Abstract

Handling Covid-19 which must be completed immediately must be made a special treatment. The urgent situation requires that a binding regulation be made in the situation of handling Covid-19 very quickly. The Tulungagung Regency Government issued a Circular regarding the implementation of Large-Scale Social Restrictions (PSBB). The problem is that the Circular which is a policy regulation can only regulate it, not for the wider community. This study aims to determine the function of the Circular issued by the regent as discretion in handling Covid-19 by regulating the community curfew, and to find out the legal consequences of issuing a circular letter by the regent in handling Covid-19. The research method used is a normative juridical type, using a statutory approach and a concept approach. The results of the study show that the Circular issued is categorized as a beleidsregel (policy regulation). This circular has the same legal status as operational guidelines, technical guidelines, official notes, announcements, guidelines and other similar terms. Beleidsregel is similar to regeling, but it is not intended/binding in general to the community and only binds internally to an institution. So that the regulation related to PSBB in the Tulungagung area related to the implementation of the curfew for all large business actors and MSMEs is less productive. The Circular issued by the Regional Government of Tulungagung Regency can be considered as a discretion. This is because there should be another mechanism established to be able to regulate the establishment of a Regional Regulation.

Abstract

Peraturan bersama kepala desa merupakan instrumen hukum penting di tingkat desa untuk mengatur aspek kehidupan masyarakat lintas desa, namun kekaburan hukum terkait batasan materi muatannya menimbulkan kebingungan dan potensi konflik yurisdiksi, sehingga diperlukan kejelasan pedoman untuk menjamin efektivitas implementasinya dalam konteks otonomi desa. Penelitian ini bertujuan untuk menganalisis bentuk kekaburan hukum dalam batasan materi muatan Peraturan Bersama Kepala Desa serta mengkaji implikasi hukum yang ditimbulkan oleh ketidakjelasan batasan tersebut. Penelitian hukum normatif mengkaji aturan-aturan hukum tertulis melalui studi kepustakaan dan analisis kualitatif untuk memahami kekaburan hukum terkait batasan materi muatan peraturan bersama kepala desa, dengan menggunakan pendekatan konseptual dan perundang-undangan serta berbagai sumber bahan hukum primer, sekunder, dan tersier. Hasil penelitian memaparkan bahwa kekaburan hukum dalam batasan materi muatan Peraturan Bersama Kepala Desa disebabkan oleh kurangnya regulasi yang jelas dan spesifik dalam perundang-undangan yang ada, seperti Undang-Undang Desa dan peraturan turunannya. Hal ini menyebabkan interpretasi yang berbeda-beda dan sering kali menimbulkan tumpang tindih kewenangan antara peraturan desa, peraturan bersama kepala desa, dan peraturan pemerintah daerah. Akibatnya, peraturan bersama sering kali mengatur hal-hal di luar kewenangan desa, yang berdampak pada munculnya konflik kewenangan, penafsiran yang tidak seragam, pelanggaran aturan hukum yang lebih tinggi, hingga potensi sengketa hukum antar desa yang terlibat dalam peraturan bersama tersebut

Abstract

East Java was originally a sugarcane plantation and the main sugar producer in Indonesia. This inability is caused by the decreasing land for planting sugarcane, especially in Java. Since the 19th century, the islands of Java and Sumatra have been among the largest sugar producers. The largest land area is on the island of Java. The quality of the soil and climate are very good for sugar plants. The problem is land conversion. Land conversion occurs due to the development of large cities and their satellite cities. The development of these cities requires land for residential and factory functions. This is actually not a problem as long as there is careful planning and strict implementation of the spatial planning of the area. This study tries to examine the synergy between sugarcane plantations and spatial planning and its implementation. By examining the case of the closure of three sugar factories in Sidoarjo Regency, the study shows that inconsistency in maintaining planting land has resulted in sugar factories experiencing difficulties in sugarcane supply.

Abstract

Constitutional changes are part of the political and legal dynamics of a country. Changes to the constitution aim to meet the legal demands and needs of the community so that they are clearly and firmly regulated in the constitution. This paper is oriented towards the idea of a formal review of constitutional changes in Indonesia. This research is a normative legal research. The approach used in this research is a conceptual approach, a comparative approach, and a statutory approach. The primary legal materials in this study include the text of the 1945 Constitution of the Republic of Indonesia, constitutional texts in various countries and the Constitutional Court Decision No. 91/PUU-XVIII/2020. Secondary legal materials include: books, journal articles, and websites related to the constitution and constitutional law. Non-legal materials include legal dictionaries. The results of the study indicate that a formal review of constitutional changes is needed as an effort to maintain the supremacy of the constitution, including also placing the court's function as guardians of the law and the constitution in dealing with the determination of non-legal aspects in constitutional changes

Abstract

Background: Women's representation in Indonesia's Village Consultative Bodies (BPD) is essential for gender equality and inclusive governance. However, unclear regulations, socio-cultural barriers, and weak enforcement hinder progress. Gap: Legal ambiguities and inconsistent practices limit effective participation and gender-responsive decision-making. Aim: This study explores the legal uncertainties affecting women's representation in BPDs and their broader impacts. Results: Findings highlight unclear legislation, gaps between national and regional regulations, and insufficient enforcement, compounded by cultural biases, reducing women’s motivation and participation. Novelty: The study provides a unique analysis of legal and socio-cultural challenges, offering actionable reform strategies. Implications: Clearer regulations and empowerment programs can improve representation, fostering equitable governance and sustainable development. Highlights: Legal ambiguities in regulations hinder women’s effective participation in BPDs. Socio-cultural biases significantly reduce opportunities for gender-responsive governance.
