Abstract

Kegiatan pengabdian kepada masyarakat yang bertujuan untuk meningkatkan pemahaman anak mengenai kenakalan remaja serta sistem peradilan pidana anak. Kegiatan dilaksanakan di SMPN 4 Martapura dengan melibatkan siswa-siswi kelas 8 sebagai responden utama. Metode yang digunakan dalam kegiatan ini meliputi penyuluhan, diskusi, dan sesi tanya jawab. Materi penyuluhan mencakup pemahaman tentang kenakalan remaja, dampak negatifnya bagi individu dan masyarakat, serta proses peradilan pidana anak. Diskusi dilakukan untuk memfasilitasi siswa dalam berbagi pendapat dan pengalaman terkait topik yang dibahas. Bahwa sebagian besar siswa memiliki pemahaman yang terbatas tentang konsep kenakalan remaja dan proses hukum yang terkait. Banyak dari mereka mengalami kesulitan dalam memahami implikasi dari tindakan kenakalan remaja serta hak dan kewajiban dalam sistem peradilan pidana anak.

Abstract

South Kalimantan has two hospitals based on sharia principles, namely RSUD Kandangan and Sultan Agung Islamic Hospital Banjarbaru which DSN-MUI has also recognized with a sharia certificate. The background of this research analyzes Sharia Compliance with DSN-MUI Fatwa No.107/DSN-MUI/X/2016 concerning Guidelines for the Implementation of Hospitals Based on Sharia Principles with the focus of Case Studies at RSUD Kandangan and Sultan Agung Islamic Hospital Banjarbaru. This study aims to examine the practice of organizing hospitals based on Sharia principles at RSUD Kandangan and Sultan Agung Banjarbaru Islamic Hospital. The suitability of hospital organization practices based on sharia principles at RSUD Kandangan and Sultan Agung Banjarbaru Islamic Hospital with DSN-MUI Fatwa No.107/DSN-MUI/X/2016. This research methodology uses descriptive qualitative research, with data sources derived from observation, interviews, and documentation. The research objects in this study are RSUD Kandangan and Sultan Agung Islamic Hospital Banjarbaru. The results of the study indicate that the practice of organizing hospitals based on Sharia principles in the two hospitals has been fully implemented even though it is still less than optimal in terms of ikhtilat and providing Islamic educational materials. The suitability of the practice of organizing hospitals based on Sharia principles at RSUD Kandangan and Sultan Agung Islamic Hospital Banjarbaru with DSN-MUI Fatwa No.107/DSN-MUI/X/2016 has also been in accordance as a whole so that the sharia certificate given by DSN-MUI is indeed appropriate to be given to the two hospitals.

Abstract

Penelitian ini didasari oleh permasalahan perbedaan pendapat oleh kalangan ulama kontemporer hingga pakar ekonomi syariah terkait hukum transaksi jual beli emas secara tidak tunai di masyarakat, termasuk putusan fatwa DSN MUI yang mana bertentangan dengan pendapat mayoritas. Penelitian ini menggunakan metode kualitatif deskriptif, dengan teknik pengambilan sampel snowball sampling. Hasil penelitian menunjukkan, pertama DSN MUI dalam menetapkan Fatwa No. 77/DSN-MUI/V/2010 menggunakan konsep ‘urf, dan maslahah mursalah, berdasarkan telah hilangnya kebiasaan masyarakat dalam menjadikan emas sebagai uang resmi, serta bahwa transaksi ini mengandung maslahat untuk mempermudah masyarakat dalam hal kepemilikan emas. Kedua, dari pandangan ekonom syariah terkait hukum transaksi jual beli emas secara tidak tunai dapat dibagi menjadi tiga, yaitu: 1) mutlak boleh, berdasarkan Fatwa DSN MUI, 2) boleh dengan syarat, dibagi dua: a) boleh tidak tunai dari segi pembayaran dan penyerahan barang dengan syarat emas diketahui jelas 4 kriteria, b) boleh tidak tunai dari segi penyerahan saja dengan syarat dapat diserah terimakan secara langsung atau diwakilkan, dan 3) mutlak haram, berdasarkan jelas dan tegasnya hadits yang melarang.

Abstract

The purpose of this study is to find out what is the rationale for the existence of a criminal prosecution and to examine future arrangements for a shorter Daluwarsa period than criminal penalties. This research is normative legal research by examining laws related to the legal issues under study and by moving from the views and doctrines that have developed in the science of law related to the problems in this research. According to the results of this study, it shows that: First, the rationale for the existence of a Daluwarsa on criminal prosecution which underlies the legislators to make a policy in this field is none other than legal certainty. This legal certainty is for the sake of creating legal order, namely legal order in the settlement of a criminal case that does not find a bright spot for a long time so that the case does not have a clear direction in its resolution. Second, the current criminal prosecution Daluwarsa policy in several of its provisions in determining Daluwarsa does not pay attention to factors that can support the functioning and operation of criminal law. In several provisions regarding the expiration date for criminal prosecution in several criminal offenses, the Daluwarsa date is shorter than the criminal penalty. The expiry period for criminal prosecution which is shorter than the criminal threat can result in motivating the perpetrators of criminal acts to run away/run away or disappear to avoid legal proceedings against avoiding criminal responsibility.

Abstract

This study aims to analyze Article 22 of Law on Zakat Management Number 23 of 2011, in which zakat paid to agencies/institutions authorized by the government can be deducted from taxable income in the city of Banjarmasin. The research method used is the sociology of law (socio-legal research) using an interdisciplinary approach between normative research aspects and a sociological approach that uses qualitative analysis. The result of the research is that in the practice of zakat as a deduction from taxable income, of course, zakat must be paid to an official body or institution that the government has approved. On this basis, the payment of zakat made by the taxpayer must be made to the agency or institution. Effectiveness of Article 22 of Law on Zakat Management Number 23 of 2011 concerning Zakat Management, there are several factors that do not affect and there are also several factors that do. There are 3 factors that do not affect the effectiveness of the regulation, namely the rule of law factor, the law enforcement factor, and the facility or facility factor. While the factors that affect the effectiveness of these regulations are community factors and cultural factors.

Abstract

The growth of the sharia insurance industry in Indonesia has given rise to new legal challenges, particularly in the development of dispute resolution mechanisms that are consistent with both sharia principles and national legislation. Alternative Dispute Resolution methods, such as mediation and arbitration, are considered more appropriate than litigation due to the unique nature of contracts and legal relationships in Sharia insurance. This study aims to evaluate the effectiveness of dispute resolution in the practice of sharia insurance in Indonesia and to assess the extent to which the existing legal framework ensures justice, legal certainty, and compliance with Islamic legal principles. This research employs a normative juridical method, using both the statute approach and the conceptual approach, to examine the relevant positive laws and Islamic legal doctrines governing dispute resolution in Sharia-based financial transactions. The findings reveal that strengthening the Alternative Dispute Resolution mechanism in sharia insurance disputes not only enhances access to justice and legal certainty but also directly contributes to the achievement of Sustainable Development Goal 16, which promotes peace, justice, and strong institutions. This study underscores the importance of harmonizing national law and Sharia norms in building a dispute resolution system that is fair, effective, and sustainable
