Abstract

Putusan Mahkamah Konstitusi No. 90/PUU-XXI/2023 yang mengabulkan sebagian dalam  penentuan batas syarat usia capres dan cawapres  menjadi  topik  yang ramai diperdebatkan. Sebagian masyarakat berpendapat bahwa Mahkamah Konstitusi harus berani mengambil kepastian hukum, sebagaimana Mahkamah Konstitusi disebut sebagai penjaga konstitusi UUD 1945. Namun, Hakim Mahkamah  Konstitusi memberikan putusan dengan penambahan pemaknaan norma yang berbeda, yang justru menjadi perdebatan dalam pandangan Masyarakat. artikel  ini  bertujuan  untuk  mengkaji  lebih  jauh  argumentasi  hukum  (ratio  decidendi)  putusan  Mahkamah Konstitusi No. 90/PUU-XXI/2023 yang bersifat open legal policy dan bagaimana wewenang Mahkamah Konstitusi terhadap penambahan norma dengan teori open legal policy, dengan konsepsi open legal policy yang menjadi Batasan dalam putusan yang diambil oleh Mahkamah Konstitusi.

Abstract

Abstract: The regulation regarding the relocation of the new capital city has sparked pros and cons within the community across various categories; one pertains to the land occupied, maintained, and nurtured by the indigenous Paser tribe residing in the area. Their land has provided sustenance for their survival and that of their descendants. The relocation of the capital city to their territory raises questions concerning the land they have cared for all this time. Article 18B, paragraph 2 of the 1945 Constitution acknowledges the importance of customary law in developing national law. Purpose: This paper will explain the protection to Paser Indigenous Tribe regarding the Land Rights after the relocation of the capital city. Design/Methodology/Approach: The type of research is normative law, The approaches used are the statute approach and the conceptual approach. Findings: The main results or discoveries of the research presented briefly. Present the article’s findings based on the analysis and discussion done in the paper. Originality/value: The background of the object being studied is the same Indigenous communities affected by national-scale strategic projects. The difference in this context is that it focuses on the indigenous communities affected by the development project of the National Capital in Nusantara.

Abstract

This study offers an integrated normative empirical assessment of transparency implementation in local revenue governance, highlighting the structural gap between legal standards and administrative capacity. This study also analyzes the implementation of the principle of transparency in the management of Local Revenue (PAD) by the Regional Financial and Asset Management Agency (BPKAD) of Surabaya City as a manifestation of the application of the General Principles of Good Governance (AAUPB). Using a sociological legal empirical research method, this study combines primary data from interviews with the Head of the Treasury and Accounting Division of BPKAD Surabaya City with secondary data in the form of laws and regulations, official documents, and scientific literature. The results of the study show that BPKAD Surabaya City has implemented the principle of openness through proactive publication, an integrated information system, public information request services, and an SPBE-based data security mechanism. However, implementation still faces significant challenges, including normative aspects (interpretation of the boundaries between open and exempt information, legal timeframe inconsistencies), technical aspects (digital human resource limitations, system downtime, data integration), and institutional aspects (political pressure, information sensitivity, bureaucratic culture). This study concludes that although the regulatory framework is comprehensive, implementation of the principle of openness requires harmonization of legal norms with empirical capacity, strengthening of digital infrastructure, improvement of human resource competencies, and a sustained commitment to realizing transparent and accountable regional financial management.

Abstract

Radicalism in Indonesia has evolved from merely an ideological perspective into a tangible threat to national stability, particularly in line with the digital transformation that accelerates the spread of propaganda and online recruitment. This situation creates a need for legal clarity regarding the jurisdiction and authority of authorities in handling pre-terror actions, such as the dissemination of extremist teachings, digital financing, and ideological training without physical violence. The revision of Law Number 5 of 2018 concerning the Eradication of Terrorism Crimes expands the authority of officials by emphasizing a preventive approach, yet it presents challenges in balancing national security with the protection of human rights. This study employs a normative legal method with statutory and conceptual approaches to analyze the effectiveness of jurisdictional regulations in countering radicalism, as well as to assess the synergy among law enforcement agencies such as the Indonesian National Police, Densus 88, the National Counter Terrorism Agency (BNPT), and the Prosecutor's Office. The research results indicate that although the national legal system has been relatively comprehensive, overlaps in authority and weak coordination among agencies are still evident, potentially reducing the effectiveness of law enforcement. Therefore, the strengthening of law enforcement jurisdiction should be directed towards regulatory harmonization, the establishment of inter-agency coordination forums, and the enhancement of institutional transparency and accountability. Legal system reform based on institutional collaboration and the reinforcement of human rights principles constitutes a strategic step in building a jurisdictional system that is adaptive to modern radicalism threats.
