Abstract

The rapid adoption of Artificial Intelligence (AI) in Islamic banking has transformed financing assessment, risk management, fraud detection, and customer service systems. While AI offers significant benefits in improving operational efficiency and decision-making accuracy, it also raises concerns regarding transparency, accountability, and legal responsibility in algorithm-based decisions. This study aims to analyze the concept of algorithmic gharar  in Islamic banking and reconstruct a framework for algorithmic transparency and accountability based on Maqāṣid al-Sharī‘ah. This study employs normative legal research using a library research method by examining statutory regulations, DSN-MUI fatwas, scholarly literature, and contemporary studies on AI Governance, Islamic finance, and Islamic legal theory. The legal materials were analyzed qualitatively through statute, conceptual, and maqāṣid al-Sharī‘ah approaches to construct a normative framework for algorithmic transparency and accountability in Islamic banking. The findings reveal that algorithmic opacity in AI-based decision-making may generate a new form of uncertainty referred to as algorithmic gharar , characterized by the inability of affected parties to understand, verify, or challenge algorithmic decisions. From the perspective of Maqāṣid al-Sharī‘ah, algorithmic transparency and accountability are essential to safeguard wealth (ḥifẓ al-māl), intellect (ḥifẓ al-’aql), human dignity, and social justice. This study proposes a Sharia-based AI Governance framework consisting of algorithmic transparency, human accountability, Sharia algorithm auditing, data and privacy protection, and algorithmic justice. The study contributes to the development of Islamic economic law by introducing the concept of algorithmic gharar  as a contemporary legal construct and providing a normative framework for ethical AI Governance in Islamic banking.

Abstract

The development of Islamic financial services and digital financial technology provides significant opportunities to strengthen financial inclusion and improve the competitiveness of halal Micro, Small, and Medium Enterprises (MSMEs). However, limited financial knowledge and restricted access to appropriate financial services remain major challenges faced by many halal MSMEs. This study aims to analyze the influence of Sharia Financial Literacy and Sharia Fintech Adoption on Financial Inclusion and Business Performance of Halal MSMEs in Banten Province. This research employs a quantitative explanatory approach using a cross-sectional survey method. Data were collected from 155 halal MSME actors in Banten Province using a structured questionnaire measured with a five-point Likert scale. The data were analyzed using Partial Least Squares Structural Equation Modeling (PLS-SEM) with SmartPLS 3. The results indicate that Sharia Financial Literacy has a positive and significant effect on Financial Inclusion, while Sharia Fintech Adoption also positively influences Financial Inclusion. Furthermore, Sharia Financial Literacy, Sharia Fintech Adoption, and Financial Inclusion, significantly contribute to improving MSME Business Performance. The mediation analysis confirms that Financial Inclusion partially mediates the relationship between Sharia Financial Literacy and Business Performance, as well as between Sharia Fintech Adoption and Business Performance. These findings highlight that strengthening Islamic financial knowledge and accelerating the adoption of Sharia-based digital financial services are essential strategies for improving financial accessibility and sustainable growth of halal MSMEs. The study provides practical implications for policymakers, Islamic financial institutions, and fintech providers in developing inclusive financial ecosystems that support halal MSME development.

Abstract

This study investigates how financial performance and third party funds (DPK) affect financing disbursement at Sharia People's Economic Banks (BPRS) in Central Java Province from 2016 to 2025. By applying quantitative methods, using secondary data from BPRS financial reports published by the Financial Services Authority (OJK). A purposive sampling approach was used to select all BPRS in Central Java Province for the study population, which includes 25 BPRS. Stata 17 research software was used to perform data processing with panel data regression techniques. The Random Effect Model (REM) was the best estimation model, according to the results of model selection that included the Lagrange multiplier, Chow test, and Hausman. With a determination coefficient of 90.42%, NPF, ROA, and DPK had a significant influence on financing disbursement, while 9.58% was influenced by other variables outside the model. Conversely, NPF and ROA partially did not have a significant influence, while DPK had a significant influence on financing disbursement in the partial test.
