Abstract

This paper initiates the study of Islamic law related to the reverse proof system contained in Articles 77 and 78 in law number 8 of 2010 concerning the Prevention and Eradication of The Criminal Action of Money Laundering. In this study, the authors used qualitative methods to respond to the concept of fiqh life in Indonesia. The purpose of this study is related to the burden of proof reversed using the opinions of Islamic law, usul fiqh, and legislation. From the study results, the evidence to the contrary does not apply to all criminal cases but only to exceptional cases such as money laundering. Money laundering in Indonesia can be in the form of enrichment by illegal means. Islamic law in the development of law in Indonesia also minimizes the crime of criminal origin that develops and continues in money crimes from the influence of controlling illicit money that feels like halal money and also includes sanctions against perpetrators of crimes punished by Islam into national law.

Abstract

Understanding the idea of prevention and countermeasures of sexual violence is the goal of this community service project Medan Krio Village area. This activity began by emphasizing the importance of knowledge related to sexual violence and problems that potentially arise due to public misunderstanding of the forms of sexual violence stipulated in law No. 12 Of 2022 On The Crime Of Sexual Violence. The implementation method includes planning activities involving 30 (thirty) participants in the Medan Krio Village Hall by providing understanding through material presented in a concise information chart and accompanied by discussion sessions. Participation in this community service project leads to a significant increase in participants ' understanding before and after participating in the activities. This fact shows that individuals who take part in this effort can benefit from later implementing their understanding in the lives of the Medan Krio Village community, in order to minimize and be free of sexual violence violations. And can carry out the implementation of the law and the purpose of punishment (rehabilitative) for the perpetrators so that the people of Medan Krio are born with character and are legally aware.

Abstract

Corruption categorized as an extraordinary crime continues to show a significant upward trend in Indonesia. As a product of the 1998 reform movement, efforts to realize a clean government were institutionalized through Law Number 28 of 1999. However, empirical realities show a structural anomaly where democratic instruments are hijacked by old power structures acting as free riders to perpetuate authoritarian tendencies. This systemic failure degrades the rule of law and forces a critical re-examination of how political transitions accommodate oligarchic resilience. Consequently, this study addresses how corruption undergoes structural metamorphosis, how state capture interacts with democratic procedures, and to what extent it deprives citizens of constitutional protections. Research Method, using a combined legal research method (normative-empirical jurisprudence) with a qualitative-descriptive approach, this study dissects State Capture Corruption through Olle Törnquist’s "shadowy democracy" thesis and Nils Bubandt's oxymoronic democracy corruption framework. Research Outcome: The results confirm that local oligarchies distort political transitions through the capitalization of authority and Sophistic truth manipulation. This paradox turns democracy into an incubator for systemic corruption, where public funds are diverted, leaving the public as a collective victim. The novelty lies in integrating Samuel Huntington’s transition models to reveal a "transformation from above" using fresh data. Theoretically, it enriches progressive criminal jurisprudence, while practically providing strategic policy recommendations for anti corruption authorities to shield public budgets from oligarchic interventions.

Abstract

Corruption is classified as an extraordinary crime due to its destructive impact on state administration, economic development, and public trust. Among the various forms of corruption in Indonesia, bribery constitutes the most fundamental and systemic offense, serving as the primary mechanism through which corruption is initiated, maintained, and normalized within public institutions. Within the justice system, bribery in law enforcement represents one of the most dangerous and corrosive forms of corruption, as it directly undermines the integrity of investigations, prosecutions, and judicial decisions. For this reason, extraordinary legal measures – including the death penalty – can serve as an alternative means to address severe bribery offenses. Nevertheless, its application in Indonesia faces legal challenges, mainly due to the shortcomings of the formulation of the death penalty provisions in the current Law on the Eradication of Corruption Crimes. Comparing with neighbouring countries concerning legal provisions for bribery, the author will assess how the reformulation or reconstruction of death penalty provisions could enhance the deterrent effect on corrupt officials in Indonesia. This study demonstrates that, despite ongoing debates over its implementation, the death penalty for bribery takers in Indonesia has a sound legal and rational foundation. Within law enforcement, it could strengthen the decisiveness of existing regulations and enhance their deterrent effect against such practices

Abstract

Penggunaan Saksi Mahkota (Kroon Getuige) dalam proses persidangan merupakan langkah pragmatis yang sering diambil saat terjadi tindak pidana penyertaan (deelneming) dan tidak adanya saksi yang dapat mengungkap fakta secara komprehensif atau kurangnya alat bukti yang memadai. Status ganda Saksi Mahkota—sebagai terdakwa sekaligus saksi bagi terdakwa lain—menghasilkan konflik yuridis signifikan, terutama dalam konteks penjatuhan hukuman. Penelitian ini membahas pengaturan hukum Saksi Mahkota dalam perkara tindak pidana kekerasan melawan pejabat yang sedang melakukan pekerjaan yang sah (Pasal 212 jo. Pasal 55 KUHP) serta menganalisis pertimbangan hakim yang menyebabkan terjadinya disparitas putusan dalam studi kasus Putusan No. 1837/Pid.B/2023/PN.Lbp (Terdakwa Maulana Adibya Lubis) dan Putusan No. 1838/Pid.B/2023/PN.Lbp (Terdakwa I Defri Ramadhan dan Terdakwa II Eko Pratama Siregar). Jenis penelitian yang digunakan adalah metode yuridis normatif dengan pendekatan kasus dan komparasi putusan. Hasil penelitian mengidentifikasi bahwa pengaturan Saksi Mahkota di Indonesia tidak eksplisit dalam KUHAP, melainkan didasarkan pada Pasal 184 dan 142 KUHAP (splitsing), didukung Yurisprudensi Mahkamah Agung Nomor 1986/K/Pid/1989 dan Surat Edaran Kejaksaan Agung Nomor B-69/E/02/1997. Ditemukan adanya disparitas putusan yang tidak sah (unwarranted disparity), di mana pemidanaan yang berbeda (5 bulan, 7 bulan, dan 5 bulan) dijatuhkan berdasarkan pertimbangan non-yuridis individualisasi pidana dan tingkat kooperatifitas pelaku. Untuk mengatasi konflik norma dan disparitas yang merusak legitimasi hukum, direkomendasikan agar Tim Penyusun KUHAP mencantumkan regulasi Saksi Mahkota secara eksplisit dan menerapkan pedoman penjatuhan putusan pidana (sentencing guidelines) yang terstruktur.

Abstract

This study aims to examine the impact of political corruption on citizens' capacity to participate in government, the efficacy of anti-corruption laws, and the role of the Corruption Eradication Commission in the fight against corruption and the strengthening of constitutional democracies in Indonesia.Examining applicable legal standards, legislation, rules, doctrine, and judicial decisions is part of the normative research strategy. This examination also included a literature review of relevant studies, articles, and government publications. The research found that corruption discourages citizens of Indonesia from becoming active in politics. The public has lost interest in politics and has become wary of the corrupt system as a result. When it comes to creating a transparent and honest political system, there are doubts about how successful anti-corruption laws and the Corruption Eradication Commission have been in eradicating political corruption.

Abstract

Penyediaan sayuran sehat dan bergizi dengan metode microgreen merupakan peluang yang dapat dimanfaatkan oleh kelompok PKK Desa Tanjung Sari dalam pemenuhan sayuran keluarga secara mandiri guna pencegahan stunting. Sayuran microgreen memiliki keunggulan dipanen lebih awal (7-21 hari setelah tanam), lebih bergizi 4-40 kali, lebih tinggi dibandingkan sayuran dewasa, variasi tanaman banyak warna yang menarik dan teknik budidaya yang mudah. Kegiatan pengabdian kepada masyarakat (PkM) bertujuan untuk : 1.Meningkatkan pengetahuan, keterampilan dan sikap (PKS) kelompok PKK Desa Tanjung Sari dalam budidaya tanaman dengan metode microgreen. 2. Memberdayakan kelompok PKK dalam swamedikasi sayuran microgreen untuk pembuatan jus dan smoothie sebagai minuman sehat bergizi pencegah stunting. Pelaksanaan kegiatan menggunakan metode training dengan pemberian materi manfaat microgreen, budidaya microgreen dan penyajian microgreen untuk dikonsumsi. Setelah peserta mendapatkan materi dilanjutkan dengan praktik secara individu dengan tim PKM. Peserta pelatihan adalah kelompok PKK Desa Tanjung Sari. Hasil evaluasi angket sebanyak 90% peserta pelatihan relatif puas dengan kegiatan pemberdayaan kelompok PKK Desa Tanjungsari, Deli Serdang dalam implementasi kreasi pangan berbasis microgreen menuju Desa Tanjungsari bebas stunting. Sebanyak 100% peserta mendapatkan pengetahuan berkaitan dengan stunting dan cara pencegahannya melalui konsumsi microgreen, 84% peserta telah memahami dan terampil dalam melakukan budidaya tanaman microgreen dan 100% peserta berniat melanjutkan kegiatan penanaman tanaman microgreen secara mandiri untuk pemenuhan sayuran sehat bergizi keluarga serta 88% peserta tahu dan dapat mengolah hasil panen microgreen menjadi makanan dan minuman sehat keluarga dan semua peserta (100%) meminta agar kegiatan ini berkelanjutan
