Abstract

Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition stipulates various prohibitions for actions that cause unfair business competition, especially contractual activities between business actors, one of which is a cartel The actions of this cartel have an impact on the sustainability and welfare of consumers as a result of price and production regulation in the market. In proving the realm of unfair business competition, namely cartel, it can be proven through indirect evidence. Indirect evidence according to the Regulation of the Commission for the Supervision of Business Competition Number 1 of 2010 concerning Procedures for Handling Cases is a guide. The cartel case approach which is regulated through Article 11 of Law Number 5 of 1999 adopts the principlerule of reason tend to see and examine the reasons of business actors who commit an act that is considered to violate the competition law. However, the success of disclosing cartel cases is still experiencing obstacles. Several countries have implemented leniency program as a response to cartel cases. The process of enforcing business competition law in Indonesia has not been able to overcome cartel cases that have harmed consumers. The results of this study explain the difficulty in disclosing cartel cases in Indonesia because there are no parties or informants to assist law enforcement to ascertain the alleged cartel. The urgency of the leniency program is the only way to reduce difficulties and restore an efficient and effective economic situation so that consumers are able to prosper.

Abstract

Background: Sebanyak 14,8% masyarakat Indonesia mengalami kulit kering dan rasa gatal yang dapat memicu peradangan. Virgin Coconut Oil (VCO) berpotensi menjadi solusi alternatif karena memiliki kandungan asam laurat, tokoferol, dan fenolik yang bermanfaat untuk kesehatan. Potensi kelapa sebagai bahan baku VCO di Provinsi Jambi mencapai 116 ton, namun pemanfaatannya di bidang pendidikan masih terbatas. Pengabdian kepada masyarakat ini bertujuan sebagai bentuk pemberdayaan komoditas kelapa serta meningkatkan keterampilan siswa SMAN 1 Kota Jambi melalui pelatihan produksi dan uji mutu VCO. Metode: Kegiatan dilakukan mulai dari persiapan, implementasi, dan evaluasi. Hasil: Terlaksanakanya pengabdian ini membuat siswa, siswi dan guru SMAN 1 Kota Jambi sangat antusias. Mereka jadi lebih memahami potensi dari buah kelapa, cara mengolah buah kelapa menjadi produk VCO, serta memahami cara menganalisis mutu produk VCO yang sesuai dengan SNI 7381:2008. Kedua jenis VCO memiliki nilai pH 5 yang memenuhi standar, sedangkan densitas VCO murni 0,963 g/mL dan VCO ekstrak nanas 0,967 g/m. Kesimpulan: Kegiatan ini berhasil meningkatkan pemahaman dan keterampilan siswa dalam aspek produksi serta analisis mutu produk, sekaligus memberikan keuntungan bagi sekolah karena produk yang dihasilkan memiliki daya jual di pasaran.

Abstract

One of the Rukun Tetangga which is the center of papaya in Balikpapan City is RT 19 Kelurahan Karang Joang Balikpapan Utara. The potentials of papaya fruit reach 10 tons per month or around 140 tons in a year. Papaya agricultural land continues to grow 10 to 20 percent. The problem is that farmers only sell their papaya in a fresh condition, even many are damaged due to too much harvest and not sold in the market. The community does not know about the use of papaya in product development so that the method used to solve the problems of the Karang Joang community, especially RT 19, is to socialize and provide materials related to food diversification. The results obtained from this community service are giving material and understanding to the women of Cempaka 19 farming women regarding the processing of papaya and training in making products including making abon and semprong papaya, and providing assistance in processing equipment to support the production of women mothers Cempaka 19 farm.

Abstract

Kasus dugaan persekongkolan antara PT Chiyoda Kogyo Indonesia dan PT Unique Solutions Indonesia menyoroti isu penting dalam hukum persaingan usaha, khususnya terkait kebocoran rahasia perusahaan yang berpotensi melanggar Pasal 23 Undang-Undang Nomor 5 Tahun 1999 tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat. Fokus utama kajian ini adalah untuk menelaah apakah tindakan tersebut termasuk bentuk pelanggaran hukum persaingan usaha dan bagaimana kewenangan Komisi Pengawas Persaingan Usaha (KPPU) dalam menangani serta menjatuhkan sanksi terhadap persekongkolan yang menyebabkan kebocoran rahasia perusahaan. Penelitian dilakukan dengan metode yuridis normatif, menggunakan pendekatan perundang-undangan dan konseptual, serta dianalisis melalui penafsiran gramatikal, dan sistematis. Sumber data terdiri dari bahan hukum primer seperti undang-undang dan putusan, serta bahan hukum sekunder berupa doktrin dan literatur ilmiah. Teori hukum persaingan usaha dan perlindungan rahasia dagang digunakan sebagai landasan dalam memahami keterkaitan antara persekongkolan dan perlindungan informasi bisnis. Kajian ini diharapkan mampu memberikan pemahaman hukum yang komprehensif terkait bentuk-bentuk persekongkolan yang dilarang serta mekanisme penanganannya.

Abstract

This article examines the growing interface between competition law and data protection in the digital economy, where large platforms accumulate vast datasets that raise both antitrust and privacy concerns. Using a qualitative doctrinal and comparative legal approach, this study analyzes legal developments in the EU, Germany, Malaysia and Indonesia to highlight tensions and complementarities between the two regulatory regimes. The paper finds that data-driven market dominance requires regulators to assess practices such as self-preferencing, refusal to supply, and exploitative data processing through both privacy and competition lenses. Case analyses from Facebook and Google illustrate how dominance in digital ecosystems can harm users and stifle competition. In the Malaysian context, the article critiques the limitations of the current legal framework, including the Competition Act 2010 and PDPA 2010, and calls for integrated regulatory reforms. In the Indonesian context, the analysis focuses on the application of Law No. 5 of 1999 on the Prohibition of Monopolistic Practices and Unfair Business Competition, which, despite not explicitly regulating data, provides an effects-based framework to address data-driven market power, self-preferencing, refusal to supply, and exploitative conduct in digital markets. The findings advocate for a balanced, coordinated framework that addresses the complexities of data governance while fostering innovation, fairness, and user autonomy.
