Abstract

The development of science and technology, communication, transportation, and entering the era of global reform bring positive and negative effect to the world community, in community of developed country or developing country like Indonesia which has plural society that different language, etnic, customs, and religion which certainly brings the highest impact of social conflict in the intern or ekstern. Bali and the society that heterogeneousas from the territory of Indonesia can not avoid negative effect from global community, among them is social conflict in the name of ‘adat’. Reflection of philosophy ‘Tri Hita Karana’ as local wisdom in tackling social conflict in the name of ‘adat’ in the era of global reform, must be discussed, reviewed, analyzed through a scientific study can later be expected to become foundation in searching a right solution for the sake of solid NKRI that based on Pancasila ideology, UUD 1945 and Bhineka Tunggal Ika.

Abstract

This study focuses on the collaboration between the Transportation Agency and the Police in controlling unroadworthy vehicles in Gianyar Regency as an effort to improve traffic safety and order. The enforcement is carried out through coordinated mechanisms and in accordance with Law Number 22 of 2009 on Road Traffic and Transportation. The collaboration is implemented through public socialization, technical vehicle inspections, and joint operations, in which the Transportation Agency is responsible for technical vehicle aspects, while the Police conduct law enforcement against violations. The type of research used in this thesis is empirical legal research with a qualitative approach, conducted through field research by collecting primary and secondary data. The results show that the collaboration between the two institutions has been relatively effective; however, it still faces obstacles such as low public awareness, limited personnel and facilities, widespread Over Dimension Over Load (ODOL) violations, and the low deterrent effect of imposed sanctions

Abstract

Standard agreements in the banking world often create an imbalance in the position between banks and customers, thereby potentially ignoring the values of justice and humanity. This research aims to analyze the application of standard agreements in bank credit agreements from a Human Rights (HAM) perspective, a s well as offering a reconstruction of the ethics of standard agreements by integrating local Balinese wisdom values. The method used is a juridical-normative approach with a conceptual and reflective character. The results of the study show that standard agreement practices that are too rigid can lead to violations of hu man rights principles, especially the right to equality and justice in contracts. Balinese local wisdom value s such as Tri Hita Karana, Tat Twam Asi, Segilik- Seguluk, and Paras-Paros Sarpanaya can be the basis for reconstructing banking ethics that are humanist, inclusive, and socially just.
