Abstract

Early January 2023, the President of the Republic of Indonesia ratified the R-KUHP to become Law Number 1 of 2023 concerning the Criminal Code. The new Criminal Code will be enforced in three years, with the agenda of socializing it to all law enforcement officials, and also to all Indonesian people. This study wants to explore the use of the Criminal Code with the various problems that accompany it, during an independent nation. The enactment of the Criminal Code raises its own problems for Indonesian religious people based on the first precepts of Pancasila and having an eastern culture. The method used in this research is doctrinal research or normative legal research and is supported by empirical legal research. The novelty of this study is an analysis of the problems with the application of the Criminal Code so far to strengthen the enforceability of the new Criminal Code which will be implemented in the next three years. Research results are, the problem with the application of the Criminal Code as a form of material criminal law has an impact on all aspects. First, the aspect of legal education where knowledge about criminal law reform is not beneficial due to the maintenance of the Criminal Code, from the judicial or law enforcement aspect, the Criminal Code also continues to be used and even becomes the basis for considering the general rules of Book I of the Criminal Code, as long as it is not regulated in laws and regulations outside the Criminal Code. The validity of the Criminal Code from the perspective of religious law and customary law has gaps that cause problems, such as the adultery article in the Criminal Code which has different meanings and principles from those stipulated in religious law and customary law. The principle of “no excuse”, which is implied in the Criminal Code, does not reflect the religious and cultural character of the Indonesian people by prioritizing the concept of forgiveness.

Abstract

The aim to be achieved is to find out and provide scientific information to interested parties and the public, the Government, the DPR RI and the Constitutional Court, that this new Criminal Code is still controversial and problematic, at least in relation to the article regarding insulting the President/Vice President. This research is a type of Normative legal research. Thus, the approach used to answer the legal issues studied in this research is to use a Statutory Approach. The analysis is by means of legal interpretation and analytical descriptive. After the primary legal materials and secondary legal materials have been collected, they are described systematically and methodically in order to obtain a universal picture of the legal issues raised in this research in order to determine the final conclusions. The result is the revival of the article on insulting the President/Vice President, which is contrary to the principle of equality before the law and there is discriminatory legal privilege treatment which is different from the position of the people as the highest holder of sovereignty, which is strengthened by the Constitutional Court Decision Number 013-022/PUU-IV/ 2006. At the same time it is contrary to Article 27 paragraph (1); Article 28; Article 28E paragraphs (2) and (3); Article 28J paragraph (1) and paragraph (2) of the 1945 Constitution of the Republic of Indonesia

Abstract

Abstrak Peredaran narkotika di Indonesia sudah mencapai tahap darurat yang sangat mengkhawatirkan. Kejahatan tindak pidana narkotika, sangat wajar dalam hukum pidana sebut menjadi salah satu extra ordinary crime (kejahatan luar biasa. Korban peredaran narkotika tidak memandang usia, dari usia dewasa, remaja, dan anak-anak. Berdasarkan data Badan Narkotika Nasional melalui hasil survey nasional prevalensi penyalahguna narkotika tahun 2023, menunjukkan angka prevalensi sebesar 1,73 % atau setara  dengan 3,3 juta penduduk Indonesia yang berusia 15-64 tahun, yang menunjukkan adanya peningkatan penyalahgunaan narkotika secara signifikan pada kalangan kelompok usia 15-24 tahun. Adapun tujuan dari kegiatan pengabdian ini, memberikan penyuluhan hukum serta edukasi terhadap anak-anak Panti Asuhan Muhammadiyah Mataram, terhadap bahanyanya penyalahgunaan narkotika. Panti Asuhan Muhammadiyah adalah lembaga sosial yang didirikan oleh Muhammadiyah untuk memberikan perlindungan, pendidikan, dan pengasuhan bagi anak-anak yatim piatu dan keluarga kurang mampu. Saat ini, panti memiliki total 39 anak asuh dari jenjang SD, SMP, sampai SMA, dan 24 lansia dalam program home care. Adapun peserta yang terlibat dalam kegiatan ini sebanyak  anak jenjang SD-SMP.  Metode yang digunakan adalah sosialisasi dan penyuluhan hukum, dengan menyampaikan materi secara visualisasi, interaktif, serta pemilihan bahasa serderhana, agar mudah dipahami oleh anak-anak perserta. Selanjutnya sesi diskusi dan tanya jawab. Hasil kegiatan menunjukkan, saat penyampaian materi, anak-anak sangat antusias mendengarkan pemaparan materi, serta merespon dengan pengajuan pertanyaan dari 7 (tujuh) anak. Selanjutnya para pemateri kembali melakukan evaluasi dengan memberikan kuis kepada para perserta. Kata kunci: narkotika; usia rentan; anak; penyalahgunaan Abstract The circulation of narcotics in Indonesia has reached a very worrying emergency stage. Narcotics crime is very normal in criminal law to be called an extra ordinary crime. Victims of narcotics trafficking regardless of age, from adults, teenagers and children. Based on data from the National Narcotics Agency through the results of a national prevalence survey narcotics abusers in 2023, shows a prevalence rate of 1.73% or the equivalent of 3.3 million Indonesians aged 15-64 years, which shows a significant increase in narcotics abuse among the 15-24 year age group This service provides legal counseling and education to the children of the Mataram Muhammadiyah Orphanage, regarding the dangers of narcotics abuse. The Muhammadiyah Orphanage is a social institution founded by Muhammadiyah to provide protection, education and care for orphaned children and underprivileged families. Currently, the orphanage has a total of 39 foster children from elementary, middle and high school levels, and 24 elderly people in the home care program. The participants involved in this activity were as many as elementary-middle school level children.  The method used is legal outreach and counseling, by presenting material in a visual, interactive manner, and choosing simple language, so that it is easy for the participating children to understand. Next was a discussion and question and answer session. The results of the activity showed that when the material was delivered, the children were very enthusiastic about listening to the material presentation, and responded by asking questions from 7 (seven) children. Next, the presenters carried out another evaluation by giving a quiz to the participants. Keywords: narcotics; vulnerable age; child; abuser

Abstract

Pengabdian masyarakat ini dilaksanakan dalam bentuk kegiatan Fokus Group Discusion (FGD) dengan tema "Eksistensi Pendidikan di dalam Dunia Pekerjaan". Kegiatan ini bertujuan untuk meningkatkan kesadaran Pelajar dan Mahasiswa NTT yang tergabung dalam Ikatan Mahasiswa dan Pelajar Komodo Boleng Mataram (IMPKBM), yang sudah masuk dalam kategori angkatan kerja, agar memahami bahwa pentingnya pendidikan formal maupun non-formal dalam mendukung kompetensi, daya saing, dan keberlangsungan karier di dunia kerja ketika sudah menjadi sarjana dengan harapan agar mampu menciptakan lapangan pekerjaan sendiri. Dalam Fokus Group Discusion (FGD ini, para peserta diberikan ruang untuk memberikan pertanyaan kepada narasumber dan menanggapi balik atas jawaban dari anrasumber. Selain itu diantara para peserta Fokus Group Discusion (FGD diberikan ruang untuk saling bertukar pendapat guna untuk mendapatkan pemahaman baru dari para narasumber dari akademisi Universitas Muhammadiyah Mataram. Hasil dari kegiatan pengabdian masyarakat ini menunjukan bahwa pendidikan formal sangat berperan penting dalam dunia pekerjaan khususnya apabila kita sebagai Aparatur Sipil Negara (ASN) dalam mendukung kinerja pelayanan kepada masyarakat termasuk dalam rangka untuk meningkatkan pendapatan jika mempunyai golongan kepangkatan yang lebih tinggi atau dalam bahasa lain untuk meningkatkan jabatan karir. Selain pendidikan yang cukup tinggi diasumsikan berperan sangat penting dalam penguasaan ilmu pengetahuan, tetapi juga dalam pembentukan sikap profesional, etika kerja, dan kemampuan beradaptasi terhadap dinamika dunia kerja yang terus berkembang. Maka kita perlu mempelajari skil kewirausahaan agara dapat menciptakan lapang kerja sendiri. Rekomendasi kegiatan ini adalah kami mengajak para calon sarjana khususnya calon sarjana dari NTT yang tergabung dalam paguyuban Ikatan Mahasiswa dan Pelajar Komodo Boleng Mataram (IMPKBM) yang menempuh pendidikan perkuliahan di Kota Mataram agar ikut pelatihan-pelatihan kewirausahaan dengan tujuan agar mempunyai skill yang cukup ketika pulang kampung dan dapat membuka lapangan pekerjaan sendiri.

Abstract

Cases of violations of child protection. Of the reports received, 837 cases occurred within the education unit, including: Children who were victims of bullying or harassment: 87 cases, Children victims of educational policies: 27 cases, Children victims of physical and/or psychological violence: 236 cases and Children victims of sexual violence: 487 cases. From data collected by the Indonesian Child Protection Commission (KPAI) and the Federation of Indonesian Teachers' Unions (FSGI), bullying cases are still a terror for children in the school environment. Meanwhile, the types of bullying that victims often experience are physical bullying (55.5%), verbal bullying (29.3%), and psychological bullying (15.2%). Meanwhile, regarding educational level, elementary school students were the most victims of bullying (26%), followed by middle school students (25%), and high school students (18.75%). The aim of this service is to provide education to participants in community service activities so that bullying does not occur at school. The method used is a socialization method carried out face to face. The results are 50%. Orphaned children do not understand the limits of bullying itself, and their rights as children and citizens, despite the social and economic disparities they have. Some of the orphanage children are still insecure about their condition of not having parents, or having incomplete parents. So they tend to tolerate what happens to them, because they are not aware of these rights and also their own condition.

Abstract

The NTT Student Community Organization in Mataram is formed based on regency, sub-district, and religious origin. These organizations include the Manggarai Mataram Muslim Family Communication Forum (FK2M), the Komodo Boleng Mataram Student and Pupil Association (IMPKBM), and several others. Each organization holds annual routines such as the inauguration of new management and an Organizational Introduction Orientation (OSPOR) for new students who are members of the IMPKBM. The methods used are discussions and lectures. The results are organizational management training at the inauguration and orientation events, with the theme "Organizing with Heart, Working0 with Action," a strategic effort to produce administrators and members who possess competence, integrity, and are ready to carry out their duties professionally. Through a series of materials, discussions, simulations, and guidance, participants gained a comprehensive understanding of organizational governance, leadership, communication, and work program planning. These activities not only strengthened technical skills but also instilled the values ​​of empathy, responsibility, and cooperation as the foundation for organizing with a heart-based approach. With this knowledge, it is hoped that administrators will be able to produce tangible results and play an active role in the organization's sustainable development. The origins of IMPKBM are a forum for maintaining unity, fostering brotherhood, and contributing to the development of their home regions.
