Abstract

Pelanggaran HAM berat di Indonesia merupakan fenomena yang terus membayangi keadaan keadilan di Indonesia. Sampai saat ini, banyak kasus dugaan pelanggaran HAM berat yang terjadi pada masa Orde Baru. Namun, belum dapat ditangani secara pertanggung jawaban yang jelas dan adil sesuai dengan standar hukum HAM internasional. Pemulihan hukum tetap menjadi kendala serius bagi Indonesia dan meskipun proses reformasi telah berlalu 25 tahun sejak tahun 1998 hingga 2023, upaya untuk mewujudkan, memajukan dan melindungi hak asasi manusia tetap harus dilakukan. Dengan demikian, masalah dari penelitian ini adalah : Apakah faktor yang menyebabkan pelanggaran HAM berat di Indonesia belum terselesaikan sampai saat ini? Dan Bagaimanakah upaya yang dapat dilakukan agar pelanggaran HAM berat di Indonesia dapat terselesaikan? Dengan menggunakan metode penelitian yuridis normatif, yakni penelitian hukum yang dilakukan dengan cara meneliti data sekunder dengan menitik beratkan pada studi kepustakaan. Sehingga hasil dari penelitian dapat mengetahui faktor tidak terselesaikannya pelanggaran HAM berat di Indonesia serta upaya yang dapat dilakukan untuk menyelesaikan pelanggaran HAM berat di Indonesia.

Abstract

The Kanjuruhan Tragedy Is the second biggest tragedy in the world, this tragedy killed 134 (one hundred and thirty-four) people, and this tragedy occurred because of the shooting of 45 shots of tear gas by the police. Security Regulation as a tool that may not enter the stadium area, while the Republic of Indonesia Police also has its own rules regarding tear gas to control the masses, the difference between these rules will be discussed in this article, regarding the legitimacy of the use of tear gas itself because in the rules there is an opacity of laws and rules that should be used in a football match, the method used in this article is a normative juridical method, namely reviewing legal aspects, principles, rules, doctrines, and others. This research contains a study of law that is conceptualized as a norm or rule that is applied to the social sphere.

Abstract

The results of votes obtained in official legislative elections by the KPU often receive unsatisfactory responses from election participants. This was triggered by intent, negligence, technical errors, administrative weaknesses or human error. In order to realize democratic elections, the following principles should be applied; honest; independent; orderly, fair, legal certainty; prioritizing public interests; openness and transparency; proportionality; professionalism; accountability; efficiency; and effectiveness. The Constitutional Court should have credibility and professionalism as a decision maker in election disputes. In 2019, 676 PHPU cases were reported to the Constitutional Court and 1135 other cases related to Kada PHP. UU no. 7 of 2017" has been ratified as a codification of election law, in order to create consistency and legal certainty as well as effective and efficient elections. Brazil, as one of the countries with the title of an effective election system, has an institution called "the Electoral Judges for municipal elections", which can be used as a reference by Indonesia in resolving disputes over regional election results. The method used in this research is normative, with explanatory explanations, using various library sources.

Abstract

Penulisan Artikel ini membahas pengaturan hukum terkait legalisasi arak bagi masyarakat Bali, dengan penekanan pada sejarah, budaya, dan tantangan yang dihadapi dalam implementasi Peraturan Gubernur Bali No. 1 Tahun 2020. Sejarah panjang minuman beralkohol, khususnya arak dan tuak di Bali, menunjukkan kedalaman hubungan antara minuman ini dan tradisi masyarakat lokal. Meskipun legalisasi bertujuan untuk memberikan kepastian hukum bagi para perajin, praktik penjualan dan peredaran arak sering kali masih dilakukan secara ilegal, dengan campuran yang tidak sesuai dan tanpa izin resmi. Konsumsi berlebihan minuman beralkohol juga memicu berbagai masalah sosial, seperti peningkatan angka kejahatan dan gangguan ketertiban. Dalam konteks ini, pentingnya peran pemerintah dalam pengawasan, sosialisasi, dan penegakan hukum sangat diperlukan untuk mengatur peredaran minuman beralkohol. Artikel ini juga menyoroti perlunya undang-undang khusus yang mengatur peredaran minuman beralkohol, agar ada landasan hukum yang kuat untuk melindungi masyarakat dan mencegah penyalahgunaan. Dengan demikian, penelitian ini menggarisbawahi pentingnya keseimbangan antara pelestarian budaya dan pengendalian konsumsi minuman beralkohol untuk kesejahteraan masyarakat Bali.

Abstract

The rapid development of information technology has driven transformation in various sectors, including public services. Artificial Intelligence (AI) is present as an innovative solution to improve the efficiency, accuracy, and quality of services provided by government agencies. This article discusses the urgency of implementing AI in public services as a strategic step to realize responsive, transparent, and data-driven governance. The use of AI can accelerate administrative processes, minimize human error, and increase public satisfaction with government services. This research uses literature as the primary method to examine various implementations of AI in the public sector both nationally and globally. The results of the study indicate that the application of AI not only supports bureaucratic efficiency but also serves as a key driver in realizing the digital transformation of government. Therefore, adaptive policies, clear regulations, and strengthening human resource capacity are needed so that the implementation of AI in public services can run optimally and sustainably.

Abstract

This study aims to determine the contents of the TNI Bill, which contains regulations governing the duties and authorities of the TNI. The TNI Bill regulates active TNI soldiers assigned as the Indonesian National Armed Forces, thus determining the roles that may and may not be performed within government institutions. The amendment to the TNI Bill was first proposed by the Indonesian House of Representatives (DPR RI) to provide a more detailed legal basis for the TNI's role in carrying out national defense duties. However, the amendment to the TNI Bill has raised public concern, as it is feared that the amendment to the TNI Bill will replace the previously civilian-led government with active TNI members, potentially leading to a repeat of the events of the New Order era, in which most state governments were staffed by ABRI personnel, which in practice severely limited freedom of expression. This study aims to determine the duties of governance, and the impact is also to determine the strengths and weaknesses of state institutions or ministries that will be staffed by Indonesian National Armed Forces soldiers in accordance with the approved bill. Meanwhile, the research used is normative juridical research (legal research). While legal research (legal research) according to Peter Mahmud Marzuki is to find a coherent truth, namely whether there are legal rules in accordance with legal norms and whether there are norms in the form of commands or prohibitions that are in accordance with legal principles and whether actions (acts) a person in accordance with legal norms (not just legal rules) or legal principles.

Abstract

Modern life today is inseparable from information technology, one of which is the use of social media, where everyone can access various things they want to know. Social media is used to facilitate daily life, especially in terms of accessing information such as socio-political and economic. Along with the rapid development of information technology, social media has become a powerful platform for sharing information, interacting, and seeking public support. This phenomenon raises important questions about how social media shapes public opinion and, ultimately, influences the political process and policymaking. With social media, anyone can increase or show one's popularity and can also create narratives that are less accurate and objective about someone. Despite the various positive impacts of social media, it also has negative impacts. If users are unable to properly filter news or information containing divisions, hoaxes or fake news, issues of ethnicity, religion, and others carried out by irresponsible people, such information can cause chaos and can certainly divide unity. Therefore, the problem of this research is the level of influence of social media on public formation and what role social media plays in the formation of public opinion in the state policy process, whether constructive or critical. With the normative method, namely the normative legal research method (normative juridical), namely studying the legal rules, theories and principles that regulate freedom of opinion, the right to information and public participation in the process of forming state policy.

Abstract

Mahkamah Konstitusi melalui Putusan Nomor 91/PUU-XVIII/2020 menegaskan bahwa prinsip demokrasi harus terwujud dalam proses pembentukan undang-undang. Hal ini diperkuat oleh Pasal 96 Undang-Undang Nomor 13 Tahun 2022 tentang Pembentukan Peraturan Perundang-Undangan yang membuka ruang partisipasi masyarakat, baik secara luring maupun daring. Namun, ketentuan tersebut belum mengatur secara rinci mekanisme pelaksanaan partisipasi publik, sehingga menimbulkan ketidakpastian hukum dan berpotensi mengurangi makna partisipasi bermakna dalam proses legislasi. Penelitian ini bertujuan untuk menganalisis urgensi pengaturan partisipasi bermakna serta merumuskan model ideal keterlibatan masyarakat dalam pembentukan undang-undang di Indonesia. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. Bahan hukum yang digunakan meliputi UUD 1945, Putusan MK, dan literatur hukum terkait. Analisis dilakukan secara kualitatif deskriptif. Hasil penelitian menunjukkan bahwa partisipasi bermakna harus menjamin hak masyarakat untuk didengar, dipertimbangkan, dan memperoleh tanggapan atas pendapatnya. Oleh karena itu, mekanisme partisipasi publik yang jelas dan terukur diperlukan guna memperkuat legitimasi, transparansi, dan akuntabilitas dalam pembentukan peraturan perundang-undangan di Indonesia.

Abstract

The rapid development of Artificial Intelligence (AI) has opened significant opportunities for reforming Indonesia's legislative system. The urgency of this research stems from the pressing need to enhance the quality, transparency, and public participation in the legislative process, which has long been perceived as slow, bureaucratic, and unresponsive to the rapidly evolving social dynamics. The presence of AI offers innovative solutions to these challenges through the application of analytical technologies, natural language processing, and legislative automation, which are capable of supporting faster and more accurate data-driven decision-making. The objective of this research is to examine the urgency of AI implementation in Indonesia's legislative process and to identify the opportunities and challenges of its integration, particularly concerning aspects of democracy, accountability, legitimacy, and personal data protection — which aims to safeguard individuals' privacy rights and ensure that data collection, storage, use, and deletion are conducted securely, transparently, and in compliance with the law. This study employs a juridical-normative method, incorporating statutory, artificial intelligence, and comparative conceptual approaches, to achieve a comprehensive understanding. The findings suggest that the application of AI has the potential to enhance participation by involving more stakeholders, particularly the public, in decision-making and policy formation processes, thereby making the outcomes more representative, democratic, and responsive to public needs, while also increasing the accuracy of participation. In conclusion, the integration of artificial intelligence into Indonesia's legislative process holds the potential to foster the creation of laws that are more participatory, transparent, and of higher quality — provided clear supporting regulations, guarantees of privacy protection, and the strengthening of institutional capacity within the state accompany it.
