Abstract

Penelitian ini dilatarbelakangi oleh adat badamai sebagai khazanah lokal masyarakat Banjar yang kemudian dihubungkan dengan sengketa pemilu. Penelitian ini bertujuan untuk mengatahui apakah bisa adat badamai digunakan dalam sengketa pemilu. Metode yang digunakan dalam penelitian ini adalah yuridis-normatif. Hasil dari penelitian ini menunjukkan bahwa adat badamai merupakan bentuk penyelesaian sengketa yang lazim dilakukan oleh masyarakat Banjar dan berperan menghadirkan keamanan, ketertiban, dan perdamaian. Adat badamai dewasa ini sering digunakan dalam kasus-kasus hukum perdata dan hukum pidana. Padahal, adat badamai tidak menutup kemungkinan digunakan juga dalam kasus sengketa pemilu. Menurut Ahmadi Hasan, saat terjadi sengketa Pemilihan Gubernur di Kalimantan Selatan dalam prosesnya pasti telah terjadi tarik-menarik baik itu terkait musyawarah atau yang mengarah kepada cara-cara nonlitigasi, seperti badamai.

Abstract

Numerous incidents and reports concerning behaviors deviating from societal norms have marred the nation's character. One of the causes is the orientation of education itself, which predominantly focuses on cognitive aspects. Therefore, it is crucial to establish a new educational paradigm based on character education. The objective of this research is to understand how the local art form of Madihin can be implemented as a new paradigm in education, serving as a learning tool through the wisdom embedded in it to shape a cultured and charactered society. The research employs a qualitative descriptive approach with field research. The findings reveal that Madihin can serve as a learning tool with cultural significance. The implementation of Madihin as a learning tool to shape a cultured and charactered society can be provided to the community in the form of: First, serving as 'moral excellence' within the Madihin verses themselves to shape character through the development of virtues that have meaning in life. Secord, focusing on soft skills to maintain noble cultural values and cultivate a holistic mindset. Third, providing knowledge about character with cultural education as the basis for daily behavior. Abstract

This study aims to determine the contribution of science, such as education and law, in overcoming immoral behavior in the educational world. This study uses qualitative research methods with literature reviews. The results of this research indicate that immoral behavior in education occurs as a result of weak supervision, irresponsibility between different parties in the educational world and religious teaching in learning as a form of overcoming. In fact, the violence in schools is a national problem that must be stopped as it is an attempt to uphold the rights of children as stated in the Child Protection Act. On the other hand, when dealing with immoral behavior that occurs in students, the teacher has the freedom and authority to punish educational behavior. Sanctions can consist of reprimands and/or warnings, both verbally and in writing, but also pedagogical punishments in accordance with the education rules, the teacher's code of ethics and laws and regulations.

Abstract

This study aims to examine the conformity of sharia-based regional regulations in Banjarmasin City with the 1945 Constitution of the Republic of Indonesia and to formulate harmonization strategies to ensure that such regulations remain consistent with the principles of the rule of law, legal pluralism, and the protection of constitutional rights. This research employs a normative juridical method using statutory, conceptual, and case approaches. The data were collected through a literature review of relevant legislation, sharia-based regional regulations in Banjarmasin City, and legal scholarship, and were analyzed qualitatively using systematic and constitutional interpretation. The findings indicate that several sharia-based regulations contain provisions that potentially conflict with constitutional principles, particularly freedom of religion, equality before the law, and non-discrimination. Although these regulations were enacted based on the aspirations of the local majority and intended to promote morality and public order, their implementation has not fully accommodated societal diversity and constitutional rights. This study proposes harmonization through substantive normative revisions, the application of inclusive legal principles, and the establishment of continuous evaluation and monitoring mechanisms. The results of this research are expected to contribute to policy formulation by local governments in developing regional regulations that are constitutional, equitable, and responsive to legal and social pluralism.

Abstract

AbstractEscalating deforestation and agrarian conflicts in and around national parks reveal the weak protection of customary forests and indigenous peoples’ rights despite constitutional recognition and Constitutional Court Decision No. 35/PUU-X/2012. This study is urgent because disharmony among sectoral regulations and a state-centric forest governance paradigm produce tenure insecurity and criminalization of indigenous communities. Using a normative legal research method with statutory and conceptual approaches, it analyzes the 1945 Constitution, Forestry Law, Conservation Law, Government Regulation No. 28/2011, Decision 35/PUU-X/2012, and literature on community-based conservation. The results show that integration of adat rights into national law remains partial and often reduced by licensing regimes, while CBC practices in Lore Lindu and Wakatobi National Parks demonstrate that tenure recognition and collaborative governance improve conservation effectiveness. The article concludes that a pluralistic, people-centered conservation policy grounded in adat law is required.AbstrakDeforestasi yang terus meningkat dan konflik agraria di kawasan taman nasional menunjukkan lemahnya perlindungan hutan adat dan hak masyarakat hukum adat meski telah ada pengakuan konstitusional dan Putusan MK 35/PUU-X/2012. Penulisan ini mendesak karena ketidakharmonisan regulasi sektoral dan paradigma pengelolaan hutan yang masih state-centric menimbulkan kerentanan tenurial dan kriminalisasi masyarakat adat. Penelitian menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan konseptual terhadap UUD 1945, UU Kehutanan, UU Konservasi, PP 28/2011, Putusan MK 35/PUU-X/2012, serta literatur tentang community based conservation. Hasilnya menunjukkan integrasi hak adat dalam hukum nasional masih parsial dan sering tereduksi oleh rezim perizinan, sementara praktik CBC di Taman Nasional Lore Lindu dan Wakatobi membuktikan bahwa pengakuan hak tenurial dan tata kelola kolaboratif meningkatkan efektivitas konservasi. Disimpulkan perlunya reformulasi politik hukum konservasi yang pluralistik dan people-centered berbasis hukum adat.

Abstract

This study analyzes the impact of U.S. President Donald Trump’s unilateral import tariffs under Section 232 of the Trade Expansion Act of 1962, which disrupted the multilateral trading system and triggered global protectionism. Using a normative legal approach grounded in international trade law, it examines the implications of these tariffs for Indonesia’s economic resilience and highlights the halal industry as an adaptive strategy. Findings show that Trump’s tariffs violate WTO principles such as Most-Favoured-Nation and non-discrimination, weakening multilateral legitimacy. Yet, this disruption offers Indonesia a chance to strengthen its halal industry through market diversification, domestic value chains, and ethical competitiveness. The study concludes that the halal sector represents a lawful and sustainable pathway to economic resilience amid declining global multilateralism.

Abstract

The Free Nutritious Meal (MBG) program initiated by the Prabowo-Gibran government is a strategic effort to overcome nutrition problems and improve the quality of human resources in Indonesia. However, its implementation faces serious challenges in the form of cases of mass poisoning, poor nutritional quality, and uneven distribution. This study aims to analyze the MBG program through the lens of two legal philosophies: the Rechtsstaat (state of procedural law) of F.J. Stahl and al-maṣlaḥah al-‘āmmah (public interest) of Ibn Taymiyah. This study uses a normative legal method with a conceptual and comparative approach by testing the program's compliance with justice and public welfare. The findings of the study show that the implementation of MBG has not met the principles of the two thinkers. From Stahl’s perspective, cases of mass poisoning, weak checks and balances, and the absence of transparent legal accountability represent the state’s failure to protect fundamental rights and uphold the principles of law-based governance (wetmatigheid van bestuur). From Ibn Taymiyyah’s perspective, centralistic inefficiency and distribution injustice are evidence of a disregard for public trust and a violation of the principle of comprehensive justice (al-‘adl). The synthesis of the research concludes that the success of MBG requires the integration of Stahl’s procedural-legal framework with Ibn Taymiyah's moral-substantive values, which demand legal accountability as well as ethical-religious responsibility in accordance with Indonesia’s philosophy as a religious nation-state

Abstract

The principle of the rule of law (rechtsstaat) positions law as the primary safeguard of justice and democracy. In Indonesian constitutional practice, however, law often operates under political influence through legal politicization. This occurs when legal instruments are used to advance political interests in legislation, adjudication, and enforcement. Such practices undermine institutional independence, weaken enforcement quality, and erode public trust. This study examines the forms, mechanisms, and impacts of legal politicization on law and enforcement in post Reformasi Indonesia. It employs a normative juridical method with statutory and conceptual approaches, drawing on Critical Legal Studies (CLS) and analysis of statutes, court decisions, and relevant cases. The findings show that legal politicization in Indonesia is systemic and structural, reflected in agenda driven legislation, judicial intervention, the weakening of independent institutions, and selective enforcement. These patterns weaken the rechtsstaat and checks and balances while accelerating democratic decline through elite impunity and shrinking civic space. Legal politicization therefore poses a serious threat to constitutional democracy in Indonesia.

Abstract

This research addresses the decline of democracy and rule of law in Indonesia under President Joko Widodo, characterized by political dynasties, judicial weakening, and laws favoring political power.itical power. These conditions led to the emergence of the Peoples’ Tribunal or Extraordinary Peoples’ Court as a public effort to demand substantive justice. The purpose of this study is to analyze the legitimacy of the Peoples’ Tribunal within Indonesia’s rule of law framework through Responsive Law Theory. This study employs normative legal research using statutory, conceptual, and case study approaches. Data were collected from relevant regulations, court decisions, and scholarly literature, then analyzed using content analysis. The findings reveal that although the Peoples’ Tribunal has no binding legal force, it holds moral and social legitimacy as a corrective mechanism against the failures of formal legal institutions. From the perspective of responsive law, the phenomenon reflects society’s demand for a more adaptive, participatory, and reflective legal system, while also serving as a critique of Indonesia's increasingly formalistic and elitist legal order.
