Abstract

This paper aims to examine the fulfillment of the requirements for implementing the judge's decision Number: 69/Pid.Sus/2019/PN Mjk in providing additional punishment in the form of chemical castration and rationalization of the Indonesian Doctors Association (IDI) in approving the implementation of the decision. The results of the study indicate that the conditions for implementing the decision No. 69/Pid.Sus/2019/Pn Mjk in providing additional punishment for chemical castration has been fulfilled, because the conditions for the imposition of additional punishment in the form of chemical castration are imposed after the convict has served the principal sentence in accordance with Article 81A paragraph (1) of Law Number 17 of 2016 concerning child protection. The reason IDI is obliged to approve the implementation of Decision Number: 69/Pid.Sus/2019/PN Mjk is that when a regulation is included in the legislation, this provision is perfectly binding and must be obeyed. So, in practice, when a doctor is asked to perform chemical castration, the doctor must do so because this provision is a legal order and there is a justification for this. The decision Sus/2019/PN Mjk is when a regulation is included in the legislation, this provision is perfectly binding and must be obeyed.

Abstract

This study aims to validate and analyze the accuracy of sentencing the the defendant as the head of the service in fulfilling the elements of the legal subject as a Civil Servant, as well as legal proof of the defendant's actions which are considered beneficial or detrimental to one of the candidate pairs. Legal research with normative juridical, as well as statutory, case, and conceptual approaches and analyzed prescriptively. The accuracy of sentencing the the defendant in Decision Number 147/Pid.Sus/2018/PN.Sdr regarding legal subjects is based that the Panel of a judge s interprets ASN holding certain positions in government as ASN. The judge's considerations did not refer to the Civil Servant Law and the the defendant was a High Pratama Official, belonging to an Echelon 2 position, and this was based on the theory of a criminal responsibility that the actions taken by the the defendant were a burden of personal responsibility not the responsibility of the position. It has nothing to do with the main duties and official functions as Head of the Social, Civil and Population Registration Service, and not as a legitimate job order task. Legal proof of the the phrase "favorable" or "detrimental" to one of the Candidate pairs is inappropriate, because it is not based on the benefit or harm is a formal offense so it does not need to be proven because there is a potential loss and at the same time the theory of  economics analysis of law on the principle of optimization, proving cost-benefit analysis, the principle of balance, and the principle of efficiency.

Abstract

Kepala Desa sebagai lembaga pemerintah  terkecil diberikan kewenangan oleh pemerintah dalam mewujudkan otonomi desa salah satunya diwujudkan dengan pemberian kewenangan pembangunan secara lokal-partisipatif kepada desa. Namun dalam praktiknya, kewenangan yang telah diberikan tersebut justru dimanfaatkan oleh sebagian kepala desa untuk korupsi. Kesadaran tentang korupsi dan dampaknya yang menghambat pembangunan dan kesejahteraan masyarakat belum dirasakan oleh Kepala Desa dengan masih banyak Kepala Desa yang terjerat kasus korupsi. Atas permasalahan tersebut Tim Pengabdian Masyarakat Fakultas Ilmu Sosial Universitas Negeri Surabaya melakukan Upaya Pendidikan anti korupsi kepada pada Kepala Desa untuk memberikan pemahaman terhadap peraturan-peraturan tentang korupsi dan akibatnya. Abstract

ABSTRAK Hukum yang hidup di masyarakat telah menyelesaikan tindak pidana yang terjadi di masyarakat. Dalam Pasal 338 KUHP mengenai tindak pidana pembunuhan, dengan ancaman pidana  berupa pidana mati. Masyarakat Indonesia sebagai local wisdom telah menyelesaikan tindak  pidana percobaan pembunuhan dengan kesepakatan para pihak. Tujuan penulisan ini adalah mengidentifikasi dasar filosofis kebijakan lokal dalam percobaan  tindak pidana  pembunuhan pada masyarakat di Indonesia.  Metode penulisan adalah normatif dengan pengumpulan bahan hukum secara studi Pustaka dengan pendekatan perundang-undangan dan konsep serta dianalisis secara kualitatif., Hasil pembahasan bahwa Filosofi penanganan percobaan  pembunuhan pada Masyarakat di Indonesia  adalah berupa kesepakatan antara para pihak adalah bertentangan dengan konsep mala in se.   Sanksi tersebut adalah kesepakatan antara pertemuan antara pelaku, korban dan perwakilan masyarakat, hal ini sesuai dengan perkembangan di dalam masyarakat dan hubungan kekerabatan atau persamaan wilayah sangat dijunjung tinggi sebagai tahapan penyelesaian percobaan pembunuhan yang terjadi.ABSTRACTThe law that lives in the community has resolved the crime that occurred in the community. In Article 338 of the Criminal Code concerning the crime of murder, the threat of punishment is the death penalty. The Indonesian people as local wisdom have resolved the crime of attempted murder with the agreement of the parties. The purpose of this paper is to identify the philosophical basis of local policies in the attempted murder of people in Indonesia. The writing method is normative with the collection of legal materials in a library study with a statutory and conceptual approach and analyzed qualitatively. The results of the discussion that the philosophy of handling attempted murder in society in Indonesia is in the form of an agreement between the parties is contrary to the concept of mala in se. The sanction is an agreement between a meeting between perpetrators, victims, and community representatives, this is following developments in the community, and kinship relations or regional equality are highly respected as a stage of completion of the attempted murder that occurred

Abstract

Background: Women's representation in Indonesia's Village Consultative Bodies (BPD) is essential for gender equality and inclusive governance. However, unclear regulations, socio-cultural barriers, and weak enforcement hinder progress. Gap: Legal ambiguities and inconsistent practices limit effective participation and gender-responsive decision-making. Aim: This study explores the legal uncertainties affecting women's representation in BPDs and their broader impacts. Results: Findings highlight unclear legislation, gaps between national and regional regulations, and insufficient enforcement, compounded by cultural biases, reducing women’s motivation and participation. Novelty: The study provides a unique analysis of legal and socio-cultural challenges, offering actionable reform strategies. Implications: Clearer regulations and empowerment programs can improve representation, fostering equitable governance and sustainable development. Highlights: Legal ambiguities in regulations hinder women’s effective participation in BPDs. Socio-cultural biases significantly reduce opportunities for gender-responsive governance. Abstract

The sanction of Community Service as formulated in Article 85 of Law Number 1 of 2023 concerning the Indonesian Criminal Code still contains regulatory ambiguity in determining the activities that constitute community service punishment. The purpose of this research is to determine: 1) The urgency of establishing the specific activities in the implementation of community service punishment in accordance with the explanation of Article 85 of Law Number 1 of 2023 concerning the Indonesian Criminal Code; and 2) How the determination of activities in the implementation of community service punishment is carried out in the Netherlands. This research is a normative legal study using a statutory approach. The results indicate that community service punishment in Indonesia has a clear legal basis as stipulated in Article 85 of Law Number 1 of 2023 concerning the Indonesian Criminal Code. However, there remains ambiguity in the determination of community service punishment since no implementing regulation currently exists to govern the specific activities to be performed. The explanation of Article 85 paragraph (1) only provides a general description of the places where community service may be conducted, such as hospitals, orphanages, nursing homes, schools, or other social institutions, but does not clearly specify the types of activities that must be undertaken by the offender at those locations. Therefore, implementing regulations are needed to establish standard procedures for the execution of community service punishment. The Netherlands has detailed implementing regulations supporting community service punishment, as stipulated in Articles 9 and 22c–22k of the Criminal Code of the Netherlands. The implementation of these provisions is carried out by the organization Reclassering Nederland, which could serve as a model for Indonesia in drafting its own implementing regulations to ensure that community service punishment functions effectively. Currently, the regulation of community service punishment in Indonesia relies solely on Article 85 of Law Number 1 of 2023 concerning the Indonesian Criminal Code. Therefore, implementing regulations are essential to complement existing policies and ensure that community service punishment can be effectively enforced in Indonesia.

Abstract

Pasal 76D juncto Pasal 81 ayat (1) Undang-Undang Perlindungan Anak telah menentukan hukuman pelaku tindak pidana persetubuhan anak, tetapi adanya pengecualian pidana minimum bagi pelaku anak berpotensi bertentangan dengan prinsip proporsionalitas, salah satu contoh pertentangan ini terdapat pada Putusan Nomor 13/Pid.Sus-Anak/2025/PN. Snn. Penelitian ini bertujuan untuk menganalisis kesesuaian Pasal 76D dengan prinsip proporsionalitas dan akibat pemberian sanksi di bawah minimum terhadap perlindungan anak korban, serta akibat pemberian pidana penjara terhadap pelaku anak. Metode penelitian yang digunakan adalah normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Hasil penelitian menunjukkan, pemberian sanksi dibawah minimum berpotensi tidak memenuhi prinsip proporsionalitas karena adanya inkonsistensi dengan Pasal 79 ayat (3) Undang-Undang Sistem Peradilan Pidana Anak dan mengakibatkan hak yang dimiliki oleh anak korban tidak terpenuhi, tetapi penjatuhan pidana penjara juga tidak boleh mengabaikan hak pelaku anak. Berbeda dengan studi sebelumnya yang hanya berfokus pada tindak pidana pencabulan anak dan memaknai asas-asas yang digunakan hakim dalam menjatuhkan pidana, penelitian ini menganalisis putusan hakim secara mendalam serta menjelaskan akibat yang diterima oleh anak sebagai korban maupun pelaku dengan pengumpulan data melalui studi kepustakaan. Kesimpulan penelitian ini menegaskan bahwa dalam proses pemidanaan harus mempertimbangkan akibat yang dialami oleh anak korban serta antara Undang-Undang Perlindungan Anak dengan Undang-Undang Sistem Peradilan Pidana Anak masih terdapat ketidaksesuaian yang menimbulkan celah terjadinya penyimpangan prinsip proporsionalitas, sehingga diperlukan evaluasi kedua peraturan tersebut untuk membenahi pemidanaan anak sesuai prinsip proporsionalitas.

Abstract

The aim is analyzes the suitability of imposing work training for children aligns with the regulation contained in Law Number 11 of 2012 “Law on the Juvenile Criminal Justice System”. This study uses a normative method with state approach, case approach. Result is judges consider the children’s psychological condition, background, and to ensure the child can continue their education, and impose work training sanctions that are below the minimum criminal penalty. These considerations reflect the existence of judicial discretion authority in deciding the appropriate sanctions for children. The judge is guided by Sema number 1 of 2017 point 5 letter a which basically stipulates that the minimum criminal threat in Article 79 paragraph (3) doesn’t apply if the perpetrator is a child, besides that the judge also weighs the main principle which is “The best interest for the child”. Discretion in sentencing children needs to be accompanied by strong and clear legal arguments or considerations to ensure legal certainty without neglecting the goal of restorative justice.

Abstract

Freedom of expression is a fundamental right in democratic states, functioning as a means of public participation and oversight of power. However, this right may be restricted through criminal law to protect individual honor and maintain public order. Problems arise when criminal defamation norms are broadly formulated and lack clear limitations, creating legal uncertainty in their enforcement. Such conditions may generate a chilling effect, where individuals restrain expression due to fear of criminal sanctions. This study aims to analyze the concept of the chilling effect in restricting freedom of expression and evaluate criminal defamation regulations from a legal certainty perspective. Using normative legal research methods, this study finds that broadly interpreted norms may encourage self-censorship, highlighting the need for clearer, more precise, and proportionate legal formulations. The findings also imply that ambiguous insult provisions in the Indonesian Penal Code risk undermining democratic discourse and require judicial safeguards to prevent excessive restriction of public criticism. Therefore, a balanced approach between reputation protection and freedom of expression is essential.

Abstract

General Background Criminal procedure must reconcile effective law enforcement with legality, due process, privacy, and the presumption of innocence. Specific Background The new Criminal Procedure Code recognizes wiretapping as a coercive measure and grants investigators authority to use it in criminal investigation, while its detailed procedures remain delegated to a separate statute. Knowledge Gap Existing discussions on coercive measures have largely centered on arrest, detention, search, seizure, and pretrial oversight, whereas wiretapping under the new procedural regime remains insufficiently examined, particularly in relation to the presumption of innocence and the absence of comprehensive procedural safeguards. Aims This study analyzes the authority to conduct wiretapping as a coercive measure and its legal implications for privacy rights, legality, due process of law, and the presumption of innocence. Results The findings show that wiretapping is relevant for uncovering modern crimes involving technological communication, but the lack of clear rules on implementation, judicial authorization, supervision, subject limits, offense categories, duration, and accountability creates legal uncertainty and opens space for abuse of authority. Wiretapping at the preliminary stage may also place individuals who have not been named suspects under state surveillance, thereby risking privacy violations and weakening the presumption of innocence. Novelty The study positions wiretapping as a high-intrusion coercive measure that requires strict subsidiarity, proportionality, and judicial control before use. Implications Comprehensive regulation is needed to balance criminal law enforcement with human rights protection and to secure the validity of electronic evidence in criminal justice.
