Abstract

Perkembangan Hisab-Rukyah tidak banyak diungkap secara akademis karena memang Ilmu Falak saat ini tidak mendapatkan tempatnya di tengah masyarakat. Perkembangan Hisab Rukyah ini tentu mesti diungkap kembali untuk menunjukkan bahwa keilmuan ini pernah mendapatkan tempat yang istimewa di tengah perjalanan sejarah Islam. Perkembangan  hisab  rukyah  masa  Rasulullah  SAW  masih  berada dalam tataran pelaksanaan ibadah dan masih bersifat sederhana. Pada masa sahabat, perkembangan hisab rukyah juga tidakjauh berbeda, namun di masa Khalifah `Umar Ibn Khattab berhasil dirumuskan sistem penanggalan Islam. Pada Masa tabi`in perkembangan hisab dan rukyah mencapai puncak kemajuannya pada masa kekuasaan bani Abbasiah, khususnya kekhalifahan al-Makmun. Hal ini ditandai dengan munculnya tokoh-tokoh penting beserta karya-karyanya yang kemudian mempengaruhi perkembangan hisab rukyah sesudahnya bahkan sampai sekarang. Pada masa pertengahan, hisab rukyah sempat mengalami kemunduran diakibatan kekacauan dunia Islam ketika itu, karya-karya di bidang ilmu Falak dimusnahkan dalam penyerangan yang dilakukan oleh bangsa Mongol, namun setelah itu hisab rukyah dapat kembali bangkit sampai pada masa modern yang kita alami sekarang.

Abstract

The scholars of the Madzhab permit funeral prayers to be performed above the grave, but they differ in opinion regarding the time limit of its permissibility. The Shafi'i Madzhab does not specify a time limit for how long after death a funeral prayer can be performed at the grave, unlike the Hambali school, which sets a limit of only one month. This research is qualitative and falls under the category of library research, utilizing a comparative approach. The Shafi'i Madzhab holds the view that there is no time limit for performing the funeral prayer above the grave because the prayer here refers to supplication, which is permissible at any time. This stance is correct as there is no evidence indicating any time restrictions. The Hambali Madzhab contends that the time limit for performing the funeral prayer above the grave is a maximum of one month because many Hadith narrations mention that the Prophet Muhammad (peace be upon him) performed the funeral prayer for Ummu Sa'ad bin Ubadah after she had been buried for a month, and at that time, the body was still considered intact. The most relevant opinion is that of the Shafi'i scholars because there is indeed no evidence restricting the funeral prayer above the grave.

Abstract

Unregistered marriages remain challenging in implementing Islamic family law in Indonesia and Malaysia. This article aims to comparatively analyze sanction systems and legal compliance levels in marriage registration in Indonesia and Malaysia based on Islamic family law perspectives, identify factors influencing the effectiveness of legal sanctions, and integrate the maqāṣid al-sharī'ah approach with legal compliance theory to provide a new theoretical framework for understanding marriage registration. Using a juridical-normative approach with comparative methodology, this article analyzes Law Number 16 of 2019 in Indonesia and Act 303 Islamic Family Law (Federal Territories) 1984 in Malaysia. The article concludes that there is a correlation between sanction amounts and public compliance levels, where stricter sanctions in Malaysia (fines of RM1,000 and imprisonment of up to six months) prove more effective than nominal sanctions in Indonesia (Rp7,500). Significant differences are also identified in law enforcement mechanisms and the accessibility of marriage registration systems. The maqāṣid al-sharī'ah approach to marriage registration, which emphasizes the protection of fundamental values in Islam, proves capable of bridging the gap between traditional Islamic law and modern administrative needs. This article implies the importance of reformulating marriage registration policies in Indonesia, including restructuring sanctions and strengthening technology-based registration systems.
