Abstract

The Supreme Court Decision No. 23P/HUM/2024 which revoked the minimum age limit provisions for regional head candidates in the General Election Commission Regulation(PKPU) has various legal and political consequences.This study aims to analyze the implications of the decision from a legal perspective and fiqh siyasah, a discipline in Islam that discusses the principles of governance and leadership. Using normative research methods, this study examines the principles of constitutional law and the concept of leadership in Islam related to the criteria for the age of leaders. The results of the study show that from a positive legal perspective, the MA decision is based on the principles of legality and hierarchy of laws and regulations. However, from a fiqh siyasah perspective, the age of leadership is not only determined by formal aspects but also by the intellectual and moral maturity of a leader. Therefore, revisions to the age limit policy need to consider the balance between legal certainty and public interest.

Abstract

The purpose of this article aims to clarify the Decree of the General Election Commission (KPU) of the Republic of Indonesia No. 789 of 2024 concerning the Determination of the Permanent Candidate List for DPD RI Members for the Electoral District of West Sumatra Against the Decision of the Constitutional Court No. 03-03 / PHPU.DPD-XXII / 2024 and to clarify the Decree of the KPU RI No. 789 of 2024 in the Perspective of Fiqh Siyasah. . The writing method uses a normative approach and data collection techniques using literature studies. This article is descriptive and aims to solve problems. Based on the analysis, this article found that the KPU RI Decree resulted in a loss of constitutional rights for Irman Gusman to be able to participate in the general election contest for DPD RI Members for the West Sumatra Electoral District. This happened because of the KPU's error in interpreting the PKPU and the Law on Elections. Second, the KPU's non-compliance with the Jakarta PTUN Decision resulted in the law in the DPD RI general election for the West Sumatra electoral district so that Irman Gusman was canceled as a Permanent Candidate List for DPD RI Members in the 2024 General Election. Third, from the perspective of Fiqh Siyasah which includes political rights, it is basically an effort to prevent former candidates from committing the same acts in the future. Fourth, the Constitutional Court's decision to hold a re-vote for the election of DPD RI Members for the West Sumatra Electoral District in the 2024 Election is basically to uphold justice and provide Irman Gusman's Constitutional Rights which have been violated by the cancellation of the KPU RI.

Abstract

Rangkap jabatan adalah dimana individu memegang beberapa posisi dalam perusahaan atau lembaga yang berbeda. Di Indonesia, saat ini rangkap jabatan menteri menjadi isu yang kontroversial. Tujuannya untuk mengetahui peraturan perundang - undangan yang berlaku. Berdasarkan pasal 23 Undang –Undang Nomor 39 tahun 2008 tentang Kementerian Negara, yang kemudian diubah dengan UU Nomor 61 Tahun 2024. Disebutkan bahwa menteri dilarang merangkap jabatan sebagai pejabat lainnya sesuai dengan peraturan perundang- undangan, komisaris atau direksi pada  perusahan negara atau perusahaan swasta dan pimpinan organisasi yang dibiayai oleh Anggaran Pendapatan Belanja Negara/Anggaran Pendapatan Belanja Daerah. Di Indonesia, masih ada menteri yang berhubungan langsung dengan organisasi nya. Maka disimpulkan bahwa rangkap jabatan menteri di Indonesia sekaligus  pimpinan organisasi besar lainnya bertentangan dengan penjelasan pasal 23 undang- undang nomor 39 Tahun 2008.

Abstract

The enforcement of human rights in Indonesia is a vital aspect of the country’s constitutional system, involving multiple institutions with distinct mandates, notably the Ministry of Law and Human Rights and the National Commission on Human Rights (Komnas HAM). This study is driven by concerns over weak coordination and overlapping functions between these two bodies, which hinder the effective protection and enforcement of human rights. The central research question examines how the integration of authority between the Ministry and Komnas HAM can be conceptualized and implemented, viewed through the framework of siyāsah dustūriyyah (Islamic constitutional politics). Using a qualitative method and a normative approach, the study draws on legal texts and Islamic political thought. The findings suggest that, from the perspective of siyāsah dustūriyyah, inter-institutional collaboration in human rights enforcement should be seen as a synergistic exercise of governance aimed at upholding justice and promoting the public good. The study concludes that integrating the roles of the Ministry and Komnas HAM requires a unified model of oversight and policy execution, guided by the Islamic principles of ta‘āwun (mutual cooperation) and al-‘adālah (justice) within the structure of constitutional governance.

Abstract

This research analyzes the sentiment reviews of the SIREKAP application on the Google Play Store using two machine learning algorithms, namely Naïve Bayes and Support Vector Machine (SVM). The dataset used consists of 19,925 reviews that have gone through preprocessing stages, including text cleaning, stopword removal, stemming, and tokenization. To overcome data imbalance, oversampling and undersampling techniques were applied. Furthermore, TF-IDF is used for feature extraction, converting text into numerical representation. The dataset is divided into 80% training data (15,940 data) and 20% test data (3,985 data). The results show that oversampling provides better performance than undersampling. In the oversampling method, the SVM algorithm achieved the highest accuracy of 95%, with consistent precision, recall, and F1-score values across all sentiment classes. The Naïve Bayes algorithm also performed quite well, with an accuracy of 77% on the oversampled data. In contrast, in the undersampling method, both algorithms have the same accuracy of 61%. This study confirms that the combination of oversampling technique and SVM algorithm is the best approach to handle imbalanced data and provides important insights into user perception of the SIREKAP application.

Abstract

This study aims to analyze the form of legal protection provided to patients holding BPJS Health cards in Medan City, as well as to examine the responsibility of BPJS Health towards participants who experience suboptimal healthcare services. Issues regarding the quality of healthcare services received by BPJS participants have become an important matter as they concern the fulfillment of basic rights to health. This research employs a normative juridical method with a statutory approach, and utilizes data collection techniques in the form of literature study and interviews with related parties, with the data analysis technique used being qualitative analysis, which involves examining and interpreting data based on applicable legal provisions, as well as connecting it with interview results obtained in the field to gain a comprehensive understanding of the implementation of legal protection. Based on the research findings, it is known that legal protection for patients holding BPJS Health cards in Medan City has been implemented in accordance with applicable laws and regulations. This legal protection is divided into two forms: Preventive protection is implemented through education, information dissemination, and ease of access in submitting complaints. Meanwhile, repressive protection is provided through dispute resolution mechanisms both through non-litigation (mediation) and litigation (court) processes. In addition, the responsibility of BPJS Health Medan branch towards participants who experience disappointment, dissatisfaction, and those who do not receive their rights related to healthcare services is manifested in the form of swift and fair actions in accordance with operational standards and applicable legal provisions. The results of this study indicate that although there are several obstacles in practice, generally the implementation of legal protection for BPJS participants in Medan City has been running and provides a foundation of protection for BPJS Health participants.

Abstract

The prohibition of vehicles crossing certain areas referred to in Medan Mayor Regulation number 13 of 2016 refers to the type of goods vehicle/truck with a tonnage of, Gross Vehicle Weight (GVW) above 3,000 (three thousand) kilograms. Heavy tonnage trucks have many impacts on safety and comfort in traffic. The part that touches on safety is such as the occurrence of accidents and comfort in traffic such as frequent traffic jams and can damage infrastructure. One factor in this problem is the lack of driver awareness to comply with existing regulations. This study aims to determine the implementation of Medan Mayor Regulation no. 13 of 2016. In Siyasah Dusturiyah, this regulation is a form of state governance that aims for public order and welfare, the community, so that its implementation must be supported by fair and effective policies so that the goal of mutual benefit can be achieved. This study uses a type of legal, empirical research, this study focuses on data collection in the field, such as observation, and interviews with related parties to determine the implementation of Medan Mayor Regulation no. 13 of 2016.

Abstract

This study aims to analyze the Constitutional Court Decision Number 2/PHPU.PRES-XXII/2024 concerning the presidential election dispute in 2024 from the perspective of siyasah qadhaiyyah. The findings reveal that the Constitutional Court assessed the case solely from a legal-formal standpoint, emphasizing administrative and procedural evidence without considering the ethical dimensions of power and the socio-political impact of state resource abuse. In the siyasah qadhaiyyah framework, justice is not limited to procedural compliance but must be substantive and directed at preventing tyranny in governance. Judges, according to this perspective, are morally obliged to uncover the hidden motives of power behind legal formalities and to uphold public welfare (maslahah 'ammah). This research recommends a paradigm reform of the Constitutional Court, urging the Court to transcend legal positivism and uphold substantive justice aimed at protecting citizens' rights and the integrity of electoral processes. Thus, siyasah qadhaiyyah serves as an ethical and philosophical foundation for enhancing the Constitutional Court's role as the guardian of democratic justice, rather than merely functioning as a procedural interpreter of legal texts

Abstract

This study aims to analyze the implementation of Regional Regulation of North Sumatra Province No. 3 of 2014 on Child Protection, particularly in safeguarding children who experience violence due to religious differences or religious conversion, through the lens of Fiqh Siyasah Dusturiyah. This research employs a normative-empirical legal method, combining statutory, conceptual, and empirical approaches, with data obtained from legislative review and interviews with relevant local government institutions. The case study focuses on a 15-year-old girl named Dewi, who faced physical and psychological violence from her father in 2023 after converting from Christianity to Islam. The findings reveal that the regulation is implemented mostly in administrative terms and lacks substantive legal enforcement. From the perspective of Fiqh Siyasah Dusturiyah, the state should act as a guardian of justice and protector of maq??id al-shar?'ah. Therefore, this study recommends a policy reform grounded in constitutional justice and Islamic benefit values to ensure comprehensive protection of children's spiritual rights and physical safety

Abstract

This research examines the legal implications of Constitutional Court Decision No. 168/PUU-XXI/2023 on employment termination, analysed through the framework of Islamic political jurisprudence (siyasah dusturiyyah). The primary objective is to explore how the decision aligns with constitutional protections for workers while reflecting core Islamic governance principles. Using a qualitative normative-juridical approach, the study combines statutory interpretation, doctrinal analysis, and a comparative review of classical and contemporary Islamic legal thought. Data sources include Constitutional Court documents, national labour legislation, and scholarly works on Islamic political law. The findings reveal that the decision reinforces due process in employment termination, curtails arbitrary dismissals, and upholds constitutional guarantees of justice and equality. From the perspective of siyasah dusturiyyah, these outcomes correspond to foundational principles such as justice (al-‘adl), public interest (maslahah), and the prevention of harm (dar’ al-mafasid), thereby harmonising state authority with moral and religious imperatives. The study concludes that the Court’s reasoning, although grounded in constitutional law, implicitly supports Islamic political values that emphasise balanced protection for both employers and employees while safeguarding human dignity in the workplace. The academic contribution lies in offering a conceptual model for integrating constitutional adjudication with Islamic political jurisprudence in labour law reform. This integration provides a theoretical basis for policymakers and legal practitioners to develop regulatory frameworks that are both constitutionally compliant and consistent with Islamic governance ethics, thus advancing the discourse on the convergence of national and religious legal systems in the protection of workers’ rights.
