Abstract

Perbankan syariah memiliki fungsi yang sangat strategis dalam system perekonomian nasional,selain fungsi intermediasi perbankan syariah juga memiliki fungsi sosial. Sehingga menarik untuk diteliti mengenai peranan perbankan syariah dalam pengelolaan wakaf uang di Indonesia. Penelitian ini dilakukan dengan menggunakan metode pendekatan yuridis normatif. Peranan perbankan syariah dalam pengelolaan wakaf uang di Indonesia berdasarkan Undang-Undang No. 41 Tahun 2004 Tentang Wakaf dan peraturan pelaksanaannya adalah sebagai Lembaga Keuangan Syariah Penerima Wakaf Uang yang menerbitkan sertifikat wakaf uang, serta menempatkan wakaf uang tersebut di dalam produk penerimaan dana dengan akad titipan (wadi’ah) atas nama Nazhir dan dapat mengelola dana tersebut sampai nazhir menentukan lain.

Abstract

Standard clauses in consumer protection are terms or conditions unilaterally determined by business actors. Standard clauses are regulated in Article 18 of the Consumer Protection Act. Understanding standard clauses is essential for consumers and business actors, so legal counseling is needed to increase awareness and understanding for consumers and business actors. The Consumer Protection Act does not prohibit the inclusion of standard clauses in agreement documents between consumers and business actors. The Consumer Protection Act only prohibits the inclusion of standard clauses contrary to Article 18, paragraphs (1) (2) of the Consumer Protection Act. Article 18 paragraph (3) of the Consumer Protection Act determines that the standard clause that contradicts Article 18 paragraph (1), (2) of the Consumer Protection Act is declared null and void. In addition, the legal consequences for business actors for the inclusion of standard clauses that are contrary to Article 18 paragraph (1), (2) of the Consumer Protection Act based on Article 62 paragraph (1) of the Consumer Protection Act are threatened with imprisonment for a maximum of five years or a maximum fine of two billion. In including standard clauses in documents or agreements with consumers, business actors must pay attention to the provisions of Article 18 of the Consumer Protection Act. This legal counseling activity increases the awareness and understanding of consumers and business actors regarding standard clauses based on consumer protection laws, which can ultimately realize consumer protection.

Abstract

The banking industry is often perceived as the heart and driving force of a country's economy. Given its strategic position, the role of banking as an intermediary institution in collecting and distributing funds to the public for financing economic sector activities is crucial. Based on field practices, debtors often refuse to make payments or settle the credit, which impacts one of the banking health factors, namely the non-performing loan percentage. Legal staffing is essentially a method for resolving credit with a collectibility of 5 and credits that have been written off (Write-Off). The legal staffing method emphasizes resolution principles through non-litigation mechanisms (out-of-court dispute resolution), focusing on the effectiveness and efficiency of case resolution.

Abstract

Nazhir dalam mengelola wakaf dapat bekerja sama dengan pihak ketiga. Dalam mengelola wakaf saham, Dompet Dhuafa bekerja sama dengan Philip Sekuritas. Kerja sama antara Dompet Dhuafa dengan Philip Sekuritas tersebut adalah bahasan yang menarik untuk dibahas. Penelitian ini bersifat deskriptif analitis dengan menggunakan pendekatan yuridis normatif. Hasil penelitian ini menemukan bahwa kerja sama yang terjalin dilakukan dengan Syirkah Mudharabah. Dalam Syirkah Mudharabah Dompet Dhuafa bertindak sebagai pemilik modal dan Philip Sekuritas bertindak sebagai pengelola. Seharusnya Philip Sekuritas bisa mendapatkan haknya atas pengelolaan harta tersebut. Namun Philip Sekuritas tidak menerimanya dan menjadikan itu sebagai CSR perusahaannya. Sinergitas CSR dengan wakaf sangat bagus untuk dilakukan karena dengan wakaf, pelaksanaan CSR dapat dilaksanakan lebih lama.

Abstract

The freedom to choose forum institutions and legal options in resolving business disputes is a freedom to contract exercised by national and international business actors, likewise in settling Islamic economic business disputes. This freedom of contract is recognized both in the principles of international trade law and Islamic law. The present development of sharia business transactions at the national and international levels does not rule out the possibility of disputes in its implementation. The consistency of implementing Islamic economics also concerns the choice of Islamic law, which is used as a choice of law for international business actors in case of a dispute between them. Studying how specific Islamic law can be applied to each country's national law is interesting. This article will discuss how Islamic law can be chosen to settle international business disputes using a normative juridical approach. Choice of law is the law the parties choose to resolve disputes between them, which can be expressed in their business contracts. The choice of law chosen by these parties in the settlement of international business disputes will also be closely related to the principles of Private International Law in harmonizing with the provisions of the National Law of each country. There needs to be mutual agreement from both countries, as well as international forums or institutions, especially international trade institutions, to support the recognition of the application of Islamic legal principles in resolving international business disputes through international agreements both bilaterally and multilaterally.

Abstract

The globalization of trade has elevated Islamic halal standards within the domain of international economic law. While halal certification is rooted in Sharia, World Trade Organization (WTO) law is governed by secular principles, including non-discrimination, Most-Favored Nation (MFN) treatment, and national treatment. This article conducts a comparative legal analysis of the potential tensions and compatibilities between these normative systems. Drawing on doctrinal and comparative methods, it examines how halal regulations in Muslim-majority and non-Muslim countries interact with WTO rules, particularly the SPS Agreement, TBT Agreement, and GATT 1994. The study argues that halal requirements, while potentially constituting non-tariff barriers, can be justified under WTO exceptions when aligned with legitimate objectives such as public morals and consumer protection. It also highlights the risk of discriminatory treatment when certification is applied selectively or instrumentally. The paper concludes with normative recommendations to reconcile Sharia-based halal frameworks with global trade norms, emphasizing mutual recognition, standard harmonization, and dialogue between religious and secular legal systems.

Abstract

One of the organs of a Limited Liability Company that often becomes a guarantor of a company’s debt is the Board of Directors. In practice, when a company can no longer carry out its obligations to pay debts, the guarantor is often bankrupted together with the debtor. Article 2 paragraph (1) jo. Article 8 paragraph (4) of the Bankruptcy and PKPU Law states that if the Debtor has two or more Creditors and has debts that are due and collectible, then the request for a bankruptcy statement must be granted if there are facts or circumstances that are proven simply. This research was conducted to examine the legal considerations of judges regarding the application of simple proof in Decision Number 20/Pdt.Sus-Bankruptcy/2022/PN.Niaga.Smg and what the implications are for the Directors of the company who act as a personal guarantee for their company’s debt. The results showed that the legal consideration of the majority of the Panel of Judges examining the case are not entirely in accordance with the Bankruptcy and PKPU Law, as the panel of judges only focused on fulfilling formal requirements without considering the principles of bankruptcy, which will have a broad impact on the parties involved. In addition, the juridical implications arising from the decision are that the Directors of the company as a personal guarantee remains personally responsible for the company’s debt, thus causing bankruptcy for him and the company.

Abstract

Differences in legal systems between Australia and Indonesia have the potential to impact the fulfillment of the legal requirements of an agreement, including in the context of rental contracts. Australia is a leading destination for higher education for Indonesian students, and in 2021, the number of Indonesian students in Australia was recorded as the highest among study destination countries. This situation makes a comparative study of the contract law of the two countries relevant, particularly to understand potential differences in the formation, implementation, and resolution of contractual disputes. This analysis is essential so that parties, especially Indonesian students in Australia, can anticipate the legal consequences of their legal actions in rental practices. The research method used in this study is normative juridical with analytical descriptive research specifications. The results show that the differences in the legal requirements of agreements between Indonesia and Australia are based, in part, on the existence of the Tellinty Form, which emphasizes the need for written contracts. The practice of renting residential properties in Australia uses a special form, as regulated by the Tendential Renancies Act, for its completeness and content. If the landlord does not execute a written contract, there will be special consequences. Meanwhile, in Indonesia, contract-making practices are still based on verbal agreements. Likewise, even when written, many do not comply with the standard rental contract format stipulated in Government Regulations. This research contributes to the analysis of student housing rental agreements as a basis for reforming rental law in Indonesia. Perbedaan sistem hukum antara Australia dan Indonesia berpotensi mempengaruhi pemenuhan syarat sah suatu perjanjian, termasuk dalam konteks kontrak sewa-menyewa. Australia merupakan salah satu tujuan utama pendidikan tinggi bagi mahasiswa Indonesia, dan pada tahun 2021 jumlah mahasiswa Indonesia di Australia tercatat sebagai yang tertinggi di antara negara tujuan studi. Kondisi ini menjadikan kajian komparatif mengenai hukum kontrak kedua negara relevan, terutama untuk memahami potensi perbedaan dalam pembentukan, pelaksanaan, dan penyelesaian sengketa kontraktual. Analisis ini penting agar para pihak khususnya mahasiswa Indonesia di Australia dapat mengantisipasi akibat hukum dari tindakan hukum yang mereka lakukan dalam praktik sewa-menyewa. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normatif dengan spesifikasi penelitian deskriptif analitis. Hasil menunjukan bahwa perbedaan syarat sah perjanjian antara negara Indonesia dengan Australia salah satunya didasari oleh adanya Ceritainty Form yang menekankan perlunya hukum kontrak yang harus dilakukan secara tertulis. Praktik sewa menyewa tempat tinggal di Australia menggunakan form khusus sebagaimana yang telah diatur kelengkapan dan isiannya antara penyewa dan pemilik tempat tinggal sebagaimana dalam Tendencial Renancies Act. Apabila pemilik tempat tinggal tidak melaksanakan kontrak secara tertulis, maka akan ada konsekuensi-konsekuensi khusus yang akan didapat. Sedangkan di Indonesia, praktik pembuatan kontrak masih didasarkan pada perjanjian secara lisan. Begitupun jika dilakukan secara tertulis, masih banyak yang tidak sesuai dengan standar format pengisian kontrak sewa sebagaimana yang telah diatur dalam Peraturan Pemerintah. Penelitian ini berkontribusi dengan menganalisis perjanjian sewa tempat tinggal mahasiswa sebagai landasan untuk mereformasi hukum sewa menyewa di Indonesia. Abstract

The escalating complexity of contemporary banking crimes is fundamentally catalyzed by the rapid evolution of digital technologies and the extensive globalization of financial transaction.   The Financial Services Authority's Annual Report shows an increase in the number of resolved banking crimes in 2023, from 13 (thirteen) cases to 18 (eighteen) in 2024. The principle of restorative justice, which prioritizes restoring the condition of the injured party, has become a new concept in enforcing banking crime law, apart from the criminal sanctions that has been applied. It is of particular interest to undertake research regarding how the principle of restorative justice is applied in the current law enforcement of banking crimes. This research engages normative juridical approach with analytical descriptive specifications. The application of the restorative justice principle in enforcing banking crime law is through a non-prosecution mechanism which provides an opportunity for parties suspected of committing banking crimes at the investigation stage to apply for resolution of violations of laws and regulations in the banking sector to the Financial Services Authority. Once the Financial Services Authority investigator approves the application, the applicant is obliged to carry out the agreement (non-prosecution agreement) including paying compensation and then the case is stopped and not continued to the investigation stage. The establishment of transparent standards and objective benchmarks is imperative for the Financial Services Authority in adjudicating settlement petitions for violations to guarantee legal certainty.

Abstract

Consumers are key determinants of business success, as the success of a food product is closely linked to its sales volume. This community engagement program was carried out through mentoring activities that emphasized the implementation of a customer-centric approach in small snack enterprises. In this approach, consumers are placed at the core of product planning, development, and marketing processes. Business actors who apply this principle are more capable of formulating strategies that correspond to customer needs, which in turn strengthens customer loyalty and increases sales performance. The training component also provided practical guidance on licensing procedures for food enterprises, grounded in the protection of consumer rights as regulated under Law No. 8 of 1999 on Consumer Protection. The program was implemented through direct mentoring and training for micro-enterprise actors. The results indicate that the customer-centric approach enhances entrepreneurs’ understanding of the importance of consumer research through segmentation analysis and product adaptation. Micro-enterprises in the food sector that adopted this approach demonstrated greater ability to design relevant business strategies aligned with customer expectations. The activity, which engaged 30 packaged-snack micro-entrepreneurs. The number of participants holding a NIB increased from 16 to 26, and several subsequently advanced to register for the SPP-IRT.
