Abstract

Penelitian ini menganalisis pengaruh globalisasi terhadap sistem hukum peradilan Islam dengan pendekatan kualitatif melalui studi kepustakaan, serta menggunakan kerangka teori maqāṣid al-sharī‘ah yang dikembangkan oleh Jasser Auda. Tujuan penelitian ini adalah untuk memahami bagaimana integrasi global memengaruhi konsepsi, prinsip normatif, dan implementasi kelembagaan hukum Islam. Globalisasi memunculkan tantangan terhadap sistem hukum Islam, khususnya dalam isu hak asasi manusia, kesetaraan gender, dan keadilan prosedural. Namun, tantangan ini sekaligus membuka peluang untuk reformasi hukum Islam agar tetap relevan dan kontekstual tanpa mengabaikan prinsip-prinsip dasar syariah. Dengan mengacu pada pemikiran kontemporer seperti Abdullahi An-Na’im dan Tariq Ramadan, penelitian ini menegaskan bahwa hukum Islam bersifat dinamis dan mampu bertransformasi. Fokus kajian diarahkan pada Indonesia sebagai negara Muslim terbesar yang menerapkan sistem hukum ganda. Hasil penelitian menunjukkan bahwa pendekatan maqāṣid memungkinkan lembaga peradilan Islam merespons globalisasi secara adaptif, membangun sistem hukum yang lebih inklusif dan berkeadilan. Dengan demikian, penelitian ini memberikan kontribusi terhadap wacana reformasi hukum Islam dan menjadi referensi penting bagi perumus kebijakan hukum di negara-negara Muslim.

Abstract

AbstrakPenelitian ini membahas pemikiran K.H. Husein Muhammad mengenai kesetaraan gender dalam perspektif Hukum Islam, yang dilatarbelakangi oleh pandangannya bahwa sistem sosial dalam Al-Qur’an bersifat kontekstual dan dapat berubah seiring perkembangan zaman. Kiai Husein melihat bahwa perempuan di era modern memiliki kemampuan dan peran yang setara dengan laki-laki dalam berbagai bidang, sehingga tafsir keagamaan perlu disesuaikan dengan realitas sosial tersebut. Fokus penelitian ini mencakup tiga hal: pandangan Kiai Husein tentang kesetaraan gender, pandangan Hukum Islam mengenai hal tersebut, serta sejauh mana terdapat perbedaan atau penyimpangan antara keduanya. Penelitian ini menggunakan metode kualitatif dengan pendekatan kepustakaan dan analisis deskriptif, serta pendekatan deduktif untuk mengembangkan kerangka teoritik dari literatur yang ada. Data primer diperoleh dari karya Kiai Husein seperti Fiqih Perempuan, didukung oleh literatur sekunder yang relevan. Hasil penelitian menunjukkan bahwa menurut Kiai Husein, kesetaraan gender mencakup aspek ibadah, munakahat, dan muamalah siyasah, sedangkan dalam Hukum Islam, laki-laki dan perempuan memiliki kedudukan spiritual yang setara. Namun, terdapat perbedaan pendapat mengenai isu-isu seperti kepemimpinan perempuan, tanggung jawab nafkah, dan perempuan sebagai imam salat.Kata Kunci: Kesetaraan Gender, K.H. Abstract

This article examines the relevance of Muhammad Abduh's thoughts on women's emancipation for addressing Domestic Violence in Indonesia. The study addresses the ongoing issue of gender-biased religious interpretations that legitimize acts of violence within the household, a problem evidenced by more than 10,000 reported cases in 2023. Abduh was chosen due to the significant influence of his reformist ideas—particularly his views on qiwamah—on the development of Islamic family law in Indonesia, largely through the intellectual networks of Al-Azhar University. The objectives of this research are twofold: first, to descriptively analyze Abduh’s concept of qiwamah as articulated in his principal works (Tafsir al-Manar and Risalat al-Tawhid); and second, to evaluate its normative and practical relevance in shaping an Islamic legal framework that opposes domestic violence in the Indonesian context. The study employs a contextual hermeneutic method, supported by comparative analysis between Abduh’s ideas and Indonesian domestic violence legislation. The findings reveal that Abduh offers three central arguments: qiwamah as a moral and protective responsibility rather than a justification for male dominance; the spiritual and ethical equality of men and women; and the necessity of legal reform grounded in the principle of maslahah. These ideas are found to be in harmony with the core values of Indonesia’s Law No. 23 of 2004 on the Elimination of Domestic Violence. The study concludes that Abduh’s reinterpretation provides a strong theological foundation for the prevention of domestic violence in Indonesia, although its practical application remains challenged by conservative interpretations and the ongoing need for contextual adaptation.

Abstract

Drugs in Indonesia are increasingly rampant, the more it is banned, the more violates it. Not only in the remote areas of the city in the village are familiar. It has been proven that in the Sumenep-Madura area there are not a few drug users and users, especially in the southwestern area of Sumenep which is a port location which is very easy for buying and selling drugs. The purpose of this study was to determine the relationship of parental supervision in children, because when a child who gets full supervision from a parent is unlikely to fall into promiscuity. In addition, it is also to provide stimulus to the public that drugs have bad consequences for the future of children as young people and the nation's generation. The method used is descriptive qualitative with a case study approach. The subjects and stages of the research are the observation, documentation and interviews of parents and children who use drugs.

Abstract

Traditional learning models are often less effective in increasing elementary school students' interest in science and technology. The limitations of interactivity and visualization in traditional models encourage the need for digital-based learning innovations. This study aims to identify the impact of digital learning models on students' interest and learning outcomes in science subjects. The research used a qualitative approach with a case study method. The research subjects consisted of school teachers at Cangkreng II Lenteng Sumenep primary school. Data were collected through in-depth interviews, observation, and documentation, and analyzed using the Miles and Huberman analysis model which includes data condensation, data presentation, and conclusion. The findings indicate that digital learning models have great potential in improving the quality of science learning in primary schools. The use of interactive media, simulations, and engaging visualizations can help students build a better understanding of abstract science concepts. This research contributes to developing digital learning theory by demonstrating the effectiveness of technology-based learning models in improving students' motivation and learning achievement. The implication for learning practice is the importance of integrating digital technology into the science learning process to create a more enjoyable and effective learning environment.

Abstract

This study explores economic neglect as a dimension of domestic violence within Indonesian divorce cases, analyzed through the lens of Fatima Mernissi’s Islamic feminist framework. Mernissi’s framework is particularly relevant in Muslim-majority contexts, as it critically challenges patriarchal interpretations of Islamic legal norms that continue to shape family law adjudication. Using a qualitative design that integrates juridical-normative and socio-legal approaches, the study analyzes 16 divorce decisions issued by five Religious Courts in Indonesia between 2016 and 2025. The findings reveal that economic neglect never occurs in isolation: 100% of cases intersect with other forms of violence, including psychological, physical, and social abuse. Three patterns of economic neglect are identified: total neglect (37.5%), partial neglect (43.75%), and neglect accompanied by economic exploitation (18.75%). However, only 18.75% of the cases culminated in the imposition of full economic sanctions, reflecting the limited enforcement of women’s economic entitlements. Significant regional disparities were also found, with courts in East Java demonstrating greater consistency than those in other regions. The study proposes legal reforms, including explicit recognition of economic neglect as an autonomous form of domestic violence in Article 9 of the Act of the Republic of Indonesia Number 23 of 2004 concerning the Domestic Violence Elimination Law (UU PKDRT) and reformulation of Articles 80 and 84 of the Compilation of Islamic Law (KHI). These reforms are intended to reinforce enforceable post-divorce economic responsibilities, advance substantive justice, and foster greater consistency in judicial practice at the national level.

Abstract

The position of penghulu holds a strategic role in the administration of Islamic family law in Indonesia. Although existing state regulations do not explicitly restrict this position based on gender, women’s participation as penghulu remains limited, indicating a gap between legal norms and institutional practice. This research aims to examine the position of female penghulu by clarifying the conceptual distinction between penghulu as an administrative state office and wali hakim as a judicial-religious authority, a distinction that is often blurred in policy implementation and public perception. This study employs a qualitative literature-based approach using normative-critical analysis grounded in legal feminism. The analysis is supported by Buya Husein Muhammad’s gender-responsive Islamic thought and Prof. Hasbi As-Shiddiqi’s concept of Indonesian fiqh, which emphasizes contextual and sociological considerations in Islamic legal interpretation. The findings reveal that obstacles to women’s participation as penghulu do not stem from Islamic legal prohibitions, but rather from public policy designs that conflate administrative and judicial functions, as well as from entrenched patriarchal social constructions. From a fiqh perspective, penghulu is not a pillar (rukun) of marriage, and therefore there is no normative basis requiring the position to be held exclusively by men. Furthermore, female penghulu contribute significantly to premarital education and the protection of women’s rights within marriage. This study concludes that gender-responsive reform in penghulu policy is essential to promoting inclusive, just, and contextually grounded Islamic family law services in Indonesia. Such reform has important implications for strengthening legal certainty, enhancing gender equality, and improving the quality of public religious services within the framework of national Islamic law administration.

Abstract

AbstrakKontribusi pemikiran Imam Asy-Syatibi dan Thahir Ibnu ‘Asyur dalam pengembangan konsep maqashid syariah, sebuah kerangka filosofis yang menekankan tujuan-tujuan utama syariat Islam dalam menjaga kemaslahatan umat manusia. Imam Asy-Syatibi melalui karyanya al-Muwafaqat fi Usul al-Ahkam merumuskan maqashid syariah secara sistematis dalam tiga tingkatan kebutuhan: dharuriyyat (pokok), hajiyyat (sekunder), dan tahsiniyyat (pelengkap). Sementara itu, Thahir Ibnu ‘Asyur dalam Maqashid al-Syari’ah al-Islamiyyah memperluas cakupan maqashid syariah dengan menekankan nilai-nilai universal seperti keadilan, kebebasan, toleransi, dan kemaslahatan umum. Penelitian ini menggunakan metode kualitatif dengan pendekatan kepustakaan, berfokus pada literatur primer maupun sekunder. Analisis dilakukan secara deskriptif-analitis untuk menemukan kesinambungan, perbedaan, dan relevansi pemikiran kedua tokoh dalam menghadapi problematika kontemporer umat Islam. Hasil penelitian menunjukkan bahwa pemikiran Asy-Syatibi memberikan fondasi metodologis yang kuat dalam teori hukum Islam, sedangkan Ibnu ‘Asyur menghadirkan aktualisasi maqashid agar tetap kontekstual dengan dinamika sosial modern.

Abstract

This study aims to analyze the Rokat Pandhaba tradition within Madurese society as a local legal system, employing Clifford Geertz’s interpretive-anthropological approach. It specifically explores the tradition’s normative dimensions, enforcement mechanisms, and its interaction with legal pluralism in Indonesia. The study offers a theoretical contribution by expanding the understanding of Indonesian customary law through Geertz’s thick description, as well as a practical contribution in the form of policy recommendations for the recognition of local legal systems within the framework of national legal pluralism. The research adopts a qualitative methodology using a legal ethnographic approach within an interpretive paradigm. Data were collected through participant observation, in-depth interviews, and documentation across several regions of Madura and analyzed using the thick description method. The findings reveal that Rokat Pandhaba functions as a local legal system characterized by normative elements (customary obligations), sanction mechanisms (both social and supernatural), and a structure of communal authority. This tradition regulates relationships among families, communities, and the spiritual realm, while simultaneously maintaining social order and collective solidarity. Rokat Pandhaba represents a form of living law that dynamically interacts with Islamic law and state law. Accordingly, this study recommends the formal recognition of local legal systems within national legal policy to strengthen an inclusive, context-sensitive model of legal pluralism.

Abstract

The protection of women’s and children’s financial rights after divorce remains a significant issue within the Indonesian Religious Court system. Article 41 of Law Number 1 of 1974 on Marriage normatively obliges the father to bear responsibility for the maintenance and education of children and provides a legal basis for financial obligations toward a former wife. However, in judicial practice, divorce litigation (cerai gugat) decisions often do not consistently stipulate iddah maintenance, mut’ah, and child support within the operative part of the judgment. This inconsistency indicates a gap between the normative construction of Article 41 and its practical implementation in court decisions. This study aims to analyze the obligation of judges’ ex officio authority in divorce litigation decisions and evaluate its implementation at the Religious Court of Pamekasan. The research employs a normative–empirical legal approach through statutory analysis and case study examination of three final and binding divorce judgments issued by the Religious Court of Pamekasan. The findings reveal that variations in the application of ex officio authority are influenced by interpretations of the ultra petita principle, evidentiary considerations, and judicial sensitivity toward the protection of women and children. Drawing on vulnerability theory, this study argues that ex officio authority should be interpreted not merely as judicial discretion but as a juridical obligation inherent in the judicial function. This research contributes to strengthening the doctrinal understanding of judges’ ex officio authority as a mechanism to ensure substantive justice and improve legal protection for women and children after divorce.application of this authority is therefore essential to strengthen legal protection for women and children after divorce.
