Abstract

The national health insurance is a strategic initiative by the Indonesian government to guarantee equitable access to affordable and quality healthcare services for all citizens. Nevertheless, the program faces multiple challenges including financial sustainability, inadequate healthcare facilities and personnel, and policy inefficiencies. To enhance the quality of national health insurance implementation, the government introduced several policy reforms, one of which is the transformation of inpatient classification into a standardized scheme known as standard inpatient class. Standard inpatient class was formulated in response to the community's evolving healthcare needs and to replace the traditional tiered room system. Law No. 40 of 2004 on the national social security system affirms that all national health insurance participants are entitled to equitable, adequate, and non-discriminatory healthcare services, including fair access to inpatient facilities. The implementation of standard inpatient class is thus regarded as part of the state’s duty in fulfilling the human right to health. This policy is expected to positively impact both hospitals and patients, fostering a just, public-oriented, and rights-based healthcare system. With comprehensive reforms, national health insurance can continue to evolve into a fair, efficient, and sustainable health insurance system for all Indonesians.

Abstract

An urgent legal issue emerges from the normative disharmony between Article 9(2) and Article 23(5) of Law No. 28 of 2014 concerning Copyright. Article 9(2) requires creators to give written permission for the use of their works, implying a direct licensing mechanism, while Article 23(5) mandates the use of a collective management system through the National Collective Management Organization. This inconsistency has led to legal uncertainty, especially in the context of public performance royalties, and has disadvantaged songwriters due to a lack of transparency in royalty calculations. This study aims to examine the legal certainty of public performance licensing in Indonesia's music royalty management system by analyzing the implementation of Article 23(5) of Law No. 28 of 2014 and Government Regulation No. 56 of 2021. This study, using a normative juridical method, finds that despite Government Regulation No. 56 of 2021 establishing SILM and LMKN, licensing conflicts persist. It recommends harmonizing the regulation by clearly recognizing direct licensing under Article 9(2) while protecting moral rights under Article 5 of Law No. 28 of 2014.

Abstract

Health workers play a critical role in responding to medical emergencies and disasters. The legal responsibilities and obligations of health workers in these situations are often highlighted, both in terms of legal protection for health workers and their responsibility to save lives. This article will examine the legal standing of health workers in emergency and disaster scenarios. It will also examine the legal protection afforded to health workers in carrying out their duties, as well as the legal difficulties and issues they face in Indonesia. This research used normative legal research techniques and it used references from various national and international legal sources, as well as case studies, will be used for comparison. The legal standing of health workers in Indonesia, especially during emergencies and disasters, requires clearer and stricter rules to protect medical personnel on duty. Existing rules and regulations provide a legal framework, but in practice, health workers often face legal obstacles, especially in emergency situations and major disasters.

Abstract

Doxing, the unauthorized disclosure of an individual’s personal information, poses a significant threat to the right to privacy guaranteed by law in many countries. This phenomenon is increasing with the development of technology and the use of digital media. This study aims to explore the legal regulations governing doxing in Indonesia and compare them with the legal frameworks in several other countries, such as the United States, the European Union, and Australia. The method used is a normative juridical approach with a comparative analysis based on relevant legislation, legal doctrine, and case studies. The results show that in Indonesia, the Electronic Information and Transactions Law and the Draft Law on Personal Data Protection serve as the primary legal basis for personal data protection. However, these two instruments do not explicitly regulate doxing as a specific crime, creating a legal loophole that makes it difficult to prosecute perpetrators. Meanwhile, the European Union has the General Data Protection Regulation, which provides comprehensive protection and severe sanctions for privacy violations. This study recommends regulatory updates that include an explicit definition of doxing, strengthened law enforcement mechanisms, and increased public digital literacy to mitigate the risk of privacy violations.
