Abstract

The purity of limbs from any dirtiness is one of requirement which must be fulfilled before shalat. That is why many Ulama were explaining this case deeply. In this paper, the study of it was the character of the water which was pure and purified that can be used for wudhu, and which was not. In Bukittinggi, most of management mosques provide small basin with full water in front of wudhu room. It was aimed to facilitate people cleaning their feet before come into mosque. Yet, some of the basins have provided with no flowing water and less than two qullah (jars). Moreover, some of mosques only have one basin in one way (in and out of wudhu room). Basically, every feet of Muslim that get into the basin will do not affect anything to the pool. However, the problem was generated by the purity of the feet that some of them may unclean and take the water into effect. That is to say that providing the basin in front of wudhu room is obnoxious (makrûh) based on precaution (ihtyâth) principle. Kata Kunci: Washing feet basin, wudhu’, dirtiness, two qullah. Abstrak Kesucian anggota tubuh dari najis merupakan salah satu syarat untuk sahnya ibadah shalat yang dilakukan oleh seorang muslim. Oleh karena itu berbagai aturan dalam membersihkan diri sebelum shalat dibahas secara mendalam oleh ulama fiqh. Salah satu pembahasan yang terkait dengan hal itu adalah persoalan air yang boleh dipakai untuk berwudhuk, yang intinya merupakan air suci dan dapat mensucikan. Untuk menjaga kesucian jamaah yang akan memasuki masjid, maka sebagian pengurus masjid membuat bak kecil untuk mencuci kaki sebelum masuk dan keluar dari tempat berwudhuk. Namun pada sebagian masjid, air yang terdapat pada bak tersebut tergenang, tidak mengalir, dan kurang dua qullah. Di samping itu hanya tersedia satu buah bak, tempat masuk berwudhuk dan sekaligus tempat keluar dan selanjutnya masuk ke dalam masjid. Pada dasarnya kaki seorang muslim yang menginjak air yang tergenang tidak akan membuat air itu bernajis, tetapi mengingat beragamnya kondisi kaki yang masuk dimungkinkan ada najis yang tertinggal di air genangan itu. Oleh karena itu berdasarkan prinsip ihtiyath, membuat bak seperti itu hukumnya makruh.

Abstract

The main problem in this paper is how the effectiveness of mediation in sharia economic dispute resolution based on PERMA No. 1 of 2016 at the Bukittinggi Religious Court, and what are the inhibiting factors success of mediation. To answer this question, the author uses an inductive and deductive analysis framework regarding the law effectiveness theory of Lawrence M. Friedman. This paper finds that mediation in sharia economic dispute resolution at the Bukittinggi Religious Court from 2016 to 2019 has not been effective. The ineffectiveness is caused by several factors that influence it: First, in terms of legal substance, PERMA No.1 of 2016 concerning Mediation Procedures in Courts still lacks in addressing the problems of the growing community. Second, in terms of legal structure, there are no judges who have mediator certificates. Third, the legal facilities and infrastructure at the Bukittinggi Religious Court have supported mediation. Fourth, in terms of legal culture, there are still many people who are not aware of the law and do not understand mediation well, so they consider mediation to be unimportant. Tulisan ini mengkaji tentang bagaimana efektivitas mediasi dalam penyelesaian sengketa ekonomi syariah berdasarkan PERMA Nomor 1 Tahun 2016 di Pengadilan Agama Bukittinggi dan apa saja yang menjadi faktor penghambat keberhasilan mediasi. Untuk menjawab pertanyaan tersebut, penulis menggunakan kerangka analisa induktif dan deduktif dengan mengacu pada teori efektivitas hukum Lawrence M. Friedman. Tulisan ini menemukan bahwa mediasi dalam penyelesaian sengketa ekonomi syariah di Pengadilan Agama Bukittinggi dari tahun 2016 sampai 2019 belum efektif. Hal ini karena dipengaruhi oleh beberapa faktor.  Pertama, dari segi substansi hukum, yaitu PERMA No. 1 Tahun 2016 tentang Prosedur Mediasi di Pengadilan masih memiliki kekurangan dalam menjawab persoalan masyarakat yang terus berkembang. Kedua, dari segi struktur hukum, belum adanya hakim yang memiliki sertifikat mediator. Ketiga, sarana dan prasarana hukum di Pengadilan Agama Bukittinggi sudah mendukung mediasi. Keempat, dari segi budaya hukum, masih banyaknya masyarakat yang tidak sadar hukum dan tidak mengerti persoalan mediasi dengan baik, sehingga menganggap mediasi tidak penting.

Abstract

Iddah is one of the obligations for a wife who is divorced by her husband, whether divorce is caused by divorce from a husband or because of a wife's lawsuit to the court (khulu '). While undergoing iddah, the wife has the right to obtain housing and living facilities, as is the case in raj'i talak. On the other hand, in the Talak Ba'in, the Islamic marriage law in Indonesia does not provide an opportunity for the wife to earn a living even though she has to undergo the same obligation, namely undergoing iddah and living in her husband's house. This is certainly not in line with gender justice that carries the equality of men and women in this life. Judging from the thoughts of the ulema of the school of thought, actually the legal thinking of Imam Abu Hanifah had first argued to give the wife the right to earn a living in divorce even though the divorce was in the form of divorce. It seems that Imam Abu Hanifah's opinion should be considered in the renewal of Islamic marriage law in Indonesia, especially in realizing justice to the women in their marriage and divorce.

Abstract

The firm stipulation of sunnah qabliyah prayer is not found in the hadith of the Prophet, but among the scholars of the Shafi'yah, such practice is still carried out by likening it to other fardhu prayers. The practice has been studied extensively by Shafi'yah scholars, and one of them is Imâm al-Nawawî. The question asked in this discussion is the rationale of Imâm al-Nawawî in establishing the law of sunnah law for the prayer and when its execution time. According to Imâm al-Nawawî, the argumentis the generality of hadith announcement about sunnah rawatib prayer and the use of qiyas between Zuhr prayer and Jumat prayer. The general argument is more valid and strong compared with other postulates. As for the time of its implementation, sunnah qabliyyah prayerfor Jumat prayer may be done if there is the first azan when zawâl. Whereas if only one azan, may pray two rak'ah with the intention of sunnah qabliyyahbefore Jum’ah prayer together with tahiyyatul masjid prayer for the new arrival at khutbah. As for those who have sat before the khutbah, it is enough with sunnah muthlaq prayer.

Abstract

Marriage customs in Binjai, Pasaman Regency, differ from those in other areas. A man is not permitted to marry a woman of the same ethnicity as his ex-wife. According to Islamic law and Minangkabau customs, this prohibition on marriage limits a widower's opportunity to marry a woman of his choice. The aim of this paper is to investigate the origin and purpose of the marriage prohibition in Nagari Binjai, as well as the perspective of Islamic law on this provision. Traditional leaders (datuak), religious leaders, and the community provided the data for this study. Simultaneously, data was gathered via interviews, which were then analyzed using descriptive methods. According to the findings, the origin is the Nagari Binjai customary ancestors' agreement that a man who marries a woman of the same ethnicity as his ex-wife is treated as a relative or referred to as the same mother (samamak). Abstak: Aturan adat untuk menikah di Binjai Kabupaten Pasaman memiliki perbedaan dengan daerah lainnya. Seorang laki-laki tidak boleh menikah dengan wanita yang sesuku dengan mantan istrinya. Dilihat dari ketentuan hukum Islam dan adat Minangkabau secara umum, larangan nikah ini sepertinya mempersempit kesempatan menikah bagi seorang duda dengan seorang wanita pilihannya. Tulisan ini bertujuan untuk mengetahui latarbelakang dan tujuan larangan perkawinan tersebut menurut adat di Nagari Binjai serta perspektif hukum Islam terhadap ketentuan itu. Penelitian ini merupakan penelitian kualitatif dengan sumber data berasal dari pemuka adat (datuak) dan tokoh agama serta masyarakat secara umum, sedangkan pengumpulan data dilakukan dengan wawancara, kemudian dianalisis menggunakan metode deskriptif. Hasil penelitian menunjukkan bahwa latarbelakang adanya larangan menikahi wanita sasuku dengan mantan isteri karena atas kesepakatan para leluhur adat Nagari Binjai menganggap bahwa seorang laki-laki yang melakukan pernikahan dengan wanita yang memiliki suku sama dengan mantan isterinya sudah seperti kerabat atau diistilahkan sudah samamak (satu mamak). Pernikahan mereka dikhawatirkan akan menimbulkan perselisihan dan dapat memutus hubungan silaturrahmi antar anggota suku. Menurut perspektif hukum Islam, larangan tersebut dikategorikan sebagai ‘urf shahih, karena tujuan yang hendak dicapai menghasilkan maslahah di kalangan masyarakat setempat, yaitu menjaga hubungan baik antar anggota suku. Abstract

The public road is a facility for those who passed by the public to support mobility. Islamic teachings determine that the public road is right to base humans who don't can in the sky by anyone. However,some people has utilise the public road for interest marriage party and events personal other so that disturb and hinder activity society. This paper aims to study the legality of Islamic law in middle take effect law positive in Indonesia regarding with use of public roads for doingmarriage reception (walimah) with a focus on two questions: First, what difference among legalization of Islamic law with law positive in case usage the public road for interest carry out party marriage? Second, is regulation of government about settings use the public road for interest party marriage in accordance with the legalization of Islamic law? Type this study is a research library with an approach qualitative. Data collection is carried out with read news, books, and related articles with problem study and analysis with the deductive method. Results of this study show that Islamic law has considered legal when already ijtihad by scholars, different with law positive that the legislation must be validated by the government, and government regulation that regulates using the public road for interest party marriage has produced benefits in accordance with the desired goal achieved in legalization Islamic law.

Abstract

Pre-employment program jockey is an agent who seeks a job for the community and obtains a fee from the services. The practice is particularly carried out related to the pre-employment card program launched by the government in 2020. This article describes the practice of pre-employment jockey and to analyze sharia economic law review on the profit. This article implemented qualitative research. The primary data were obtained through interview, observation and documentation, while the analysis was conducted descriptively. The research reveals that the jockey practice has assisted people to register pre-employment card program in 2020. The assistance consisted of account registration, training, and filling survey. The incentive given to the approved people is IDR 3.550.000 but the transparency about the exact number is not precisely informed to the account owner. It can be more than the said amount or, even worse, the jockey got more incentive. This is inappropriate in sharia economic law. Ijarah principles are not applied here because there is no transparency, the willingness of account owner and justice; instead, the service contains ghulûl (corruption) and gharâr (scam) done by the jockey since what they did can be included as treason.

Abstract

Based on the Minangkabau aphorism, the marriage system in society must refer to the guidance of the Quran and Sunnah, but there are some researchers who say that matrilineal culture, including the marriage system practiced in Minangkabau, is not in line with the values contained in the Quran and Sunnah. The aim of this research is to prove the relationship between the concept of culture in the Quran and the culture of marriage in Minangkabau by asking two questions. First, is the marriage system and culture in Minangkabau in line with the values of marriage in the Quran? Second, what is the relevance of marriage in Minangkabau to the cultural values carried by the Quran? This research is library research using a qualitative approach in the field of interpretation studies, while data analysis uses a comparative method. The results of the study show that there is no fundamental difference between the marriage system adhered to in the Quran and the marriage system practiced by the Minangkabau people and the values promoted by the Quran have been well-cultivated in the marriage process in Minangkabau which has a pivotal to monotheism, in line with human nature, and, produce Islam rahmatan lil alamin.

Abstract

The changes in the implementation of eid prayers in Sungai Landia by abolishing women’s rights to become imam and khatib do not necessarily eliminate the progressive sides of Sungai Landia women. This study aims at exploring the persistence of progressive sides in the transition process of eid prayer tradition from female imam and khatib to conservative fiqh provisions. This research is qualitative in nature with the main data obtained from community leaders and women from Sungai Landia. The data analysis was carried out using a descriptive method. This study concludes that the process of changing to conservative fiqh was carried out by going through the stages of fiqh scientific deepening and socialization for four years to avoid chaos in society. The community began to realize their mistake because of criticism from various parties. The criticisms were not only from the local community, but also from the ulama who were invited to give religious lectures. Sungai Landia women accepted the change with the condition that male and female congregations must still be separate in implementing eid prayers even though the imam and khatb are men. There are progressive sides that are still maintained by paying attention to aspects of gender equality and social justice to create peace in worship as evidenced by the existence of public recognition for women to be separate from men in carrying out the eid prayers.

Abstract

The claim for child’s nafaqah māḍiyah (past income) is often overlooked in the rulings of the Religious Court. This research aims to propose a shifting from the concept of li al-intifā’ (benefit) to li al-tamlīk (ownership) regarding child’s living costs claims in the Religious Court, employing the istihsān (juristic preference) approach. The objective is to ensure a more equitable judgment for the child. This study was conducted as a literature review using a normative juridical approach. The research findings reveal that the legal standpoint, which rejects any claim for child’s nafaqah māḍiyah in the Religious Court based on the argument that child’s living costs is categorized as li al-intifā’, contradicts Islamic legal principles regarding child’s living costs and fails to fulfill the principles of justice, as well as being incongruent with several other legislative provisions related to child protection. Therefore, this article proposes a shifting from the concept of li al-intifā’ to li al-tamlīk in determining child’s nafaqah māḍiyah in the Religious Court.
