Abstract

Perkembangan dunia usaha, khususnya sektor usaha mikro, kecil, dan menengah (UMKM), mengalami pertumbuhan yang cukup pesat dan berperan penting dalam perekonomian daerah maupun nasional. Di Kota Cilegon, UMKM bidang kuliner menjadi salah satu sektor yang terus berkembang karena memiliki peluang pasar yang luas. Salah satu UMKM tersebut adalah Kedai Eva Cookies yang bergerak dalam produksi dan penjualan kue kering. Dalam menjalankan kegiatan usahanya, Kedai Eva Cookies melakukan berbagai aktivitas perdagangan yang berkaitan langsung dengan hukum dagang, seperti perizinan usaha, transaksi jual beli, kerja sama dengan pemasok, serta tanggung jawab terhadap konsumen. Namun, pada praktiknya, penerapan hukum dagang pada usaha kecil sering kali belum dilakukan secara optimal. Hal ini disebabkan oleh keterbatasan pemahaman pelaku usaha terhadap aturan hukum, kurangnya pendampingan, serta pengelolaan usaha yang masih bersifat tradisional. Penelitian ini bertujuan untuk mengetahui bagaimana penerapan hukum dagang dalam pengelolaan usaha Kedai Eva Cookies di Cilegon, serta mengidentifikasi tantangan dan upaya pengembangan usaha yang dilakukan. Hasil kajian ini diharapkan dapat memberikan gambaran mengenai peran hukum dagang dalam mendukung keberlangsungan usaha UMKM, meningkatkan kesadaran hukum pelaku usaha, serta menjadi referensi bagi pengembangan usaha kecil agar dapat berjalan secara tertib, profesional, dan berkelanjutan sesuai dengan ketentuan hukum yang berlaku.

Abstract

The use of intellectual property (IP) as collateral for bank loans, although regulated under Government Regulation No. 24/2022, still faced significant challenges in practice. These included difficulties in determining fair market value due to IP’s intangible nature, the lack of standardized valuation systems, complex execution mechanisms in cases of default, and the limited readiness of specialized appraisal institutions. Banks applied prudential principles because IP was considered a higher-risk asset. This study used a qualitative empirical juridical approach based on primary, secondary, and tertiary data analyzed descriptively. The results showed that IP certificates had strong legal and economic prospects as collateral for creative entrepreneurs and rights holders, as they already met legal criteria. However, their practical use as bank collateral in Serang City remained limited and not yet optimal.

Abstract

This article reviews Minister of Home Affairs Regulation Number 9 of 2014 concerning Guidelines for Development of Regional Featured Products, Law Number 28 of 2014 on Copyright, and Law Number 5 of 2017 on Advancement of Culture. The article aims to ascertain how Serang Regency's local and regional potential is distributed across its products and culture and to outline and identify a development model that Serang Regency's local and regional potential can apply to the region's intellectual property. The article employs a socio-legal research methodology along with a qualitative method—analysis and discussion around the allocation of local and regional. With an emphasis on Golok Seuat, Silat Bandrong, and Rudat, the analysis and discussion of local and regional potential distribution based on communal intellectual property, including products and culture, is highly varied. Golok Seuat is widely distributed and fairly even, but Rudat and Silat Bandrong are not uniformly distributed for various reasons. While Silat Bandrong and Rudat have been inventoried, secured, and published, the development approach employed in Golok Seuat is based on regional superior products with a core competency model with improved attractiveness and promotion.
