain: pemetaan produk hukum desa, dan penyusunan dengan metode Roccipi. Pemetaan di lima desa menunjukkan belum memiliki produk hukum yang berkaitan dengan rehabilitasi mangrove. Pelatihan produk hukum desa peduli mangrove dengan menggunakan metode ROCCIPI membentuk kesadaran hukum yang dibuktikan dengan keterlibatan seluruh pihak dalam menyusun kanvas desain peraturan desa peduli mangrove di lima desa yang berada di Kawasan Delta Mahakam. Hasil pemetaan dan pelatihan diperoleh data potensi penguatan produk hukum desa dan peningkatan kapasitas aparatur desa dan masyarakat dalam menyusun produk hukum desa peduli mangrove.

Abstract

The phenomenon of sea fences in coastal waters raises legal issues because there are currently no specific regulations governing their status within the Indonesian legal system, even though the utilization of marine space is already regulated by various laws and regulations. This study aims to analyze the legal framework regarding the existence of sea fences within the context of marine spatial planning and coastal zone management in Indonesia, as well as their implications for the rights of coastal communities. The study employs a normative legal research method utilizing statutory and conceptual approaches, analyzing primary, secondary, and tertiary legal materials through a descriptive-qualitative method. The findings indicate that sea fences constitute a form of marine space utilization that must comply with regulations concerning marine spatial planning, coastal zone management, and marine space utilization mechanisms. Although not specifically regulated, the construction of sea fences cannot be undertaken arbitrarily; it must align with spatial plans and applicable regulations. The presence of sea fences—which restrict public access to marine space—conflicts with the principle of state control as stipulated in Article 33, Paragraph (3) of the 1945 Constitution of the Republic of Indonesia and potentially infringes upon the rights of coastal communities to utilize marine space.

Abstract

Penyelesaian sengketa Kekayaan Intelektual (KI) di Indonesia masih didominasi oleh jalur litigasi yang memakan waktu dan biaya besar, sementara jalur non-litigasi melalui mediasi belum dimanfaatkan secara optimal di tingkat daerah. Penelitian ini bertujuan untuk menganalisis penerapan inovasi Intellectual Property Conflict Resolution Center (IP.C.R.C.) di Kanwil Kemenkum Kalimantan Timur serta mengidentifikasi faktor pendukung, faktor penghambat, dan dampaknya terhadap penguatan tugas dan fungsi Kanwil Kemenkum di daerah. Penelitian ini menggunakan pendekatan kualitatif dengan teknik pengumpulan data melalui wawancara mendalam, observasi partisipatif, dan analisis dokumen. Informan kunci terdiri dari Kepala Kanwil, Kepala Divisi Pelayanan Hukum, Inovator, dan petugas layanan IP.C.R.C., sedangkan informan adalah penerima layanan. Analisis data dilakukan menggunakan model interaktif Miles dan Huberman. Hasil penelitian menunjukkan bahwa IP.C.R.C. telah dimanfaatkan masyarakat untuk menyelesaikan sengketa KI, meskipun pelaksanaannya belum sepenuhnya sesuai dengan Standar Operasional Prosedur (SOP). Faktor pendukung utama adalah dukungan Direktorat Jenderal Kekayaan Intelektual (DJKI), kepemimpinan yang kuat, kompetensi dan dedikasi inovator, serta kerja sama dengan pihak eksternal. Faktor penghambat meliputi keterbatasan SDM, kompetensi yang tidak merata, penyimpangan prosedur, kurangnya pemanfaatan teknologi, inovasi yang belum dikenal luas, persepsi masyarakat yang skeptis terhadap layanan gratis, dan belum adanya kerja sama dengan Aparat Penegak Hukum (APH). Dampak inovasi ini mencakup perluasan kewenangan Kanwil, peningkatan produktivitas pegawai, peningkatan akses masyarakat terhadap layanan KI, penyelesaian sengketa yang efektif dan efisien di daerah, serta perluasan kerja sama dan sinergi. Penelitian ini menyimpulkan bahwa IP.C.R.C. merupakan bentuk adaptasi dinamis Kanwil Kemenkum Kaltim dalam memperkuat tugas dan fungsinya di daerah, dan berpotensi menjadi model bagi Kanwil lainnya di Indonesia.

Abstract

This study aims to analyze the judge's considerations and assess whether the sentence imposed in Decision Number 24/Pid.Sus-TPK/2023/PN Smr has reflected the purpose of sentencing, considering that the defendant was proven to have committed the crime of corruption in the form of misuse of capital participation as regulated in Article 2 paragraph (1) in conjunction with Article 18 of the Corruption Law in conjunction with Article 55 paragraph (1) point 1 of the Criminal Code, which resulted in state financial losses of Rp25,209,090,090.00, yet the defendant was only sentenced to 4 years and 6 months in prison, a fine of Rp300,000,000.00, and restitution of Rp1,160,685,293.50, all three of which were deemed too lenient and disproportionate when compared to the sentencing guidelines stipulated in Supreme Court Regulation Number 1 of 2020. The research used a doctrinal method with a statutory and case-based approach, supported by interviews with the East Kalimantan High Prosecutor's Office, the Auditor of the Financial and Development Supervisory Agency, and the Head of the Legal Sub-Division of the Financial Supervisory Agency of the East Kalimantan Provincial Representative Office. The results showed that non-legal mitigating considerations obscured the principle of proportionality. The sentences imposed did not reflect the optimal sentencing objectives of the three sentencing theories, resulting in disparities in sentencing that were deemed disproportionate to the gravity of the offense.

Abstract

Coal mining activities in Argosari Village have generated both economic benefits and negative impacts on the surrounding community, including damage to residents’ houses due to vibrations, blasting activities, and land subsidence. These conditions raise legal issues regarding the mining company’s civil liability, particularly in relation to land lease agreements between the company and residents. This study aims to analyze the company’s civil liability and examine the legal implications of land lease agreements without written evidence from the perspective of Indonesian civil law. This research uses a socio-legal approach that examines not only legal norms but also the implementation of law in society. The findings indicate that affected communities consist of residents with land lease agreements and residents without contractual relationships with the company. The absence of written evidence prevents the application of liability based on breach of contract, making tort liability the appropriate legal mechanism. The company’s forms of compensation include financial compensation, house repairs, construction of new houses, and land restoration in areas affected by landslides. This study highlights the importance of legal certainty and community protection in mining activities.

Abstract

The Borneo Orangutan Survival (BOS) Samboja Lestari Foundation is the rightful owner of the conservation area that was the subject of an unauthorized land sale, as stated in Criminal Case No. 71/Pid.B/2025/PN Trg. These actions raise legal issues because they have the potential to harm the party holding rights to the land and undermine the interests of environmental and wildlife conservation. Although the case has been prosecuted criminally, the civil aspects related to unlawful acts and forms of compensation for the aggrieved party still require further examination. This study employs a doctrinal (normative) legal method using a legislative and case-law approach. The legal materials consist of primary sources—such as laws and court decisions—and secondary sources—such as books, journals, and previous research. These materials are analyzed qualitatively using a prescriptive method to address the legal issues under investigation. The research findings indicate that the sale of land within the BOS Samboja Lestari Foundation’s conservation area constitutes a tort under Article 1365 of the Civil Code, encompassing an unlawful act, fault, damage, and a causal relationship, thereby giving rise to civil liability separate from criminal sanctions as stated in Judgment No. 71/Pid.B/2025/PN Trg. The recommended form of redress is restitution through the restoration of the land to its original condition (restitutio in integrum) to restore the ecological function of the area and compensate the BOS Samboja Lestari Foundation for its losses.
