Abstract

Neglect towards children and spouses is a form of criminal act where an individual, in this case, a husband, neglects his obligations and responsibilities to fulfill the basic rights of his children and wife, resulting in them not receiving adequate care, attention, and protection. The issue in this case arises when a husband has been proven to commit the crime of psychological neglect towards his child, but the Appellate Court instead acquitted the Defendant. This raises the question of how child neglect committed by parents, in this case, a father, is regulated based on child protection laws and laws related to domestic violence, and what considerations influence the Appellate Court to render an acquittal for the Defendant. The main finding of this research is that the responsibility and duty to provide attention and protection to children are not solely the task of a wife but require the joint effort of both the father and mother. One of the considerations that led to the Defendant's acquittal by the Appellate Court is that the Defendant provided a year's worth of child support amounting to Rp 700,000.00, and he has one dependent child whose education was disrupted due to detention by the police. Neglect or emotional neglect of a child can have a negative impact on their self-esteem in building relationships with their peers, as they lose the presence of a father who can serve as a role model and guide in facing the world.

Abstract

The development of prisoners in prison aims to foster prisoners so that they do not repeat their crimes and become better individuals so that they can be accepted back into society. In fostering prisoners, the classification of prisoners must be applied. The classification of prisoners is an application of the principle of individualization. The principle of individualization of punishment is one part of the purpose of punishment. Article 12 of Law Number 12 Year 1995 on Corrections once regulated the classification of prisoners based on the type of crime. In its amendment, namely in Article 36 paragraph (4) of Law Number 22 Year 2022 on Corrections, it no longer regulates the classification of prisoners based on the type of crime. The placement of prisoners is only classified based on age and gender or other reasons based on risk assessment.

Abstract

The validity in proving a crime must provide a strong belief to the judge about the truth of the evidence. This is in order to determine whether the defendant really committed the act charged or it can also be used to obtain the basis for the verdict in resolving a case. Expert testimony has the nature of validity or validity of evidence in assisting the examination in the crime of child abuse. The research will examine the validity of expert evidence in the crime of child molestation by the biological father. This study aims to determine how the validity of expert evidence in the crime of child molestation by biological fathers using descriptive-based normative juridical methods, using primary data, namely legislation, decisions and secondary data sourced from books, journals related to the validity of experts in the crime of child molestation. The problem examined in this study refers to one of the judge's considerations in Decision Number 22/JN/2021/Ms.Aceh. which states that the psychological expert is considered to have made every effort to lead the child victim to provide testimony according to the charges and the expert's testimony is ruled out. If there is doubt about the testimony presented by the expert, the Criminal Procedure Code provides room for the judge to call a second expert to be questioned to avoid in dubio pro reo in the judge's decision. If the child is a victim, the examination process must be accompanied by community counselors and social workers who have the competence and profession of social work and expertise. Based on this, expert evidence and psychological experts are needed in the examination of the crime of child abuse.

Abstract

Sentencing does not always have a deterrent effect on the perpetrator. The large number of perpetrators who repeat their crimes is proof that the punishment imposed on them does not have a deterrent effect. There needs to be regulation regarding the repetition of criminal acts, especially regarding serious crimes such as criminal acts of terrorism. Improving criminal penalties for repeat criminals or recidivists can be used as a step to reduce and prevent repeated crimes. This research uses the Muhammad Basri case as an example of a repeat case of criminal acts of terrorism. This research aims to find out how criminal penalties are imposed on terrorist recidivists.

Abstract

The banking sector is a crucial tool for driving the Indonesian economy, maintaining balance, progress, and unity within the national economy. Naturally, the banking sector requires regulations and elements that play a crucial role in optimal economic operation. Indonesia, a country governed by the rule of law, naturally has regulations regarding banking in its implementation. Banks, as financial service institutions, are expected to maintain the trust of the public who invest their funds in them, as stipulated in banking law. The principle of bank secrecy requires banks to maintain the confidentiality of their deposits and to help protect the interests of individual customers as a guarantee for the public who will place their trust in the bank and can entrust their funds to it. The strong commitment of banks to maintaining bank secrecy as financial service providers, coupled with the development and advancement of science and technology, has given rise to a problem where banks are often used as venues for criminal acts. In the process of resolving banking crimes, many parties, such as banks, play a significant role in assisting in resolving the problem. However, in practice, the process of resolving the problem remains incomplete due to a legal vacuum in disclosing bank secrecy to perpetrators of banking crimes. Referring to the research results, Singapore is included in the category of countries with a fairly high level of bank secrecy and has special banking regulations to help resolve banking crimes specifically, making it a comparison in this research analysis.

Abstract

General Background: The exponential growth of digital technology has accelerated the emergence of online gambling as one of the most pervasive forms of cybercrime in Indonesia, generating severe social, economic, and psychological repercussions. Specific Background: Despite the government’s introduction of Law No. 1 of 2024 amending the Electronic Information and Transactions Law, online gambling continues to proliferate, involving transnational networks and massive financial transactions. Knowledge Gap: Previous studies have insufficiently addressed the complex interaction between legal frameworks, enforcement capacity, and sociocultural factors that hinder the effectiveness of policing online gambling. Aims: This study aims to analyze the Indonesian National Police’s legal policies and enforcement strategies in combating online gambling, focusing on barriers such as digital evidence collection, jurisdictional limitations, and public legal awareness. Results: Findings reveal that punitive measures alone are ineffective, as enforcement faces constraints in tracking cross-border transactions, accessing banking data, and countering influencer-driven promotions. Novelty: This research integrates criminological, psychological, and legal perspectives to propose a multidimensional approach combining penal and non-penal measures. Implications: Strengthening legal literacy, enhancing digital forensics, and promoting international cooperation are essential to develop adaptive, preventive, and rehabilitative strategies for addressing online gambling in Indonesia. Abstract

Perkembangan teknologi digital telah memperluas bentuk interaksi anak di dunia maya, termasuk melalui platform game online seperti Roblox yang menyediakan ruang komunikasi interaktif. Kondisi ini tidak hanya membuka peluang kreativitas, tetapi juga meningkatkan risiko anak menjadi korban pelecehan seksual digital yang dilakukan secara anonim. Penelitian ini bertujuan menganalisis pengaturan hukum Indonesia dan efektivitas perlindungan hukum terhadap anak yang mengalami kejahatan seksual pada platform game Roblox. Metode penelitian yang digunakan adalah penelitian yuridis normatif dengan pendekatan perundang-undangan, pendekatan konseptual, serta pendekatan kasus. Hasil penelitian menunjukkan bahwa Undang-Undang No. 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual telah memberikan dasar normatif bagi perlindungan anak, termasuk pengaturan mengenai pelecehan seksual nonfisik dan kekerasan seksual berbasis elektronik. Selain itu, penelitian menemukan bahwa bentuk kejahatan seksual di Roblox umumnya terjadi melalui fitur chat, interaksi sosial, dan mekanisme komunikasi lain yang memudahkan pelaku membangun kedekatan dengan anak. Kendati kerangka hukum telah tersedia, implementasi perlindungan belum optimal karena hambatan pelaporan, keterbatasan penegakan hukum pada platform internasional, serta minimnya pemulihan psikologis bagi korban. Penelitian ini juga menegaskan perlunya peningkatan literasi digital, pengawasan platform, dan mekanisme kerja sama internasional dalam penanganan kejahatan seksual digital. Dengan demikian, perlindungan hukum terhadap anak korban pelecehan seksual pada platform game online memerlukan penguatan regulasi, koordinasi, dan implementasi yang lebih komprehensif.

Abstract

Kekerasan seksual terhadap anak adalah pelanggaran yang sangat berbahaya yang berdampak pada fisik, psikologis, serta sosial jangka panjang. UU No. 12 Tahun 2022 mengenai Tindak Pidana Kekerasan Seksual (UU TPKS) melalui asas kepentingan terbaik bagi korban yang terdapat dalam pasal 2 huruf c sebagai dasar perlindungan, namun implementasinya masih menghadapi berbagai kendala seperti reviktimisasi, ketimpangan layanan pemulihan, serta kurang optimalnya pendekatan berbasis korban. Penelitian ini bertujuan menganalisis pengaturan dan penerapan asas tersebut dalam perlindungan korban, serta melakukan perbandingan dengan National Framework for Protecting Australias Children yang mengembangkan perlindungan holistik melalui pendekatan trauma-informed, intervensi dini, dan sistem layanan terintegrasi. Penelitian hukum normatif ini menggunakan pendekatan perundang-undangan (conceptual approach) dan pendekatan perbandingan (comparative approach). Hasil penelitian memperlihatkan bahwa meskipun UU TPKS telah membangun kerangka yang kuat, realisasi di lapangan belum setara dengan standar perlindungan holistik Australia. Penguatan koordinasi antar lembaga, akses layanan yang merata, serta pemulihan jangka panjang diperlukan agar asas kepentingan terbaik bagi korban dapat terwujud secara efektif.

Abstract

Penelitian ini mengkaji hak khusus narapidana hamil di lembaga pemasyarakatan di Indonesia melalui pendekatan hukum normatif komparasi. Tujuan utama adalah untuk menganalisis norma hukum yang mengatur hak-hak khusus bagi narapidana hamil, seperti hak kesehatan, perawatan prenatal, dan perlindungan dari diskriminasi, serta membandingkannya dengan standar internasional dan praktik di yurisdiksi lain khususnya Inggris dan Jerman. Metode penelitian menggunakan data sekunder yang dikumpulkan melalui studi pustaka dari undang-undang nasional misalnya Undang-undang Nomor 22 Tahun 2022 tentang Pemasyarakatan, konvensi internasional seperti Konvensi Hak-Hak Perempuan (CEDAW), serta literatur hukum dan putusan pengadilan, diikuti dengan interpretasi hukum untuk mengidentifikasi kesamaan dan perbedaan. Hasil penelitian menunjukkan bahwa meskipun hukum Indonesia mengakui hak-hak dasar narapidana hamil, implementasinya masih terbatas dibandingkan dengan standar internasional, terutama dalam hal akses layanan kesehatan reproduksi dan rehabilitasi. Kesimpulan menekankan perlunya reformasi hukum dan kebijakan untuk meningkatkan perlindungan hak narapidana hamil, guna memastikan kesetaraan gender dan hak asasi manusia di lembaga pemasyarakatan. Penelitian ini berkontribusi pada pengembangan hukum pidana dan hak asasi manusia di Indonesia.

Abstract

General Background: Grounds for the exclusion of criminal liability serve as essential mechanisms within Indonesian criminal law to ensure that punishment is not imposed automatically when the elements of a crime are fulfilled, but instead aligned with substantive justice. Specific Background: Although Articles 48–51 of the Criminal Code regulate justifying and excusing grounds, judicial practice demonstrates variations in how judges assess their validity. Knowledge Gap: Limited scholarship has comprehensively explained the principles applied by judges in determining whether these grounds are legally acceptable, particularly in cases involving psychological conditions and proportionality assessments. Aims: This study aims to analyze the normative framework of grounds for criminal exemption and identify the principles guiding judicial evaluation. Results: The findings show that judges consistently apply the principles of proportionality, subsidiarity, and culpa in causa, while also assessing trial facts, the defendant’s mental state, and the balance between the threat faced and the defensive act. Novelty: This research highlights that judges also consider jurisprudence and customary law as extended bases for exemption beyond the Criminal Code. Implications: These findings underscore the need for consistent judicial guidelines to ensure that the application of grounds for criminal exemption remains aligned with the objectives of criminal law and the pursuit of substantive justice. Highlights: Judges apply proportionality, subsidiarity, and culpa in causa to assess criminal exemption. Trial facts and the defendant’s psychological condition strongly influence judicial decisions. Jurisprudence and customary law expand exemption grounds beyond the written Criminal Code.
