Abstract

Tulisan dalam artikel ini membahas mengenai peranan pemerintah daerah terhadap pelaksanaan corporate social responsibility (CSR). Tujuannya untuk mengetahui bagaimana arah kebijakan dan pengaturan CSR di provinsi Lampung. Metode yang digunakan adalah kajian pustaka dengan menggunakan pendekatan yuridis. Berdasarkan Pasal 74 Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas mewajibkan setiap perusahaan untuk melaksanakan CSR. Peran pemerintah daerah Provinsi Lampung dalam pelaksanaan CSR yaitu dengan membentuk Peraturan Daerah Provinsi Lampung Nomor 16 Tahun 2012 tentang Tanggung Jawab Sosial Perusahaan dan Peraturan Gubernur Nomor 30 Tahun 2011 tentang Pedoman Pengelolaan CSR/PKBL. Peran pemerintah daerah dalam hal pelaksanaan CSR menurut Pergub No. 30 tahun 2011 yaitu, membentuk forum komunikasi dan tim fasilitasi. Kedua tim tersebut memiliki kewajiban mewadahi seluruh pihak yang terlibat pelaksanaan CSR, yaitu pemerintah, perusahaan dan masyarakat. Pergub No. 30/2011 juga mengatur pedoman mekanisme pengelolaan CSR dimulai dari; 1) perencanaan; 2) pelaksanaan; 3) pembinaan dan pendampingan; 4) pelaporan dan evaluasi. Berdasarkan hal tersebut secara khusus pemerintah kota Metro juga telah menerbitkan Peraturan Daerah Nomor 6 Tahun 2016 tentang Tanggung Jawab Sosial Perusahaan.

Abstract

The Creative Commons License is the breakthrough that non-profit organizations are making for the internet. Creative Commons has 4 (four) main conditions offered to creators for their copyrighted works, namely Attribution, Non-Comercial, No Derivatives, Share Alike. CCL is a response to the rapid development of internet technology. Various information that is accessed by the public through the internet, not a few of them are intellectual works that are protected by copyright. In the context of today's digital technology, it is very difficult to control activities such as copy-cut-paste (copying-cut-pasting), editing (editing), or sharing of documents (file sharing), which are contradictory to copyright law. So to overcome this, innovation and breakthroughs are needed that allow sharing and using creativity and knowledge without conflicting with legal provisions. The innovation is the Joint Creativity License. Through this license, a person is given the convenience to allow others to reproduce their copyrighted works, provided that their names are still listed. Creative commons is not an alternative to copyright law, but a partner to applicable copyright law.

Abstract

Hukum dan Masyarakat Desa: Pasca Berlakunya Undang-Undang Nomor 6 Tahun 2014 tentang Desa. Tulisan dalam artikel ini membahas mengenai arti penting hukum bagi masyarakat di desa.Tujuannya untuk mengetahui bagaimana perkembangan pembangunan hukum masyarakat desa pasca 5 tahun setelah berlakunya Undang-Undang Nomor 6 Tahun 2014 tentang Desa. Berdasarkan undang-undang tersebut mengatur pengakuan atas eksistensi desa melalui penerapan asas rekognisi dan subsidiaritas yang menjadi prinsip dasar pelaksanaan pembangunan, serta aturan mengenai dana desa yang menjadi perhatian besar terhadap desa saat ini.Namun sejak berlakunya undang-undangdesa dengan harapan dapat terwujudnya desa berdaya dan mandiri, dalam kenyataannya tidak sedikit desa yang masih dihadapi dengan beragam permasalahan yang timbul berkaitan dengan undang-undang tersebut.Dengan demikian penguatan kapasitas dan pengetahuan hukum masyarakat desa wajib diperlukan.Penguatan kapasitas dan pengetahuan hukum dapat melalui kegiatan sosialisasi hukum (law socialization) dan kesadaran hukum melalui pelatihan-pelatihan kepada masyarakat desa. Selain itu desa memiliki pendamping, peran pendamping tentunya juga harus diperhatikan, dalam konteks ini pendamping harus juga memiliki pengetahuan hukum yang memadai untuk melaksanakan tugasnya kepada desa.

Abstract

Berdasarkan UUPT Pasal 74 mewajibkan setiap perusahaan untuk melaksanakan CSR. Kebijakan CSR di PT. GGP adalah berperan aktif dalam upaya memberdayakan ekonomi, sosial dan lingkungan, terutama di wilayah sekitar operasional perusahaan. Upaya PT. GGP terhadap pemenuhan hak-hak pekerjanya adalah dengan membentuk Perjanjian Kerja Bersama (PKB) antara PT. GGP dan SPSI. PKB ini memuat tentang hak-hak normatif/dasar pekerja yang diatur oleh peraturan perundang-undangan. Selain itu PT. GGP juga memahami bahwa selain yang diatur PKB, perusahaan juga wajib memenuhi hak-hak tenaga kerja yang tidak diatur di PKB maupun peraturan perundang-undangan dengan tujuan mensejahterakan pekerjanya. Bentuk-bentuk CSR untuk pekerja di PT. GGP adalah program pendidikan dan bea siswa untuk anak pekerja, program fasilitas tempat tinggal untuk pekerja, program sosial di Balai Pengobatan, penghargaan masa kerja, rekreasi dan keakraban antar pekerja, program pelatihan dan keterampilan pekerja, program pensiun sehat.

Abstract

There are numerous sophisticated innovations emerge in this modern era. This leads to copyright works in the form of intellectual property rights (HKI). Intellectual property right protects the owner’s right of the property. Other parties may use the property to gain benefit only if the owner granted the license.  Based on the analysis of the discussion, license is a transfer of intellectual property rights as stated in the form of an agreement. The parties involved in the agreement are the licensor and the licensee. License is a form of right to take one or a series of actions, granted by those who have rights in the form of a license as stipulated in the agreement.  According to Law number 28 of 2014 concerning copyright, a license is a permit given by a copyright holder to other parties to announce and / or reproduce their work or related rights products with certain conditions.  In the form of a license transfer, the inventor of the property still has certain economic rights from his/her work which are transferred to the holder of intellectual property rights.

Abstract

Pembangunan insfrastuktur jalan, yang dibuat untuk meningkatkan kesejahteraan masyarakat dan memiliki fungsi untuk mempermudah jalur masyarakat untuk memberikan kemudahan transportas. Beradasarkan Pasal 1 ayat (6) Undang-Undang No. 23 Tahun 2014 yang berbunyi, “Otonomi Daerah adalah hak, wewenang, dan kewajiban daerah otonom untuk mengatur dan mengurus sistem Negara Kesatuan Republik Indonesia. Akan tetapi pada kenyataannya tugas dan kewajiban Dinas Pekerjaan Umum Kabupaten Lampung Utara yang memiliki tugas pokok dan kewenangan dalam merencanakan pembangunan dan pemeliharaan jalan terdapat dari fakta di lapangan masih ditemui banyaknya jalan di perkotaan dan poros desa yang masih rusak dan belum layak, sehingga kondisi jalan akan menjadi sulit untuk dilewati dan sangat membahayakan para pengendara yang melewati jalan dan tidak sedikit pula kasus kecelakaan terjadi akibat kerusakan di jalan raya, tetapi masyarakat tidak memiliki pilihan lain melainkan untuk menggunakan jalan tersebut. Penelitian ini menggunakan metode penelitian lapangan (field research) dengan penelitian ini bersifat diskriptif kualitatif dengan sumber data primer (diperoleh secara langsung dari lapangan) dan data sekunder. Berdasarkan hasil analisis, dapat disimpulkan bahwa pandangan hukum Islam dan masyarakat terhadap Peranan Dinas Pekerjaan Umum dan Tata Ruang Kabupaten Lampung Utara dalam Pembangunan Infrastruktur Jalan memberikan hal yang positif karena memberikan kemaslahatan bagi masyarakat setempat baik dari aspek perbaikan jalan maupun aspek sosial. Pembangunan infrastruktur yang dikatakan memberikan kemaslahatan apabila masyarakat merasakan dampak terhadap perbaikan jalan yang rusak dan untuk menggunakan akses jalan dalam melintasi tidak lagi berlubang dan menimbulkan kecelakaan bagi masyarakat.

Abstract

General elections serve as a democratic mechanism aimed to a lawful transition of power based on the constitution. The legal basis for general elections is found in Article 22E, while the election of the President and Vice President is governed by Article 6A of the 1945 Constitution of the Republic of Indonesia. There is no provision regarding the presidential threshold in the 1945 Constitution, as this regulation is an additional provision in Article 222 of Law Number 7 of 2017 concerning General Elections. The research methodology employs normative legal research with a juridical and conceptual approach by examining and studying relevant literature on the research topic. From a constitutional perspective, the presidential threshold provision lacks constitutional grounds. Constitutionally, every citizen has equal rights before the law and in governance. However, this limitation impacts an individual's right to be elected and to vote. From the democratic principle standpoint, political parties as representatives of the people will be restricted according to the regulations of the presidential threshold. This regulation, based on the previous general election results, eliminates the political rights of new or small parties to nominate candidates for President and Vice President.

Abstract

The position of migrant workers is often seen as a weak party. To some extent, such migrant workers are regarded as similar to slaves. In Indonesia, the government has to protect all citizens, including those abroad who have the status of migrant workers. Migrant Workers’ Protection Law 18/2017 was issued to protect citizens as migrant workers. However, several migrant workers remained legally unprotected abroad. This study used the normative approach that aimed to discuss the protection of Indonesian migrant workers from two-fold, juridical and fiqh siyasah dusturiyah perspectives. While the government protected migrant workers by issuing Law 18/2017, it has more specifically provided directions and objectives to protect migrant workers. This Law ensures human rights for migrant workers despite legal, economic, and social protection for them and their families. Then, the protection of migrant workers from fiqh siyasah dusturiyah should be under the four principles of the workforce in Islam: human independence, human dignity, justice, and the clarity of the contract and wage transaction. Abstract

The communication revolution is growing in the assumption that communication is a vital element in human life. The problem that emerges in the use of communication technology is the perception of the Indonesian people that the social, educational, and economic spheres of technology are regarded as tools that can solve the problems of this world of life easily without paying attention to the effects of these three areas. Industry implications in the field of communications technology are significant for social life, economic growth, and educational dynamics in Indonesia, but also have a threat of negative impacts that are difficult to avoid. The industrialization of the media is increasingly demonstrating how much society and all aspects connected with it, including social, economic, and educational aspects, are in need of information through mass media technology that is growing so rapidly in the age of globalization.

Abstract

The purpose of this study is to determine the goals of the green economy in achieving benefits through an Islamic economic perspective. The analysis states that this study uses a qualitative descriptive method using data collection techniques from secondary data, namely, studies of book libraries, journals, websites, newspapers, and magazines. The results of the study show that the concept of the green economy is compatible with Islamic economics. This is evidenced by several principles of a green economy that are in accordance with Islamic economics, including principles of Islamic social and business ethics, principles of protecting the environment and reducing social problems, principles of sustainable development, and policies that include the preservation of religion, preservation of soul, preservation of mind, preservation of mind, and maintenance of a property.
