Abstract

The credibility of football has been repeatedly questioned due to allegations of bribery and related violations, as reflected in judicial decisions such as Case No. 51/Pid.Sus/2019/PN.Bnr, which established bribery as the initial act in match fixing. This study, employing normative legal research with legislative and conceptual approaches and analyzed through philosophical interpretation, examines match fixing through the principle of loss as the basis for its criminalization. The findings show that bribery constitutes a mala in se offense, inherently wrongful in nature, and that the principle of loss satisfies the indicators of criminalization by recognizing both material and immaterial harm to society. These results confirm that bribery, with identifiable victims in the community, underlies the complexity of match fixing and provide new insights to raise public awareness..

Abstract

Kepala Desa sebagai lembaga pemerintah  terkecil diberikan kewenangan oleh pemerintah dalam mewujudkan otonomi desa salah satunya diwujudkan dengan pemberian kewenangan pembangunan secara lokal-partisipatif kepada desa. Namun dalam praktiknya, kewenangan yang telah diberikan tersebut justru dimanfaatkan oleh sebagian kepala desa untuk korupsi. Kesadaran tentang korupsi dan dampaknya yang menghambat pembangunan dan kesejahteraan masyarakat belum dirasakan oleh Kepala Desa dengan masih banyak Kepala Desa yang terjerat kasus korupsi. Atas permasalahan tersebut Tim Pengabdian Masyarakat Fakultas Ilmu Sosial Universitas Negeri Surabaya melakukan Upaya Pendidikan anti korupsi kepada pada Kepala Desa untuk memberikan pemahaman terhadap peraturan-peraturan tentang korupsi dan akibatnya. Hasil dari kegiatan ini sangat bermanfaat dan mampu memberikan pengetahuan lebih kepada Kepala Desa untuk lebih akuntabel dan transparan dalam membangun desa

Abstract

ABSTRAK Hukum yang hidup di masyarakat telah menyelesaikan tindak pidana yang terjadi di masyarakat. Dalam Pasal 338 KUHP mengenai tindak pidana pembunuhan, dengan ancaman pidana  berupa pidana mati. Masyarakat Indonesia sebagai local wisdom telah menyelesaikan tindak  pidana percobaan pembunuhan dengan kesepakatan para pihak. Tujuan penulisan ini adalah mengidentifikasi dasar filosofis kebijakan lokal dalam percobaan  tindak pidana  pembunuhan pada masyarakat di Indonesia.  Metode penulisan adalah normatif dengan pengumpulan bahan hukum secara studi Pustaka dengan pendekatan perundang-undangan dan konsep serta dianalisis secara kualitatif., Hasil pembahasan bahwa Filosofi penanganan percobaan  pembunuhan pada Masyarakat di Indonesia  adalah berupa kesepakatan antara para pihak adalah bertentangan dengan konsep mala in se.   Sanksi tersebut adalah kesepakatan antara pertemuan antara pelaku, korban dan perwakilan masyarakat, hal ini sesuai dengan perkembangan di dalam masyarakat dan hubungan kekerabatan atau persamaan wilayah sangat dijunjung tinggi sebagai tahapan penyelesaian percobaan pembunuhan yang terjadi.ABSTRACTThe law that lives in the community has resolved the crime that occurred in the community. In Article 338 of the Criminal Code concerning the crime of murder, the threat of punishment is the death penalty. The Indonesian people as local wisdom have resolved the crime of attempted murder with the agreement of the parties. The purpose of this paper is to identify the philosophical basis of local policies in the attempted murder of people in Indonesia. The writing method is normative with the collection of legal materials in a library study with a statutory and conceptual approach and analyzed qualitatively. The results of the discussion that the philosophy of handling attempted murder in society in Indonesia is in the form of an agreement between the parties is contrary to the concept of mala in se. The sanction is an agreement between a meeting between perpetrators, victims, and community representatives, this is following developments in the community, and kinship relations or regional equality are highly respected as a stage of completion of the attempted murder that occurred

Abstract

Background: Women's representation in Indonesia's Village Consultative Bodies (BPD) is essential for gender equality and inclusive governance. However, unclear regulations, socio-cultural barriers, and weak enforcement hinder progress. Gap: Legal ambiguities and inconsistent practices limit effective participation and gender-responsive decision-making. Aim: This study explores the legal uncertainties affecting women's representation in BPDs and their broader impacts. Results: Findings highlight unclear legislation, gaps between national and regional regulations, and insufficient enforcement, compounded by cultural biases, reducing women’s motivation and participation. Novelty: The study provides a unique analysis of legal and socio-cultural challenges, offering actionable reform strategies. Implications: Clearer regulations and empowerment programs can improve representation, fostering equitable governance and sustainable development. Highlights: Legal ambiguities in regulations hinder women’s effective participation in BPDs. Socio-cultural biases significantly reduce opportunities for gender-responsive governance. Abstract

This study is expected to have significant implications for policymakers and stakeholders in Indonesia and other developing countries seeking to reform their labor laws. The study can validate the development of new policies and programs to protect the rights of the workers, promote decent work, and provide greater access to social protection. The discussion on comparing labor regulations before and after implementing the Job Creation Law (The Law Number 6 Year 2023) in Indonesia covers several key aspects, including wage arrangements, outsourcing, social protection, and fixed-term employment agreements (PKWT). The Job Creation Law reflects the trend to provide more flexibility to employers, allowing them to customize working conditions according to business needs. While a push exists to improve the investment climate and create jobs, these changes raise serious questions about workers’ rights and welfare, particularly concerning about social protection and job security. This comparison indicates significant changes in Indonesia’s labor regulations, providing a clearer picture of workers’ challenges and opportunities. Labor law reform in Indonesia has impacted workers’ perception and responses. While some perceive it as a positive step that strengthens legal protection against unfair termination of employment, many workers still experience inequalities in access to health insurance, pensions, and workplace accident insurance. The government and stakeholders should work to improve workers’ access to social security and strengthen law enforcement and oversight to minimize potential implementation failures that could harm the rights of the workers.

Abstract

The sanction of Community Service as formulated in Article 85 of Law Number 1 of 2023 concerning the Indonesian Criminal Code still contains regulatory ambiguity in determining the activities that constitute community service punishment. The purpose of this research is to determine: 1) The urgency of establishing the specific activities in the implementation of community service punishment in accordance with the explanation of Article 85 of Law Number 1 of 2023 concerning the Indonesian Criminal Code; and 2) How the determination of activities in the implementation of community service punishment is carried out in the Netherlands. This research is a normative legal study using a statutory approach. The results indicate that community service punishment in Indonesia has a clear legal basis as stipulated in Article 85 of Law Number 1 of 2023 concerning the Indonesian Criminal Code. However, there remains ambiguity in the determination of community service punishment since no implementing regulation currently exists to govern the specific activities to be performed. The explanation of Article 85 paragraph (1) only provides a general description of the places where community service may be conducted, such as hospitals, orphanages, nursing homes, schools, or other social institutions, but does not clearly specify the types of activities that must be undertaken by the offender at those locations. Therefore, implementing regulations are needed to establish standard procedures for the execution of community service punishment. The Netherlands has detailed implementing regulations supporting community service punishment, as stipulated in Articles 9 and 22c–22k of the Criminal Code of the Netherlands. The implementation of these provisions is carried out by the organization Reclassering Nederland, which could serve as a model for Indonesia in drafting its own implementing regulations to ensure that community service punishment functions effectively. Currently, the regulation of community service punishment in Indonesia relies solely on Article 85 of Law Number 1 of 2023 concerning the Indonesian Criminal Code. Therefore, implementing regulations are essential to complement existing policies and ensure that community service punishment can be effectively enforced in Indonesia.
