Abstract

The establishment of a minimum education requirement for candidates of the House of Representatives (DPR) has become a complex legal issue, sparking debates between the principles of meritocracy and the fulfillment of citizens’ constitutional rights. On one hand, educational qualifications are considered essential to ensure the intellectual capacity, rationality, and legislative competence of parliamentary members in performing their lawmaking and supervisory functions. On the other hand, such provisions may lead to discrimination against citizens who lack access to adequate formal education, thereby restricting their constitutional right to be elected as guaranteed under the 1945 Constitution of the Republic of Indonesia. This article aims to thoroughly examine the legal implications of establishing a minimum education requirement for DPR candidates from the perspective of the 1945 Constitution and the Constitutional Court’s jurisprudence. Using a normative juridical approach, this study analyzes the compatibility of educational restrictions with the principles of equality before the law, political rights, and constitutional democracy. The findings reveal that educational qualifications should not be perceived as discriminatory limitations but rather as instruments to ensure competence and integrity within the legislative body as part of a democratic rule-of-law system. Nevertheless, such restrictions must be formulated proportionally, clearly, and in accordance with constitutional objectives so as not to violate the principle of equality before the law or the fundamental right of citizens to participate in governance. Therefore, any regulation regarding educational requirements for DPR candidates must strike a balance between the need for legislative professionalism and the protection of citizens’ constitutional rights.

Abstract

Program gotong royong masyarakat melalui kegiatan bersih lingkungan dan penanaman lavender merupakan salah satu upaya pencegahan perkembangbiakan nyamuk. Kegiatan ini dilaksanakan di Desa Wadungasri, Kecamatan Waru, dengan melibatkan Kepala desa, perangkat desa, RT/RW, dan warga setempat. Program ini menggunakan pendekatan Asset-Based Community Development (ABCD), yaitu pendekatan yang menekankan pada pemanfaatan dan pengembangan aset sosial, individu, dan lingkungan yang dimiliki masyarakat. Pelaksanaan kegiatan dilakukan melalui beberapa tahap, meliputi persiapan alat, pembersihan lingkungan seperti mencabuti rumput, menyapu sampah, dan menghilangkan genangan air, serta penanaman tanaman lavender sebagai pengusir nyamuk alami. Hasil dari kegiatan ini menunjukkan adanya peningkatan kesadaran dan partisipasi masyarakat dalam menjaga kebersihan lingkungan serta terciptanya lingkungan yang bersih dan terjaga. Keterlibatan Kepala Desa berperan penting dalam mendorong partisipasi masyarakat dan mendukung untuk keberlanjutan sebuah program. Dengan demikian, program gotong royong ini dapat menjadi alternatif dalam upaya pencegahan perkembangbiakan nyamuk dan peningkatan kualitas lingkungan masyarakat agar tetap terjaga.

Abstract

Strengthening character education constitutes a strategic agenda in addressing the challenges of globalization and the declining sense of nationalism, particularly among the younger generation. This community engagement activity aims to revitalize the practice of tirakatan as a character education medium rooted in local wisdom. The tirakatan tradition is selected due to its spiritual, social, and national values, which are relevant in fostering historical awareness and strengthening national identity. The implementation method employs a participatory approach involving higher education institutions and local communities. The series of activities includes socialization, training of local facilitators, collective tirakatan practices, and reflective discussions on national values. Higher education institutions serve as facilitators and providers of academic perspectives, while the community acts as the custodian of the tradition as well as the primary partner in program implementation. The results indicate that tirakatan is effective as a contextual and meaningful space for character learning. The younger generation gains a deeper understanding of the nation's historical struggles and internalizes values such as mutual cooperation, solidarity, and religiosity. Collaboration between higher education institutions and the community also contributes to the preservation of local culture and the development of innovative non-formal character education models. This activity recommends further replication and development by involving multiple sectors, such as schools, youth communities, and local governments, in order to establish tirakatan as a collective movement in fostering national spirit.

Abstract

Marriage registration is an important aspect of the family law system in Indonesia as it relates to legal certainty, protection of women's and children's rights, and orderly population administration. However, in practice, there are still rural communities that conduct marriages without official registration. This phenomenon also occurs in Pasrepan Village, Pasrepan District, Pasuruan Regency. This study aims to examine the level of community understanding regarding the importance of marriage registration and to analyze how this practice is viewed from the perspectives of Islamic law and Indonesian positive law. The study was conducted from January to February 2025 using a qualitative approach through observation, interviews, and documentation involving members of the local community. The collected data were analyzed descriptively to illustrate the social conditions and legal awareness of the community regarding marriage registration. The results show that some community members still believe that a marriage that is valid according to religious norms is sufficient without official registration by the state. Limited understanding of the legal function of marriage registration, along with socio-cultural factors, contributes to the persistence of this practice. From the perspective of Islamic law, marriage registration can be understood as an effort to safeguard public welfare (maslahah) and to ensure legal protection for family members. Therefore, increasing legal education and public awareness is essential to encourage communities to register marriages in accordance with applicable legal regulations.
