Abstract

This study examines the concept of joint property division after divorce within the semenda marriage system of the Lampung Saibatin customary community, where the husband resides in the wife’s family environment. This socio-cultural arrangement influences ownership, control, and distribution of marital assets, often creating imbalances when separation occurs. Using a qualitative socio-legal approach and the framework of maqāshid al-sharīʿah, this research analyzes how Islamic legal principles align with or diverge from customary practices. Data were collected through field observations, interviews with customary and religious leaders, and analysis of secondary literature and legal documents. The findings reveal that Lampung Saibatin’s semenda practice recognizes shared property but lacks standardized procedures for its division after divorce. The maqāshid al-sharīʿah perspective particularly hifẓ al-māl (protection of wealth), hifẓ al-nasl (protection of lineage), and hifẓ al-ʿirdh (protection of dignity) offers an integrative solution to ensure fairness and gender equity. It recommends that property distribution should not be strictly equal but proportional to each party’s contribution and social responsibility. Harmonizing Islamic law and local custom through mediation, prenuptial agreements, and recognition of non-monetary contributions can achieve substantive justice and preserve social harmony in the Lampung Saibatin community.

Abstract

Penelitian ini bertujuan untuk mengkaji implementasi kebijakan pengelolaan dana desa berdasarkan ketentuan dalam Pasal 2 Peraturan Menteri Keuangan Nomor 145 Tahun 2023 melalui pendekatan Fiqh Siyasah Maliyah, dengan fokus analisis di Desa Brabasan, Kecamatan Tanjung Raya, Kabupaten Mesuji. Metodologi yang digunakan bersifat kualitatif dengan pendekatan normatif-empiris, menggabungkan analisis regulatif dengan temuan lapangan melalui observasi, dokumentasi, dan wawancara. Temuan menunjukkan adanya perubahan signifikan dalam praktik pengelolaan dana desa pasca diberlakukannya regulasi tersebut. Perubahan mencakup peningkatan keteraturan dalam perencanaan, keseragaman dalam penganggaran, sistem administrasi yang mulai terdigitalisasi, pelaporan yang lebih terstruktur, serta transparansi yang meningkat. Dampak positif terlihat dalam pembangunan infrastruktur publik dan penguatan kapasitas ekonomi warga melalui pengembangan BUMDes, pelatihan keterampilan, serta program pemberdayaan sosial. Ketika dianalisis dari perspektif Fiqh Siyasah Maliyah, tata kelola dana desa di Brabasan menunjukkan kesesuaian nilai, seperti prinsip musyawarah, keadilan distribusi, transparansi, serta orientasi kemaslahatan. Meski demikian, masih ditemukan tantangan berupa keterbatasan kapasitas SDM, kompleksitas regulasi, keterbatasan infrastruktur pendukung administrasi, dan rendahnya tingkat literasi keuangan serta partisipasi masyarakat dalam pengawasan.

Abstract

Penelitian ini bertujuan untuk mengidentifikasi nilai-nilai esensial syura dalam perspektif fiqh siyasah dan menganalisis sejauh mana mekanisme musyawarah di DPRD Kota Metro merefleksikan nilai-nilai tersebut, serta merumuskan tantangan dalam implementasinya. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan studi kasus, yang mengintegrasikan analisis dokumen rapat dan keputusan DPRD dengan kajian literatur keislaman serta ketatanegaraan sebagai kerangka normatif. Hasil penelitian menunjukkan bahwa secara prosedural, DPRD Kota Metro telah mencerminkan nilai syura melalui rapat paripurna dan pembahasan anggaran yang kolektif, namun secara substantif, masih terdapat kesenjangan pada kedalaman partisipasi publik, transparansi deliberasi, dan adanya dominasi kepentingan politik partisan. Implikasi dari penelitian ini menekankan perlunya penguatan partisipasi masyarakat secara langsung dan peningkatan kapasitas anggota dewan dalam melakukan deliberasi substantif agar praktik musyawarah di tingkat daerah dapat mendekati idealisme syura yang berorientasi pada kemaslahatan umum.

Abstract

This study examines the wage system for workers in Jaya Screen Printing Pelastik Desa Negara Ratu, Natar District, South Lampung Regency from the perspective of Islamic economic law. Using a descriptive-analytical qualitative approach, data was collected through in-depth interviews with seven informants, direct observation, and documentation during February-April 2025. The results showed that the company implemented two wage systems: wage per unit (Rp5,000-8,000/kg) for operators and screen printing assistants, and daily wage (Rp70,000-80,000) for drivers and assistants. This creates a significant income gap, with workers earning IDR 40,000-96,000 per day compared to a fixed daily wage for an equivalent 8-hour workload. Critical findings included the absence of written employment contracts for all 11 workers, with wage agreements made orally. Analysis based on the principles of Islamic economic law shows inconsistencies in four main aspects: the justice of distribution (al-'adl) is violated because wages are disproportionate; the clarity of the contract (al-'aqd al-mubin) does not exist, creating gharar (uncertainty); voluntary agreements (al-taradhi) are disrupted by the weak bargaining position of the workers; and the accuracy of the payment is not in accordance with the hadith of the Prophet, which requires immediate payment of wages. The study concluded that the wage system does not meet the requirements of the ijarah contract, especially related to clear ijab qabul and fair ujrah, which has the potential to involve zulm (oppression) and exploitation of workers. Recommendations include the development of a standard ijarah contract template with minimum wage provisions based on the South Lampung Regency Minimum Wage (Rp2,889,193/2024), the implementation of a hybrid wage system that combines a fixed basic wage with productivity incentives, as well as the establishment of a government program that provides sharia-compliant employment contracts and halal wage certification for micro enterprises.

Abstract

This study addresses a critical issue exacerbated by the pandemic: the increasing number of street children in Lampung Province. This demographic represents a vulnerable group necessitating focused attention from both governmental and societal entities to prevent exploitation and enhance access to education and social services for women with disabilities. Despite the implementation of various social policies, challenges persist, particularly in developing regions such as Lampung, Indonesia. This study aims to delineate a policy model for managing street children during the pandemic by identifying existing implementation obstacles. The theoretical framework is grounded in the concepts of social empowerment and social welfare policies, as outlined in Law No. 11 of 2009. Employing a qualitative descriptive methodology, data were gathered through interviews, observations, and documentation from 14 relevant informants and analyzed using the Miles and Huberman model alongside triangulation techniques for validation. The findings reveal that Lampung Province’s policy model encompasses orphanages, families, communities, and semi-social homes. However, significant challenges, such as limited budgetary and human resources, impede their effectiveness. This study provides a comprehensive overview of social welfare policy implementation during the pandemic and underscores the necessity of enhancing intersectoral collaboration to improve the welfare of street children in Lampung Province.   Studi ini membahas masalah kritis yang diperburuk oleh pandemi: meningkatnya jumlah anak jalanan di Provinsi Lampung. Kelompok demografi ini merupakan kelompok rentan yang memerlukan perhatian khusus dari entitas pemerintah dan masyarakat untuk mencegah eksploitasi dan meningkatkan akses pendidikan dan layanan sosial bagi perempuan penyandang disabilitas. Meskipun berbagai kebijakan sosial telah diterapkan, tantangan tetap ada, terutama di daerah berkembang seperti Lampung, Indonesia. Studi ini bertujuan untuk menggambarkan model kebijakan untuk mengelola anak jalanan selama pandemi dengan mengidentifikasi hambatan implementasi yang ada. Kerangka teoritis didasarkan pada konsep pemberdayaan sosial dan kebijakan kesejahteraan sosial, sebagaimana diuraikan dalam Undang-Undang No. 11 Tahun 2009. Dengan menggunakan metodologi deskriptif kualitatif, data dikumpulkan melalui wawancara, observasi, dan dokumentasi dari 14 informan terkait dan dianalisis menggunakan model Miles dan Huberman beserta teknik triangulasi untuk validasi. Temuan penelitian mengungkapkan bahwa model kebijakan Provinsi Lampung mencakup panti asuhan, keluarga, masyarakat, dan rumah semi-sosial. Namun, tantangan signifikan, seperti keterbatasan anggaran dan sumber daya manusia, menghambat efektivitasnya. Studi ini memberikan gambaran komprehensif tentang implementasi kebijakan kesejahteraan sosial selama pandemi dan menggarisbawahi perlunya peningkatan kolaborasi lintas sektoral untuk meningkatkan kesejahteraan anak jalanan di Provinsi Lampung.

Abstract

State legitimacy and public trust have emerged as central concerns in transitional political systems, where institutional instability and evolving constitutional frameworks often challenge the consolidation of democratic governance. While existing scholarship has extensively examined political legitimacy and citizen trust as separate constructs, limited attention has been given to their integration within a constitutional perspective. This study aims to analyze the relationship between state legitimacy and public trust by situating both within the framework of constitutional governance, with a particular focus on transitional political contexts. Employing a qualitative approach through a systematic literature review, this research synthesizes scholarly works indexed in Scopus and Web of Science over the past decade, focusing on key themes such as constitutionalism, institutional trust, and governance performance. The findings reveal that state legitimacy is not solely derived from formal constitutional arrangements but is significantly shaped by public perceptions of institutional performance, accountability, and the effective enforcement of the rule of law. Moreover, the study identifies a critical gap between normative constitutional design and empirical trust-building processes in transitional systems, often exacerbated by weak institutions and elite capture. This paper proposes a conceptual framework that links constitutional structures, institutional performance, public trust, and state legitimacy as an interconnected cycle. The study contributes to the literature by offering an integrative perspective that bridges constitutional theory and trust dynamics, providing both theoretical advancement and practical insights for strengthening governance in transitional democracies.

Abstract

The prevalence of smoking behavior in society has become a problem that must be addressed immediately by the government, the dangers of cigarettes are currently not only a problem for adults but also a problem for teenagers, especially those aged 15-18 years, namely children who are still in high school, to overcome this problem, the West Lampung Regency Government has formed a policy on areas that are restricted to not smoking in the environment which is usually called KTR. In this study, the method used is a qualitative research method with the type of field research, the author also uses library research as a support in conducting research, using literature in the library related to the problem to be studied. The findings of the study identified that the Implementation of West Lampung Regency Regional Regulation Number 1 of 2017 concerning Smoke-Free Areas has not been implemented properly, there are no signs or banners for smoke-free areas, and students were found smoking in the school environment, based on Fiqh Siyasah Tafidziyah, the policy regarding the Smoke-Free Area has been in accordance with Islamic law because it was made/determined for the benefit of humanity, but its implementation has not been implemented effectively.

The practice of constitutional democracy demonstrates a tendency toward an increasingly strong concentration of power in the political and legislative processes. The influence of powerful economic actors and interconnected interests within state institutions contributes to shaping policy directions that do not fully reflect the broader public interest. This situation is reinforced by the formation of public narratives that influence public perceptions and support the legitimacy of existing power. This study aims to examine how these practices reflect an imbalance of influence in the implementation of constitutional democracy. This research uses a qualitative approach based on a socio-legal literature review, utilizing various relevant sources. The results show that the concentration of power, interference with the independence of state institutions, and policy distortions form interrelated and recurring patterns. The direction of public policy tends to reinforce certain interests, while accountability and participation mechanisms are not functioning optimally. The formation of public narratives plays a role in maintaining the legitimacy of power, thereby narrowing the scope for correction of practices that align with the broader public interest.

Abstract

The tension between religious norms and constitutional supremacy is a persistent issue in state administration practices in Muslim-majority countries. These two sources of legitimacy often coexist in the legal system, creating a space for interaction that is not always harmonious. This situation is influenced by social, political, and institutional factors that shape the ongoing direction of legal regulation. This study aims to analyze the configuration of the relationship between religious norms and constitutional supremacy and its implications for state governance and public life. This research uses a qualitative approach utilizing secondary data obtained from various relevant sources, including previous studies and legal documents. The results show that the relationship between religious norms and the constitution is formed through diverse patterns and is influenced by the role of state institutions and socio-political pressures. This interaction impacts the consistency of legal application, the protection of citizens' rights, and the balance between diversity and unity of law. The state's ability to manage this relationship proportionally is a crucial factor in maintaining social stability and government legitimacy.
