Abstract

Seeing from some perspectives, happiness has not reach finish line yet since it is very different and varied amongst the religions. The term ‘happy’ or ‘happines’ turns to be a most wanted thing for people as it is their destination in life. For western philosophers especially classic philosophers such as Socrates, Plato, Aristoteles, Epikuros argue that happiness is the highest level achieved by someone. The sciences developed by the philosophers eventually aim to reach inner peace (eudiomonia). The happiness could be achieved by good deeds, peaceful heart and a healthy body. In the Qur’an, the word ‘happy’ is translated from sa’id, meanwhile the word ‘sad’ as antonym of happy is translated from Saqiy. Other words used in the Qur’an to describe happines are falah, najat and najah. In the Qur’an’s view, there are at least 6 ways to gain happiness in life: First, believing that there must be solution after troubles. Second, thanking Allah for favors granted, pleasure, patience, and resignation for any disaster. Third, forgive others if they make mistakes upon you. Fourth, staying away from prejudice. Fifth, avoid habitual grumpy when facing or hit something. Sixth, reducing the desire worldly with zuhud and qona’ah.

Abstract

Abstract

This study examines Tājuddīn al-Subkī’s concept of ḥifẓ al-‘irḍ, as an essential part of maqāṣīd al-sharī’a, and uses it to analyze hoax news. To limit this study, the authors focuse on two crucial aspects. First, what is the concept of ḥifẓ al-‘irḍ according to Imam Tājuddīn al-Subkī? Second, how to contextualize ḥifẓ al-‘irḍ in the contemporary time to approach hoax news? This library research uses content and critical analysis to Tājuddīn al-Subkī’s thoughts, which are contained the works written by himself and those written by scholars after him. This study argues that al-Subkī initiated the concept of ḥifẓ al-‘irḍ (maintaining honor). As an essential part of maqāṣīd al-sharī’a, ḥifẓ al-‘irḍ must be held in addition to five other main purposes, namely maintaining the soul, religion, reason, lineage, and treasure. According to al-Subkī, defending honor can be equated with keeping the lineage because the two have a close and robust relationship, especially when discussing adultery and qadhf/قذف (accusing people of committing adultery). The spread of hoaxes today is like qadhf in Islamic law. The hoax spread must be stopped because it causes damage to the life of society, nation, and state. Preventing injury and realizing benefits are at the core of maqāṣīd al-sharī’a.

Abstract

Interfaith marriage has no legal foundation. However, this marriage practice is still carried out among the people of North Lombok. Using a purposeful sampling methodology, the authors used a descriptive qualitative method to collect data from several interviewees, including village heads, religious leaders, and interfaith marriage players. According to this study, interfaith marriage requires the bride to follow the religion of her prospective spouse. Environmental factors, kinfolk or kindred, married by accident, sociocultural factors, a lack of religious knowledge, and transmigration all contribute to this marriage. At the very least, this marriage psychologically affects spouses and families. It also has an impact on the religious peace of the surrounding communities. In the meantime, interfaith leaders advise against interfaith weddings.

Abstract

The issue of polygamy is one of the issues in Islamic family law which still become a hot, interesting, and updated debated topic to be studied, either in the view of state law or a theme for discussion, under the different interpretations in understanding the verses of the Qur'an. The theme of polygamy has been discussed by scholars in the books of fiqh and their interpretations. But, their views that have developed so far tend to reinforce the opinion that polygamy is permissible based on the text of paragraph 3 of surah al-Nisa. The verse is a source of polemic interpretation, by both classical and contemporary scholars on answering the question of whether polygamy practice is permissible or not. This paper focused on two contemporary scholars, namely Fazlur Rahman and Muhammad Syahrur. They have their views on the polygamy law. This research was normative legal research, using the approach of ushul fiqh and comparative law. The study indicates that Fazlur Rahman, with double movement theory, interprets fairness as a condition for the permissibility of polygamy with love and not material things, such as fairness in physical services. Meanwhile, Muhammad Syahrur, with his boundary theory (nazariyyat al-hudud), interprets fairness as one's ability and obligation to look after, protect and raise orphans from polygamous widows. Apart from that, Syahrur also stated that the widow of being married in polygamy was a widow whose husband had died. The two theories have contributed new colors and the interpretation of Islamic law.

Abstract

This paper analyzes the command to travel in the Qur'an, which is understood from the word sīrū or yasīrū with various accompanying words. The Quranic injunction to travel that uses the word sīrū contains orders to contemplate, think, and take lessons from the attitude of the former people who denied the Prophet and Messenger of Allah and the consequences experienced by these people. Productive tourism in the Qur’an is carried out with a good purpose, benefiting oneself, others, and the surrounding environment and maximizing the use of reason, mind, and heart. In the Qur'an, the orientation of travel is very varied, namely, seeing the behavior of the former people, knowing the universe and its contents, adding insight, clearing the heart, softening the mind, and so on. The phenomenon of travel and efforts to develop the tourism sector in various countries are currently very diverse and continue to develop significantly in various means and forms so that they can provide benefits for social, political, cultural, and religious life. The order to travel contained in the word sīrū must be actualized in today's modern life by sticking to and being guided by the values in the holy book of the Qur'an.
