Abstract

The initiative to include 'uqubat ta'zir whips as a punishment for those who commit animal killing, as stated in Qanun Aceh Number 11 of 2019 concerning Wildlife Management, has been rejected due to its reference to Law Number 5 of 1990 concerning Natural Resources Conservation. This initiative holds significance in terms of the conceptual understanding and application of caning as a criminal sanction in Indonesia. Through doctrinal methods, this study has determined that caning for perpetrators of animal killing falls under 'uqubat ta'zir, where the form, type, and severity of punishment are determined by the ruler based on philosophical, juridical, and sociological considerations. The implementation of caning for those who commit animal killing is deemed appropriate, as the regulations in Indonesia are founded upon values deeply rooted in the community. Therefore, it is fitting to carry out this punishment, similar to other offenses regulated in the Aceh Qanun Jinayat.

Abstract

Tanah Pusako Tinggi di dalam Adat Minangkabau merupakan bagian dari harta pusako tinggi yang diwarisi secara turun temurun dari Niniak kepada Mamak dan dari Mamak kepada Kamanakan. Pembagian tanah pusako tinggi dikenal dengan istilah Ganggam Bauntuak yang berarti diturunkan berdasarkan pertalian darah seketurunan ibu dan dikuasai dengan hak kolektif bersama dalam suatu kaum. Penguasaan dan pengelolaan tanah pusako tinggi beresiko menimbulkan sengketa yang terjadi di dalam ataupun diluar kaum. Berkaitan dengan ini, Kerapatan Adat Nagari berperan sebagai lembaga peradilan adat untuk menyelesaikan berbagai persengketaan yang diajukan oleh masyarakat nagari melalui jalan musyawarah untuk mencapai mufakat perdamaian. Penelitian ini mengkaji bagaimana mekanisme penyelesaian sengketa harato pusako tinggi oleh lembaga Kerapatan Adat Nagari Limau Purut dan bagaimana tinjauan Fiqh Siyasah Dusturiyah terhadap putusan dari Kerapatan Adat Nagari Limau Purut dalam menyelesaikan sengketa harato pusako tinggi. Metode penelitian yang digunakan adalah Yuridis Sosiologis dengan jenis Kualitatif. Berdasarkan hasil penelitian diambil kesimpulan bahwa penyebab terjadinya sengketa tanah pusako tinggi antara pihak A Cs sebagai penggugat dengan pihak BH Cs sebagai tergugat adalah karena adanya pengajuan permohonan untuk pengeluaran surat kepemilikan tanah atas nama BH Cs kepada KAN Limau Purut diatas tanah yang sudah dihibahkan oleh leluhur dari pihak penggugat A Cs. Pihak A Cs merasa hibah tersebut tidak sah karena tidak adanya pembuktian yang kuat menurut kesaksian kaumnya, sementara itu pihat tergugat A Cs melampirkan bukti surat tebus gadai dan hibah sebagai pembelaan diri. Mekanisme penyelesaian sengketa ini dilaksanakan sesuai dengan ketentuan adat bajanjang naiak batanggo turun dengan upaya putusan perdamaian berdasarkan adaik basandi syara’, syara’ basandi kitabullah yang mengacu pada konsep Islam fiqh siyasah dusturiyah dalam pengambilan putusan berpedoman dengan kaidah-kaidah Siyasah Dusturiyah yakni merundingkan, mengaktualisasikan, dan memberlakukan putusan.

Abstract

This study discusses the issue of work specifications and wage provisions which are analyzed using the concept of ijārah al-'amāl. In practice, there is still a discrepancy between the work specifications imposed on workers and wages that are not in accordance with the level of risk and responsibility of workers in early childhood school (Pendidikan Anak Usia Dini [PAUD]). This causes workers' welfare to be neglected and has implications for the quality of services provided. This study is a type of juridical-empirical research using primary and secondary data, primary data obtained through interview techniques and secondary data obtained through reviewing library materials. The data collected was analyzed in qualitative descriptive form which was arranged systematically. The results of the research show that work specifications regarding labor wages at PAUD IT Mahkota Insani, PAUD Kasih Ibu and PAUD RA An Nur are fixed through calculating working days and hours for 6 days a week and working hours of 8 hours per day. Viewed according to the theory of ijārah al-'amāl, even though the terms and conditions of the contract have been fulfilled, there are problems in determining wages that do not fairly consider the level of risk and responsibility of workers in PAUD. To achieve justice and worker welfare in line with maqāṣid al-sharī'ah, it is necessary to make wage adjustments that take into account the number of children handled, the level of risk, and the responsibilities of each worker. In this way, the wages received reflect more justice and provide adequate welfare for workers.

Abstract

The political conflict in Myanmar has resulted in a massive exodus of the Rohingya ethnic group from their country. The acceptance of Rohingya refugees in Aceh has sparked a societal dialectic due to the increasing number of refugees. The study focused on Islamic jurisprudence and local wisdom according to influential figures in Aceh in the protection of Rohingya immigrants. The empirical legal research method was deemed appropriate to analyze the conflict between the application of Islamic law in Aceh and the rejection of Rohingya refugees. The Islamic legal approach and local wisdom were important to analyze the context of Aceh's society, which is religious and highly values its customs. This study reveals that the handling of Rohingya refugees in Aceh, according to the views of ulama, academics, political leaders, and UNHCR Indonesia representatives, emphasizes Islamic values, Acehnese local traditions, and government policies. Ulama stresses the moral and religious obligation to assist refugees, following the Teurimong Jame tradition. Political leaders highlight the importance of government regulation to prevent negative social impacts, while UNHCR emphasizes the application of international refugee protection principles. Collaboration between society, the government, and International organizations is key to a humanitarian and structured approach to addressing the issue.

Abstract

This study aims to discuss the Mappammaq Mangaji tradition in Mandar, West Sulawesi in relation to al-Quran-based child rearing patterns from an Islamic legal anthropological perspective. Mappatammaq mangaji is a tradition carried out by the community when someone is able to read the Koran fluently. This study is an empirical legal study with an anthropological approach to Islamic law as an analytical tool. Data was collected based on in-depth interviews and literature studies. This study concludes that the mappatamaq mangaji tradition carried out by the Mandar community in West Sulawesi is an acculturation of Islamic teachings and cultural values. Mappatammaq mangaji, including sayyeang pattuqduq (dancing horse), kalindaqdaq(Mandar poetry) and mabbaranji. When viewed from a legal anthropology perspective, the mappammaq mangaji tradition in Mandar society is an integration and acculturation between Islamic law and local traditions. This local tradition has become a living law and continues to be practiced in the culture of the Mandar people. So it can be said that if Islamic law is practiced in society and has become a culture, it will continue to survive today and in the future, because Islamic law has a cultural space. If it is related to the objectives of Islamic law, especially benefit, then this provides benefits, especially in the context of child rearing patterns based on the Qur’an, so that children receive care and education from parents and families based on the values of the Qur’an.

Abstract

The coexistence of Islamic law, customary law, and the national legal system within empirical societies remains an ongoing phenomenon. The consequences of such legal pluralism have implications for the protection of women and children. This study aims to examine the dynamics of legal relationships, the determination of diverse laws among the people of Aceh and West Nusa Tenggara, and the factors influencing the contestation of legal choices that impact legal favoritism towards women and children. This study employed a juridical empirical legal research method with a legal pluralism approach. Data were obtained by means of in-depth interview and document study. The interviews were conducted with customary leaders, religious leaders, and academics, whilst document analysis included journal articles, laws, and relevant books. The study took place in two locations: Aceh and West Nusa Tenggara Provinces. The findings of the study reveal that the dynamics of the relationship between customary law, religious law, and state law run concurrently in the context of the application of family law and criminal law. Some members of the community follow customary law and religious law, while others follow state law. The determination of law among the people of Aceh and Lombok is based on the legal consciousness of the community concerned. The choice of law in societal reality has an impact on favoritism towards women and children. The choice of state law tends to guarantee legal certainty and can provide legal protection for women and children. Conversely, the choice of religious law and customary law may sometimes be detrimental to women and children.

Abstract

This article aims to examine the application of ta’zīr punishment as a reinforcement of education in Islamic law. Humans are mulattoes or social beings who are related to one another, they cannot be separated from interactions with others. In order for this relationship to be in the corridor and frame of justice, Allah sent down rules in the form of orders and prohibitions. This study is a normative legal study using ushul fiqh theory and maslāhah theory. This study concludes that all commands and prohibitions contained in Islamic law are based on the Qur'an and the commands and prohibitions of the Prophet. which is formulated in fiqh, it will be seen that everything has a specific purpose, namely the benefit of mankind. If there is a violation of these rules, a penalty will be imposed, whether the punishment is in the form of ḥadd, qiṣaṣ or ta’zīr punishment. In addition to ḥadd, qiṣaṣ, kaffārah punishments, ta’zīr punishments are seen as punishments/sanctions that contain educational values because they aim to create a deterrent effect on the perpetrators and become a lesson for others not to commit similar violations. Therefore, this study argues that the imposition of punishment in Islamic law including ta’zīr contains beneficial values that educate humans and has a deterrent effect for perpetrators and for others.

Abstract

This article aims to analyze various legal traditions working within the implementation of Islamic law after special autonomy in Aceh. Although Aceh's legal system follows the national legal system derived from civil law, diverse legal traditions still exist. The scope of this study is limited to the interaction of Aceh's legal traditions by taking the construction of juvenile and immoral criminal law and describing the social authorities who also operate the legal tradition to the parties in the case. This study presents the results using a case study model. Data obtained from interviews and documentation, analyzed using an interlegality approach. Based on the results of data analysis, it was found that the dialectic of legal traditions is determined by the role of actors acting as companions for victims to ensure that the rights of victims are not neglected. The traditions of Islamic law, customary law, and laws for protecting women and children are used interchangeably. The effort to combine these three legal traditions was carried out to obtain justice and guarantee the fulfillment of the victim's civil rights, such as the right to continue education, to relieve the trauma caused by the psychological pressure. The amalgamation of legal traditions in Aceh is an effective way to achieve justice for women and children and the construction of new laws to develop a national legal system that favors the interests of victims.

Abstract

As a special province in Indonesia with the jurisdiction to enforce Islamic law, Aceh has enacted Jinayat Qanun to regulate criminal actions. However, incidents of sexual offenses in cyberspace remain unregulated. This article seeks to elucidate the necessity for amendments to the Jinayat Qanun, particularly for instances of sexual offenses in cyberspace. It employs empirical research methodologies assessed via a legislative framework utilizing system theory. Data was gathered through meticulous literature review and extensive interviews. This study reveals that online prostitution has emerged as a global concern, reflecting the adverse effects of contemporary advancements. In Aceh, the currently enacted Jinayat Qanun is perceived as necessitating ammandments. These modifications are tailored to the evolving conditions of society. According to system theory, Jinayat Qanun substantially addresses the issue of online prostitution implicitly. However, obstacles persist within the legal framework and cultural context. Indonesia's legal structure and cultural dynamics, particularly in Aceh, pose significant challenges, underscoring the need for collaboration among various stakeholders, including judges, prosecutors, law enforcement, ulama, and community leaders.

Abstract

Recompense for victims of rape is governed by Article 51 of the Aceh Jinayat Law, which underscores the victim's entitlement to request recompense. In reality, judges do not impose restitution punishments on all rape cases, as the victims of rape do not submit a restitution request. This results from a deficiency in comprehension concerning the procedure for seeking recompense for the victim's incurred losses. This study examines the provision of recompense for rape victims through the lens of Islamic criminal law, specifically concerning the nature and status of reparation. This paper is a normative legal analysis. Data acquisition was performed via library research. The research findings indicate that the restitution mechanism within the Qanun Jinayat is inadequately detailed, resulting in numerous rape victims being unable to seek restitution. Consequently, judges cannot impose restitution penalties without such requests from the victims. In Islamic criminal law, reparation holds an equivalent status to diyat. The method for restitution in Islam does not necessitate a request; instead, the judge explicitly determines that the culprit is obligated to pay diyat to the victim of rape for their crimes. Consequently, the government should establish an institution to provide restitution to rape victims if the perpetrator is unable to pay restitution, as the provision of restitution is contingent upon the financial capability of the perpetrator. Furthermore, standards should be established to determine the minimum reparation that the offender must provide to the rape victim, ensuring that the restitution aligns with the losses incurred by the victim.
