Abstract

The realization of a country's national development goals is a measure of a country's success, namely through law enforcement and a good health index of its citizens in that country. This research specifically discusses the enforcement of health law where it is not only looked at from the perspective of the laws that apply in Indonesia, but a comparison is made of the resolution of problems in health law that arise as a result of actions carried out by medical personnel that are related to their competence (unprofessionalism: medical errors in the form of omission, negligence, and/or intentional) which resulted in lawsuits and lawsuits based on legal provisions in the Netherlands and the United Kingdom. The research method used is prescriptive analysis and qualitative approach data analysis. The research results show that the settlement of lawsuits, especially the settlement of medical cases in Indonesia, the Netherlands and the United Kingdom, is currently still within the jurisdiction of the general courts; in Indonesia it is regulated in Law Number 2 of 1986 concerning General Courts along with amendments to the two Laws in Law Number 49 of 2009; in the Netherlands it is regulated in the Judicial Organization Act, the Judicial Sector (Funding) Decree of 2005, and the Constitution of the Kingdom of the Netherlands 2002; whereas in the United Kingdom it is based on the Criminal Procedure Rules 2020 and Criminal Practice Directions 2023

Abstract

Penelitian ini bertujuan untuk memahami dan mengerti pengaturan kompetensi dalam praktek kedokteran spesialis dan alternatif penyelesaian sengketa ketika terjadi permasalahan. Metode peneltian adalah yuridis normatif serta mengacu pada suatu peraturan yang telah ditetapkan dan serta menelahnya. Hasil penelitian menerangkan bahwa pengaturan kompetensi telah diatur melalui Majelis Kolegium Kedokteran Indonesia yang diberikan amanah ke masing-masing kolegium. Mediasi merupakan metode alternatif penyelesaian sengketa kompetensi yang dapat difasilitasi oleh suatu komite medik rumah sakit. Proses penyelesaian sengketa sejak lama dikenal melalui proses litigasi di pengadilan. Seiring dengan perkebangan zaman, proses penyelesaian sengketa diluar pengadilan ikut berkembang. Penyelesaian sengketa ini disebut dengan alternatif penyelesaian sengketa. Undang-undang kesehatan nomor 17 tahun 2023 Bagian Ketujuh dan Kedelapan mengenai Konsil dan Kolegium. Konsil memiliki peran antara lain melakukan pembinaan teknis keprofesian Tenaga Medis dan Tenaga Kesehatan, sedangkan Kolegium menyusun standar kompetensi Tenaga Medis dan Tenaga Kesehatan. Dalam hal sengketa atau perselisihan, hanya ditemukan bahasan pada dugaan tindak pidana menggunakan keadilan restoratif atau melalui alternatif penyelesaian sengketa di luar pengadilan.  Sengketa kompetensi juga dapat meluas ke persoalan etika profesi dimana dikatakan Kode Etik Kedokteran Indonesia pasal 19, setiap dokter tidak boleh mengambil pasien dari teman sejawat, kecuali dengan persetujuan keduanya atau berdasarkan prosedur yang etis. Sehingga peran MKEK (Majelis Kehormatan Etik Kedokteran) diperlukan dalam memutus suatu perkara etik yang berhubungan dengan sengketa kompetensi.

Abstract

The transformation of the healthcare system in Indonesia through the enactment of Law Number 17 of 2023 concerning Health represents an important step in strengthening legal protection for patients. The law aims to ensure that patients receive proper healthcare services, clear medical information, and legal protection within the doctor–patient relationship. However, limited awareness and understanding of patient rights among both healthcare providers and patients often contribute to medical disputes and ineffective implementation of legal provisions. Therefore, an analysis of patients’ rights from the perspective of health law is necessary to clarify their legal position and implications in healthcare services. This study aims to analyze the legal aspects of patients’ rights under Law Number 17 of 2023. The research employs a normative juridical method with a qualitative approach. Data were collected through library research and document analysis of statutory regulations, legal doctrines, and relevant scholarly literature obtained from reputable academic sources. The data were analyzed using qualitative descriptive and juridical interpretation to understand the regulation and implementation of patients’ rights in Indonesia’s health system. The results show that the law strengthens patient protection by regulating fundamental rights such as the right to obtain health information, the right to appropriate healthcare services, the right to consent to or refuse medical treatment, the right to access medical records, and the right to seek a second opinion. These provisions reinforce patient autonomy and promote a more balanced doctor–patient relationship in healthcare practice.
