Abstract

The National Sharia Council of the Indonesian Ulema Council (DSN-MUI) plays a central role in shaping the principles of Islamic economic law in Indonesia through its fatwas. These fatwas serve as primary references in the practices of Islamic financial institutions. However, the legal status of DSN-MUI fatwas within national legislation remains a subject of debate, particularly regarding their binding authority. This article aims to analyze the position of DSN-MUI fatwas from the perspective of Islamic law and legislative theory within the national legal system. This study employs a qualitative method with a normative and literature-based approach, examining various legal regulations and legal theories. The findings indicate that in Islamic law, fatwas are not absolutely binding unless institutionalized by an official authority. In the national context, DSN-MUI fatwas attain functional binding power as they are used as references in regulatory frameworks by Bank Indonesia, the Financial Services Authority (OJK), and Islamic financial institutions. Although these fatwas do not possess formal legal authority within the hierarchy of national legislation, they have become part of the living law that is internalized in national economic legal practices. Therefore, normative reinforcement is needed through explicit recognition in sectoral regulations to prevent legal vacuums. This study recommends the codification of DSN-MUI fatwas into derivative regulations to enhance their juridical legitimacy in supporting a just and legally certain Islamic economic legal system.

Abstract

This study aims to comprehensively analyze the practice of underage marriage in Wajah Jaya Village, Lasalimu Selatan District, Buton Regency. The focus of this research includes identifying the factors underlying the occurrence of early marriage and examining them from the perspectives of Islamic law and positive law in Indonesia. This study employs a qualitative method with an empirical juridical approach, emphasizing both legal norms and social realities within the community. Data collection techniques were carried out through observation, in-depth interviews, and documentation, which were then analyzed using descriptive qualitative methods to obtain a systematic and comprehensive understanding. The results indicate that the practice of underage marriage in Wajah Jaya Village is influenced by several factors, including premarital pregnancy, social pressure from the surrounding environment, limited public understanding of marriage law, and family efforts to maintain honor. In addition, economic factors and low levels of education also contribute significantly to the occurrence of early marriage. From the perspective of Islamic law, marriage is permissible when the prospective bride and groom have reached maturity and possess readiness to build a household, although no explicit age limit is specified. Meanwhile, Indonesian positive law stipulates that the minimum legal age for marriage for both males and females is 19 years, while still allowing marriage dispensation through the court. Therefore, the phenomenon of underage marriage reflects a gap between state legal provisions and the social realities within the community, indicating the need for legal education and increased public awareness to minimize such practices in the future.
