Abstract

This study aims to determine Joseph Schacht’s thoughts on hadith as Islamic law and to determine the influence of Joseph Schacht’s thoughts on Islamic law. Schacht is one of the orientalists who has a significant influence in the study of Islamic studies, especially regarding the authenticity of hadith. He argues that most of the hadith circulating today are products of the second and third centuries of Hijriah, not directly from the Prophet Muhammad SAW. The research method used is a qualitative method with a historical-critical approach. The main data sources are the works of Joseph Schacht, especially his books and articles that discuss the status of hadith in Islamic law. This study also includes a literature review of the responses and criticisms of contemporary Islamic scholars towards Schacht’s views. The data are analyzed to identify Schacht’s main arguments, as well as how these views influence the methodology of modern Islamic law studies. The results of the study show that Schacht argues that hadith is more of a recording of an oral tradition that developed after the death of the Prophet Muhammad SAW. According to him, the process of collecting, distributing, and verifying hadith was often influenced by social and political factors at the time, raising doubts about the authenticity and reliability of hadith as a source of law. Its influence was not only limited to academics, but also influenced the public’s view of the importance of historical criticism in understanding the intellectual heritage of Islam. This study emphasizes the importance of a more critical and balanced approach in the study of Islamic law, which can help develop interpretations that are more relevant to contemporary demands and values.

Abstract

This study investigates the key determinants of consumer preference for digital services provided by Islamic financial institutions in Indonesia. It examines the influence of relative advantage, Sharia financial literacy, Islamic religiosity, and initial trust on consumer preference. A sample of 524 respondents was analyzed using structural equation modeling (SmartPLS 4.0.9.9). The results show that relative advantage and Sharia financial literacy significantly influence initial trust, which in turn positively impacts consumer preference. Islamic religiosity was found to significantly influence Sharia financial literacy but not consumer preference directly. However, it plays a moderating role in strengthening the relationship between relative advantage and consumer preference. These findings offer both theoretical and practical implications by enhancing our understanding of digital service adoption in a religious financial context and providing strategic insights for Islamic financial institutions aiming to improve digital service engagement.======================================================================================================== ABSTRAK - Peran Religiositas dan Literasi Keuangan dalam Adopsi Layanan Digital Islam di Indonesia.

Abstract

This study aims to analyze the implementation of the Muhammadiyah Tarjih Decision on prayer in children's education in the Muhammadiyah family in the Special Capital Region of Jakarta. By using a descriptive qualitative approach through interviews, observations, and literature studies, this study found that the understanding of the Muhammadiyah family, especially the cadres and leaders, of the Tarjih Decision on prayer was good and they practiced it in their daily lives. The implementation of prayer education is carried out in two forms, namely the practice of prayer according to tarjih by teaching reading, memorization, and the example of parents, as well as the cultivation of spiritual, moral, and social values through prayer. The factors that support the success of the implementation are the relatively high level of education and family economy, while the obstacles faced are the limited access to Muhammadiyah educational facilities, so that some children study outside Muhammadiyah schools and are faced with different worship procedures. This research contributes to the development of Islamic education in the Muhammadiyah family and strengthens the implementation of the Tarjih Decision in urban communities.

Abstract

This research addresses the divergence of scholarly opinions regarding the legal status of Indonesia's National Health Insurance (BPJS Kesehatan) and its implications for Sharia compliance. The controversy arises from varying arguments put forth by the Indonesian Ulema Council (MUI) and Nahdlatul Ulama as the largest Islamic organization in Indonesia, which has implications for the pro-people government program. The study aims to identify and analyze the factors contributing to the disparities in fatwas issued by MUI and NU concerning national health insurance. Additionally, it examines the role of scholars in shaping public policies to ensure their alignment with Sharia principles. The method used in thos study is by employing a descriptive-analytical approach, this research combines document studies and interviews for data collection. Qualitative analysis, guided by ushul fiqh and fiqh siyasa principles, is used to evaluate the controversies surrounding national health insurance issues. The research reveals that discrepancies in fatwa rulings are rooted in differences in the focus of study. MUI emphasizes the contractual aspect, deeming National health insurance incompatible with Sharia principles. In contrast, NU highlights the program's societal benefits, considering it Sharia-compliant due to its social insurance components. This study demonstrates that scholars' involvement in policy formulation is essential to ensure compliance with Islamic law. The divergence of fatwas regarding national health insurance underscores the need for greater scholarly input in shaping pro-people government programs. This research offers a comprehensive analysis of the national health insurance controversy from a scholarly perspective, shedding light on the critical role of scholars in policy-making processes in predominantly Muslim countries
