Abstract

Dispute resolution procedures from lawsuits and applications filed at the State Administrative Court based on negative fictitious administrative orders or positive fictitious administrative orders. The adoption of the positive fictitious principle in various legislative policies of member states has finally brought positive results in facilitating the process of obtaining licenses and issuing decisions / other actions submitted by citizens to administrative organs. The essence of the Positive Fictitious Principle is that 'silence means agreement' and aims for legal certainty. The requirements of the application must have been received in full and are associated with legal principles that are affected to be the reason for not needing the involvement of the judiciary. On the other hand, the court is needed to provide legal protection for third parties who feel aggrieved by the issuance of decisions born from the positive fictitious process.

Abstract

Bali is onel of thel world-class tourist attractions in Indonelsia. Thel nicknamel Bali as thel island of thel gods shows Bali as a relligious island. Thel objelctivels of this relselarch includel thel delvellopmelnt of relligious tourism elducation baseld on Balinelsel customs and Islam and elducation on thel concelpt of relligious tourism baseld on tourist arelas baseld on "biorelgionalism". Abstract

The concept of legal responsibility is related to legal obligations, which means that a person is legally responsible for their actions and can be subject to sanctions if their actions conflict with their obligations. The term governmental liability is a form of accountability resulting from government actions that violate the law. One of the things that the government must be held accountable for is the failure to protect the personal data of Indonesian citizens in the incident where the National Data Center was breached due to a weak national defense system. This research discusses legal sanctions that can be applied to the government and the implications of these sanctions in the world of law in Indonesia. The methodology that researchers use is a normative legal research methodology with a statutory and regulatory approach, where the results are presented using analytical descriptive techniques. The aim of this research is to find new legal facts in the field of data protection. It can be concluded that the sanctions imposed within the scope of government office responsibilities for failure to protect personal data are in the form of administrative sanctions or civil sanctions, while from the perspective of personal responsibility they can be in the form of administrative sanctions or civil or criminal sanctions. The existence of legal sanctions for protecting personal data (UU PDP, UU ITE) has created a definite legal atmosphere, but these regulations have not been effective in preventing the onslaught of various types of multi-diverse risks in the cyber world

Abstract

The debt and receivable agreement entered into by business actors and consumers at UD Bhuana Rahayu is a money lending and borrowing agreement. The contents of the agreement must be implemented by the parties, especially consumers, by returning the debt in accordance with Article 1754 of the Civil Code. Apart from that, this is done to fulfill consumer obligations and the rights of business actors. However, in reality there are consumers who do not pay their debts (default) which results in losses for business actors. So the procedures and mechanisms for resolving defaults are being questioned, as well as how legal protection can be provided to business actors. Through empirical legal research methodology, the answer was obtained that business actors use verbal/unwritten agreements in debt and receivable agreements. The solution can only be resolved through mediation. Therefore, the legal protection that can be provided is repressive legal protection through statutory regulations that have been regulated to prevent, and preventive legal protection through resolving litigation, namely district court lawsuits.

Abstract

This study was carried out at Asri Jewellery engaged in a craft of bone carving, located at Br. Mantring, Tampaksiring Village, Bali. The training, mentoring, and evaluation methods for the sustainability of service activities. The results were the installation of wifi and neon boxes, website creation, product catalogs and brochures, business cards and business stamps, and online promotion assistance and through social media and marketplaces. The activities that have been carried out have provided the benefit of increasing a wider market share which resulted in the income maintained during the COVID-19 pandemic.

Abstract

Asri art bone waste carving is one of the carving cow and buffalo bone waste which is an icon of Tampaksiring Village. Some problems faced by Asri are not having a place to store raw materials, the quantity of production is still relatively low, and product quality control is still lacking. To overcome these problems, the solutions provided are making raw material storage, providing production equipment, as well as making and assisting in the implementation of Standard Operating Procedures for production. The results of this activity are the quality of Asri's raw materials to be better maintained, the quantity of Asri's production has increased, and the quality of the products produced can be controlled.

Abstract

This study aims to determine strategies for increasing Asri Jewelry production capacity by continuing to apply health protocols during the Covid-19 pandemic. They are socialization, procurement of hand sanitizers, simple handwashing stations, masks, hand gloves, building materials, assistance in repairs, and expansion as well as arrangement of production sites. The study finds that increased workers' awareness of using masks, and hand gloves, a more comfortable workplace, and more structured flow of production activities. This implies that workers' health and safety are fully guaranteed. The improvements of the production site provide workers the comfortability bringing an increase of the total production capacity of Asri Jewelry.

Abstract

This study focused on the role of Sad Kertih, a policy concept based on Balinese local wisdom, from the perspective of environmental control. Bali, with its rich culture and traditions, has developed various environmental management practices rooted in local values, one of which is through the Sad Kertih system. This system combines social, cultural, and ecological aspects to maintain environmental sustainability and the sustainability of Balinese people's lives. The purpose of this study is to explore how Sad Kertih can contribute to environmental control and preservation, both locally and globally. With a local wisdom approach, this system not only prioritizes respect for nature but also empowers communities to play an active role in sustainable natural resource management. This study uses a normative legal research method, that is a research examining legal norms prescriptively. The finding of the study indicated that Sad Kertih has a potential to increase environmental awareness among Balinese people and can provide more adaptive solutions to climate change and increasing environmental damage. In conclusion, the application of Balinese local wisdom values ​​through Sad Kertih is very relevant in strengthening environmental control in the modern era, by paying attention to aspects of sustainability and ecosystem balance. Abstract

This article critically analyzes the implications of licensing simplification which has the impact of making business licensing easier. This raises the crucial question of whether the licensing simplification model has an impact on the industrialization of business licensing and the effect on the degradation of environmental wisdom? This research uses the methodQualitative research with data collected and analysis is more qualitative in nature. Qualitative analysis is used by adopting an investment model as a form of implementing business permits in environmental protection in France and Japan with the composition of France being a country without environmental wisdom and Japan having very strong environmental wisdom values. As a result, these two countries implemented a green investment model which emphasizes that economic growth must also pay attention to environmental protection. The environment is also positioned as a legal subject with the same rights as other legal subjects. The government has an important role in forming regulations that lead to a green economy so that every business activity places green investment as the foundation for implementing business activities.

Abstract

The leadership of Balinese customary village is highly patriarchal so the position of the women in the leadership system is merely a subordinate of the man. It is an issue since the leadership development of the modern era does not discriminate against gender. This discrimination leads this study to formulate a new concept concerning leadership in customary villages based on gender equality. This study used the social-legal method. An interdisciplinary study is a hybrid of a grand study concerning the jurisprudence and science of law from a societal perspective. This study formulated a customary village leadership based ongender equality. This formulation was formed by implementing functions of the customary village comprehensively in form of the Woman Association (Pakis) as a new organization which empowers Balinese women. Pakis should make programs to empower and develop leadership for Balinese women, especially in the customary village leadership. Besides that, the nyentana marriage system that transforms the role of purusa (man) to be predana (woman) must be implemented comprehensively in Banjar so the woman who conducts this marriage system takes the position as a man and her name is listed in Banjar. The final formulation is by duplicating the leadership pattern in sekeha teruna teruni which has concerned with gender equality.
