Abstract

Capital market plays an essential role in economic activity, particularly in the allocation of public money which is can’t be separated from the role of investor and issuer as well as the implementation of capital market, stipulated in the Capital Market Law No. 8 Year 1995. The transaction mechanism between the investor and the issuer themselves known as the Initial Public Offering (IPO) which furtherly understood as the process of selling securities from the issuers to investors. Hence, in the running of capital market itself there were found such a violation in the principle of full disclosure, also, the market manipulation that obviously undertook in the IPO that would obviously causes several losses for the investor rights. The research method was carried out using a judicial normative legal approach, in which, solely through the examination of library materials or secondary data. All the legal materials obtained would be analyzed using a logical/systematical interpretation referring to the relatable laws and regulations, also supported from the judge decision that strengthened the legal issue which further explaining the research’s result and discussion. It is clear that the Issuer responsibility would be served under the supervision of the Financial Services Authority (OJK) that would undertook either the preventive or the repressive action toward every crimes formed by the issuer. So does in the market manipulation cases, there would be imposing sanctions contained in the Capital Market Law in the form of criminal and administrative sanctions which were given intentionally of having a deterrent effect and providing legal certainty upon the Capital Market Law.

Abstract

Education in Indonesia has a very important role in educating the nation. Every citizen has the right to receive equal and fair education without any differences in social, economic, gender, ethnic or religious status. The systematics of education in Indonesia begins with the New Student Admission System (PPDB). This is in accordance with Minister of Education and Culture Regulation No. 1 of 2021. In the PPDB system there are several routes, one of which is the zoning system. Central Java Province has also regulated a zoning system policy through Central Java Governor Regulation Number 13 of 2023. However, in implementing the PPDB zoning system specifically in Central Java province, it cannot be separated from several problems, including the large number of prospective new students who transfer family cards to be able to register at school. which are desired. Apart from the transfer of KK, another problem is related to the number of quotas for each admission route which are not fulfilled as they should be in accordance with applicable regulations. And the last one is related to the fact that there are still gaps in the achievement verification stage. This research is a type of juridical-empirical legal research with a sociological and legislative approach. The data sources in this research come from primary data and secondary data. The validity of the data used is source triangulation and technique triangulation. Data analysis is descriptive analysis starting from data collection, data reduction, data presentation and drawing conclusions. The results of the research show that: 1) Legal provisions regarding SMA PPDB in Central Java Province have been regulated in the Regulation of the Governor of Central Java, but there are still many shortcomings in its implementation. 2) Juridical transformation needs to be carried out because in practice the PPDB zoning system still has several shortcomings such as unequal access. , Socio-Economic Discrimination, Limited Capacity, and many attempts to transfer domicile/KK carried out by prospective new students as an attempt to circumvent the regulations or legal provisions that have been implemented.

Abstract

ABSTRACTPPAT is authorized to execute deeds in land rights transfers. In debt and credit agreements, the use of an absolute power of attorney for transferring land rights is a frequent practice, though absolute power of attorney has been prohibited. This article examines the validity of land sale deeds relying on an absolute power of attorney in debt agreements and the responsibility of PPAT in executing such deeds. Using a normative legal approach, the research concludes that land sale deeds based on absolute power of attorney in debt agreements are null and void and the PPAT who drafts the deed can be held accountable under civil, and administrative law.    Keywords: Deed; Absolute Power of Attorney; Agreement.ABSTRAKPada saat proses pemindahan hak atas tanah yang berwenang membuat akta adalah PPAT. Dalam Perjanjian hutang piutang sering kali ditemukan penggunaan kuasa jual sebagai dasar pemindahan hak atas tanah. Surat kuasa mutlak telah dilarang penggunaannya. Artikel ini bertujuan untuk mengetahui keabsahan akta jual beli tanah berdasarkan surat kuasa mutlak tanpa sepengetahuan penjual dan tanggung jawab PPAT dalam membuat akta berdasarkan surat kuasa mutlak. Penelitian ini dilakukan dengan pendekatan yuridis normatif. Hasil penelitian ini yaitu pembuatan akta jual beli berlandaskan surat kuasa mutlak tanpa sepengetahuan penjual merupakan batal demi hukum, dan PPAT yang membuat akta dapat dimintai pertanggungjawaban perdata dan administratif. Kata Kunci: Akta; Surat Kuasa Mutlak; Perjanjian.

Abstract

Perjanjian baku merupakan bentuk kontrak standar yang banyak digunakan dalam transaksi bisnis modern guna meningkatkan efisiensi serta menyederhanakan proses perjanjian antara pelaku usaha dan konsumen. Tujuan utama dari penggunaan perjanjian ini adalah untuk mengurangi waktu negosiasi, menekan biaya transaksi, serta mempercepat kesepakatan antara kedua belah pihak. Praktiknya, perjanjian baku sering kali memunculkan ketimpangan dalam hubungan bisnis karena umumnya disusun oleh pelaku usaha tanpa memberikan ruang negosiasi bagi konsumen. Hal ini dapat mengarah pada ketidakadilan, terutama jika klausul dalam perjanjian bersifat sepihak dan merugikan konsumen. Regulasi yang memadai diperlukan agar perjanjian baku tetap memberikan manfaat tanpa mengorbankan hak-hak konsumen.Penelitian ini bertujuan untuk mengkaji fungsi perjanjian baku dalam transaksi bisnis, keuntungan yang ditawarkan, serta berbagai potensi permasalahan yang dapat merugikan konsumen. Dengan menggunakan pendekatan normatif, penelitian ini menganalisis ketentuan hukum yang mengatur perjanjian baku serta mengkaji beberapa studi kasus dalam dunia bisnis. Hasil penelitian menunjukkan bahwa meskipun perjanjian baku mampu meningkatkan efisiensi transaksi, tetap diperlukan mekanisme perlindungan konsumen agar klausul yang bersifat merugikan dapat diminimalkan. Upaya yang dapat dilakukan antara lain dengan memperkuat pengawasan oleh otoritas perlindungan konsumen, menerapkan sanksi bagi pelaku usaha yang menyalahgunakan perjanjian baku, serta meningkatkan kesadaran masyarakat mengenai hak-hak mereka dalam transaksi bisnis. Dengan demikian, keseimbangan antara kepentingan bisnis dan perlindungan konsumen dapat terwujud, menciptakan sistem transaksi yang lebih adil dan berkelanjutan.

Abstract

Perbuatan melawan hukum merupakan tindakan yang bertentangan dengan peraturan perundang-undangan serta norma sosial yang berlaku di masyarakat. Tindakan ini dapat menimbulkan berbagai dampak negatif, baik dalam aspek sosial, ekonomi, maupun hukum, yang pada akhirnya dapat melemahkan perlindungan terhadap hak-hak masyarakat. Ketidakpatuhan terhadap hukum berpotensi menciptakan ketidakadilan, pelanggaran hak asasi manusia, serta ketidakpastian hukum yang berdampak pada stabilitas sosial dan kesejahteraan masyarakat. Penelitian ini bertujuan untuk menganalisis dampak hukum dari perbuatan melawan hukum serta mengkaji mekanisme perlindungan yang diterapkan dalam menjaga hak-hak masyarakat yang terdampak. Dengan menggunakan metode penelitian normatif, studi ini berfokus pada analisis peraturan perundang-undangan, putusan pengadilan, serta doktrin hukum yang relevan. Selain itu, penelitian ini juga menyoroti peran pemerintah, aparat penegak hukum, dan masyarakat dalam menanggulangi perbuatan melawan hukum serta meningkatkan efektivitas perlindungan hukum. Hasil penelitian menunjukkan bahwa penerapan sanksi hukum terhadap pelaku perbuatan melawan hukum merupakan langkah penting dalam menegakkan keadilan dan memberikan perlindungan kepada masyarakat. Namun, efektivitas penegakan hukum masih dipengaruhi oleh berbagai faktor, seperti rendahnya kesadaran hukum di kalangan masyarakat, lemahnya sistem pengawasan, serta kendala dalam implementasi kebijakan. Oleh karena itu, diperlukan reformasi hukum yang lebih komprehensif, peningkatan edukasi hukum bagi masyarakat, serta kolaborasi yang lebih erat antara berbagai pihak untuk memastikan perlindungan hak-hak masyarakat secara optimal dan berkelanjutan.

Abstract

Buying and selling land is the transfer of land rights from one person to another. This is often done because land has economic value. In a sale and purchase agreement, the object and price must be stated clearly. This is related to income tax (PPH) and exemption of rights. Ata Land and Building (BPHTB) this tax will arise with the transfer of land rights. This makes some people do not mention the actual price in the agreement to avoid the amount of tax that must be paid. This writing aims to know and describe the responsibilities of a notary in making a sale and purchase agreement. The writing method takes normative juridical, namely emphasizing the problems that are researched based on reality through related literacies. The notary is only tasked with making the contents of the agreement based on the agreement of the parties. In addition, the notary has tried to take preventive measures such as writing in detail, in detail and as completely as possible and for the legal consequences of the agreement it will not meet the objective requirements, namely a certain matter and a lawful cause because the price in the Sale and Purchase Agreement (PPJB) does not match at the actual price so that the deed is automatically null and void.

Abstract

This study aims to analyze the practices of land grabbing and environmental degradation occurring in downstream processing projects of natural resources in Indonesia, as well as the urgency of legal enforcement to address these issues. The methodology employed is normative legal research with a qualitative approach, based on literature review of legislation, court decisions, and relevant academic sources. The findings indicate that downstream processing is often used as a justification for forced land acquisition and ecological destruction, violating Articles 28H and 33 of the 1945 Constitution, as well as Law No. 5 of 1960 and Law No. 32 of 2009. The study concludes that weak law enforcement is a key factor contributing to structural injustice, thus highlighting the need for regulatory reform, stronger oversight, and a legal system that is fair, transparent, and participatory.

Abstract

On September 24, 2024, the Basic Agrarian Law (UUPA) was enacted and implemented, which is the main legal basis for land regulation in Indonesia. Before the UUPA was enacted, land regulations in Indonesia were still based on unwritten customary law and Western civil law inherited from the colonial era. In practice, many Indonesian people control land based on customary law, which often does not have valid written evidence to show ownership rights. Therefore, regulations regarding land rights are still often complicated and prone to disputes. The UUPA is present as an implementation of Article 33 paragraph (3) of the 1945 Constitution which mandates that the earth, water, and natural resources must be controlled by the state and used as much as possible for the prosperity of the people. The main objective of the UUPA is to create a just and prosperous society, as well as to provide legal certainty regarding land ownership and provide protection to people who have ownership rights to customary land, the UUPA allows the conversion of ownership rights to customary land into ownership rights in accordance with the provisions of the UUPA. The process of proving land rights in the UUPA can be done in several ways, such as land registration followed by the issuance of a land certificate, the issuance of a Land Rights Certificate (SKHAT) by the Village Head or Lurah which is authorized by the Sub-district Head, and also with physical control of the land which is proven by the existence of plants or buildings on the land. Through the UUPA, the government plays a role in equalizing land distribution and improving natural resource management, as part of agrarian reform. This is important to create a fairer and more equitable land ownership system throughout Indonesia.

Abstract

In order to realize the Republic of Indonesia as a State of Law based on Pancasila and the 1945 Constitution of the Republic of Indonesia in order to guarantee certainty, order and legal protection for those who need authentic written evidence which explains the circumstances, events or legal acts that require the Office of Notary, in 2004 the Republic of Indonesia Law Number 30 of 2004 concerning the Office of Notary was issued as amended by Law of the Republic of Indonesia Number 2 of 2014 concerning Amendments to the Republic of Indonesia Law Number 30 of 2004 concerning the Office of Notary. Based on the Provisions of Article 1 number 1 of the Republic of Indonesia Law Number: 30 of 2004 concerning the Position of Notary as amended by the Republic of Indonesia Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning the Position of Notary, the definition of Notary is as follows: Notary is a public official who is authorized to make authentic deeds and other authorities as referred to in this Law. Thus, because the Notarial Deed is an Authentic Deed, the Notarial Deed has perfect or complete evidentiary power, as stipulated in Article 165 HIR.

Abstract

A grant is a form of legal agreement in Indonesian civil law, as regulated in the Civil Code (KUHPerdata). However, in practice, a grant can cause legal problems if there is a change in circumstances on the part of the grantor (grantor), especially if the person concerned experiences economic decline to the point of poverty. This study aims to examine whether the qualifications of the state of poverty experienced by the grantor in the Judicial Review Decision Number: 336/PK/Pdt/2016 are legally appropriate, and to analyze the legal consequences of the cancellation of a deed of gift through a court lawsuit. This study is a normative legal study with a statutory approach and a conceptual approach. The nature of this study is descriptive analysis, with the main data sources in the form of primary and secondary legal materials, which are analyzed qualitatively. The results of the study indicate that Article 1688 paragraph (3) of the Civil Code does open up space for the cancellation of a grant if the grantor falls into poverty, but does not provide a definite measure regarding the limits of "falling into poverty". In the judge's considerations, this assessment is still subjective and is determined based on the judge's belief in the facts presented in court. The legal consequences of the cancellation of a deed of gift are basically a form of legal protection for the grantor who experiences losses or injustice due to the granting of the gift. This study contributes to the development of a normative understanding of legal protection for grantors and the importance of clearer regulations regarding the criteria for falling into poverty in the context of grant cancellation.
